SECTION 1. The following described real property situated in the
City of Ashland, Jackson County, Oregon, is hereby reclassified
from Jackson County RR-5 (Rural Residential 5 AC Minimum) District
to City of Ashland C-l (Retail Commercial) District:
A tract or parcel of land situated in the Southwest quarter of
Section 11, ~'ownship 39 South, Range 1 East of the Willarnette
Base and Meridian, Jackson County, Oregon and being more fully
described as follows:
Commencing at the section corner common to Sections II, 12, 13 and
14, said Township and Range; thence North 78045'23" West, 3,435.60
feet to a 5/8 inch iron pin situated in the Westerly right of way
of Tolman Creek Road, as said road has been resurveyed and monu-
mented; thence leaving said road right of way South 89057'36" West,
315.08 feet to a found 3/4 inch pinched top iron pipe for the True
Point of Begi_nning; thence South 00021 '05" West, 126.27 feet to a
5/8 inch iron pin; thence North 89057'36" East, 315.70 feet to a
5/8 inch iron pin situated in the Westerly right of way of Tolman
Creek Road as heretofore described; thence South 00004'0911 West along
said Westerly right of way, 126.27 feet to a 5/8 inch iron pin; thence
leaving said right of way, South 89057'36" West, 316.32 feet to a
5/8 inch iron pin; thence South 00021'05" West, 180.66 feet to a
point in the present City Limits Line, which is 230 feet Northerly
of the South boundary line of Section 11, said Township and ~'nge;

the same proportion of such outstanding bond~ and interest there-
on as the assessed valuation of that part wJ.thdrawn bears to the
as~essed valuation of the entire district on the effective date of
this ordinance.

and also upon the effective date hereof, the City Recorder is
authorized and directed to submit a copy of this Ordinance to

THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. The City of Ashland finds that the owners of
the property described in Exhibit "A" attached hereto- and by
the reference incorporated herein have consented to the annexa-
tion of said land to the City of Ashland.
SECTION 2. The submitting of the question of the said
annexation is hereby dispensed with and a Public Hearing is
hereby set to be held before the Ashland City Council in the
- Council Chambers, Ashland Civic Center, Ashland, Oregon on the
1st day of December, 1981 at the hour of 7:30 P.M. at which time
all persons may appear and be heard on the proposed annexation.
SECTION 3. The City Staff is directed to cause notice of
said hearing to be given as required by ORS 222.120 so that
public notices are published in a newspaper of general circulation
appearing in the City in issues of such newspaper on November 23
and November 30, 1981, and that notices be posted in four (4)
public places in the City for a period of not less than two (2)
weeks prior to the date of the Public Hearing.
SECTION 4. Pursuant to ORS 222.524 a Public Hearing shall
be held on December 1, 1981, at 7:30 P.M. in the Council Chambers,
Ashland Civic Center, Ashland, Oregon on the question of
withdrawal of certain real property from Jackson County Fire
District No.5. All persons may appear before the Ashland City
Council and be heard an the question. The real property above
mentioned is situated in Jackson County, Oregon and more particu-
larly described in Exhibit "A" attached hereto and by this
reference made a part hereof.
SECTION 5. The City Staff is directed to publish and post
notices of said hearing in the same manner and on the pame dates
as described above relative to the proposed annexation.

RESOLUTION
A resolution of the Young Men's Christian Association of
Ashland, a non-profit corporation in the State of Oregon,
authorizing appropriate signature for the petition of
certain property herein described (Exhibit A) to ~e
annexed to the City of Ashland.
Whereas the Board of Directors finds that the subject
property is no longer needed to serve the Young Men's
Christian Association of Ashland purposes and can be de-
clared surplus upon the construction of new facilities,
and;
Whereas the Board of Directors finds that the best
interest of the Young Men's Christian Association of
Ashland can be served by the disposition of the subject
property, and;
Whereas the best monetary return for the Young Men's
Christian Association of Ashland can be achieved by
the annexation of the subject site;
Now, therefore be it resolved by the Young Men's
Christian Association of Ashland Board of Directors
that the Chairman of the Board, Chuck Lemar, be author-
ized and hereby directed to execute the petition for
annexation of the property described in Exhibit A,
attached and made a part of this resolution.

PLANNING ACTION #81-59 is a request for Annexation and Zone Change for 3.98 acres
of property located at 2245 Ashland Street. The property is designated as Rural
Residential 5 in the County, and the applicant is requesting that it be rezoned
to C-l (Retail Commercial) upon annexation to the City. A portion of the property

In reviewing the data and testimony which are in the records of Planning Action
#81-59, we make the following conclusoryfindings:

That, with the exception of water, there exists adequate public facilities
to service subject property. '
That the applicant has submitted evidence which indicates that the YMCA's
well will be able to satisfy the water demand of subject property.

That the request, with attached conditions, minimizes the impact on the
neighborhood and the City as a whole.
That C-l is the appropriate zoning designation to apply to the property when
it is annexed to the City. This is based upon the Retail Commercial designa-
tion of the property in the City's Comprehensive Plan.
That the land is contiguous to the Ashland City limits.
That the City's Urban Growth Boundary has been agreed to by Jackson County.

Based on our overall conclusions and upon the proposal being subject to the
following conditions, we approve Planning Action #81-59. Further, if the follow-

land and to be in substantially the following words: "Water for use on the
subject land will be supplied by the Ashland YMCA. The City of Ashland will

City, in its judgment, finds that its water system has been improved so as
to make furnishing of water consistent with good water management practices.
At that time all of the sUbject land that is developed shall be connected
