Statement:
Resolution No. 2004-31, authorizing and ordering the implementation of the Nevada Street Local Improvement District was
approved by Council on September 7,2004. All planned improvements have now been constructed and final costs
compiled. In accordance with Ashland Municipal Code (AMC) Chapter 13.20 final assessments shall be levied against the
benefiting property owners. A public hearing is required to provide an opportunity for the council to hear and consider written
and oral testimony regarding the final assessment.
Staff Recommendation:
Staff recommends approval of the attached resolution to set a public hearing to consider written and oral objections to the
final assessment for the Nevada Street LID No. 85.
Background:
The Nevada Street LID was developed in response to citizen requests to provide an opportunity to meet the following
specific goals pertaining to Nevada Street:
1. Reduce speed of traffic
2. Encourage uniform traffic speed
3. Provide a safe and comfortable pedestrian route
4. Provide a safe and comfortable bike route
5. Provide a safe motorist route
6. Maintain safe and unimpeded emergency access
7. Maintain the street function as a neighborhood collector
8. Increase livability of the neighborhood (relating to noise, traffic speed, convenience of travel, maintain trees,
and reduce clutter)
9. Balance street function, safety and livability, and
10. Reduce the anticipated impact of increased traffic
To meet these goals a comprehensive plan was developed with the assistance of a citizens panel comprised of a cross
section of owners within the Quiet Village subdivision area, both from within and outside of the assessment district
boundary. The design process was a rigorous one lasting nearly six months and culminating in seven different and distinct
plans being submitted to the engineering staff. Staff was charged with refining the seven plans into a single acceptable
design. This was accomplished by incorporating elements from the seven plans, into one single concept plan. This plan was
reviewed and approved by the Council on August 3, 2004. The final project plans were completed by Thornton Engineering
of Medford and the project was advertised for construction in April 2005. To provide economies of scale and to reduce
bidding and administration costs, the Nevada Street LID project was included as Bid Schedule C in conjunction with two
other projects (Schedules A and B) within the 2004 Miscellaneous Concrete Construction Project No. 2004-04.

This project was originally bid on May 10, 2005, with only a single bid received. Since that bid was 48% higher than the
engineer's estimate, the single bid was rejected and the project was rebid later that year in the hopes of a more improved
and competitive bidding atmosphere. Several changes were made to the project to help encourage a more competitive
project including:
1. The project was rescheduled as a winter construction project to take advantage of what is generally considered
to be the "slack" construction season.
2. The project construction time limits were extended through to May 31, 2006, to provide maximum construction
time.
3. The bidding period was extended to six weeks to provide contractors with adequate time to prepare bids.
4. A concerted effort was made to contact prospective bidders. Plans and bid packages were distributed to ten
plan centers, three newspapers and 20 contractions in the hopes that additional competition could be
generated.
The Miscellaneous Concrete Construction Project was rebid on December 14, 2005 with results similar to the May 10, 2005
bid. Again, we received only a single bed from L TM, Inc. The results of the bid are as follows:

The original estimated construction cost from 2004 was for $148,500.00 which was revised in 2005 to $175,525.50. The final
bid at $249,050.50 was 29.5% higher than the latest revised cost estimate and 40.4% higher than the original 2004
estimate.
The construction contract was reviewed by Council on January 17, 2006, where it was determined that, due to the
unlikelihood of receiving a more competitive and lesser bid, the single bid would be accepted and a contract be entered into
with L TM Inc. to construct the Nevada Street Traffic Calming Improvements.
In accordance with AMC Section 13.20.060 (B) it was further determined that the amount of increase to be allocated to the
benefited assessment district would be limited to just 10% over the advertised rate with the balance to be assumed by the
City and funded through alternative sources. The assessment rate as indicated on Resolution No. 2004-31 was $575.20 per
equivalent dwelling unit. With the additional 1 0% over the stated assessment rate, the final rate is now projected at $632.72.
Bullock vs. City of Ashland
During the course of the Nevada Street LID project development, numerous legal suits were filed in the State Circuit Court
by Art Bullock. In Mr. Bullock's many filings he contended that the City had erred in over 80 points of law or procedure in the
formation of the Nevada Street assessment district. Judge Mark Schively has ruled in favor of the City on all counts except
the following two points:
1. That the City should have adopted findings as to the determination of the LID boundaries. (Circuit Court Case
No. 04-397123(7)). This condition was remedied on June 6, 2006 when Council officially accepted findings
which were promptly forward to the court where they were accepted.
2. The City did not have the ability to vary from the specified formula of assessment determination as specified in
Resolution 99-09 which states that the city will contribute the following amounts to reduce the assessments to
a local improvement district:
60% of the total costs for sidewalk improvements;
75% of the total costs for storm drain improvements;
20% of the total costs for street surface improvements; and
50% of the total costs for engineering and administration.
City staff had considered this project to be a sidewalk improvements project which did not correlate well with the above
standard formula, and elected to use a more equitable interpretation of the formula which resulted in a reduction in the
assessment amount. In computing the assessment rate, the City chose to apply a 60% City participation to all categories of

costs, except engineering costs. Rather than show a 20% and 75% participation for street improvement and storm drain
costs, a uniform 60% reduction was applied overall. If the exact formula was to be followed the results would be as follows:
Based upon the latest engineer's estimate for construction the full costs are allocated to each of the four categories.

As shown, the full formula interpretation would result in a 24.5% increase in individual assessments This has no impact upon
the final assessment rate as it is legally established by Resolution No. 2004-31 plus 10% and additional costs in excess of
that increase are already assumed by the City.
Final Costs
The Nevada Street LID project was substantially completed in September of 2006 at a total project cost of $283,125.38. The
final price included $34,074.88 in extra work and additional quantities resulting from unexpected site conditions. Engineering
costs were $12,712.25 for a total project cost of $295,837.63. Following is a breakdown of the allocations of project costs:

AMC Chapter 13.20.010 Definitions
A. "Improvement resolution" means that resolution adopted by the council declaring its intention to make a local
improvement.
B. "Local Improvement" has the meaning given under ORS 223.001.
C. "Local Improvement District" means the property that is to be assessed for all or any portion of the cost of a local
improvement and the property on which the local improvement is located.
D. "Lot" means a lot, block or parcel of land.
E. "Owner" means the owner of the title to real property or the contract purchaser of real property of record as
shown on the last available complete assessment role in the office of the County Assessor.
Council Options:
Council may approve the attached resolution setting a public hearing for May 1,2007, or may elect to set a later date
pending further study by Council or staff.
Potential Motions:
Council may move to approve the attached resolution setting a public hearing date for May 1,2007, or
Council may move to delay the public hearing pending further analysis of the LID.

A RESOLUTION SETTING A PUBLIC HEARING FOR
ASSESSMENTS TO BE CHARGED AGAINST LOTS
WITHIN THE NEVADA STREET LOCAL IMPROVEMENT
DISTRICT NO. 85
THE CITY OF ASHLAND RESOLVES AS FOLLOWS:
SECTION 1. The City Council having received proposed assessments to be charged
against each lot within the Nevada Street Local Improvement District; orders that a
public hearing be held to consider written or oral arguments to these assessments at
7:00 p.m. May 1, 2007 in the City of Ashland, City Council Chambers at 1175 East Main
Street. The City Recorder is directed to mail the attached notices of the proposed
assessments to the owners of the lots to be assessed.
SECTION 2. This resolution takes effect upon signing by the Mayor.

