AN ORDINANCE AMENDING ORDINANCE NO. 1805 RELATIVE TO THE AtmExATION
OF CERTAIN PROPERTY; AND DECLARING AN El1ERGENCY.
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. Section 2 of Ashland Ordinance 1805 is
hereby amended to read as follows:
"SECTION 2. This Ordinance shall be ~ffectivc
upon receipt of an affidavit or other proof satisfactory
to the City that a valid contract has been entered into
for the construction of a mobile home park for approximately
fifty (50) units and which contract shall provide for a
mobile home park to be developed in accord with a
contract between the City of Ashland and Richard Meister
and Barbara Meister, said Contract being dated November 9,
1973; however, if such proof is not received by August 5,
1975, then this Ordinance shall be null and void."
SECTION 2. It is hereby adjudged and declared that the
existing conditions are such that this Ordinance is necessary for
the preservation of the public health and safety of the people of
the City of Ashland and an emergency is hereby declared to exist
and this Ordinance shall take effect and be in full force and effect
from and after its passage and approval by the Mayor.
The foregoing Ordinance was first read at a regular meeting
of the Common Council held on theJ/~!day of January, 1975, and passed
to its second reading, and duly passed on the7~ day of February,

According to the agreement, Meisters were to have paid both the annexation
fee (j~2,891.ho) and TRFPD bond fee (,1335.28) upon executi,on of the contract,
but Council authorized us to execute, and Salter saw no problem there,
since the Agreement does not read "herein receipted for".

and in order to do so, it ia their desire to have the land annexed to

NOW, TllEREFORE, in consideration of the foregoing Recitals,
and of the mutual covenants contained herein, it is agreed by and
between thp. parties hereto as follows:
THINGS TO BE DONE BY HElSTERS:
1. They agree to pay to the City of Ashland, the sum of
one cent (le) per square foot for the land described in the foregoing
Recitals, and that this totals $2,891.40, and that this sum shall be
paid in full in cash to the City upon the execution of this A~reement
and is in payment to the City for the cost of City utility facilities
that have been paid for by the taxpsyers of the City of Ashland and
which shall benefit the above described land.
2. To develop the above described land as a mobile home
park in nccord ,;ith all existing state and city laws, and when the
two may be in conflict, then in secord with the more restrictive law,

completed to the reasonable satisfaction of the City; said
requirements are:
a. All mobile home sites shall have an average area of not
less than four thous~~d (4,000) square feet wtth a minimum width of

b. Storaze areas shall be provided for the storege of

c. Only one identification sign is permitted on the premises
and it shall not exceed fifteen (15) square feet in area and it shall
be set back at least ten (10) feet from ,the property lines and not
over five (5) feet in height.
d. Each mobile home site shall be clearly defined snd

e. All mobile homes and structures sball be set back:
1. Ten feet (10) from boundary iines of the mobile
home park.
2. Five feet (5) from side and rear boundary lines
of all mobile home sites.
3. Eight feet (8) from all interior driveways and walks.
f. There shall be a fifteen (15) foot minimum distance'
between mobile homes.
g. All driveways and parking areas shall be paved with
asphalt "ith a minimum thickness of tWO-inches (2) on a suitable rock
base, or comparable SUrfaCing, with roll-type curbing on both sides
of all driveways.
h. The minimum width of all interior driveways shall be twenty
(20) feet plus eicht feet if parking is permitted on one side. Interior
driveways shall be adequately lighted with decorative t~)e fixtures.

1. All mobile homes must confom with American Standard
No. A-119.ll (s?onsored by the National Fire Protection Association
and 14obilo Coach Association).
m. Friar to any site liar!: being done, a Grading Plan
prepared by registered engineers shall be submitted to the Department
of Public works for its approval.

n. A peripheral treatment plan shall h~ r~ovidcd, includi,~
~ six (6) foot wall, appropriate hedge, or decorative fence around the
property and a thirty (30) inch to forty-two (42) inch wall along
Tolman Creek set back twenty (20) feet from the right of way line. The
area between the wall and the street shall be landscaped and maintained;
such plan to be submitted to the Zoning Adjustment Committee for its
approval.
o. The natural characteristics of the land, including all
trees, water courses and topography shall be maintained so long as
the land is used for a mobile home park, unless permission to the
contrary is first obtained from the Planning Commission.
p. Meisters shall pay all costs reasonably incurred by the
City in acquiring any easements necessary for electrical power lines
between the subject property and a point designated by the City
Electrical F.nginoer.

