4.20.090 Credits.
\
A. When development occurs that gives rise to a system
development charge under section 4.20.040 of this Chapter, the
system development charge for the existing use shall be
calculated and if it is less than the system development charge
for the proposed use, the difference between the system
development charge for the existing use and the system
development charge for the proposed use shall be the system
development charge required under section 4.20.040. If the
change is use results in the systems development charge for the
proposed use being less than the system developmen't charge for
the existing use, no system development charge shall be required;
however, no refund or credit shall be given.
B. The limitations on the use of credits contained in this
Subsection shall not apply when credits are otherwise given under
section 4.20.090. A credit shall be given for the cost of a
qualified public improvement associated with a development. If a
qualified public improvement is located partially on and
partially off the parcel of land that is the subject of the
approval, the credit shall be given only for the cost of the
portion of the improvement'not attributable wholly to the
development. The credit provided for by this Subsection shall be
only for the public improvement charge charged for the type of
improvement being constructed and shall not exceed the public
improvement charge even if the cost of the capital improvement
exceeds the applicable public improvement charge.
C. Applying the methodology adopted by resolution, the City
Administrator shall grant a credit against the public improvement
charge, the reimbursement fee, or both, for a capital improvement
constructed as part of the development that reduces the
development's demand upon existing capital improvements or the
need for future capital improvements or that would otherwise have
to be provided at City expense under then-existing Council
policies.
D. Credits for additions to dedicated park land, or development
of planned improvements on dedicated park land, shall only be
granted by the city Administrator upon recommendation by the Park
and Recreation Commission for land ~r park development projects
identified in the Capital Improvement Plan, referred to in
section 4.20.060(B).
E. When annexation systems development charges have been paid
prior to the effective date of this chapter, a credit shall be
given for the systems development charge required hereunder.
F. In situations where the amount of credit exceeds the amount
of the system development charge, the excess credit is not
transferable to another development. It may be transferred to
another phase of the original development.

w. have several discrepancies to deal with. First, a $25,000

attention that this was not a legal collection. We want this

that this will apply to future phase fees. However, we need

Also, after investigating Super Good Cents notes and
Bonneville Powe~ guidelineg, we have established another
discrepancy.
We were told at least three times that our reimbuysements foy
ou~ pYI~ject would ba over $14,000. We would not have
implement~d the SGC program for the $7,500 we reteived.

for .ach building and .750 for each additional unit u"der the
same roof. This comes to $14,~OO. Bonneville ha~ made
similar payments and it co.ts the City of Ashland no~hing.

I would also like to give you some constructive criticism
which may help future builders and the City. I would suggest
that you develop a fee and requirement check list.
This will keep all departments and the builder on the same
track.
We had fee, requirement, and obligation changes that cost us
nearly .~o,OOO. It appeared to us that ..veral departments
had apathy problems if not total disregard for out rights and
obligations.
It has been very important for UB to maintain every
appearance of ho~~r and lnteyrity. We will continue to ~o
business at this level and look forward to future phases.

Dear Mr. Albertson:
This is in response to your FAX of September 3, 1991 in which you
address annexation fees and reimbursements from BPA for SGC
Weatherization.
First, concerning the question you raised about SGC Weatheri~~ation
reimbursements, I have forwarded your FAX to Dick Wanderscheid for a
response.
As to annexation fees you paid under our previous Ashland Municipal
Code Chapter 4.16 imposing an annexation Systems Development Charge,
please be advised that this fee was a "legal collection". This
Chapter was repealed as of June 30, 1991, since the new Stat,~ law on
SDC's requires that the methodology and fees be imposed under
guidelines set forth in State law. This new State law did not
invalidate fees collected prior to that date, but only requires that
all fees collected after July 1, 1991 be developed under the new
guidelines.
section 4.20.090(E) of the new SDC ordinance simply provides that
anne~ation SDC's previously paid be treated as a credit against future
SDC's. It does not provide for a refund as you have requesbed.
You should be hearing from Dick Wanderscheid shortly regarding your
weatherization payments.

