GEORGE APPLICANT'S STATEMENT OF ULTIMATE FACTS AND BASIC FACTS IN SUPPORT: See attached. STAFF INPUT: Applicant has correctly noted that the property is located within the City"s Urban Growth Boundary. They are requesting a variance from the subdivision ordinance which requires that lots abut upon a street for a width of at least 40 feet, as subject property has only 27.2' of frontage on the dedicated but unimproved portion of Hillview Drive. Applicant has proposed alternate ways of,access from either Crestview Drive or Park Street, both of which require the use of neighboring property for access. No evidence of permission to use neighboring property for either proposed access has been supplied by the applicant. At some later date, applicant may wish to divide 'the property for further development. This will be difficult due to the slope and attendant difficulties with access. However, the total impact of the annexation at this time would be one house on three acres. Findings are adequate. RELEVANT COMMENTS FROM THE PLANNING COMMISSION PUBLIC HEARINGS & COMMISSION DISCUSSION: STAFF REPORT: Wanderscheid gave the Staff Report indicating that the applicant has correctly noted that the property is located within the City's Urban Growth Boundary. A variance trom the Subdivision Ordinance was also requested, which requires that lots abut upon a street for a width of at least 40' as subject property has only 27.2' of frontage on tee dedicated, but unimproved portion of Hillview Drive. Applicant has proposed alternate ways of access from either Crestview Drive or Park Street, both of which would require the USE' of neighbor- ing property for access. No evidence of permission to use neighboring property for either proposed accesses has been supplied by the applicant. At some later date, applicant may wish to divide the property for further development. This will be difficult due to the slope and attendant difficulties with access. However, the total impact of the annexation at this time would be one house on three acres. He further stated that CPAC had voted 3-3 on this particular item, therefore no recommendation was forwarded. He stated that the neighbors in the area had been in opposition to using Crestview Drive tor access and that it would be within the Commission's realm to require as a .condition of annexation that access only be provided off Park S,treet. He stated that there was pre- cedent for this type of action in a,Minor Land Partition that was approved on Strawberry Lane and that the Commission could in fact require this. He then went over the suggested conditions. He read a letter from Lucy Harrell saying that she was in the process of buying tax lot 502 and would deed access from Park Street to the subject's property at the time the sale was complete. He then read a letter from Mrs. George ~tating that she was sorry that: she had caused such concern in the neighborhood and that she is amending her application to only get access from Park Street. He then stated that legal access would be from Hillview Drive, but functional access would be from Park Street. Box stated that this was different from the Hudson partition which had legal access off Ditch Road, but required access to the north. He stated that the proposed access off of Park Street is not in the City, however, it makes no difference on this particular application. He then pointed out that the three dissenting votes on CPAC were based upon the point of access and the steepness of Park Street and they believed it would be dangerous in inclement weather. Mr. Formolo, 1800 Crestview, tax lot 4100, stated that the new access off of Park Street is merely a word of mouth and he did not believe that it could be enforced. He was concerned about allowing the annexation and then the applicant trying to gain access off of Hillview Drive. He said he did not believe it woula remain as a single-family residence and that when the City Council had determined to include it into the UGB, it was done for. various reasons and one of them being that the area could be divided into a subdivision. He stated that the City Council, in putting it into the UGB, did not discuss access. He was concerned that once the annexation was granted, that the applica~t. would try to gain access off Hillview Drive anyway. Wander- schied stated in response to this that if the Planning Commission set a condit- ion that aCcess only be provided off Park Street, that it would not be possible for the George's to get access off of Hillview. Bob Milts with Marquess and Associates who are the engineers in this application said he checked two alternative routes of access and stated that the George's were aware of the neighbors' feelings and now have changed the functional access to Park. He said that they are only proposing one homesite now and feel that any later development would have to come before the Planning Commission and that this annexation should only be concerned with one house. Morris asked where the sewer and water services would be located for this proposed house. Milts responded that it would come up directly from Crestview . and go underneath the canal. He stated that this was expensive, but that it could be done. He then showed a map of the area showing the proposed access off of Park Street. RELEVANT COMMENTS FROM THE CITY COUNCIL PUBLIC HEARING AND COUNCIL DISCUSSION: City Administrator Almquist read a memorandum relative to thE' approval by Planning Commission of a request for annexation and requested that along with memo that Staff Report dated 5/9/79, map and pUbLic notice, minutE's of 5/9/79 Planning Commission meeting, findings of fact considered by Planning Commission be made part of the record. Box reviewed the request and action by Planning Com- mission and on question as to if and when six allowable houses mig;ht be built on the proposed subdivision (at a future date) Box said that it will be an expensive development with the access problem of that many people resultant from development along with expenses for hydrants, services etc. Ragland opened the public hearing and there was no comment, pro or .con, from the audience. The public hearing was closed. Laws moved approval of annexation and subdivision variance with conditions put on by Planning Co~ission and adoption of findings of Planning Commission; Phelps seconded and on roll call the motion passed unanimously. CONCLUSIONS AND ORDER OF THE CITY COUNCIL: The City Council concluded that the applicant adequately met the required burden of proof in support of the assertion of ultimate facts; and that the basic facts presented by the applicant, staff, and persons speakinl~ at the public hearing were sufficient reasons in support of the ultimate facts, and the Council therefore conCurs in the action taken by the Planning Connnission Hnd hereby approves of Planning Action No. 79-42 (Annexation and Subdivision Variance), subject to the following conditions: CONDITIONS: 1. That a fire hydrant be provided as per City Fire Code. 2. That the access way be 20' in width and end in a turnaround to specifica- tions of the City Fire Department. 3. That access be provided by private drive from Park Street to serve one house only. ,. ,;." ,', Findings of Fact for Varience Requirements 1. The deeded access to the property is located on ground that would be the logical extension of Hillview Street if the City had not changed design standards for steepness of city streets since 1965 when the original parcel of land was first subdivided and a portion of it became the Kensington subdivision of the City of Ashland. Therefore it is effectively landlocked unless this varience is granted. Z..If the varience were not granted the property would be unuseabee, clearly against the planning goal of providing acreage for single family dwellings within the urban growth boundary. The property owners would be unable to gain access to their property and thus unable to exercise their property rights. 3. Only the neighbors on the east and west sides of the right-of-way would be directly affected by the proposed private drive; the neigh- bors on the east by the use of the southern one-half to one-third of the presently unused but dedicated street for a free fall fill, and the neighbors on the west who ~ve already granted an easement through their lot for the beginning of the private drive.. Proper . tree and shrub plantings are planned to sh i eld both residences froI;; the 'adverse impact of headlight glare during night use of the drive. The city of Ashland Comprehensive Plan development, public hearings and adoption process has addressed this parcel of land. It was included in the Urban Growth Boundary during the meeting on January 10, 1978 of the Gity Council. At that time, during public hearings, it was agreed that (1) the acreage was small ( 3 acres ), (2) the sewer and water services in that area were adequate and would not require additional pumping stations, (]) the land did not fall in an agricult- ural soil designation, (4) the land was not forested, and (5) since the northern boundary of the parcel was contiguous with the southern boundary of the city annexation would be an orderly deve>>pment. As a result of the City:s action in including this land within the Urban Growth Boundary, the Findings have been executed by both City and County to support the inclusion, the ~~ermination has been made that the property is part of a well-considered ubanization process, and the requirements of the state Planning Goals have been fulfilled. . > .2- .
