(A request was made at the November 7, 2006 City Council meeting to leave the record open for seven days.) 111:l.iI:IVcU NOV 1 5 2006 Dear Mayor and City Councilors; City of Ashland Community Development November 14, 2006 As you must now realize, the packet for planning action 2006-00078 is extensive. As two appellants, we would like to help hone your review process down to the specific water issues that are still on the table. In the Staff Report Addendum of June 13, 2006, city planning staff noted that the outline plan approval criteria require "That the existing and natural features of the land; such as wetlands, floodplain corridors, ponds, large trees, rock outcroppings, etc., have been identified in the plan of the development and significant features have been included in the open space, common areas and unbuildable areas." At the time of approval by the Planning Commission the above criteria was not fully met for Lot 18. Further, specific information as to the properties of the well, the springs in the pool, and the spring in the pool holding tank were not disclosed. It is not our intention to imply this was deliberate, we believe it arose from a misunderstanding as to whether Lot 18 was part of this application or not. This misunderstanding plagued the proceedings for quite some time until staff made it clear that Lot 18 was part of the application. The proceedings were further plagued by the uncertainty as to whether Lot 18 was being represented in the application. The applicant, Sage LLC, subsequently made it clear that she represents the entire parcel slated for sub-division. The existing natural features of the other lots were extensively covered during the hearings before the Planning Commission. That brings us to Lot 18. The appellants below signed this appeal to bring to the council's attention the above requirements for Lot 18. They are yet to be addressed. We urge you to read the Draft Geothermal Assessment Report from Cascade Earth Sciences recently made available in the packet. While not answering all questions (e.g., how much water is coming from the artesian well/spring box?) it certainly answers many of them, and will help you focus on what remains to be designated existing and natural features of the entire parcel. ( test Planning Action 2006-0078 Helman Springs Development-- Supplemental Filing During Council's 7 -Day Record Period by Art Bullock This document is a supplemental filing of key points and evidence for the record of Planning Action 2006- 0078, Helman Springs Development, submitted Nov 15, 2006 during the 7-day record period. 1. Include video records of related meetings. I ask that the record include videos of PC (Planning Commission) meetings where this application, or the general issue of development access streets and LID policy, was discussed, including and not limited to Mar14, Apr11, May9, Jun13, Jul11, and Aug8, all 2006. It's not necessary to individually copy these video records since videos are viewable online and downloadable; no work is required of staff. I ask that videos be incorporated by reference and preserved on the website until all appeals on this application are exhausted. I also ask that the record be supplemented to include the minutes and related documents submitted at those meetings, if not already included in the packet. 2. Attached is a signed petition showing neighborhood support for appellants' consensus position. Over 95% of those contacted, on and off Laurel Street, signed to support appellants' proposal that: (a) Council needs to set a policy for how developers should participate in a nearby LID to mitigate the effects of traffic on the neighborhood, and (b) Developer Sage should be required to pay their fair share of street improvements costs in Laurel St LID. The petition is submitted with confidential address information, which I ask be kept confidential to the fullest extent allowed by Oregon's Public Records Law and other laws. A separate copy is submitted with addresses redacted for this purpose. The petition page with the Laurel St signatures was lost or misplaced by the copy business, and is not available for submission at this time. Several attempts to locate it have been unsuccessful. It included dozens of signatures on Laurel St from Nevada St to the railroad tracks at Hersey St. 3. Also attached is a related email from a neighborhood resident to my Iistserve at http://groups.yahoo.com/group/AshlandCouncil, which should be included in the public record. 4. The LID policy has indeed changed. At the Oct 17, 2006 hearing, Councilor Silbiger questioned whether the LID participation policy had changed, and got an ambiguous answer. We dispute the PO (Planning Dept) answer/insinuation that the LID policy hasn't changed. The policy has indeed changed, even if there's no formal statement that the policy has changed. The old policy is simply not being followed any more. THAT'S the policy change. Council may recall its May 17,2006 meeting on Plaza St LID, when Councilor Chapman asked city attorney Mike Franell if non-remonstrance agreements don't mean anything, why are we using them? Franell's answer was "good question". They're meaningless and unconstitutional, and no longer used. Non- remonstrance agreements were used to force a developer to pay large sums of money to City without the legal right to object ('remonstrate') to bad street design. Given we've now demonstrated