This item is being brought to Council so that the Department of Environmental Quality (DEQ) can present the proposed
Bear Creek Total Maximum Daily Loads (TMDL) and the impact to the City of Ashland.

Background:
For the past several years, the Department of Environmental Quality (DEQ) has been discussing the need for more
stringent regulations for the Bear Creek watershed for the enhancement and protection of salmonid habitat. The
proposed regulations are out for public comment through March 9, 2007, and expected to be enacted this spring.
The impacts to the City of Ashland are in three primary areas. Staff has been aware of the issues surrounding these
new regulations and has been preparing for implementation. A copy of the TMDL documents is available in the Public
Works office at 51 Winburn Way, or can be obtain on line at http://www.deq.state.or.us/wQ/TMDLs/Rogue.htm.
· Temperature Limitations for the Wastewater Treatment Plant (WWTP): The most significant issue for the
City will be the temperature reduction requirements for the WWTP. Staff will present additional information on
the WWTP temperature requirements after the presentation from DEQ as a part of the "Right Water for the Right
Use" discussion.
· Non-point source Bacteria in Ashland Creek: The bacteria regulations do not have specific limits, but require
target reductions which will be attained through better management practices and storm water runoff reductions
as a part of the storm water Nonpoint Pollution Discharge Elimination System permits (NPDES Phase II) for
smaller Cities.
· Sediment to Reeder Reservoir: The TMDL for sediment loading proposes "no significant delivery of sediment
to Reeder Reservoir above that which would occur naturally..." Although the impact to the City of Ashland
specifically is minimal as the City owns very little land within the watershed, the partnership with the US Forest
Service will need to be strengthened to ensure the impact to the City are not above the natural occurrence. The
specific impact to the City will be in the management of the road around the reservoir to ensure that does not
contribute sediment loading to Reeder Reservoir.

It is expected that Council will direct staff to continue with the implementation requirements proposed in the DEQ

Proposed TMDLs for the
Bear Creek Watershed
The Oregon Department of
Environmental Quality (DEQ) is
releasing the Draft Bear Creek
Watershed Total Maximum Daily
Loads (TMDLs) for public review.
Total Maximum Daily Loads are water
pollution limits designed to ensure that
waters of the Bear Creek Watershed will
meet water quality standards. Currently
311 miles creeks in the watershed do not
meet those standards.
The Bear Creek Watershed TMDLs will
address water quality problems related to
bacteria, temperature and sedimentation.

(TMDL) for any waterbody designated as
water quality limited on the State's 303(d)
List. The TMDL is the total permissible
pollutant load allocated to point,
nonpoint, background and future sources
of pollution. DEQ also includes a Water
Quality Management Plan (WQMP) in
the TMDL. The WQMP identifies the
jurisdictions and agencies responsible for
developing and implementing TMDL

and timelines they will use to meet the
TMDL load allocations.

Area covered by the action:
This action covers the entire Bear Creek
Watershed located in Southwest Oregon.
What is proposed?
DEQ proposes to submit the Bear Creek
Watershed TMDLs to the U.S.
Environmental Protection Agency (EPA)
for approval as TMDLs for federal, state
and private lands within the Bear Creek
Watershed. A Water Quality
Management Plan (WQMP) is also
included in this submittal, although
currently EPA does not officially approve
or disapprove tha~ plan. However, DEQ
is asking for comments on the WQMP as
part of this public notice.
EPA approval of the TMDL will remove
40 water quality limited streams
segments from DEQ's 303(d) list of
impaired waterbodies under the federal
Clean Water Act.
The purpose of this notice is to invite
written comments on the proposed TMDL
and WQMP and provide notice of
informational meetings and Public
Hearings related to this action.
Who is affected?
The TMDL affects local public and
private landowners, managers of
industrial and municipal facilities in the
watershed as well as people interested in
water quality and fisheries. The TMDL
specifically identifies Jackson County,
the cities of Ashland, Talent, Phoenix,
Medford, Jacksonville and Central Point,
Irrigation Districts: Medford, Talent and
Rogue River Valley as well as state and
federal government agencies with land use
authority. These jurisdictions will identify
appropriate limits, best management
practices, measures and approaches to best
meet the TMDL
Need for action:
Section 303(d) of the federal Clean Water
Act requires the development of TMDLs for
waterbodies included on a state's 303(d) list.
EPA must approve TMDLs submitted by a
state.
What happens next?
DEQ will review and consider all comments
received during the public comment period.
Following this review, DEQ will modify the
TMDL and WQMP if necessary and approve
them as an order. DEQ will then submit the
documents to EPA for approval.
After the order is signed, DEQ will notify all
cQmmenters and affected parties that the
TMDL has been finalized and a summary of
responses to comments is available. If you
do not comment and are not an affected
party but wish to receive notification, please
contact DEQ as indicated previously in this
notice.