RESOLUTION NO. iii.
A RESOLUTION AUTHORIZING AND ORDERING THE LOCAL
IMPROVEMENTS FOR THE CONSTRUCTION OF IMPROVEMENTS TO
NEVADA STREET CONSISTING OF SIDEWALKS, CURB EXTENSION
PLANTER AREAS, PEDESTRIAN SAFETY IMPROVEMENTS TO
INTERSECTIONS, DRAINAGE AND ASSOCIATED IMPROVEMENTS
AND AUTHORIZING THE CITY TO BORROW MONEY AND ISSUE AND
SELL NOTES FOR THE PURPOSE OF PROVIDING INTERIM
FINANCING FOR THE ACTUAL COST OF THE LOCAL IMPROVEMENT
RECITALS:
A. The Council has declared by resolution its intention to develop the improvements
described in the above title and in the improvement resolution previously adopted and
to assess upon each lot or part of lot benefited by the improvement its proportional
share of the cost of the improvement; and
B. Notice of such intention was duly given, a public hearing was held and it appears to
the Council that such improvements are of benefit to the city and all property to be
assessed will be benefited to the extent of the probable amount of the respective
assessments to be levied for the costs.
THE CITY COUNCIL OF THE CITY OF ASHLAND RESOLVES:
SECTION 1. A local improvement district is created and shall consist of all the tax lots
described in the attached Exhibit A. The district shall be called the Nevada Street Local
Improvement District, No. 85.
SECTION 2. The council intends to make local improvements to provide the
improvements described in the above title. Such improvements will be in accordance
with costs estimated to be $173,500.00 of which $71,900.00 will be paid by special
assessments on benefited properties. Costs will be allocated based on $575.20 per
equivalent dwelling unit or potential equivalent dwelling unit within the assessment area.
Lots will be assessed as specified on the attached Exhibit A.

SECTION 3. The City of Ashland is authorized to borrow money and issue and sell
notes for the purpose of providing interim financing for the actual cost of the local
improvement. The notes may be payable from the proceeds of any bonds, issuance of
additional notes or from any other sources from which the bonds are payable. This
borrowing shall be issued according to the terms of ORS 223.235(7).
SECTION 4. The City of Ashland expects to make expenditures from its available funds
to pay for the costs of the improvement project. The City reasonably expects to issue
bonds or other obligations (the "Reimbursement Bonds") and to use the proceeds of
the Reimbursement Bonds to reimburse the City for the expenditures it makes from its
available funds for the improvement project. To permit interest on the Reimbursement
Bonds to be excludable from gross income, the Internal Revenue Code of the United
States requires that the City declare its intent to reimburse itself from Reimbursement
Bond proceeds within 60 days after the expenditures are made. The City expects that
the principal amount of the Reimbursement Bonds will not exceed $90,850.00.
SECTION 5. The assessment imposed upon benefitted properties is characterized as
an assessment for local improvement pursuant to ORS 305.583(4).
SECTION 6. The city recorder is directed to prepare the estimated assessment of the
respective lots within the local improvement district and file it in the lien records of the
city.
SECTION 7. This resolution takes effect upon signing by the Mayor.
This resolution was read by title only in accordance with Ashland Municipal Code
!l2.04.090 and duly PASSED and ADOPTED this 7 day Of/~ 2004.

Statement:
Attached is an ordinance which would amend the ethics provisions in Ashland Municipal Code. The primary change made
to the current ethics code is to also include elected officials and appointed officials in its applicability. A provision restricting
appointed officials from representing clients for hire before any body of the city on a matter that will or has come before the
body to which the official is appointed to serve has been added. Additionally, procedures for addressing the applicability of
the code provisions has been added, with the City Administrator making that determination for applicability to employees
and the City Council making the determination of applicability to appointed and elected officials.
Background:
The Ashland City Council held a study session March 6, 2006, to discuss the possibility of amending the ethics provisions
within the Ashland Municipal Code. After careful consideration the City Council indicated an interest in:
1) Amending the Ethics provisions currently in the Ashland Municipal Code to be applicable to elected and
appointed officials in addition to applicability to city employees;
2) Adding in a procedure for investigating and enforcing the ethics provisions;
3) Adding a provision similar to provisions in the Gresham City Charter which would require Ashland to have
ethics provisions in its municipal code which can be enforced locally.
The proposed ordinance would amend the ethics provisions in the Ashland Municipal Code to apply to elected and
appointed officials in addition to employees. Additionally, the amendments would prevent an appointed official from
representing clients for hire before any board or commission or before the City Council on matters which would come before
the board or commission on which the appointed official sits. The proposed changes also add exceptions for the use of
public property for private benefit for instances which are specifically set forth as a benefit of employment and for the
granting of special treatment or advantage to a citizen when provided for by law. Finally, the proposed ordinance permits
determinations of applicability by the City Administrator for applicability to employees and determinations of applicability by
the City Council for applicability to appointed and/or elected officials. The sanctions paragraph has been amended to
provide violations are considered cause for discipline.

SECTION 1. Section 308020 of the Ashland Municipal Code is amended to read
SECT10N 3.08.020 Code of Ethics.
A Declaration of Policy. The proper operation of democratic government requires that public officials.
including eJected of11cwls. <lnpoJnred QJliciah aJ.!.<:Lemployees be independent impartial and
responsible to the people: that governmental decisions and policy be made in the proper charmels of
the governmental structure; that public office not be used for personal gain; and that the public have
confidence in the integrity of its government. ]n recognition of these goals, there is hereby
established a Code of Ethics for allJJublic nl11cials, whether paid or unpaid.
The purpose of this Code is to establish ethical standards of conduct for all ,public ojjlcials by setting
forth those acts or actions that are incompatible with the best interests of the City of Ashland. It is
also the purpose of this Code to assist]1uhhc offiCIals in determininglhe proper course of action when
faced with uncertainty regarding the propriety of a contemplated action, thereby preventing them
from unwittingly entangling public and private interests.
Through adoption of this Code the City hereby expresses its intent to maintain high ethical standards
in the City service, and to increase pubhc confidence in the integrity of City JJublic officials.
B. RespOnsibilities of Public Office. J'ub!ic otlicials are agents of public purpose and are "Cnga12ed for
the benefit of the public. They are bound to uphold the Constitution of the United States and the
Constitution of this State and to carry out impartially the laws of the nation, state and the City, and
thus to foster respect for all government. They are bound to observe in their official acts the highest
standards of morality and to discharge faithfully the duties of their office regardless of personal
considerations, recognizing that the public interest must be their primary concern.

loan, thing or promise, from any person, firm or corporation which to their knowledge is
interested directly or indirectly in any manner whatsoever in business dealings with the City; nor
shall any such employee (l) accept any gift, favor or thing of value that may tend to influence the
employee in the discharge of their duties, or (2) grant, in the discharge of their duties, any
improper favor, service or thing of value.
4. Representing Private Interests Before City Agencies or Courts. No employee whose salary is
paid in whole or in part by the City shall appear in behalf of private interests before any agency of
the City. An employee shall not represent private interests in any action or proceeding against the
interests of the City in any litigation to which the City is a party, unless the employee is
representing himself/herself as a private citizen on purely personal business, No appointed

when given. The employee shall have the opportunity to present their interpretation of the facts at
issue and of the applicable provision(s) of the code before such advisory decision is made. All such
requests for advice shall be treated as confidential. This code shall be operative in all instances
covered by its provisions except when superseded by an applicable statute, ordinance or resolution,
and each statute, ordinance or resolution action is mandatory, or when the application of a statute,
ordinance or resolution provision is discretionary but determined to be more appropriate or desirable.

