ANNEXATION (PA #81-92) On December 10, 1981, the Ashland Planning Commission voted 8-0 to recommend to the City Council that approximately 5.2 acres of property located on the west side of Walker Avenue and north of the Southern Pacific Railroad tracks be annexed to the City. CPAC voted 10-0 in favor of the . request on December 8, 1981. Included witn this memo are the Findings, Staff Report, Minutes, and a letter from Bob Britzman regarding this Planning Action. PLANNING ACTION #81-92 is a request for an annexation and zone change of about 5.2 acres of property located on the west side of Walker Avenue and north of the Southern Pacific Railroad tracks. The property is presently designated as RR-5 in the County and the larger parcel would be rezoned as R-l:5 and the smaller parcel would be re- zoned to SO (Southern Oregon State Coll ege) upon annexati on. Comprehensive PI an Designation: Rural Residential 5. Zoning: RR-5. Assessor's Map #: 100. Tax lots: 1800 and part of 1300. APPLICANT: City of Ashland. In reviewing the data and testimony which are in the records of Planning Action #81-92 we make the following conclusory findings: 1 ) 2) 3) 4) That the property is within the City's Urban Growth Boundary. That the property is contiguous to the present City limits. That tax lot 1800 has an inadequate septic system which has also contaminated the well that serves as the water supply for the house located on tax lot 1300. That the house and mobile home on tax lot 1800 have had City water for some time, and the house on tax lot 1300 has recently been hooked up to City water after getting permission from the City Council. Because there would be no additional water hook-ups as a result of this annex- ation, this request will not adversely impact the City's water system. That this annexation is a logical extension of the City limits because property to the south and property across Walker Ave. to the east are already within the City. That provision of City sewer service is necessal'y to alleviate the health hazard that presently exists on the site. That Jackson County has reviewed the request and found that it does not conflict with mutually adopted City/County urbanization policies. That the proposed zoning of the property (R-l :5) is in conformance with the City's Comprehensive Plan designation for the area (Suburban Residential). Based on our overall conclusions and upon the proposal being subject to the following conditions, we approve Planning Action #81-92. Further, if the following condition is found to be invalid, for any reason whatsoever, then Planning Action #81-92 is denied. PUBLIC HEARING PA#81-92 ANNEXATION, ZONE CHANGE CITY OF ASHLAND DESCRIPTION: Planning Action #81-92 is a request for an annexation and zone change of about 5.2 acres of property located on the west side of Walker Ave. and north of the Southern Pacific Railroad tracks. The property is presently designated as RR-5. in the County and the larger parcel would be rezoned as R-1-5 and the smaller parcel would be rezoned to SO (Southern Oregon State College) upon annexation. Comprehensive Plan designation: Rural Residential 5. Zoning: RR-5. Assessor's map #: 10D.. Tax lots: 1800, part of 1300. APPLICANT: City of Ashland. STAFF REPORT: Wanderscheid gave the staff report. He stated that CPAC had voted 10-0 in favor of the request. He showed the map and explained why the property was designated as SOSC, but would come into the City as K-1-5 because it was not in SOSC ownership. Barnes wanted c 1 ari fi cati on of why only part of tax lot 1300 vias included. Wanderscheid stated he did not know for sure, but it was probably because they only wanted to include the house in the City limits and did not want to create a subsized parcel in the County. Wanderscheid stated this request had come from the City Council be- cause of a failing septic tank on tax lot 1800 which was polluting the well of the house owned by the College on tax lot 1300. Greene wanted to know if they woul d only be requi red to sign in favor of the portion that was annexed. Wanderscheid stated yes, but when they propose to annex any other porti on, they woul d be requi red to sign in favor again. Barnes wanted to know if the College could in fact sign in favor. Wanderscheid stated we believed in the past that they couldn't, but Al Alsing had stated that they can.sign in favor. PUBLIC HEARING: 1. Al Willstatter, 128 Central Ave., wanted to know if the City could grant the annexation with the condition that the bike path be given. The Planning Commission and staff stated that was not an issue that should be addressed in this particular request. 2. Don Rist wanted to know if this would cause any additional water hook-ups. Wanderscheid stated no, that the house and the mobile ho~e APC, 12/10/81, Page 3 are already on City water and the College-owned house had already been granted permission from the City Council for a water hook-up because of their contaminated well. The public hearing was then closed. COMMISSION DISCUSSION AND MOTION: 1. Barnes stated he felt that we should not get involved with the bike path and should just deal with the annexation. The Commission agreed with that. 2. Wenker moved to approve PA#8l-92 with the suggested conditions and findings. The motion was seconded by Hansen and passed unanimously. 1'2--11:\ ---6/ STAFF REPORT December 10, 1981 Planning Action: 81-92 Applicant: City of Ashland Location: West side of Walker Ave. and north of the SPRR tracks Zone Designation: RR-5 Comprehensive Plan Designation: Rural Residential Ordinance Reference: 18.20, 18.108 Type of Action: Annexation and zone change REQUEST: Annexation and zone change of about 5.2 acres of property. 1. Relevant Facts A. Background - The City Council passed a resolution (No. 81-60) on October 8, 1981, directing the Planning Commission to initiate public hearings for this planning action. B. Description of the Site I) Topography - The property is relatively flat with a slight slope from south to north. 