Bear Creek Watershed TMDLs
What is a Total Maximum Daily Load?
Many waterbodies in Oregon do not meet all
water quality standards including over 311
miles of creeks in the Bear Creek
Watershed. Bacteria, temperature, and
sedimentation are currently identified as
problems for Bear Creek and its tributaries.
When waterbodies do not meet water quality
standards, they are classified as impaired on
the 303(d) list. The 303(d) list, named after
the section of the federal Clean Water Act, is
a state list of all impaired waters. When
rivers or streams are listed, DEQ is required
to develop total maximum daily load (TMDL)
which defines how much of a pollutant a
waterbody can receive and still meet water
quality standards.

Bear Creek Watershed TMDL Area
Background
Bear Creek currently has a TMDL in place.
Approved by USEPA on December 12,1992
it was among the first TMDLs in the State of
Oregon. The TMDL addresses the non-
attainment of pH, aquatic weeds and algae,
and dissolved oxygen (DO) standards. To
address the standards the TMDL
established instream concentration targets
for total phosphorus, ammonia nitrogen and
biochemical oxygen demand. The 1992
TMDL is currently adequate to protect water
quality.
The 2007 Bear Creek TMDL deals with the
violation of three additional water quality
parameters: bacteria, temperature and
sedimentation.
Temperature TMDL
DEQ's water quality standards are applied to
protect the most sensitive beneficial uses in
a waterbody. Numeric criteria in the
temperature standard were developed to
protect different aspects of the life stages of
salmon and trout: spawning, rearing and
migration.

For point sources of heat such as
wastewater treatment plants, waste load
allocations have been developed that will
allow increasing the temperature of the
receiving stream no more than 0.10C above
the applicable criterion. For nonpoint
sources, the load allocation is based on the
attainment of maximum shade provided by
riparian vegetation under site-potential
condition. Tree species and heights were
determined by ecoregion, a geographic
concept that takes into account climate,
soils, slope, elevation and natural
vegetation. When point sources achieve
their waste load targets, and site potential
vegetation is reached, the TMDL will be met
and water temperatures will meet standards.
Bacteria TMDLs
High bacteria levels can impact the health of
Oregon's citizens who recreate in or near
Bear Creek and its tributaries. Water quality
will be restored when sources of bacterial
pollution reduce their contribution to levels
identified in the TMDL. The reductions
needed specifically apply to non point
sources. Nonpoint source refers to pollution
that doesn't come from a pipe, but is carried
off the landscape in runoff. Various land
uses including urban, rural residential, and
agricultural and others are potential sources
of nonpoint source bacterial runoff.

Sedimentation TMDL
In the sedimentation TMDL, the pollutant is
sediments that enter into Ashland Creek and
deposit into Reeder Reservoir located above
the City of Ashland. The sources for these
additional sediments include forest
management, and road construction and
maintenance practices that may destabilize
slopes and increase the velocity of runoff.
Excessive levels of sediment may result in
impaired salmonid habitat or spawning,
Water Quality Management Plan
The Bear Creek Watershed TMDL includes
a Water Quality Management Plan designed
to identify strategies and approaches for
implementing the TMDLs. The WQMP
identifies the Designated Management
Agencies (local, state and federal
government agencies with responsibility for
addressing pollution problems), as well as
proposed management strategies designed
to meet the targets in the TMDLs. It also
establishes a schedule for the submission of
Implementation Plans, and incorporates
action plans already in place.
An agricultural water quality management
plan, which addresses stream heating,
bacteria and sedimentation from agricultural
activities, has been adopted for the
watershed. Impacts from forestry activities
on private lands will be controlled through
the implementation of the measures in the
Oregon Forest Practices Act. On federal
forestlands the Northwest Forest Plan will
serve to protect water quality.
For other land uses implementation plans
will be developed by the entity with
jurisdiction over the particular land use.
These include Jackson County, the cities of
Ashland, Talent, Phoenix, Medford,
Jacksonville and Central Point as well as the
Irrigation Districts: Medford, Talent, and
Rogue River Valley. These jurisdictions will
identify appropriate limits, best management
practices, measures and approaches to best
meet the TMDL

