which are noted on the reverse side of this letter, were not included with the boundary change actions
you reported to us. In order for boundary change actions to receive consideration for Federal Revenue
Sharing purposes, all such actions must be reported to the Bureau. Please send a copy of the effecting
authorization (ordinance, resolution, etc.) and a certified (i.e., signed by a city official) map of the
boundary change area to the Bureau' of the Census.
o The State Certifying Official has indicated to us that the State is unable to certify one or more of the
boundary change actions which your municipality has reported to us. Please review this information,
which has also been listed on the reverse side of this letter. If the items listed are legitimate boundary
change actions, please send a copy of the effecting authorization (ordinance, resolution, etc.) and a
. plat to the State Certifying Official, requesting that the Certifying Official notify the Bureau upon
receipt. Should your review indicate either that the State's records are in error or that information
previously reported to the Bureau regarding boundary change actions needs to be modified, both
the State Certifying Official and the Bureau should be informed accordingly.

AN ACT
Relating to annexation by cities.
Be It Enacted by Ihe People of Ihe Slale of Oregon:
SECTION I. Seclion 2 of this Act is added 10 and made a part of ORS chapter 222. )
SECTION 2. (I) When territor is annexed to a cit under ORS cha ter 199 or this cha ter the recor~

(2) Additiopal or, .increased fees or taxes, other than ad _ valorem taxes, imposed on _ a public utility as a
result-of an annexation of territory _ to ~ city shall ~come effective on the effective date of the annexation if
notice of the annexation is given to public utilities as required under subsection (I) of this section. However, if
notification of the ,annexation is provided to the public utilities later than the 30th day after the effective date of
the annexation, the additional or increased fees or taxes become effective on the date of notification.
(3) As used in this seclion:
(a) "Effective date of annexation" is the effective date described in ORS chapter 199 or this chapter.
whichever is applicable.
(b) "Public utility" has the meaning given that term in ORS 757.005.

Relating to district school boards; amending ORS 332.405.
Be It Enacted by the People of the State of Oregon:
Section I. ORS 332.405 is amended to read:
332.405. (1) The district school board may provide transportation for pupils when considered advisable by
the board. Instead of transportation, the board may furnish board and room for pupils when reasonable board
and room can be provided at equal or less expense than transportation. The transportation costs or expenses
for board and room may be paid from district funds.
(2) The district school board may expend dIstrIcl funds to improve or provide for pedestrian fadBt\es off
dIslrict property If the board finds that the expenditure reduces transportation costs of the dIslrict and enhances
the safety of pupils going to and from schools of the district.

So that we may revise our data pertaining to fire insurance rating, which
may benefit the property owners located in the newly annexed area, would you
please send us the following material:
1. A copy of the referenced document(s) containing the LEGAl, DESCRIPTION.
(Any pages expressing L.C.D.C. goals, zoning, census, etc. are not
necessary and can be omitted.)
2. A surveyor's MAP drawn to a measurable scale showing bOlUldaries of
the area, accurate distances, angles and streets therein and enough
of the former boundary and streets in the close vicinity to properly
locate the annexation.
3. One completed copy of the enclosed ANNEXATION STATEMENT for each

amended by deleting the last five (5) lines therefrom and sub-
stituting the following seven (7) lines:

CONSENT TO Ah~EXATION AND AGREEMENT
I!We represent that we are the owners of record of the follm,ing
described real property located in the County of Jackson, State of Oregon,
and which is described as follows:

Beginning at a point which is 1391.8 feet West, and lJ33.3 feet North from
the East-Southeast corner of Denation Land Claim No. 52, in Township 39
South, Range 1 Eas t of the Willa.'!lette Meridian in Jackson County, Oregon;
thence Southeas terly along the northerly sideline of Eas t Main Stre'et Road,
approximately 385 feet to a fenceline which originally was the boundary
between the Bayliss property and the Owen property; thence North 450 East,
approximately 461.9l,.feet to the southwesterly boundary of the Ashland
Airport; thence Northwesterly along the south."esterly boundary of Ashland
Airport, approximately 380 feet to the northeast corner of the Skillman
Trust property; thence South 50.28' West, 461.91 feet to the point of