Forest Management Plan. Ronald J. MCCormick, Grants Pass, explained
the proposed process for developing the Forest Management; Plan for
City-owned and forest-interface lands, which will include formation of
a citizens advisory group scheduled to meet on January 8, preceded by
several public meetings, and the plan presented to Council in
April/May. John Hoffman, McCormick & Assoc., said the main goal is to
prevent a catastrophic fire in the watershed, and maintain the
ecosystem.
SDC Credit Request - H. Albertson. City Admin. Almquist read a letter
from Hank Albertson, Lakeview, requesting a systems development charge
credit for off-site improvements in conjuction with a condominium
project on Clay street. He then reviewed a staff memo explaining why
the request should be denied. Albertson said the storm drain system
was of no benefit to his project but was required as a condition of
annexation by the Council in order to provide a pedestrian way along
Clay st. Public Wks. Dir. Hall said this is not a part of the storm
Drainage Master Plan and does not qualify as a public improvement for
SDC credit. Arnold moved to deny the request, Williams seconded and
the motion passed on roll call vote with Reid dissenting.
Tolman Creek Road L.I.D. Hall said he met with affected property
owners and noted five properties which should have been included in
the signal L. 1. D. He asked that Council re-open the public hearing
and said transportation SDC's from the Tolman Creek Plaza totalling
$18,000 could be used to help off-set costs. Williams seLid he would
abstain from voting due to a conflict of interest. Acklin noted the
policy of forming an L.I.D. with 50% signatures in favor. Arnold said
the L.I.D. boundary should be as broad as possible, S.D.C. monies not
used, and non-profit organizations re-noticed. Laws said the 2/3 rule
is reasonable for other than residential L.1.D. 's, Le. employment/
commercial/manufacturing. Acklin suggested including co~mercial
property on Highway 66 from Tolman to the overpass also; but excluding
the Tolman Mobile Park. John Zupan, Summit Investments, said Croman
and L.T.M. should share in the signal cost. Zak Brombaciler,
Independent Printing, agreed and added that all funding sources should
be researched. Barbara Allen, 2622 Ashland st., also said Croman and
LTM should be included. Vicky Neuenschwander, 455 Tolman, said the
district should be formed on the basis of impact, not acreage.
Estelle Richards, 463 Tolman, said this is the only LID formed to
place a traffic signal on a state highway. Acklin moved to request
that staff expand the properties notified as shown on Map 2 in the
agenda packet, excluding the Tolman Mobile Park, but including
commercial properties up to the overpass and the 5 properties
previously omitted. Arnold explained that the boundaries can be set
now, but the assessments will be prepared later and can be made on
impact. Reid noted that the agreements were signed as early as 1983
prior to the Tolman Plaza project application. The motion passed on
roll call vote with Williams abstaining.

ASHLAND CITY COUNCIL
DECEMBER 17, 1991
CALL TO ORDER: Mayor Golden called the meeting to order and led the
Pledge of Allegiance at 7:30 P.M. on the above date in the Council
Chambers. Laws, Reid, Williams, Acklin, and Arnold were present.

APPROVAL OF MINUTES: Arnold moved to approve the minutes of the
Regular Meeting of December 3, 1991; Acklin seconded, all AYES on
voice vote.
SPECIAL PRESENTATIONS & AWARDS: Mayor Golden read a Proclamation
declaring January 4 as "CHRISTMAS TREE RECYCLE DAY". Boy Scout Troop
112 will pick up trees left at the curb and, with assistance from the
Parks Department, will chip them to be used on park trails and as
mulch for park vegetation. Councilor Acklin noted that today is the
104th Anniversary of the Driving of the Golden spike in Ashland.
Mayor Golden noted that this is the last Council meeting for Chief of
Police S. victor Lively, who is retiring after 28 years of service to
the Ashland Police Department. Lively expressed his appreciation to
the Mayor and Council for their support. Laws asked that Council
recognize the Ashland High School Grizzlies for winning the 1991 State
Football Championship, at the next meeting.
CONSENT AGENDA: Laws asked that Item 5 be pulled for discussion.
Reid moved to approve the remainder as follows: 1. Min.utes of
Boards,.commissions, and Committees; 2. Departmental Reports -
November 1991; 3. Letter from TCI Cablevision relative t,o rate
adjustments effective February 1992; 4. Memo from Dir.of' Public Works
concerning status of left-turn project at Maple and N. Main Streets.
Acklin seconded, all AYES on voice vote. Laws asked if the Audit
Committee will follow up on recommendations made in the Report to
Management which accompanied this year's Audit Report. Acklin is
Liaison to that committee and said each item was discussed with the
Auditor and will be pursued. Finance Dir. Turner said a formal
response will be submitted for the Council's goal-setting session.
Laws moved to accept the Audit Report for Fiscal Year ended June 30,
1991, Williams seconded, all AYES on voice vote.
NEW & MISCELLANEOUS BUSINESS: Recycling Task Force Grant Application.
Julian Henry, Recycling Task Force Member, explained that the $32,000
grant application, if awarded from the DEQ, will fund the following:
1) education/promotion of backyard composting; 2) demonstration site

January 5, 1988 at 7:30 P.M., in the civic Center Council Chambers,
1175 E. Main Street on the following subject:
Proposed annexation, withdrawal from Jackson County
Fire District No. 5 and rezoning of property located
North of 289 Clay Street between Highway 66 and East
Main Street, comprised of tax lot 3100 of assessor's