the City's actual cost of instslling an eight (8) inch water line
from Tolman Creek Road and Highway 66 to the property line of the
subject property. Any properties connecting to this water line
within ten (10) years of its completion and which are either directly
across Tolman Creek Road from the Meister's property, or between
Meister's property and Highway #66 and which abutt Tolman Creek Road
shall be required to p~y to the City a reasonable sum for the water
line. This Sum sh~ll be ba~cd on the front footage of the property
connected in relation to the total front footage of the Meister's
property and the property on Tolman Creek Road described in the
preceding sentence. The City shall then pay that sum over to Meisters
to compensate them for the cost of the water line. At Completion
of construction, this water line shall be tha property of the City.
4. PrioF to connecting to the City sewer system, Meisters
agree to pay to the City the normal connection fee for this type of
installation which is $530.00 which is for an eight (8") inch lateral
connection; however, if the City determines that a six (6") inch

5. So that the City may provide electrical services to the
subject property, Meisters agree that they will dig the necessary ditches
on their property and if the soil is rocky so that conduit is required
in the judgment of the City, then Meisters will reimburse the City for
the cost of such conduit and after the line is instelled, then Meisters
will backfill the ditChes. At each trailer unit, Meisters will provide
a .meter base switch and a conduit of two (2) inch rigid steel leading
from the meter base to the ditch. In addition, decorative interior
street lights with underground feeds shall be installed by the Meisters.
6. Meisters agree that this shall be an adults only park and
that no residents under the age of eighteen (18) shall be permitted.
7. Meisters agree that they shall not remonstrate to any
proposal to improve Tolman Creek Road and that if requested, they will
join in any petition for the improvement of Tolman Creek Road which
may be proposed either by Jackson County, or by the City of Ashland.

The subject land shall be maintained in accord with all of
the provisions of this Aereement in accord with tho la"s of the state
of Oregon and the City of Ashland so long as said land is used as e
mobile home park.
9. Hoisters shall complete the d~volopment of subject
property in accord ~ith the ter~s and provisions of this Agreement
and the l",..s of tlw City of AshLmd end the? State of Oregon, so as

Agreement.
10. Upon Execution of this Agreement, Meisters shall pay to
the City of Ashland the sum necessary to compensate the City for
assuming the land's indebtedness for bonded obligations issued by the
Talent Rural Fire Protection District. Such sum is in the amount
of $35.28 (Thirty-five and 28/100 Dollars).

1. To furnish City utilities services, including water, sewer,
and electricity to the land described above if said land is annexed
to the City and then within a reasonable time thereafter and from the
request for such scrvices being made by the Meisters.
2. To schedule and hold the necessary public hearings
relative to the annexation of the above described land, and its
withdrawal from the Talent Rural Fire Protection District.
GE~rERAL TERMS:
1. This Agreement shall be null and void and all monies paid
into the C~~y by the Meisters shall be returned to them unless the

does annex the above land, withdraw it from the Talent Rural Fire
Protection Fire District, and change its zone classification to R-3,
Residential; Multiple-Fa~ily District.
2. All determinations or approvals which by the terms hereof
are required to be made by the City of Ashland's agent~ or commissioners,
shall he made with reference to the standards set forth in tho Ashland

Ordinance shall not be effcctive until the City Administrator shall

Last year you and your predecessors kindly spent
much time and consideration in approving my proposed plans
to construct a trailer park. Unfortunately, due to increased
building costs and increased interest rates, we find that it
is no longer financially feasible to proceed with this project.
For that reason, we are abandoning the project at this time.
Again, we thank both you and the Staff for the time
spent on this proposal.

City Administrator that the water supply capability of the
City had been restored. The dredging of Reeder Reservoir was
completed on the morning of July 4, 1974, and therefore the
City is now in a position to certify the annexation to the
Secretary of State and the Jackson County Assessor.

Tolman Creek Road was to take effect when the following
conditions were met:
1. Payment of annexation fee in the amount
of $2,891.40.
2. Payment of sum necessary to retire TRFPD
bonds in the amount of $35.28.
3. An affidavit of proof that a contract has
been signed for construction of a mobile
home park.
4. Statement from City Administrator Almquist
that the damage to city's water system has
been repaired.
I note that City Administrator Almquist issued a statement
to you on July 5, 1974, that the water system has been re-
paired, but we are still waiting for proof of your contract
for construction as well as the monies mentioned above
totaling $2,926.68. When the funds and proof of contract
are received, I will then proceed with delivery of the
Annexation Ordinance to the proper State and County Officials.

Ordinance 1777, Section 1-:1.-2. If i.t is determined that a six-inch
latera1 connection is adequate, the connect fee will be $400.00; if

Re: Annexation
Dear Mr. Meister:
As you are aware, the Ordinance annexing your land on Tolman
Creek Road was to be effective upon a determination by the
City Administrator that the water supply capability of the
City had been restored. The dredging of Reeder R~servoir was
completed on the morning of July 4, 1974, and therefore the
City is now in a position to certify the annexation to the
Secretary of State and the Jackson County Assessor.
Upon receipt of the required annexation f~es and deposits
as specified in the Agreement, we will forward the necessary
documents to complete the formal annexation of the land.

certain conditions and to the terms of an agreement
dated November 9. 1973. That agreement specified that
