AN ORDINANCE ANNEXING A CONTIGUOUS AREA TO THE CITY OF ASHLAND, OREGON.
TilE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOHS:
SECTION 10 The following land is contiguous to the City of
Ashland and is located in Jackson County, Oregon, and is hereby annexed
to the City of Ashland. The description is as follow~:

SECTION 2< In accord with ORS 222<170 the City Recorder is
hereby authorized and directed to make and submit to the Secretary of
State of the State of Oregon, a copy of this Ordinance, a copy of the
Statement of Consent from the landoi<ners of the tract annexed, and a
copy of the Ordinance dispensing with the election on the proposed
annexation; and the City Recorder is authorized and directed to submit
a copy of this Ordinance to the County Assessor and County Surveyor of
Jackson County, Oregon.
The foregoing Ordinance was first read at a regu~ar meeting
of the Common Council held 011 the3/"J day of July, 1973, and passed
to its second reading and duly passed on the /7u day of July, 1973,
the vote being as follows:

TIm TALENT RURAL FIRE PROTECTION DISTRICT.
THE PEOPLE OF THE CITY OF ASHLAND ORDAIN AS FOLLOWS:
SECTION I. The following described real property situated
in the City of Ashland, Jackson County, Oregon, is hereby withdrawn
from the Talcnt Rural Fire Protection District pursuant to the pro-
vEions of ORS 222.520(b). Said real property is described as follows,

SECTION 2. The City of Ashland elects pursuant to ORS
222.520(2)(b) to pay annually, as the bonds of the Talent Rural Fire
Protection Disti-ict that were outstanding on the effective date of
this Ordinance, as the same proportion of such outstanding bonds, and
the interest thereon, as the assessed valuation of that part withdrawn
b'ears to the assessed valuation of the entire district on the e:lfcctive
date of this Ordinance.
SECTION 3. It is hereby adjudged and declared that the
existing conditions are such that this Ordinance is necessary for the
preserva tion of the public health and safety of the people of the City
of Ashland a:ld an emergency is hereby declared to exist and tbis Ord:i.n~nce
shall talw effect and be in full force and effect from and after its
passage and approval j,y the Hayor.

in Jackson County, Oregon, and which is adjacent to the City
Limits of the City of Ashland, and n~re particularly deec.ribed

motel-restaurant conplex and in order to do so, it is hig
daaire to have tile land annexed to the City of Ashland so that
it may be afforded City Services, including, but not limited
to, sewer, water and electricity.

that Valentine will connect to the City Utilities in accord
with all of the general laws of tho City in effect lilt the timo
of such connection and which may require him to pay certain

to similarly situated property inside th~ City of Ashland.
2. ~'o develop the above dlt!9cribed land as a motel-
restuuxant co~plex in accord with all existing state and City
laws, and when the t.~~o Day be in conflict, then in accord with
the more restrictive law, and alao in compliance with the
followin9 requirements which shall be completed to the reasonable
satisfaction of the City; said requirenwnt~ arc;
a. 'lhat a phalllinq plan showing what facilities
will be installed under each stage be subrnittod to the Zoning
Adjus~nentCommittee for its reasonable approval.
b. 'fhat iii gradinl] plan, including provisions
for the collection and underground transmission of drainage
waterz, be submitted to the City Engineer for his approval
prior to any site.work. That these plans shall be implemented
on a schedule loft to the roasonable discretion of the City
Engineer pursuant to the phasing required in Section (a).
c. That a landscape plan, includinq typos and
placoll'ont of plant materials, and irrigation and protective
curbs or heade.rs, bo submitted to the Zoning Adjustment Com-
mitte~ for approval. Such plans to show how landscaping will
be in$talled under the phasing schedule. Said plant ~aterlals
to be installed prior to occupancy, and that this landscaping

d. That complate plans and elevations be sub-
mitted to the Planning Con~1ssion for QPproval prior to the
issuance of a bulldin9 permit, and that the architecture
follow the preliminary renderings submitted and on' file in

e. That an,~le trash storage arens be provided,
enclosed with ~ six (6) foot view-obscuring wall or fence
vith self-closing gates.
f. That within sixty (60) Gays of th0 time
that a deroand for its installation shall be wade upon Valentine
or bis successor by the city, a six (6) foot view-obscurinq
wall or fence b0 provided along the northerly, easterly and
westerly property lines, except one need not be installed
along the westerly line where there ilJ a common boundary between
the above described property and that property operated as &
service station. All such walls, fences or hedges shall be
reduced to forty-two (42) inches in height for a distance of
-twenty (20) fc~tfroro the street property line on Highway 66.
9. ~~at the parking area shall be lighted by
light standards not exceeding ten (10) feet in height, except
that such height limitations may be exceeded at the entranc<!ls
to the property. All lighting ahall be directed into or on
the site, and away from property lines.

three (3) in nuwher, inoluding protectivQ barricades, shall be
proviuod on the property as required by tho Fire Chief.