AN ORDINANCE DISPENSING WITH AN ELECTION WITHIN THE CITY OF ASHLAND
ON THE QUESTION OF A PROPOSED ANNEXATION AND SETTING THE TIME AND
PLACE FOR A PUBLIC HEARING THEREON: SETTING A PUBLIC HEARING DATE
ON THE WITHDRAWAL OF CERTAIN REAL PROPERTY FROM JACKSON COUNTY FIRE
DISTRICT NO.5: DIRECTING PUBLICATION OF NOTICES AS DIRECTED BY
ORS 222,524; AND DECLARING AN EMERGENCY. (ALBERTSON ANNEXATION)
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS,
SECTION I. The City or Ashland rinds that the owners of the property
described in Exhibit "A" attached hereto and by this reference incorp-
orated herein have consented to the annexation or said land to the City
of Ashland.
SECTION 2. The submitting or the question of the said m1nexation is
hereby dispensed with and a Public Hearing is hereby called at the
Council Chambers, Civic Center, 1175 E, Main Street, Ashland, Oregon,
on the 18th day of November, 1986, at the hour at 7:30 P.M., at which
time all persons may appear and be heard on the proposed annexation,
SECTION 3, The City Staff is directed to cause notice of said hearing
to be given as required by ORS 222,120 so that public notices are pub-
lished in a newspaper of general circulation appearing in the City in
issues of such newspaper on October 28, 1986 and November 4, 1986 and
that notices be posted in four (4) public places in the City for a
period of not less than two (2) weeks prior to the date of the public
hearing.
SECTION 4. Pursuant to ORS 222,524 a Public Hearing shall be held on
November 18, 1986, at 7:30 P.M. in the Council Chambers, Civic Center,
1175 E, Main Street, Ashland, Oregon, on the question of the withdrawal
of certain real property from Jackson County Fire District No.5. All
persons may appear before the Ashland City Council and be heard on the
question. The real property above mentioned is situated in Jackson
County, Oregon, and more particularly described in Exhibit "A" attached
hereto and by this reference made a part hereof.
SECTION 5. The City Staff is directed to publish and post notices of
sald hearing in the same manner and on the same dates as described on
Exhibit "A" attached hereto relative to the proposed annexation.
SECTION 6. In order that a public hearing may be held on a timely basis,
the public welfare requires that an emergency be hereby declared, and
this ordinance shall therefore be effective upon its passdLe by tlw Counci ]
and approval by~he }~ayor,

AN ORDINANCE OF THE CITY OF ASHLAND ANNEXING A CONT'IGUOUS AREA
TO THE CITY OF ASHLAND, OREGON AND PROVIDING FOR AN EFFECTIVE
DATE. (ALBERTSON ANNEXATION)
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. The land described in Exhibit "A" attached hereto and
made a part hereof is contiguous to the City of Ashland and is
located in Jackson County, Oregon, and is hereby annexed to the City
of Ashland as provided in Section 2 of this ordinance.
SECTION 2. Upon the effective date of this ordinance, the City
Recorder, in accordance with ORS 222.170, is hereby authorized and
directed to make and submit to the Secretary of the State of Oregon,
a copy of this ordinance, a copy of the Statement of Consent from the
electorate of the tract annexed, and a copy of the ordinance
dispensing with the election on the proposed annexation, and also
upon the effective date hereof, the City Recorder is authorized and
directed to submit a copy of this ordinance to the County Assessor
and County Surveyor of Jackson County, Oregon.

TIME AND PLACE FOR A PUBLIC HEARING THEREON: SETTING A PUBLIC
HEARING DATE ON THE WITHDRAWAL OF CERTAIN REAL PROPERTY FROM
JACKSON COUNTY FIRE DISTRICT NO.5; DIRECTING PUBLIC]l,TION OF
NOTICES AS DIRECTED BY ORS 222.524; AND DECLARING AN EMERGENCY.
(ALBERTSON ANNEXATION)
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. The City of Ashland finds that the owners of the property
described in Exhibit "A" attached hereto and by this reference incor-
porated herein have consented to the annexation of said land to the
City of Ashland. The Council further finds that there are no electors
residing in the proposed annexation.
SECTION 2. The sUbmitting of the question of the annexation is hereby
dispensed with and a Public Hearing is hereby called at the Council
Chambers, Civic Center, 1175 East Main Street, Ashland, Oregon, on the
5th day of January, 1988, at the hour of 7:30 P.M., at which time all
persons may appear and be heard on the proposed annexation.
SECTION 3. Pursuant to ORS 222.524 a Public Hearing shall be held on
January 5, 1988, at 7:30 P.M. in the Council Chambers, civic Center,
1175 E. Main Street, Ashland, Oregon, on the question of withdrawal of
certain real property from Jackson County Fire District No.5. All
persons may appear before the Ashland City Council and be heard on the
question. The real property above mentioned is situated in Jackson
County, Oregon, and more particularly described in Exhibit "A" attached
hereto and by this reference made a part hereof.
SECTION 4. In order to schedule a public hearing in a timely manner,
the public interest requires that an emergency be declared and this
Ordinance shall take effect on its passage and approval by the Mayor.
The foregoing Ordinance was first read on the 1st day of December,
1987 and duly PASSED and ADOPTED this 15th day of December, 1987.
