Code is hereby amend~d, and shall read as follows:

facilities in"new subdivisions and mobile home parks except trenchins, b&ck-

and shall keep sn accurate accounting of all costs.' Upc~ completion of toe

billing for an 2dditional deposit if the project cost exceeds the amount on

~ follm,'ing cost recovery plans:
A. The developer may enter into an agreement with the Utility ror a
refund of the per lot costs of electric servjce at the time of applica-
tion for service under Section 14.12.010 et. seq. in accordance '.lith
the follo~ing schedule:
1. Within one (1) year of the furr.ishirlg of the stater::~nt
of cos ts by the Utility, one hundred (l00) percent;
2~ '"ithin r.;ro (2) :;ears, eighty (80) percent;
3. Within three (3) years, sixty (60) percent;
4. Within four (4) years, forty (40) p=rcent;
5. Within five (5) years" twenty (20) percent;

B. In subdivisions only, the developer may submit an application
within thirty (0) days ror bonding seventy-five percent (75%) of the
costs thereof under the Bancrort Ronding Act (ORS 223.300) and Article IX,
Section 3 of the Ashland City Charter, no part of which is refundable.
The remaining b,enty-five percent (25%) of the costs shall be refunded
to the developer in accordance with the schedule set forth in Subsection A.,

~ECTION 2. It is hereby adjudged a0d declared that the existing conditions are
such that this Ordinance is necessa17 for the preservation of the public health
and safety of the people of the City of Ashland and an emergency is hereby declared
to exist and this Ordinance shall take effect and may be in full force and effect
from 2nd after its passage and approval by the Mayor.

ON THE QUES_TION OF A PROPOSED ANNEXATION" AND SETTING THE TIME AND
PLACE FOR A PUBLIC HEARING THEREON: AND SETTING A PUBLIC DATE ON
THE WITHDRAWAL OF CERTAIN REAL PROPERTY FROM THE TALENT RURAL FIRE
PROTECTION DISTRICT AND DIRECTING PUBLICATION OF NOTICES AS DIRECTED
BY ORS 222.524; AND DECLARING AN HIERGENCY.
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. The City of Ashland finds that the owners of
the property described in Exhibit "At. attached hereto and by this
reference/incorporated herein have consented to the annexation of
said land to the City of Ashland.
SECTION 2. The submitting of the question of the said-
annexation is hereby dispensed with and a l'ublic HearJ.ng is hereby
set to be held before the City Council of Ashland at the City Hall,
Ashland, Oregon, on the 16th day o~ July, 1974, at the hour of
7:30 p.m. at which time all persons may appear and be heard on the
proposed annexation.
SECTION 3. The City Staff is directed to cause Notice
of said Hearing to be given as required by ORS 222.120 so that -
Public Notices are published in a newspaper of general circulation
appearing in the City in issues of such Newspaper on July 5, 1974,
and July 12, 1974, and that Notices be posted in four (4) public
places in the City for a period .of not less than two (2) weeks
prior to the date of the Public Hearing.
SECTION 4. Pursuant to ORS 222.524 a Public Hearing shall
be held on July 16, 1974, at 7:30 o'clock p.m. in the Ashland City
Hall, Ashland, Oregon, on the question of the withdrawal of certain
real property from the Talent ~ural Fire Protection District. All
persons may appear before the Ashland City Council and be heard on
the question. The real property above-mentioned is situated in
Jackson County, Oregon, and more particularly described in Exhibit
"A" attached hereto and by this reference made a part hereof..
SECTION 5. The City Staff is directed to publish and post
notices of said Hearing in the same manner and on the same dates as
described above relative

said subdivision by the construction of water mains, sewer and
paving (including curbs and gutters) have been approved by the

final approval by the Planning Commission of the City. of Ashland,

covenant with the City of Ashland:

2. If the improvements herein provided for, or any
thereof, shall not be completed within the time specified, or as the
same may be extended, as hereinafter provided, the City may complete
such work and subdivider will pay to City its costs and expenses of
completing the same.
3. The time within which the 'above mentioned improvements
shall be completed shall be extended for such time as subdivider or
subdivider's contractor shall be prevented from prosecuting such work
by reason of act of the City of Ashland, strikes, unavailability of
material, lack of labor, weather conditions, government prohibition
or restriction, act of God, or other condition beyond control of sub-
divider or contractor.
4. If, during the time of construction of any of said
improvements, such improvements or any thereof shall be constructed

under any assessment district act or ordinance and such improvement
shall be at least the equivalent of the improvements herein agreed to
be constructed by subdivider, then this agreement shall, as to such
improvements so made, be deemed terminated upon the completion of the
proceedings under such assessment district act or ordinance.
5. The City Engineer of Ashland will provide adequate
"and timely progress inspection of said work and upon completion of any
of said improvements in accordance herewith will issue to the under-
signed his final certificate of inspection and acceptance thereof.
6. All statements of things to be done by subdivider
contained in this agreement shall constitute a cove~ant on the part
of subdivider ~o perform the same.
7. The approval of this agreement by the Planning Commission
of the City of Ashland shall constitute an agreement between Subdivider
and City of Ashland in accordance with the terms and provisions hereof.

To develop all of the above described land for

single family dwelling purposes in accord with all State and

City taws and when the two may be in conflict, then in accord
with the more restrictive law, and also in compliance with the
folloJring requirements which are:

To prepare a Master Plan for the entire parcel of
land showing a maximum of 80 lots and showing approxi-
mately 5.794 acres of open space to be maintained by a
property owners' assoc'iation and, provided that tax
exempt status is requested and granted for such open
space, such open space shall be usable by the public.
If an application is made for tax exempt status for open
space, then and only then shall the City" Gouncil have the
right to review the nature and purpose and other pro-
visions of the By-laws of the property owners' association;
and the right to consider these provisions and their ade-
q u acy in determining whether to grant tax exempt status
to the land. The Plan,ning Commis s ion's re view and
approval of the MasterPlan shall be based upon the con-
ditions and requirements of a Subdivision. After the
Master Plan is approved by the Planning Commission,
then Mountain Ranch agrees that the entire parcel will
be developed in accord with such Master Plan.
B. To prepare a plat, based upon the above mentioned
Master Plan, of the area described in Exhibit A, which

in its entirety and consisting of 54 lots and approximately
5.446 acres of open space, which plat shall be developed
in stages as approved by the Planning Commission.
2. To pay upon execution of this Agreement to the City

described above which is located outside the City of Ashland and

Ranch acknowledges that this money is to be paid to the City for

It is understood, however, that Mountain Ranch or its successors
in interest will connect to the City utilities in accord with all

of the general laws of the City in effect at such time of connection

and which may require the payment of connection fees: such fees
to be the same as those applicable to similarly situated property

3. Upon execution of this Agreement, to pay to the City

gENERAL TERMS
1. This Agreement shall be null and void and all money
paid into the City by Mountain Ranch shall be returned to it
unless the City within 90 days of the public hearing above
mentioned does adopt an Ordinance annexing the land located
outside the City and withdrawing it from the Talent Rural Fire
Protection District with the effective date to be as the above
stated.
I 2. All determinations or approvals which by the terms

