The undersigned, referred to in this document as "Owner" whether singular or plural,
owns or is the purchaser under a recorded land sale contract of real property in Jackson
County, Oregon, described below and referred to in this document as "the property":
Tax Lot 39-1E-S, 300 (843 Fox Street)
In consideration of the City of Ashland permitting the connection of Owner's building
sewer from the residence on the pro:::erty to the sewer system of the City of Ashland,
Owner declares and agrees that the pioperty shall be held, sold, and conveyed subject
to the following covenants, conditions and restrictions, which shall constitute covenants
running with the 'Iand and shall be binding on all parties having any right, title or interest

Whenever a proposal to annex the property is initiated by the City of Ashland or

described on attached Exhibit "A".
In consideration of the City of Ashland permitting the connection of Owner's building
sewer from the residence on the property to the sewer system of the City of Ashland,
Owner declares and agrees that the property shall be held, sold, and conveyed subject
to the following covenants, conditions and restrictions, which shall constitute covenants
running with the land and shall be binding on all parties having any right, title or interest
in the property or any part, their heirs, successors and assigns:
Whenever a proposal to annex the property is initiated by 'the City of Ashland or
otherwise, Owner shall consent and does consent to the annexation of the property to

APPLICATION AND CONSENT TO ANNEXATION

For the purpose of applying to the City of Ashland to have our land annexed to that
City, we represent that we are the legal owners of record, or the contract purchasers pursuant
to a recorded contract, of the following-described land located in Jackson County, Oregon:
Beginning at a point 572.46 feet West of a stone monument at the
Southeast corner of Lot 47, ASHLAND ACRES, in Township 39 South, Range
1 East, Wil1amette Meridian, Jackson County, Oregon; thence South 0
07' East, 665.04 feet; thence west, 131.0 feet, to the East line of
tract conveyed to School District No. ~ Ashland, Oregon; thence North
o 07' West, along said line, 665.04 feet; thence East 131.0 feet, to
the point of beginning. (Fee for annexation to be based on a 10,000
sq. ft. parcel surrounding the residence: $.0383 X 10,000 = $383.00)
We hereby request and consent to the annexation of the above-described land to the
City of Ashland; and, in exchange for the scheduling of a public hearing and in consideration
of this request by the City of Ashland, we agree that this consent to annexation shall be
nonrevokable. .
We further agree to pay the systems development annexation charge set forth in
Section 4.16.010 of the Municipal Code for each square foot of land sought to be annexed to the
City of Ashland as a fair and just contribution toward the cost of existing municipal improve-
nents and utilities that may benefit the land; said payment to be made to the City of Ashland
~t the time the land is annexed, or when either water or sewer services are furnished to the
land at our request, whichever occurs first.

Following discussions with Brian Almquist. John Fregonese and Steve
Hall. I am submitting this Consent to Annexation form so that our
permit to connect to City sewer may be expedited. It is my
understanding from John Fre~go~ese that the City will initiate the
Type III Planning action for actual annexation. We agree to annexation
after July I. 1991. Enclosed are the fees that Steve .Hall told me
would be necessary in order to receive the sewer connect permit:
