VOLVES SITE REVIEW APPROVAL FOR THE CONSTRUCTION OF A )

FINDINGS,
CONCLUSIONS
AND ORDERS

RECITALS:
1) Tax lot 1103 of 391E 14A is located on Washington Street, 250 feet
east of the intersection of Washington and Jefferson Streets and is
zoned RR-5 (County).
2) The applicant is requesting Annexation and Zone Change for 1.03
acres of property, and site Review approval for the construction of a
7000 square foot office/warehouse. site improvements are outlined on the
site plan on file at the Department of Community Development.
3) The criteria for approval of an Annexation are found in Chapter
18.108.180 and are as follows:
A. That the land is within the City's Urban Growth Boundary.
B. That the proposed zoning and project are in conformance with the
city's Comprehensive Plan.
C. That the land is currently contiguous with the present city
limits.
D. That public services are available or can be made available to the
site.
E. That a public need for additional land, as defined in the city's
Comprehensive Plan, can be demonstrated.
The criteria for site Review approval are found in Chapter 18.72 and are
as follows:
A. All applicable city ordinances have been met and will be met by the
proposed development.
B. All requirements of the site Review chapter have been met.
C. The site design complies with the guidelines adopted by the City
council for implementation of this chapter.
4) The City council following proper public notice, held a Public
Hearing on November 7, 1989, at which time testimony was received and
exhibits were presented. The City council approved the application
subject to the conditions pertaining to the appropriate development of
the site.
Now, therefore, The City Council of the city of Ashland finds, concludes
and recommends as follows:
SECTION 1. FINDINGS
1.1 The City Council hereby incorporates by reference the Staff
Report noted as "Exhibit A", the findings submitted by the
applicant noted as "Exhibit B", the site Plan submitted by the
applicant noted as "Exhibit C" and the minutes from the public
hearing on this proposal held on November 7, 1989, noted as
"Exhibit D".
SECTION 2. CONCLUSORY FINDINGS
2.1 The city Council finds that it has received all
information necessary to make a decision based on the Staff
Report, public hearing testimony and the exhibits received.
2.2 The City Council finds that the proposal for Annexation and
Zone Change for 1.03 acres of property and site Review for the
construction of a 7000 square foot office/warehouse meets the
criteria found in the Annexation Chapter 18.108.030 and site Review
Chapter 18.72.
The City Council makes the following findings:
The Comprehensive Plan indicates that a 5 year supply, as
calculated by the Plan, should be in the City I S inventory. The
Plan projects that approximately 200 acres is needed for the
planning period, indicating the need for 50 acres of land at any
one time. The current vacant land inventory compiled by the
Planning Staff indicates approximately 48 acres of vacant E-l land.
Furthermore, information brought up during the recent 92-unit
apartment application on Hersey Street indicates that only about
25 acres of E-l land is readily available for development, with
much of that not on the market.
By either standard, the Council believes that there is a current
need for E-1 lands in the City. Further, this site is already at
a usable size (1 acre) and can have services easily extended.
The proposal also involves a site Review. The applicant has
provided a site Plan and building elevations. The structure is
proposed to have a two-story office in the front, with 4000 sq. ft.
of area. The rear will have 2000 sq. ft. of enclosed storage and
1000 sq. ft. open storage. The building has been oriented towards
the street, with pedestrian access provided to the front of the
building from Washington street. The parking are has been situated
to the side of the building. The proposed building and parking area
orientation and provision for pedestrian access meets the
requirements of Ashland's site design and Use Guidelines.
2.3 The city Council hereby adopts the applicant's findings
as submitted.
SECTION 3. DECISION
3.1 Based on the record of the Public Hearing on this matter, the city
Council concludes that the proposal for Annexation and Zone Change for
1. 03 acres and site Review approval for the construction of a 7000
square foot office/warehouse is supported by evidence contained in the
whole record.
Therefore, based on our overall conclusions, and upon the proposal being
subject to each of the following conditions, we approve Planning Action
#89-161. Further, if anyone or more of the conditions below are found
to be invalid, for any reason whatsoever, then Planning Action #89-161
is denied. The following are the conditions and they are attached to the
approval:
1) That a boundary survey be completed by a registered surveyor prior
to reading of the first ordinance by the city Council.
2) That the annexation include all abutting street right-of-way.
3) That the systems development annexation fees be paid prior to
issuance of a building permit.
4) That all necessary easements for sewer, water, and electric be
provided as required by the City of Ashland.
5) That a hal f-street improvement, including curb and gutter, be
provided along the Washington Street frontage.
6) That all paving and landscaping be installed prior to issuance of
a certificate of occupancy.
7) That the landscaping plan be reviewed by the Tree Commission and
that any proposed changes be reviewed and approved by the Staff Advisor.
8) That street trees, 1 per 30' of frontage, be installed along the
Washington street frontage.
9) That all hydrant requirements of the Fire Department be met.
10) That additional landscaping be placed around the parking area with
a 5' wide buffer along the west property line, and be reviewed by the
Ashland Tree Commission and approved by the staff Advisor.