The draft Bear Creek Watershed TMDL has

Creek Watershed Council and others.
Comments and recommendations made by
these groups during the development
process have been incorporated into this
TMDL.
The Bear Creek Watershed TMDL is now
entering a formal public comment period
from January 8 through March 9, 2007. An
informational session to present TMDL
background and overview will be provided
preceding a public hearing on February 20,
2007. This meeting will be held at the
Community Justice Center at 6 PM. The
center is located at 1101 West Main Street,
Medford.
Copies of the TMDL document are available
at several locations including the Jackson
County libraries in Medford, Ashland, and
Jacksonville, the Medford and Portland DEQ

Statement:
This is a Council Communication updating the Council on Electric rates and recommending no
change in Electric rates or the BP A surcharge for this fiscal year.
Background:
The City of Ashland has a ten-year power sales contract with the Bonneville Power
Administration (BPA). This contract runs from October 1,2001 to September 30,2011. The
first 5 years of the contract included a 5-year rate period which ended September 30,2006.
The previous 5 year rate period allowed BP A to use three different Cost Recovery Adjustment
Clauses (CRAC's) to adjust its wholesale power rates for each 6-month period. BP A has
triggered one or more CRAC's for every 6 month period of all the five years of the prior 5-year
rate period.
When BP A added the CRAC costs to our wholesale, the City decided to implement the BP A
surcharge concept to ensure that the City was able to cover our wholesale costs, but not make
these extra costs subject to the City's Electric Users Tax. This BP A surcharge has ranged from a
high of20.8% to its current rate of 16.6%.
The total amount of CRAC's that BP A charged, varied from a high of 49.5% for April-
September 2003, to a low of30.56% for October 2005-March 2006. The rate for the final 6-
month period (April-September 2006) was 30.71 %. The average cost of BP A power for the final
year of the rate period was about $0.02917/kWh. BP A recently completed a formal rate setting
process to establish wholesale power rates for the next three year period.
BPA's final rate proposal for the next 3-year period actually turned out to be significantly lower
than their initial proposal. Their power rate for Federal Fiscal Year FY06-07 is $0.02984/kWh.
BPA still will be able to add adjustments to the initial rates during the next 3-year period if they
need more revenue then will be generated by their initial wholesale power rates. They are
proposing 3 mechanisms to be able to do this. They are as follows:

CRAC- This could be triggered ifBPA's accumulated modified net revenues fall below a
targeted amount which is set to assure that BP A has a 95% of meeting its annual treasure
payment. It is capped at $300 million a year and would be applied to both energy and
low voltage delivery charges.
NFB Charge-The National Fisheries Service Federal Columbia River Power System
Biological Opinion Adjustment ofNFB charge would be levied as a result ofFish costs
increases, caused by Court action related to the 2004 Biological Opinion. This could be
applied in addition to the CRAC and is uncapped. It would apply to energy, low
V oltage and demand charges.
Emergency Fish Surcharge-BP A is proposing this in answer to a situation where they
can't get money fast enough to meet its Treasury obligations due to Court ordered fish
costs. Because triggering the NFB charge could have up to a year time lag, BP A wants
this tool to deal with emergency fish costs. As proposed, this charge could be added to a
monthly wholesale power bill with only 30 days notice.
Because BP A's wholesale rates are now set at levels which are nearly equal to their previous
rates plus the amount they added by applying the CRAC'S to previous rates, we proposed in this
year's budget to absorb these costs into our retail rates. However because of the projected health
of both the Electric and General funds staff feels that there is no need to make these changes this
year. We expect that, after getting a couple more months of data, we may still propose to
eliminate the surcharge and raise electric rates again during this upcoming budget process.
BPA's power costs (energy, demand & transmission) for FY05, 06 & 07(projected), are
compared in the following table:

The actual ending fund balance for FY05-06 was $2,116,269. This exceeded our targeted fund
balance of$1,457,000 by $659,269. Our projections are that our ending fund balance at the end
of this fiscal year will be about $1,563,000.
Related City Policies:
The City has adopted fund balance policies for enterprise funds. Our target fund balance for
2007 is $1,650,000. Leaving electric rates as they currently stand will leave us a little lower than
this target but current projections are based on only seven months of data and the cold winter we
are experiencing could produce extra revenue that may make up this difference by years end.
Council Options:.
1) Leave the electric rate at their current levels and retain the BP A surcharge at 16.6%.
2) Adopt the budget proposal raising electric rates by 10.76% and eliminating the 16.6%
BP A surcharge.

Staff Recommendation:
Staff recommends that Electric rates and the BP A surcharge remain at current levels and that no
action is needed at this time.