Statement: During the September 19,2006, City Council meeting, the Department of Environmental
Quality made a presentation regarding the concern for the levels of particulate matter throughout the
County and requested that the City of Ashland consider a ban on open burning. At this time, City
Council requested staff to return with an ordinance which would ban open burning. On March 6, 2007,
staff returned with proposed amendments to the Ashland Municipal Code to modify the burning
ordinance. The City Council approved option number one which would allow open burning for the
prevention of wildfire hazard and noxious weed abatement activities, and prohibits all other open
burning.
Background: Ashland Municipal Code 10.30 establishes Controls on Open Burning, which are
enforced by the City's Fire Marshal. The current ordinance allows open burning from March 1 until
the beginning of fire season and in the fall from the end of fire season for two weeks. Fire Season
typically begins between May 15 and June 1 and ends about mid-October. The burning of dry, woody
debris is permitted in a person's backyard and for the purposes of forest fire fuel reduction. Products
allowed to be burned under the open burning ordinance are limited to dry, woody debris and prohibits
stumps, leaves and grass. Burning of products that are the result of land clearing for development is
not permitted. A permit from Ashland Fire & Rescue is required for any open burning, pile size is
limited and specific fire safety measures are required to be implemented. Burning is only allowed to
occur on a day when the Jackson County Ventilation Index is greater than 400.
The ordinance approved at first reading, would allow open burning for the prevention of wildfire
hazard and noxious weed abatement activities, but prohibits all other open burning. If the second
reading is approved, it will go into effect in the middle of April which is in the middle of the spring
burning season for which permits have already been issued. Unless the City Council opts to postpone
the effective date of the ordinance, issued permits will be rescinded prior to their expiration date. The
end of the spring bum period is the beginning of Fire Season which usually occurs sometime between
mid-May and mid-June.
Ashland Fire & Rescue currently issues permits for any activity which requires the use of an open
flame with the exception of free-standing barbecues, designated campfire rings in Lithia Park, and

outdoor fireplaces meeting the specifications of Ashland Fire & Rescue. Examples of permits issued
include fire dancing, North Mountain Park Salmon Bake, sweat lodges, candlelight vigils, campfires
for public events, and religious or ceremonial events. The proposed ordinance included with this
council communications does not include changes in these activities.

10.30.005 Definitions.
The following words and phrases whenever used in this chapter shall be
construed as defined in this section unless from the context a different meaning
is intended.
A. "Fire Chief' means the City of Ashland Fire Chief or the Chiefs
representative.
B. "Campfire" means any fire for cooking located outside of a building or
recreational vehicle.
C. "Outdoor fire" includes any fire except a fire for cooking.
D. "Person in charge" means a person or a representative or an employee of
a person who has lawful control of the site of the fire by ownership,
tenancy, official position or other legal relationship.
E. "Ventilation index" means the National Weather Service's indicator of the
relative degree of air circulation in the Rogue Valley.
F. "Noxious Weed" means any plant classified by the Oreqon State Weed
Board that is injurious to public health. aqriculture. recreation. wildlife. or
any public or private property.
SECTION 2. Section 10.30.020 A. of the Ashland Municipal Code is amended to read:
SECTION 10.30.020. Period When Outdoor Burning is Authorized.
A. After a permit is obtained from the Fire Chief, outdoor fires are authorized
from March 1 until fire season is declared, and for a period of two weeks
immediately following the termination of fire season, when the ventilation index is
over 400 and fire fuel conditions are conducive to safely burning. Permits shall
only be issued for the purpose of forest fire fuel reduction or noxious weed
manaqement.

which can be given effect without the invalid provision or application, and to this end the
provisions of this Ordinance are declared to be severable.
SECTION 5. Codification.
Provisions of this Ordinance shall be incorporated in the Ashland Municipal Code
and the word "ordinance" may be changed to "code", "article", "section", or another
word, and the sections of this Ordinance may be renumbered, or re-Iettered, provided
however that Sections 4 thru 5, unincorporated Whereas clauses and boilerplate