AN ORDINANCE DISPENSING WITH AN ELECTION WITHIN THE CITY OF ASHLAND
ON THE QUESTION OF A PROPOSED ANNEXATION AND SETTING. THE TIME AND
PLACE FOR A PUBLIC HEARING THEREON: AND SETTING A PUBLIC DATE ON
THE WITHDRAWAL OF CERTAIN REAL PROPERTY FROM THE TALENT RURAL FIRE
PROTECTION DISTRICT AND DIRECTING PUBLICATION OF NOTICES AS DIRECTED
BY ORS 222.524; AND DECLARING AN EMERGENCY.
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS;
SECTION 1. The City of Ashland finds that the owners of
the property described in Exhibit "A" attached hereto and by this
reference incorporated herein have consented to the annexation of
said land to the City of Ashland.
SECTION 2. The submitting of the question of the said
annexation is hereby dispensed with and a Public Hear.ing is hereby
set to be held before the City Council of Ashland at the City Hall,
Ashland, Oregon, on the 16th day of July, 1974. at ~he hour of
7:30 p.m. at which time all persons' may appear and be heard on the
proposed annexation.
SECTION 3. The City Staff is directed to cause Notice
of said Hearing to be given as required by ORS 222.120 so that
Publi.c Notices are published in a newspaper of general circulation
appearing in the City in issues of such Newspaper on July 5, 1974,
and July 12, 1974, and that Notices be posted in four (4) public
places in the City for a period of no"!: less than two (2) weeks
prior to the date of the Public Hearing.
SECTION 4. Pursuant to ORS 222.524 a Public Heaxing shall
be held on July 16, 1974, at 7:30 o'clock p.m. in the Ashland City
Hall, Ashland, Oregon, on the question of the withdrawal of certain
real property from the Talent Rural Fire Protection District. All
persons may appear before the Ashland City Council and be heard on
the question. The real property above-mentioned is situated in
Jackson County, Oregon, and more particularly described in Exhibit
"A" attached hereto and by this reference made a part hereof.

SECTION 5. The City Staff is directed to publi.sh and post
notices of said Hearing in the same manner and om the same dates as
described above relative to the proposed annexation.

SECTION 6. It is hereby adjudged and declared that the
existing conditions are such that this Ordinance is necessary for
the immediate preservation of .the public health and safety of the
people of the City of Ashland and an emergency is hereby declared
to exist and this Ordinance shall take effect and be in full force
and effect from and after its passage and approval by the Mayor.

AN ORDINANCE DISPENSING WITH AN ELECTION WITHIN THE CITY OF ASHLAND
ON THE QUESTION OF A PROPOSED ANNEXATION AND SETTING THE TI~IE AND
PLACE FOR A PUBLIC HEARING THEREON: AND SETTING A PUBLIC DATE ON
THE WITHDRAWAL OF CERTAIN REAL PROPERTY FROM THE TALENT RURAL FIRE
PROTECTION DISTRICT AND DIRECTING PUBLICATION OF NOTICES AS DIRECTED
BY ORS 222.524; AND DECLARING AN EMERGENCY.
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. The City of Ashland ,finds that the owners of
the property described in Exhibit "A" attached hereto and ,:Py this
reference incorporated herein have consented to the annexa.tion of
said land to the City of Ashland.
SECTION 2. The submitting of the question of the said
annexa tion is hereby dispensed with and a Public Hear.ing i.s hereby
set to be held before the City Council of Ashland at the City Hall,
Ashland, Oregon, on the 16th day of July, 1974, at the hOllr of
7:30 p.m. at which time. all persons may appear and be heard on the
proposed annexation.
SECTION 3. The City Staff is directed to cause Notice
of said Hearing to be given as required by ORS 222.120 so that
Public Notices are published in a newspaper of general circulation
appearing in the City in issues of such Newspaper on July 5, 1974,
and July 12, 1974, and that Notices be posted in four (4) public
places in the City for a period of not less than two (2) weeks
prior to the date of the Public Hearing.
SECTION 4. Pursuant to ORS 222.524 a Public Hearing shall
be held on July 16, 1974, at 7:30 o'clock p.m. in the Ashland City
Hall, Ashland, Oregon, on the question of the withdrawal' of certain
real property from the Talent Rural Fire Protection District. All
persons may appeffr before the Ashland City Council and be heard on
the question. The real property above-mentioned is situated in
Jackson County, Oregon, and more particularly described in Exhibit
"A" attached hereto and by this reference made a part hereof.
SECTION 5. The City Staff is directed to publish and post
notices of said Hearing in the same manner and on the same dates as
described above relative to the proposed annexation.

