able state through the annexation process when soliciting funding.
Stone reviewed the conditions attached to the proposal and noted the
street improvements will come with the actual development and asked
that the annexation fees be deferred until the time of development.
Stone asked that annexation fee deferral be part of the annexation
approval.
Vicki Neuenschwander, 455 Tolman Creek Road, expressed concern that
she was not notified of the public hearing and had just learned fron
the published agenda that a public hearing was being held. Neuensch-'
wander said for this reason she had no prepared statement but felt
'that development plans should accompany the application for annexatic~
so the matter can be addressed by the residents should they have res-
ervations about the development. Neuenschwander said that there is
a lot of idle land in the area now and that it is not being maintain~d
and creates a fire hazard. Fregonese said there are no plans now and
in the urban growth boundary they are,not necessary at this time,but
there are guidelines on what can be developed there. Fregonese added
that Neuenschwander was not 'notified because she is not within 250 ft.
of the proposed annexation. Stone said there will be opportunities
for people to have input. Stone added that Shapiro was out costs of
plans etc. when a mobile home park was proposed and subsequently
rejected. The Mayor closed the public hearing.
Deferment of annE'x"tion fp"" was discussed by CoullE.!l and Acklin noted
that the Growth Management Committee is working on a policy relative
to fee schedules including annexation fees.
Howard moved for approval; Reid seconded the motion. Dale asked if
the approval, inc1""ded deferring the annexation f,~e and 'HowanCfi.ild it
dTcf;----~voice vote the motion passed unanimously.
The City Administrator read the petition and a memo dated January 11,
1984 outlining nuisance criteria should Council declare such nuisance
exists. Almquist noted that occupants do have a business license
doing business as Southern Oregon Mobile Muffler/Towing. Salter
reviewed the options of owner to remove anything specified and in the
event it isn't removed, the City would do it with a charge to be paid
by property owner. Nicki Dawson, 478 N. Laurel said the neighbors
agreed to take action by petitionfeeling that existence of nuisance
is detrimental to the neighborhood and injurious to children.
Dawson said it would decrease value of homes in area and submitted a
list of things considered in the nuisance complaint along with pic-
tures of the home and yard. Smith asked if the matter was brought to
the attention of the owner of the property and Dawson said that a
complaint had been filed with the Police Department in September so
the occupant was aware of neighbors' concern. Dale Hayden, 467 N.
Laurel said the condition has existed over a three year period and
said that engines, machinery, old oil filters and cans and generally
resembles a parking lot or auto repair business. Hayden said it
doesn't resemble a home you would expect in an R-l Residential Zone.
Haydenconcluded by saying if there are no ordinances prohibiting
such a nuisance in an R-l Zone, there should be.

For the purpose of applying to the City of Ashland to have our land annexed to
that City, we represent that we are the legal'owners of record, or the contract purchasers
pursuant to a recorded contract, of the foll0l1ing-described land located in Jackson County,
Oregon:
See attached Exhibit "A"
We hereby request and consent to the annexation of the above-described land to the
City of Ashland; and, in exchange for the scheduling of a public hearing and in consideration
of this request by the City of Ashland, we agree that this consent to annexation shall be
non-revokable for a period of three (3) years from its date.
We further agree to pay five cents (5) for each square foot of land sought to be
annexed to the City of Ashland as a :fair and just contribution toward the cost of existing
municipal improvements and utilities that may benefit the land; said payment to be made to
the Ci ty of Ashland at the time the land is annexed, or \1hen either water or sewer services
are fur~ished to the land at our request, whichever Occurs first.
At the time the land described herein is annexed to the City of Ashland, we agree
to pay to the City of Ashland an amount sufficient to enable it to withdraw this land from
all public service districts as defined by ORS 222.510 and to which it may belong so that
this shall be at no present or future expense to the City of Ashland. With respect to each
such public service district that, at the time of annexation, has outstanding liabili tics
or' indebtedness, we shall pay to the City of Ashland an amount equal to the preceeding ycar I s
assessment for such indebtedness multiplied by the number of years remaining on such ind~bted-
ness.
We agree that this agreement shall be binding upon our heirs and assigns.

THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. That Ordinance No. 2052 and Section 13.12.030 of the Ashland
Municipal Code be, and the same hereby is, amended to rezone from Jackson
County RR-5 (Rural Residential - 5 Acre Min.) District, to City R-l:3.5
(Single Family Residential) District, the following.described real prop-

SECTION 1. The following described real property situated in the City of
Ashland, Jackson County, Oregon, is hereby withdrawn from Jackson County
Fire District No. 5 pursuant to the provisions of ORS 222.524. Said real

SECTION 1. The following land is contiguous to the City of Ashland and is
located in Jackson County, Oregon, and is hereby annexed to the City of Ash.
land as provided in Section 2 of this Ordinance, and described as follows:

OF NOTICES AS DIRECTED BY ORS 222.524; AND DECLARING AN

'rHE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
'SECTION 1. The City of Ashland finds that the owners of the pro-
perty described in Exhibit "A" attached hereto and by this reference
incorporated herein have consented to the annexation of said land
to the City of Ashland.

SECTION 2. The submitting of the question of the said annexation
is hereby dispensed with and a Public Hearing is hereby called at
the Council Chambers, Civic Center, 1175 East Main Street, Ashland,
Oregon, on the 17th day of January, 1984, at the hour of 7:30 P.M.,
at which time all persons may appear and be heard on the proposed
annexation.
SECTION 3. The City Staff is directed to cause notice of said
hearing to be given as required by ORS 222.120 so that public notices
are published in a newspaper of general circulation appearing in the
City in issues of such newspaper on December 27, 19f.3 and January 3, 193.
and that notices be posted in four ,(4) public places in the City for
a period of not less than two (2) weeks prior to the date of the
pub lic hearing.
SECTION 4. Pursuant'to ORS 222.524 a Public Hearing shall be held
on January 17,1984, at 7:30 P.M. in the Council Chambers, Civic Center,
1175 E. Main Street, Ashland, Oregon, on 'the question of the withdrawal
of certain real property from Jackson County Fire District No.5.
All persons may appear before the Ashland City Council and be heard on
the question. The real property above mentioned is situated in Jackson
County, Oregon, and more particularly described in Exhibit "A" attached
hereto and by this reference made a part hereof.
SECTION 5. The City Staff is directed to publish and, post notices of
said hearing in the same manner and on the same dates as described on
Exhibit '~A" attached hereto relative to the proposed annexation.
SECTION 6. This Ordinance being necessary for the immediate preserva-
tion of the public peace, health and safety, an emergency is declared
to exist, and this Ordinance takes effect on its passage and approval
by the Mayor.