Statement:
The State Department of Environmental Quality(DEQ) has requested that Jackson County and all
municipalities in Jackson County, Air Quality Maintenance Area(AQMA) adopt local ordinances
that require non-certified wood stoves be removed upon change of ownership of the residence.
The Council adopted first reading of this ordinance on March 6, 2007.
Background:
The Jackson County AQMA has had non compliance issues with State and Federal air quality standard
for a number of years. There have been many actions that local and state governments have implemented
which have made significant progress on cleaning up the air. These include inspection and maintenance
for vehicles, open burning restrictions, wood stove curtailment ordinances, air quality advisories and air
quality controls on industry. These programs have allowed the AQMA to meet PM 10 standards for the
last few years. However, the EP A in December adopted new PM 2.5 standards, which are more stringent
and could cause the AQMA to again violate Federal standards.
In September, the Oregon DEQ staff attended the Ashland City Council meeting and requested that the
City adopt a ban on open burning and also an ordinance that would require that non-certified woodstoves
be removed from a home when the home changes ownership. The subject of this communication is the
woodstove ordinance. The cities of Medford, Talent, Jacksonville and Jackson County have already
adopted this woodstove change out ordinance and according to local DEQ officials Eagle Point and
Central Point are also working on passing local change out ordinances.
Senate Bill 338 has been introduced into the 2007 legislative that would, among other things, require
removal of non-certified stoves upon the sale of a home in all parts of the state. This bill while supported
by DEQ, is not actually being sponsored by them. At the Council meeting in September 2006, staff was
directed by Council to develop a local change out ordinance and bring it back to the Council for
consideration. .

The conservation element ofthe City's Comprehensive Plan and the Valdez Principles both support city
initiatives that improve air quality.

DISCLOSURE AND REMOVAL CERTIFICATION

THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. Section 9.24.010 of the Ashland Municipal Code is amended to add the
following two new definitions lettered "N and "C" and to re-Ietter the remaining definitions as
follows:
9.24.010 Definitions
For the purposes of this Chapter, the following definitions apply:
A. "Conveyance of Real Property" means the transfer of title to real property from one
person or entity to another by any transfer means whatsoever, includinq but not limited
to a transfer by deed, land sale contract, foreclosure, inheritance, bankruptcy or other
action at law. For purposes of this ordinance a lonq term lease of ten years or more,
with or without an option to purchase, shall be considered a conveyance of real property
under this ordinance. A revocable inter vivos (Iivinq) trust shall not be deemed a
conveyance.
~. A "High pollution period" means a period of time commencing three hours after initial
designation as a red or yellow day by the Oregon Department of Environmental Quality
(further referred to in this chapter as DEQ) or the Jackson County Department of Health
and Human Services. In the event more than one consecutive days are designated as
red or yellow, they shall all be considered a part of the same period.
C. "Non-Certified Woodstove" or "Fireplace Insert" also referred to as "non-certified
device s" means a residential s ace heatin device that has not been certified b either
the Oreqon Department of Environmental Quality. mEQ) or the U.S. Environmental
Protection Aqency (EPA) as complyinq with smoke emission standards, such as those
referenced in the definition of Oreqon Certified Stove below. For purposes of the
re uirements of Section 9.24.055 below "Non-Certified Woodstove" or "Fire lace
Insert" does not include:
1. Exempt Devices, meaninq heatinq devices exempt from certification
requirements under the applicable Oreqon or federal rules, includinq but not
limited to pellet stoves.
2. Cook Stoves, meaninq indoor wood burninq appliances the primary purpose
and desiqn of which is to cook food.