that property owners have such a right under city code and the Constitution regardless of a signed document saying they don't, PO and Public Works don't pursue them. If City forces a developer to participate in the LID while retaining the right to stop it with a huge block vote, City empowers the developer to stop the LID with 1 block vote, which in Nevada St LID constituted a one-person majority in a 125-lot LID. This new situation is a total turnaround from the old disempowerment pattern of a financial burden with disenfranchisement. Even if the developer agrees with the financial costs, the homeowners who buy the lot may not, so the developer's position at the time of application is non-binding and thus not very meaningful. The policy change is the unannounced stoppage of the old policy without a replacement. PC recognized the problem, and specifically asked council to direct it with a a policy statement of how PC and PO are to approach LIDs in planning applications. Similarly, appellants ask for a general council-set policy on the appropriate way to mitigate development traffic costs on neighborhood, which will then be applied to Helman Spring Development. Given that PO and PC don't know what council expects for LIDs, it's incumbent on council to generate the replacement policy. 5. To correct the misrepresentations/misunderstanding--there's no request that Sage pay all, or even most, of laurel St LID costs. Billings Ranch subdivision has already added much traffic to Laurel St, with much more coming, including much heavy truck subdivision traffic barreling down the Laurel St incline past the school zone and homes with children playing. Billings subdivision should also be required to pay its test fair share, because of the dramatic increase in traffic resulting from that 72-home subdivision, of which only a few homes are currently occupied. Other traffic comes from Laurel St and side streets. 6. I dispute Assistant City Attorney Richard Appicello's claim that Sage agreed to any other agreement other than that in our jointly-filed appeal document Appicello claimed that Sage and Legal Dept had agreed to allow Legal Dept to apply Dolan criteria (from the landmark Dolan v. City of Tigard Supreme Court case) to determine the developer's costs for Laurel St LID. The so-called 'agreement' solved NONE of the problems that prevented this from occurring before: definition of access streets, formula for calculating developer costs, timing of payment (now vs. by homeowners years later), etc. The developer has considered many options for fair share costs, and to my knowledge, has not agreed with or directly opposed any option. In consensus sessions, Sage's position was that Sage would be willing to participate in the LID consistent with a Council-set policy. Sage and the 2 appellants working on this issue (Stout & Bullock) ask for a guiding policy that sets criteria, formula calculations, what costs and access streets are included, timing of payment, etc. We're not asking for a precedent-setting backdoor policy from the Legal Dept. We're asking for a publicly-discussed and council-set policy on how to fairly treat the developer and neighborhood in mitigating traffic costs. 7. I object to any 'agreed-upon' condition that has not been put in the record to allow review and rebuttal. Appicello claimed Sage agreed with a condition of approval, yet there's nothing in the record to support such a claim. Sage didn't say Sage agreed with it, and in fact, principal Devian Aguirre said, after Appicello's testimony, that some of what she had just heard was inaccurate. There's no factual basis for Appicello's claimed condition. If such a written agreement exists, it should be placed in the public record for an opportunity to review and rebut. If the agreement is oral, then it should be converted to writing so Sage can agree or disagree in writing, and we have the opportunity to review and rebut. As appeal documents show, we object to any 'factual' assertion of what the developer (or any other party) agreed to without that agreement being signed by the party that City claims agreed. As council sees in the record, a continuing planning procedural error is requiring as a condition of approval everything the applicant agreed to, without clarity or signatures of what was actually agreed to, whether in public or behind closed doors. For example, Appicello or Franell could privately ask the developer, "Are you okay with a flat payment up front to mitigate traffic costs?", Sage could answer, "If that's council policy, we'd agree with it", and Legal Dept could mishear that as a "YES", claiming later that Sage agreed to a flat payment. The best way to prevent City from hearing what it wants to hear as an agreement to an undocumented, unreviewable condition of approval is to require the agreement to be in writing and signed, and in the record BEFORE the condition is set. When Appicello claims on the record that the applicant agreed to something off- record, off-camera, behind closed doors, on the phone, etc., it has the effect of forcing a non-existing 'agreement' to become a condition of approval, with wasted appeal time later trying to clarify what the agreement and condition of approval was. Since these conditions must be met later, it opens the door to expensive claims months later about what was and was not actually agreed to. 8. Despite new claims, development access streets