AREA TO THE CITY OF ASHLAND, OREGON AND PROVIDING FOR AN
EFFECTIVE DATE. (ADROIT CONSTRUCTION CO. ANNEXATION)
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. The land described in Exhibit "A" attached hereto and
made a part hereof is contiguous to the City of Ashland and is
located in Jackson County, Oregon, and is hereby annexed to the
city of Ashland as provided in section 2 of this ordinance.
SECTION 2. Upon the effective date of this ordinance, the City
Recorder, in accordance with ORS 222.177, is hereby authorized and
directed to make and submit to the Secretary of the State of
Oregon, a copy of this ordinance, a copy of the Statement of
Consent from the electorate of the tract annexed, and a copy of the
ordinance dispensing with the election on the proposed annexation,
and also upon the effective date hereof, the City Recorder is
authorized and directed to submit a copy of this ordinance to the
County Assessor and County Surveyor of Jackson County, Oregon.

RECENTLY ANNEXED REAL PROPERTY FROM JACKSON COUNTY FIRE
DISTRICT NO. 5 (ADROIT CONSTRUCTION CO. ANNEXATION)
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. The land described in Exhibit "A" attached hereto,
situated in the city of Ashland, Jackson County, Oregon is hereby
withdrawn from Jackson County Fire District No. 5 pursuant to the
provisions of ORS 222.524.
SECTION 2. The city of Ashland elects to pay the bonds of the
Special Taxing Districts pursuant to the provisions of ORS
222.520(2) (b).

THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. The land described in Exhibit "A" attached hereto and
made a part hereof is contiguous to the City of Ashland and is
located in Jackson County, Oregon, and is hereby annexed to the
City of Ashland as provided in section 2 of this ordinance.
SECTION 2. Upon the effective date of this ordinance, the City
Recorder, in accordance with ORS 222.177, is hereby authorized and
directed to make and submit to the Secretary of the State of
Oregon, a copy of this ordinance, a copy of the Statement of
Consent from the electorate of the tract annexed, and a copy of the
ordinance dispensing with the election on the proposed annexation,
and also upon the effective date hereof, the city Recorder is
authorized and directed to submit a copy of this ordinance to the
County Assessor and County Surveyor of Jackson County, Oregon.

porated herein have consented to the annexation of said land to the City
of Ashland. The Council further finds that there are no electors
residing in the proposed annexation.
SECTION 2. The submitting of the question of the annexation is hereby
dispensed with and a Public Hearing is hereby called at the Council
Chambers, civic Center, 1175 East Main Street, Ashland, Oregon, on
January 16, 1990, at the hour of 7:30 P.M., at which time all persons
may appear and be heard on the proposed annexation.
SECTION 3. Pursuant to ORS 222.524 a Public Hearing shall be held on
January 16, 1990, at 7:30 P.M. in the Council Chambers, civic center,
1175 E. Main Street, Ashland, Oregon, on the question of withdrawal of
certain real property from Jackson County Fire District No.5. All
persons may appear before the Ashland City Council and be heard on the