3. Antique wood stoves, meaninq a wood stove manufactured before 1940 with
ornate construction and a current market value substantially hiqher than a
common wood stove manufactured in the same time period.
4. Fireplaces not used for heatinq purposes.
SECTION 2. A new Section 9.24.055 is hereby added to the Ashland Municipal Code
and shall read as follows:
9.24.055 Removal and Disposal of Non-Certified Woodstoves and Fireplace Inserts.
A. PROHIBITION. It shall be unlawful and a violation of the Ashland Municipal Code, for the
Conveyance of Real Property to occur for any real property located within the City of
Ashland in violation of the requirements of this Section, includinq specifically documented
compliance with the Disclosure, Removal/Disposal and Certification requirements set forth
herein. Notwithstandinq the fine limitations of AMC Section 1.08.020, the fine for violation
of any provision of this Section shall be a minimum of $250.00 and a maximum of
$1000.00, excludinq any required state and local assessments.
DISCLOSURE. The Seller of any real property located within the City of Ashland shall
disclose to potential buyers as part of the seller's written property disclosure for the
Conveyance of Real Property, the existence of any and all certified or non-certified wood
stoves, fireplaces and fireplace inserts. The disclosure to the buyer shall be evidenced by
a Disclosure Certificate executed by the seller with receipt acknowledqed by the buyer,
with seller certifyinq under penalty of perjury and false swearinq, whether any of the wood
stoves or fireplace inserts present on the real property are non-certified or otherwise
nonconforminq as to use or applicable emission standards. The Disclosure Certificate
shall be executed prior to, or concurrent with closinq, reqardless of the manner of c10sinq of
any real estate transaction, and prior to any transfer of title involvinq real property located
within the City of Ashland. Seller and Buyer shall use the standard Disclosure Certificate
form adopted by Resolution of the City Council, as such certificate may be amended from
time to time.
B. REMOVAL AND DISPOSAL. Except as otherwise provided for herein, all non-certified
wood stoves and fireplace inserts shall be permanently removed from buildinqs or
structures located on real property within the City of Ashland on or before the Conveyance
of Real Property containinq such non-certified devices. If the seller has assumed
responsibility for removal, then such removal shall be completed on or before the c10sinq
date or title transfer date of the real property, whichever occurs first. If the Buyer has
assumed responsibility for removal, or should the seller fail to remove the non-certified
device(s), for any reason whatsoever, then buyer shall complete the removal within thirty
(30) calendar days after closinq or title transfer date, whichever is earlier. Proper disposal
of the non-certified device(s) shall be evidenced by a receipt from a DEQ requlated landfill
or a business licensed to recycle scrap metal. The removal of the non-certified device(s)
shall be evidenced by a Removal Certificate executed by the buyer, with buyer certifyinq,
under penalty of periury and false swearinq, that all non-certified devices referenced on the
Disclosure Certificate have been removed and properly disposed of as required in this
Section. The Removal Certificate shall be executed by buyer as early as possible after
removal and disposal but in no case more than thirty (30) days after c10sinq or transfer of
title. Within thirty (30) days of the closinq or transfer of title date, the buyer or buyer's

desiqnee, shall submit a true copy of the executed and acknowledqed Disclosure
Certificate and Removal Certificate and receipt for disposal to:

Tripartite Housing Committee
Report
March 20,2007
The joint committee of Council, Parks, and Schools (dubbed the Tripartite) has met
intermittently over the past several months. Attached is a refined list of the goals and
priorities that resulted from one of their earlier meetings. Issues are ranked according to
the number of votes received. Goal number two, in the category of "Housing" is to find
solutions to the declining enrollment in schools and to provide more affordable housing.
Number four in the category of "Planning" is to look at land holdings and review
affordable housing options.
At the Oct. 5,2006 joint meeting I volunteered to call together a meeting of the Housing
Committee. Since then the committee has met three times. The membership has
consisted of:

1. Bring 200 new students to Ashland through the creation of workforce/affordable
housing with the goal of opening (or reopening) an elementary school.
2. Bring additional families to Ashland to maintain the viability of our community
hospital.
3. Inventory all public lands to identify potential sites for workforce/affordable
housing.
The committee has also identified two sub-goals or specific outcomes:
1. Facilitate housing for 20 households with members employed by the Ashland
School District.
2. Facilitate housing for 20 households with members employed by the City of
Ashland and Parks Department.
To work toward accomplishing these goals the committee is asking each parent
organization to identify a piece of property that would be suitable for siting
workforce/affordable housing. The City conducted an inventory of possible surplus
properties in 2002, and the present seems to be a good time to revisit this inventory.
In addition to the above goals, the committee has embarked on two other projects in
conjunction with the Housing Commission:
1. An awareness campaign, the first step of which has been the development of a
brochure intended for employees of the City, Schools, and Parks to aid them in
identifying financing and other information on affordable housing.
2. The development of a notebook, both paper and on-line, highlighting workforce
housing success stories from other municipalities and school systems.