have not been identified, as required by code. gave separate presentations to PC regarding decision rules for how to determine ALL access streets to a development, as required by code. Current code requires that all development access streets be fully improved to existing city standards. They haven't been improved, or even identified. That's a LUBA- appealable error. This hasn't been resolved because neither PO nor PC know how to do it without a new guiding policy. The bully power of non-remonstrance agreements is gone and there's nothing to replace it, so PO and PC ignored this requirement. It's still City code that ALL development access streets be FULLY improved to existing city standards. This has to be done, and it's up to council to determine the fair distribution of street improvement costs. After much difficult discussion, neighbors and developers reached a consensus position that if council sets a specific policy for LIDs before the final plan, and applies that policy to the development as part of the final plan, then appellants would agree to defer the details of how Sage pays their fair share to the final plan. What's critical here is that council, not Legal Dept, take responsibility for generating an LID policy before the final plan with adequate time for the PO and PC to apply that new policy to the Helman Springs Development. If council were to do so, we could shift city and neighborhood resources from a LUBA appeal to the more constructive approach of clarifying and applying a 'Fair-Share Policy' to mitigate traffic effects on a neighborhood. We don't need to waste City resources on an unnecessary LUBA appeal. We need a public, community-building consensus council decision on traffic mitigation cost distribution. test 9.1 dispute Appicello's claimed definition of 'significant feature', as presented in the Oct 17, 2006 council meeting. There's nothing in the record to indicate or support his claimed definition, which was presented as a factual statement, claiming the definition is x. It was not presented as his interpretation or Franell's interpretation. The record shows the developer and Franell (not Appicello) met and used a different interpretation of significant existing and natural features, which was used as the basis for PC decisions and our consensus appeal. 10. We have a continuing procedural error of allowing staff and developer to enter new evidence and arguments after public testimony has concluded. The record shows this occurred repeatedly at PC, causing multiple hearings. This procedural error was repeated at the council meeting, when Appicello and PO staff introduced new evidence after the public portion of the hearing concluded. When I made a procedural objection to allow the right to rebut, mayor disallowed it, saying that part of the hearing was closed. Appicello informed the mayor that I indeed had a right to rebut, and all 5 appellants were then allowed to rebut the new, allegedly improper evidence. 11. Allowing developer to lodge new legal arguments after the close of the record period is a separate procedural violation. I dispute the new policy, to which council acquiesced, that would allow Sage to make new legal arguments after the 7-day record period closes. I object in advance to any so-called 'final arguments' that are new and occur after the record closes. ORS 197.763(6)( e) may allow 'final arguments' that aren't new; Oregon's quasi-judicial rules don't allow any party to introduce any evidence or arguments without all other parties having the right to review and rebut. It's a procedural error to allow ANY new arguments by the developer or any other party after closing the record. We again assert our right to rebut ANY new arguments (or evidence) raised by Sage or any other party after the record closes on November 15, 2006. Council should stop this reversible procedural error and prevent an unnecessary LUBA appeal by disallowing any new arguments or evidence after the record closes. Oregon law requires fairness and balance. Every party has the right to review the evidence and arguments, and rebut. When we return the system to fair balance, with equal opportunity to review and rebut, City of Ashland returns it to imbalance, giving the developer an unfair advantage to add information after the close of the record, or significant information just before the hearing, or after the public testimony period of the hearing. PC and council perpetuate this error by: (1) asking questions of the developer after public testimony, who introduces new evidence and arguments in answering questions, (2) allowing staff to present new information and variations of old information either voluntarily or in response to questions, and (3) allowing Legal Oept to introduce new evidence/arguments on behalf of the applicant. This continued violation of basic quasi-judicial law generates needless appeals, wastes taxpayer money that would be better spent building consensus, and increases distrust by taxpayers, who see Ashland's planning process as unfair and stacked against the public interests. 12. Council improperly interpreted the procedure to extend time. Franell has clarified previously his interpretation that it is NOT proper to request an extension of an appiicant--the only proper process is a voluntary extension initiated by applicant. Appicello had council ask Sage for an extension, under what appeared to me to be undue pressure, then asserted another automatic 7-day extension as a result of the request to hold the record open for 7 days, as allowed by code. Both the request, and the 'automatic' extension of 7 days, were improper. 