Ci ty Attorney Sal tel' reported that an agreement was
being, drawn up covering the twenty acres in the City
and the proposed annexation of the five plus acres in
which applicant agrees to' develop into single family
units the eighty lots in his master,plan. Salter said
that the five acres of open space are to be maintained
by a property owner's association and suggested that
same should be reviewed by the Planning Commission and
reviewed by the Council so that the City would have
some control of development. The public hearing was
opened and there was no opposition from the audience.
The public hearing was closed and McCannon moved that
City Attorney be instructed to prepare ordinance for
annexation. Allen seconded and asked Salter if it
would be possible to require through the agreement that
Talent Irrigation District water be piped to each lot.
Salter said this could requested and if agreed to could
be put into the agreement. Harry Skerry, Attorney for
Applicant Oredson said that "Subdivision #1" ,<ould be
prepared for record and that the Planning Commission
will have to approve it so that many of the details
liill be incorporated into the agreement with the City.
On roll call Allen, Soderberg and McCannon voted YES.
Conklin opp?sed.
Salter asked Council for guidance relative to control
of the Property Owner's Assn., on the open space.
Oredson expressed that he felt the whole package should
go before the Planning Commiss"ion and the Council if
it wished. Soderberg asked Oredson if the open space
would be used by the propel.ty owners or the public and
Oredson explained he would have to 'iait on that decis-
ion until such time as he applies for open space tax
status. Soderberg moved that matter not be brbught to
Council until such time as Olmers .ask for tax exempt
status. McCannon seconded. On roll call, all YES.

THE TALENT RURAL FIRE PROTECTION DISTRICT.
THE PEOPLE OF THE CITY OF ASHLAND ORDAIN AS FOLLOWS:
SECTION 1. The following described real propert:y situated
in the City of Ashland, Jackson County, Oregon, is hereby withdra~n
from the Talent Rural Fire Protection District pursuant to the pro-
visions of ORS 222.520(b). Said Real property is described as follows,
to-wit:

bears to the assessed valuation of the entire district on the
effective date of this Ordinance.
SECTION 3. This Ordinance shall be effective when Ashland

is furnished with such proof as it may require indicating that the
owners of the above described land have fully complied with the
things to be done by them as set forth in an agreement between the
owners of said land and the City of Ashland; and, if thi.s is not
done within one (1) year from the date of this Ordinance, then
this Ordinance shall be made null and void.
The foregoing Ordinance was first read at a regular meeting'
of the Common Council held on the 6>::c day of August, 1974, and passed

An ordinance providing for deferral of assessment of property
in unimproved districts and providing for the payment of assessments
.in installments w~th regard to property liable for assessment for
trunk line sanitary sewers under the prov~sions of Ordinance No.
1201 and for police and fire protection under the provisions of
Ordinance No. 1342, and declaring an emergency.
.
WHEREAS, substantial areas have been annexed to the City of
Ashland since the passing of Ordinance No. 1201 and Ordinance No.
1342, and
WHEREAS, portions of said areas annexed are unimproved and in
many cases the Cornmon Council believes it to be just and equitable
that assessments be deferred with regard to such unimproved areas,
NOW, THEREFORE, THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN
AS FOLLONS:
Section 1.
unimproved property for the purposes of this ordinance shall
be real property which has not been subdivided or which is not
within 300 feet of a public road; provided, however, that any prop-
erty in single ownership which has an area of one acre or less and
access to a public road shall be considered improved property.
Section 2.
The trunk line sanitary sewer assessment provided for in
Ordinance No. 1201 and the police and fire protection assessment
provided for in Ordinance No. 1342 may be deferred with regard to
unimproved property as heretofore provided.
Section 3.
The sewer assessment and police and fire protection assessment
deferred under the foregoing provision shall be levied upon benefited
property When one or more of the following shall occur:
(al A subdivision or resubdivision, either by major
or minor subdivision, is filed by the owner of such real
property.

