ANNEXATION AGREEMENT 7/',;1- ~CJt/d 53S-- 1 "7.{;;-7 f~~:23 This agreement, entered into by the City of Ashland, hereinafter referred to as the "City" and Dolores and Claude Benson, hereinafter referred to as the "Property Owners," is for the purposes of establishing the terms and conditions for the annexation of certain property to the City, described in Exhibit "A" attached. The City shall annex the subject property as described on Exhibit "A" attached. The Property Owners shall execute and deposit with the City an irrevocable agreement to create a Local Improvement District (LID) to assure and guarantee the construction of required internal improvements on the subject site to include but not be limited to: streets, curbs and gutters, sidewalks, streetlights, sewer lines, water lines, storm sewers, and underground utili- ties. The City shall exercise the LID process only in the event the Property Owners fail to comply with the requirements of this agreement. The Property Owners may use temporary sewage holding tanks as an interim sewage disposal system until such time as the Crowson Road trunk sewer Is constructed. At the time the Crowson Road trunk sewer has been com- pleted, the Property Owners shall discontinue the use of all sewage holding tanks and connect all occupants of the site to the Crowson Road trunk sewer. Water service on the site consists of an existing six (6) inch line for water services on a temporary basis until the planned ten (10) inch water main has been constructed along Crowson Road. At such time as the Crowson Road water main has been constructed, all users on the subject property shall be connected to the ten (10) inch water main via a lateral water line. The water line extension and connections shall meet the adopted standards of the City, including fire hydrants. It is acknowledged by both parties that the development of this particular tract will take place in phases. As each phase Is constructed, the Property Owners warrant that all construction shall meet the urban specifications of the City. It Is further acknowledged by the parties that the tentative subdivision plat submitted with the annexation request represents a potential use option only. To meet the requirements of the City and serve the needs of the Property Owners, the Property Owners agree and warrant the following: 1. A perimeter survey shall be prepared and recorded 120 days follow- ing the execution of the document, including deed restrictions 2. An internal street system built to City urban standards shall be constructed through the property with a projected connection to Clover Lane. The street will be constructed in phases. 3. Engineered construction drawings for all required and necessary Improvements shall be submitted for each phase of the site develop- ment to be reviewed and approved by the City. 4. At the completion of the entire project, an "as built" subdivision (survey) map shall be prepared and recorded. Annexation Agreement Page 2 City of Ashland/Benson ,. The major stumbling block is that water service is probally not available in the capacity needed to supply the subdivision from the source that was planned on, namely the 6" line that runs from the Croman Corp. land to Oak Knoll Subdivision. The continuing development of that area has eliminated the option of hooking on to this line, as it is at capacity now, and B & G properties have been informed that they must extend a water line from Siskiyou to Crowson Road before they can proceed. This property, therefore, has facilities available, but at a relativly high cost in terms of the off site extent ions that must be made. However, the applicants are willing to proceed with development, if the provision of sewer can be phased, so as to spread out the costs of the off site improvements. We therefore reccomend the following course of action: 1) proceeding with the annexation, subject to an annexation agreement which will provide for payment of the annexation fees at the time the first phase of the subdivision is approved in final plan form; 2) Approval of the preliminary plat of the subdivision, with a var iance to delay the provision of sewer serv ice, subject to the following conditions: a) The first phase of the subdivision will be limited to no more than three acres. b) Septic tanks may be used in the first phase. The approval of specific uses in the first phase is subject to prior approval of a septic tank installation by Jackson County, to be dete:rmined at the time of site review or building permit approval, whichever comes first. c) All other facilities in the first and following phases 1lUII. ...-- ""~~",lf.,:"":',i,*'il,';iu:~',,.~L__",",,"''''j...ill! ',,- l:l will be built to standard city requirements, including water service requirements for use and fire flow. d) Sewer lines must be installed in phase one of the subdivision, and facilities for connection to any structures built on the site must be provided, in anticipation of eventuial co,mection to sewer service. e) The sewer system design shall be approved by the Director of Public Works, and shall be connected to the sewer line that is in the best long term intrests of the city. Sewer pumps shall be avioded if at all possible in the design of the sewer system. f) A restrictive covenant in favor of the city shall be included on all lots in phase one requiring connection to sewer when it becomes available, and payment of all regular connect fees applicaple at the time. g) Development of phase 2 and subsequent phases shall require a connection to the city sewer, and the connection to sewer of all buildings in phase one which are using septic tanks. h) That all the conditions attached to PA# 83-16 shall also apply to this approval. If the Council agrees with this proposal, they should make a motion to approve the annexation, subdivision, and variance, and instruct the staff to prepare the nessessary findings, ordinance, and annexation agreements. (Claude Benson Annexation) THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS: SECTION 1. The City of Ashland finds that the owners of the property described in Ex- hibit "A" attached hereto and by reference incorporated herein have consented to the annexation of said land to the City of Ashland. SECTION 2. The s'lbmitting of the question of said annexation is hereby dispensed with and a Public H~aring is hereby set to be held before the City Council of Ashland in Civic Center Council Chambers, 1175 E. Main Street, Ashland, Oregon on the 21st day of June, 1983, at the hour of 7:30 P.M. at which time all persons may appear and be heard on the proposed annexation. SECTION 3. The City Staff is directed to cause notice of said hearing to be given as re- quired by ORS 222.120 so that public notices are published in a newspaper of general circula- tion appearing in the City in issues of such newspaper on June 6 and June 13, 1983, and that notices be posted in four (4) public places in the City for a period of not less than two (2) weeks prior to the date of Public Hearing. SECTION 4. Pursuant to ORS 222.524 a Public Hearing shall also be held on June 21, 1983 at 7:30 P.M. in the Civic Center Council Chambers, 1175 E. Main Street, Ashland, Oregon on the question of withdrawal of certain real property from Jackson County Fire District No.5. All persons may appear before the Ashland City Council and be heard on the question. The real property above mentioned is situated in Jackson County, Oregon and more particularly described in Exhibit "A" attached hereto and by this reference made a part hereof. SECTION 5. The City Staff is directed to publish and post notices of said hearing in the same manner and on the same dates as described above relative to the proposed annexation. SECTION 6. It is hereby adjudged and declared that the existing conditions are such that this Ordinance is necessary for the immediate preservation of the public health and safety of the people of the City of Ashland and an emergency is hereby declared to exist and this Ordinance shall take effect and be in full force and effect from and after its passage and approval by the Mayor.