of Oregon, Valentine will dodicate to tho City or the State
of Oregon whatever land area is necQssary for use as a rlght-
of-way in thQ widening of Highway 66, said area to be deter-
mined by the State Highway V()jpartl'~cnt, but in no event ahall
such area excccu fifty (SO) feet from the oxiGtlng c9nt0r line
. of ~ighway 66, m,d to install transitional paving to and along
saia highway as. approved by the City Engineer.
k. That a paved roadway necessary for the cir-
culation of fire apparatus bo provided in conjunction with the
first plmse of the proposed dovelopment 4S required by the
City ~ngineer and Fire Chief.
3. 'rhe land described a.bove shall be Il'"..a!ntained in
0ccord with the for~goin9 require~~nts and all provisions of
this Agreement and in accord with the lawa of the State of
Orogon and the City of Ashland 80 long as said land is used
as a. motel and restaurant complex.
4. To complete the development of the entire proporty
described above in compliance with all of the terms and pro-
visions of this Agreement so as to establish thereon a
motel conBistL~g of one hundred twenty (120) to one hundred
fifty (150) units, together with a restaurant and banquet room;
said dovelopment to he commenced and cOlllplotetl with all due
dispatch and within a reAsonable tirr~ from th~ date of ~~is

for assuming the land's indebtedness for bonded obligations
issued by the Talent Rural Fire Protection District. Such sum
is in the a~~unt of $105.31.
6. It is agreed that, the conditions set forth herein
under "Things to be Done by Valentine" shall'be considered a
restriction upon ths use to be made of said land by Valentine,
his assigns or successors in interest, until a motel-restaurant
complex h~s been substnntially completed, or it has been shown
by clear and convincing evidence, that all reasonable efforts
h~ve been made to finance and construct the ~~tcl-restaurant
complex conte~plated by this Agreement, and such efforts have been
unsuccessful, and upon the occurrence of either of said events
such restrictions shall be terminated.
THINGS TO BE DONE BY THE CITY:
1. To furnish City utilities services, including water,
sewer and electricity to ~le land described above upon the
execution of this Agreement and issuance of a building permit
for the above described land in accord with the terms of this
Agreement.
2. To schedule and hold the necessary public hearings
relative to the annexation of the above described land, its
withdrawal from the Talent Rural Fire Protection District, and
also for the zoning of the land as C-l.

1. This Agreement shall be null and void and all
monies paid into the City by Valentine shall be returned to him
unless the City, within ninety (90) days of the public hearings

its zone cla~sification to C-l.

change, and that case, as augmented by preVious cases, indicates

then the buildings placed upon such land may have to be removedl
~lerefore, Valentine, his assigns and successors in interest,
Aqree to hold the City, its agents or employees, mu:rnless

any ~rocadural failures involved in tho activities contemplated
in this Agreement, with the exception of such as may retJu1t: froID

itself from any claims or against any litigation brought against
it, arising from its acts in the annexation or rezoning con-
templated here~~der, should those be the results of the City's
participation, to the extent such losses are not covered by
other valid insurance coverage in favor of the City, and
further, excepting such claims or litigation as may be based
upon or the result of fraud, malice, or acts committed or
omitted in bad faith.
4. It is agreed thnt this Agreement and all of its
provisions shall be binding on the heirs, successors and
assigns of the parties hereto.

We have been advised by the office of the Secretary of State that the
City has filed the referenced ordinances pertaining to municipal annex-
at ion.
So that we may i~sue the necessary fire insurance rating data, would
you please send us a copy of each of these ordinances and a surveyor's
map of the area annexed. Also would you return a completed Annexation
Statement for each ordinance; the second copies are for your file.
This information will enable us to be of service to property owners in
the annexed area.

Dear Mrs. Hale:
Since our discussion on the teleph~ne this morning of the nature of tax-
ation for the Talent Rural Fire District, I have looked up my copy of the
tax rates in Jackson County, a copy of ~hich I am enclosing.
Your property was located in the area the tax department has called Code
5-4. You will see that line shows that last year you were taxed $2.73
per thousand of True Cash Value for the operation of the Talent Rural Fire
District. Our information from TRFD is to the effect that of that amount,
sixty cents is needed to meet payments on bonds the TRFD sold to make
capital improvements, and the remainder is to cover their operational
co~ts. . They have informed us that there are eight years remaining in
which they will continue to collect the serial levy of that same sixty cent
rate.
In the process of annexing your property to the City of Ashland, it was
necessary to withdraw your property from the TRFD. To avoid any deficits
on the part o~ the fire district in redeeming their bond issue, we are
required to pay them sixty cents times 76.16 thousand of assessed value
times the remaining eight years of serial levy, which amount to the sum
of $365.57. Had the property not been removed from TRFD, you would be
paying an equal amount over the next eight years for the retirement of
their bonds.

Enclosed is a receipt for your payment of annexation fees in the amount
of $331.05 and for the retirement of Talent Rural Fire District bonds
in the amount of $365.57.
As you probably recall from our previous conversation, the annexation
fee is based on one cent per square foot of area innexed to the City.
The amount necessary to retire your property's share of the fire dis-
trict bonds is based on the current assessed valuation of the property
of $76,160.00 at the rate of sixty cents per thousand times the remain-
ing eight years required to amortize the bonds.