By scheduling this hearing, Council is doing what you asked Mt Ashland Association to
NOT do-- take final action while a court case is in appeal.
Nevada Street LID is in Oregon Court of Appeals, appealed on several solid grounds
that may overturn the entire LID and make a waste of what you're trying to schedule.
You need to let the appeals process finish before activating liens on people's homes.
let's remember:
1. The majority of property owners on Nevada Street voted by signed documents
AGAINST this LID.
2. Billings Ranch Golf Group LLC made improvements on Public Works Director
Paula Brown's property, built her a big wooden fence, in direct alleged violation of state
ethics law against receiving financial benefits.
3. City of Ashland admitted to Jackson County Circuit Court that all city councilors
and mayor, plus city recorder Barbara Christensen, city administrator, and city attorney
Mike Franell knew of 8-not 1, 8--conflicts of interest for Paula Brown.
4. Paula Brown at last check has still not submitted ANY disclosures of her conflicts
of interest, yet you folks proceed as if everything is hunky-dory.
5. I took Jim Olson's deposition for the court case. In that deposition, he admitted
that Paula Brown gave him improper percentages, that he knew at the time they were in
violation of Resolution 1999-09, and that he withheld this information from you.
6. City of Ashland admitted to Circuit Court that percentages you used saved Billings
subdivision thousands of dollars. This after the subdivision improved Paula Brown's
property. You then compounded it by a blow-the-budget monopoly bid from L TM that
added more LID costs and more subdivision subsidy. By my calculations, Ashland
taxpayers have now subsidized Billings Ranch by more than $35,000. Yet you do
nothing.
7. Here you have a clear case of staff acting improperly and deliberately misinforming
you about proper procedures, and yet you protect staff instead of taxpayers. Have you
folks no ethics at all? Every taxpayer seeing this can see clearly what's going on, and
it is NOT ethical.
You need to do 4 things:
1. You need to not schedule Nevada LID hearing until appeals are finished. The
courts can still declare Nevada LID to be null and void.
2. You need to not activate liens on Nevada St properties, until you're certain the
Court doesn't make you go back and undo the damage, just as you asked Mt Ashland.
3. You need to require Paula Brown to disclose her 8 conflicts of interests in writing in
the public record, as required by ORS 244.120.
4. You need to fix the LID policy so neighborhoods determine for themselves how
their streets and sidewalks are improved. Staff has their own agenda, and it's NOT the
public interests.

Consideration of the call up of the Glenn Street proposal.
Section 18.108.110 sets forth the appeal process to city council. 18.108.l10(B)(3) allows the city
council, by majority vote, to appeal a Planning Commission decision.
As the legal department has previously advised, there are many provisions within our land use ordinance
that compete with other provisions of the ordinance. The purpose of having a multi-member commission
is to be able to have full discussion of the competing provisions, providing appropriate weight to the
most important considerations in each case. The ability of the City Council to appeal a decision of the
planning commission is a power that should be used sparingly and only when significant policy issues
are at stake and the Council determines that it is important to weigh in and provide the Planning
Commission with additional policy guidance.
The issue at hand required the Planning Commission to balance between two interests that in this
particular matter were competing: the challenge of making sure a proposed development is consistent
with the character of an existing nationally registered historic district and the policy of the City to require
larger setbacks along arterial streets to facilitate potential future widening.
The weighing of the competing values was not an easy matter. The Planning Commission considered
this matter during two public hearings, finally making a decision at a third meeting when they had the
option of reconsidering their decision, but instead voted to adopt the findings and conclusions, thus
creating a final order of the Planning Commission. This decision was backed by recommendations for
approval from both staff and the city's Historic Commission. The Planning Commission decision was a
difficult decision, which resulted in a 5-4 vote approving the variance request.
The Council should only appeal this issue if it believes that significant policies are being implicated and
that the Council feels compelled to take a more detailed look at the consideration and weight given to the
competing values between the arterial setbacks as applied in historic districts.