(b) A dedicated roadway is extended to within 300
feet of such real property making such real property
adjacent to, and providing access to, such real property.
(c) An application is made for a permit to connect
improvements existing or proposed upon any portion of
such pro,?crty to the sewer system of the City.
Section 4.
Upon the assessment of any property, the assessment for .."blch
has been deferred under the foregoing provisions, such assessment
shall be made as provided in said Ordinance No. 1201 and Ordinance
NO. 1342 and may be paid by installments as provided in said
ordinances.
Section 5.
Since the Common Council desires to promptly make the assess-
ments under Ordinance No. 1201 and Ordinance NO. 1342 in certain

the interest thereon, as the assessed valuation of that part withdrawn
bears to the assessed valuation of the entire district on the
effective date of this Ordinance.
SECTION 3. This Ordinance shall be effective when Ashland
is furnished with such proof as it may require indicating that the
owners of the above described land have fully complied wi.th the
things to be done by them as set forth in an agreement between the
owners of said land and the City of Ashland; and, if this is not
done within one (1) year from the date of this Ordinance, then
this Ordinance shall be made null and void.
The foregoing Ordinance was first read at a regular meeting
of the Common Council held on the 6 >t"'c day of August, 1974, and passed

ZONE CHANGE NO. 74-42
FINDINGS OF FACT AND DETERMINATION
Vincent L. Oredson and John D. Todd, partners, have hereto-
fore filed an application for a zone change from County R-R
(Rural - Residential) to City of Ashland R-l:B-8 (Residential _
Single Family). The application appertains to approximately 7.96
acres westerly of Tolman Creek Road.
The Planning Commission heretofore held a public meeting on
April 22, 1974, in accordance with Section 8, Ordinance No. 1361,
the zoning ordinance of the City of Ashland. The Planning Com-
mission unanimously approved said application and adopted the
proposed findings at said meeting.
The Common Council has heretofore held its hearing on said
application on June 4, 1974, in accordance with the provisions
of Ordinance No. 1361. At said hearing all proponents of said
rezoning were heard as appears from the minutes of said meeting
which have been heretofore approved by the Common Council. No
opponents appeared to protest said rezoning.
The Common Council by a vote of 4 to 2 approved said rezon-
ing, subject to the approval of the written findings.
After considering all of the evidence and being fully advised
in the premises, the Common Council of the City of Ashland hereby
makes and enters the following FINDINGS:
I.
The Common Council does hereby approve and adopt as its own
the findings of fact and determination of the Planning Commission
entered in the minutes of the meeting of said Commission dated
April 22, 1974, subject to such additions, exceptions and modi-
fications as hereinafter stated.

The evidence introduced showed that the proposed plan of
Mountain Ranch Subdivision, heretofore entered as proponents'
Exhibit "I", would permit only five more residences than would
be permitted under the existing subdivision ordinance of the
City on the IB.17 acres presently located within the City. The
proponents have shown by Exhibit "1" that there would be approxi-
mately 5~ acres in open space if the ordinances for the proposed
annexation and rezoning were passed.
III.
The Common Council does hereby add the following to the
findings of the Planning Commission under paragraph II, Public
Need and Other Available Land:
The proposed subdivision, because of its large size,
includes in its plans that approximately 5~ acres thereof
be open space. Although there are smaller undeveloped
acreages in the City, the Common Council does hereby find
that it would be impractical to require such a large per-
centage of developable property to be in open space and
thus, finds that there is not only a public need, but there
is no other available land of the size, kind and nature of
the proposed subdivision.
IV.
The Common Council does hereby find that the applicants have
borne the burden of justifying the rezoning of a portion of their
property to R-l:B-B should the same be annexed to the City of
Ashland; provided, however, that prior to said rezoning and pro-
posed annexation ordinances being voted upon, the proponents enter
into a contract with the City of Ashland that any subdivision

shall be designed in accordance with the preliminary subdivision
plan submitted as proponents' Exhibit "1" herein, with such con-
tract to have such other provisions for the protection of the
City of Ashland as the Common Council and proponents may agree
upon.
The foregoing Findings were adopted by the Common Council
of the City of Ashland on the day of , 1974, the
vote being as follows:

on the entire acreage 80 single-family residential lots and to
maintain approximately 5

4. The necessary public hearings have been held relative
to a request to have the above -described land located outside of f
the City of Ashland zoned as R-l:B-8 in accord with the Ashland
Zoning Ordinance and for such zoning to be effective when and
if the land is annexed to the City of Ashland; and the City has
adopted findings indicating that the public interest will best
be served by the Zone Classification.
NOW, THEREFORE. in consideration of the for€,going
recitals, and of the mutual covenants contained herein, it is
agreed by and between the parties hereto a,s follows:

1. To develop all of the above describod land for single
family dwelling purposes in accord with all State and City laws

and when the two may be In conflict, then in accord with the more
restrictive law. and also In compliance with the following
requirements which are:
A. To prepare a Master Plan for the entire parcel of
land showing a maximum of 80 lots and showing
approximately 5 acres of open space to be maintained
by a property owners assoclation,and, provided that
such open space be given tax exempt status, such open
space shall be usable by the public. If an application
is made for tax exempt status for the open space, then
and only then shall the City Council have the right
to'review the nature and purpose and other provis Ions
of the By-Laws of the property owners association;
and, the right to consider these provisions and their
adequacy in determining whether to grant tax E'xempt
status to the land. ,The Planning Commission's review
and approval of the Master Plan shall be based upon
the conditions and requirements of a Subdivision. After
the Master Plan is approved by the Planning Commission.
then Mountain Ranch agrees that the entire pal'cel will
be developed in accord with such Master Plan.
B, To prepare and record, based upon the above
mentioned Master Plan, Subdivision Unit No.1 to Include
the road to be known as "Green Meadows Way" In its
entirety and consisting of 54 lots and apprOXimately
4.5 acres of open space
2. To pay upon execution of this Agreement to the City
of Ashland the sum of one cent (l~) per,square foot foJ' the land
described above which Is located outside th'e City of Ashland
and that this totals Two thousand five hundred thirteen and forty
one one hundredths dollars ($2,513.41). It Is understood that <
this sum Is based on acreage determined by aerial photography and

polar planimeter and that an adjustment to this sum will be made
at the time of the final plat when a computerized acreage will
be avallable. Mountain Ranch acknowledges that this money Is
to be paid to the City for the cost of City utlllty facil1ties that
have been paid for by the Taxpayers of the City of Ashland and
which shall benefit the land. It is understood, however, that
Mountain Ranch or its successors in interest will connElct to the
City utilities in accord with all of the general laws of the City
in effect at such time of connection and which may require the
payment of connection fees; such fees to be the same as those
appl1cable to similarly situated property inside the City of Ashland.
3. Upon the execution of this Agreement, to pay to the
City of Ashland, the sum necessary to compensate the City for
assuming the land indebtedness for bonded obl1gatlon issued by
the Talent Rural Fire Protection District. Such sum ill in the

4. Mountain Ranch agrees to use TID water exclusively
for irrigating the common areas during the TID watering
season. Recognizing the limited supply of City water, Mountain
Ranch will, wherever economically feasible,furnish TID water

1. To schedule and hold the necessary public hearings rela-
tive to the annexation and to the withdrawal from the Talent
Rural Fire Protection District of the above described land located
outside the City of Ashland; and then to determine what actually
will best serve the publ1c Interest. If the public hearings Indicate
that the publ1c interest will be best served by the annexation of
the above-described land, then such annexation shall b'l effective
upon Mountain Ranch completing Items A and B of "Things to be

time, then all rights and duties under this Agreement shall
terminate. It is understood that if this Agreement Is terminated
for reasons stated above, the City shall refund to Mountain Ranch
the sums paid under Items 2 and 3 of "Things to be Done by
Mountain Ranch".

1. This Agreement shall be null and void' and all money
paid into the City by Mountain Ranch shall be returned to it
unless the City within 90 days of the public hearings above mentioned
does adopt an Ordinance annexing the land located outside the
City and withdrawing it from the Talent Rural Fire Protection
District with the effective date to be as the above statl,d.
2. All determinations or approvals which by the terms
hereof are required to be made by the City's agents. including t'he
Planning Commission and the City Council, shall be made with
reference to the standards set forth in the applicable City and
State laws. or the terms of th,is agreement, or if not !IO covered.
shall be made to best promote the public interest as determined
by the City Council of the City of Ashland.
3. It is agreed that the burdens imposed by this Agreement
on the land are intended to be a burden on the land and run with the
land, so as to be binding on its future owners. and the heirs and
assigns of Mountain Ranch Development Company,
