John C. Schweiger, Trustee or his successor in trust, under the John C. Schweiger
Loving Trust, dated December 24, 1996, Grantor, conveys and warrants to CITY OF
ASHLAND, Grantee, the real property described on the attached Exhibit A free of
encumbrances.
This conveyance is made on the express condition that the grantee shall only use the
premises for a public park or open space or as access between public parks or open
spaces, and if the premises are ever used for any other purpose, the grantor or his
heirs and assigns may re-enter and terminate the estate hereby conveyed. This
conveyance is also made on the express condition that if grantee improves that portion
of Ashland Street betwee~t Guthrie and Terrace Streets with curbs, gutters and paving
thereby connecting Ashland Street to Terrace Street, the grantor or his heirs and
assigns may re-enter and terminate the estate hereby conveyed.
THIS INSTRUMENT WILL NOT ALLOW USE OF THE PROPERTY DESCRIBED IN
THIS INSTRUMENT IN VIOLATION OF APPLICABLE LAND USE LAWS AND
REGULATIONS. BEFORE SIGNING OR ACCEPTING THIS INSTRUMENT, THE
PERSON ACQUIRING FEE TITLE TO THE PROPERTY SHOULD CHECK WITH THE
APPROPRIATE CITY OR COUNTY PLANNING DEPARTMENT TO VERIFY
APPROVED USES AND TO DETERMINE ANY LIMITS ON LAWSUITS AGAINST
FARMING OR FOREST PRACTICES AS DEFINED IN ORS 30.930.
The true and actual consideration for this conveyance and easement is ONE DOLLAR
($1.00) and other good and valuable consideration.