As the owners of the said land and in exchange for the presently
existing dwelling or building heing connected to the water system of the
City of Ashland, I!We do consent and request that said land be annexed to
the City of Ashland and agree to be bound by the nrovisions of Ashland
Ordinance No. 1774 relative to water charges and Ashland Ordinance No. 1835
relative to water connections, as the same now exist or may hereafter be
amended. In addition, I!We agree to the following conditions:
1. To permit no connections to the on-premise water system other
than to the dwelling existing on the date of this agreement.
In the event the dwelling is subsequently replaced for any
reason, then the replacement dwelling may continue to be con-"
nected to the water system of the City of Ashland, as long as
the use of the water system will not be substantially increased
in the opinion of the Director of Public ~orks.
2, To be bound by all rules and regulations governing the use of
water as they presently exist or may hereafter be changed by
the City of Ashland. These rules expressly include the :right
of representatives of the City of Ashland to go upon the premises
at all reasonable times and places to inspect the water system
and its connections, to insure that it is being properly main-
tained and that no more than the permitted number of connections
are in existence.
3. At the time of annexation, to pay to the City one cent (l~) for
each square foot of land, which is to conpensate the City in part
for the cos t of exis ting capi tal improvements as required by Ash-
land Municipal Code Section 4.16.010.

4. At the time of annexation, to pay to the City an amount equal to
the current assessment for liabilities and indebtedness previously
contracted by a public service district, such as Talent Rural Fire
Protection Dis trict (Jackson County Fire Dis trict No.5), multi-
plied by the number of years remaining on such indebtedness, so
that the land may be ,dthdrawn from such public service districts
in accordance with O.R.S. 222.50 at no present or future expense
to the City.
5. Prior to installation of the water main and service by the City,
to deposit with the City the total estimated-cost of extending a
six inch (6") water main and one inch (1") water service and
meter which estimated cost is $1,867.17. Any properties to which
the City permits connection to this water main within 10 years of its
completion, shall be required to pay to the City the sum of $425.00
for each such water connection. City shall pay such sum,ove:r to
owners of. the land described in this' agreement, to compensate such
owners in part for the cost of extension of such water main. It
is noted hm:ever, that at present the policies of the City do not
permit extension or connection of \Vater services to users outside
the City of Ashland. The total paid over shall not exceed :n,592.00.
Further, we agree this Agreement shall be binding upon our heirs and assigns.

BE IT RESOLVED by the Mayor and City Council as follows:
SECTION 1. Section 1 of Resolution No. 81-28 is hereby amended

A RESOLUTION INITIATING AN ANNEXATION, COMPREHENSIVE PLAN CHANGE,
AND ZONE ',CHANGE PROCEEDINGS ON THE ASHLAND AIRPORT AND ON CERTAIN
PARCELS BETWEEN THE ASHLAND AIRPORT AND EAST 11AIN STREET.
WHEREAS, there exists a public need for the Ashland
Airport to be included within the Ashland City limits,
and,
WHEREAS, the area is within the Ashland Urban Growth
Boundary; and
WHEREAS, the City's Airport Committee has indicated
a desire for the Airport to be annexed, and
~{EREAS, the City will be able to exercise greater
control on the Airport and surrounding area if it is
within the City limits; and
~lEREAS, the City Council is authorized to initiate
these proceedings by resolution of the Council by
Section 18.108.180 of the Ashland Municipal Code.
NOW, THEREFORE, THE CITY COUNCIL OF 'THE CITY OF ASHLAND DOES
HEREBY RESOLVE:
SECTION 1. The City Council directs the Ashland
Planning Commission to initiate Annexation, Compre-
hensive Plan Change, and Zone Change proceedings
on the following tax lots in the county Assessor's
Map 39S IE 12: 301.
SECTION 2. The City Council hereby directs the
Ashlan d Planning Commission to hold appropriate
public hearings and make recon~endations to the
Council on the above request as required by law.

SECTION 3. The City Council hereby directs the
Planning Staff to set notice for such proceedings
as required by law.