2) Vegetation - There are some large, mature trees located on both parcels. 3) Existing Structures - Tax lot 1800 has one single-family residence and one mobile home on it, and tax lot 1300 has one residence on it. 4) Current Use - The property is presently used residentially. 5) Ownership - Tax lot 1800 is owned by Judith McKenzie and tax lot 1300 is owned by SOSC. C. Surrounding Area and Land Use - Subject property is bordered on the south by the Southern Pacific Railroad tracks. Properties to the west and north are vacant and the property to the east across Walker Ave. is the site of the Ashland Junior High School. D. Detailed Description of the Proposal I) Area - Subject property consists of one full tax lot (39 IE 10D, tax lot 1800) and a portion of another (39 IE 10D, tax lot 1300). Tax lot 1800 is 186,000 sq. ft., or 4.3 acres, and the portion of 1300 is 41,800 sq. ft., or .9 acres. The total area of property that is proposed for annexation is 227,800 sq. ft., or 5.2 acres. 2) Number of Units - There are three existing residences located on this property. 3) Other - There are no physical changes being proposed for this property. E. Existing Services I) Streets - Walker Ave. is presently partially paved in front of subject property. 2) Water - This area is served by a 6-inch water main on Walker Ave. This is in the water moratorium area. 3) Sewer - Sewer is available from Walker Ave. 4) EleCtric - Electric service is presently supplied by Pacific Power & Light Company, but will need to be switched over to the City's electric system. 5) Other - All other services are adequate. II. Procedural - Since the City of Ashland is the applicant, the Planning staff proposes the following findings, which we believe to be adequate to justify the request: A. That the property is within the City's Urban Growth Boundary. B. That the property is contiguous to the present City limits. C. As a result, we have re" quested the coordinators at Dunn House to take the standard precautions outlined previously to them in regard to hand washing and utensil washing, bathing, etc. In addition, we have requested Jerry Havel1 of your staff to provide containers of Ashland City water to the residents of Dunn House for drinking purposes until the situation is resolved. . To briefly reiterate the pertinent history - in October of last year we were contacted by your staff in regard to a possible contamination problem with the well serving Dunn House. At that point we placed the facility on a temporary BOIL WATER order until the source of the problem could be identified and its correction achieved. After the well was batch chlorinated, this office was able to obtain a conforming bacteriological sample which was followed by a non-conform- ing sample. This bad sample was followed by two (2) bacteriologically acceptable samples at which time the "Boil Water" order was lifted with the provision that monthly monitoring of the system would be continued by this Department. Fo110w- i ng the removal of the "Boi 1 Water" order in January, a total of four (4) con- forming samp1eshave been obtained until our sample of 5-28-81 which was positive for coliform bacteria. At that point Jerry Havel1 and the people at Dunn House were instructed that they should reinstate the "Boil Water" Order provisions. Since that time we have obtained a second bacteriologically contaminated sample. The Dunn House well bacteriological history would seem to indicate a sporadic influx of surface water from some unknown source at different times of the year. Although the physical construction of the well appears quite satisfactory, it is evident from our bacteriological results that surface water, contaminated with coliform bacteria and possible accompanying pathenogenic bacteria, is entering the well at some point. To further complicate matters, as has been documented in the past, there is a failing septic system on a neighboring property in close proximity to the Dunn House well. Not withstanding the County Planning Depart- ment's efforts to have this failing system abandoned and the neighboring residents hooked to city sewer, be advised that the abandoned neighboring failing septic system would still pose a potential threat to the integrity of the well which Mr. Phil Campbell RE: Dunn House June 8, 1981 Page -2- serves Dunn House. It is the agency's firm opinion that the only reasonable solution, is the connection of the Dunn House facility to the Ashland City water system. The relatively delicate population being served by Dunn House coupled with the existing close proximity of city water would seem to point to this solution as being the only viable alternative. To reiterate, we are extremely interest- ed in facilitating this process in any way possible and hope that you will con- tact us if we may be of assistance in this matter. Mrs. McKenzie has owned the properties since 1971. The house at #163 has been on the property for more than 10 years. Mrs. McKenzie indicated that there was a mobile home on the property at #161 at the time she acquired the property but that they replaced it seven or eight years ago with the mobile home presently on the lot. There is a sewer main adjacent to the property and if the dates given to me by the property owner are correct, the properties would qualify for city sewer under the ordinance. This is the section of Walker Ave. where the street right of way is entirely within the City limits and the adjacent property is entirely outside the City limits. For this reason only half of the street was paved at the time of construction of the junior high school. It would be desireble to eventually annex this property so the pavement can be completed at some future date.