13. Mayor improperly denied applicant's right to include appellants in her presentation. Applicant Sage brought the 4 other appellants to the table as part of her 15-minute presentation, which was appropriate given the joint nature of the prepared presentation. Mayor and Appicello disallowed it, saying that appellants would not be allowed to speak at that time. City has no authority to determine who does and does not speak with or for the applicant, nor does mayor or Legal Dept had statutory authority to prevent appellants from speaking during the applicant's 15-minute period, if the applicant so chooses, as she did. Developer principal Devian Aguirre WAS allowed to speak during the appellants' 15-minute appeal, as one of the appellants, giving her nonstop access for the entire period--applicant, appellant, and applicant rebuttal. This is a huge unfair advantage, and is an unnecessary LUBA-appealable procedural error. We saw no evidence that Aguirre sought this unprecedented unfair advantage. Instead she worked to promote consensus and community goodwill by including appellants in her presentation of our joint consensus, as we did when I invited her to join our appeal and develop a consensus presentation to council. This procedural error led to an unplanned situation where attorney Hearn was misinterpreted as representing appellants,- because we weren't allowed to be part of consensus presentation as planned. test As a partial remedy, and to help prevent a LUBA appeal on this error, council and mayor should clarify for the record and future appeals that City has no authority to decide who the applicant can or cannot have participate in their presentation, even if it is appellants. Conclusion Developer Sage and the neighborhood have worked hard for months to reach consensus on every issue before us. Devian Aguirre and the Sage team have worked diligently and persistently to satisfy PD, PC, property owner, and neighborhood. The problem is City's planning process, which continues to needlessly drive a wedge between developer and neighborhood. Issues like spring water, tree removal, traffic mitigation, sidewalks, part rows, and the like can all be resolved by consensus in an environment of effective communication. Instead of supporting consensus-building, PD, PC, Legal Dept, and now council continue to make it more difficult. "Let's you and them fight" is bad public policy. The current planning process assumes and supports a confrontational conflict between developers and neighbors, rather than a community-building process of developer and neighborhood working through issues and options with consensus. As the Siegel consulting report clarified, Ashland's planning process is broken and needs to be fixed. Helman Springs application shows from developer and Quiet Village's community-building approach and a dysfunctional process that violates quasi-judicial procedures, needlessly prolongs the decision process, wastes taxpayers' money, and generates distrust rather than goodwill. It was improper for Appicello to claim the developer agreed to something without written documentation, signed by Sage, as to what was agreed. This so-called 'agreement' didn't exist, and was an improper way to influence council's decision by improperly claiming the developer agreed to what the Legal Dept wanted. The Legal Department has had more than a dozen opportunities in the last year to resolve this LID issue and failed to do so. Instead, they waited until after public testimony had ended to introduce a new 'policy' where Legal Dept determines the traffic mitigation costs and procedures. This is exactly what we AREN'T asking for. We aren't asking council to have the Legal Dept, after the close of public testimony, to set a policy to get what the Legal Dept wants. We're asking for an open, transparent discussion in the public interest to establish a Fair Share Policy for traffic mitigation costs, to get what the majority of Ashland taxpayers want. All 3 appellants for whom LIDs are an issue agree that council should set a Fair Share Policy. We're not proposing any particular formula for traffic mitigation costs, or criteria for defining access streets, or whether the amounts should be paid by the developer upfront rather than by the homeowners years later in an LID. We've considered, and I've presented to you and PC, a wide range of issues and options, anyone of which may be appropriate--or inappropriate--given council's Fair Share Policy. It's simply not possible to make a traffic mitigation decision that's fair to developer and property owners who may get liens on their homes to pay for Laurel St LID without a council policy that applies to this development and other applicants. None of the appellants want to shift the burden from council to staff or appellants, which would define the policy from one party's self-interest or narrow point of view. We're prepared to fairly apply a Council-led Fair Share Policy to the Final Plan for Helman Springs Development. To prevent legally arbitrary decisions and greater distrust of Ashland's planning process, the Fair Share Policy for neighborhood traffic mitigation costs should be set by council policy, not by patchwork.
