McKeen, Mayor of the City of Ashland, do hereby proclaim that at a special election held in the City of Ashland, Oregon, on the 29th day of February, 1972, there was submitted to the electors a measure to repeal City of Ashland Ordinance No. 1706. That as a result of the canvass of said votes by the Mayor and Common Council, the result was as follows: 72 REPEAL OF ORDINANCE #1706 YES: 999 NO: 1575 I do hereby proclaim that the electors of the City of Ashland have rejected the measure, and Ordinance #1706 remains in effect. Re: Sewer Improvement Bond Issue Dear Joe: Enclosed is a copy of a proposed Ordinance which will call a special election for the issuance of sewer improvement bonds. We need to acquire election officers and insert their names in the blanks that are contained in that Ordinance. This should be done prior to its presentation to the Council at the adjourned meeting on August 8, 1972. If possible would you check with the people who served at the last special election and see if they, or others, are willing to serve again. Also enclosed is a Notice of the. Special Election which needs to be posted at the places set forth in the Ordinance in Section 8 and also published in The Daily Tidings at least 10 days prior to September 26, 1972 and after the Ordinance is finally adopted. As part of the bond issue procedure we will have to acquJre an affidavit stating where and when the notices were published and posted so as to prove that we have complied with this pos~ing provision. BE IT RESOLVED BY THE CITY OF ASHLAND, as follows: SECTION 1. A special election is hereby called to be held in the City of Ashland, Oregon, on the 29th day of February, 1972, from 8:00 a.m. to 8:00 p.m., pacific standard time, at which election there shall be submitted to the legal voters of said city for their adoption or rejection the following proposed measure, to-wit: PROPOSED BY INITITATIVE PETITION AN ACT An Ordinance providing for the repeal of the City of Ashland Ordinance No. 1706, commonly called the "Stop and Frisk" law. THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS: SECTION 1. Ashland Ordinance No. 1706 enti tled"An Ordinance relating to detention and threshold inquiry by police officers; making unlawful to resist such detention; repealing Section 26 of Ordinance No. 1600 which related to loitering and prowling; and declaring an emergency" is hereby repealed. SECTION 2. That the Ballot Title under which the proposed measure shall be submitted and as the same shall appear on the ballot at the Special Election shall be as _follows: AN ORDINANCE REPEALING ORDINANCE NO. 1706, THE "STOP AND FRISK" LAW- YES / / I vote to approve the measure and repeal Ord. 1706 By the initiative process it is proposed to repeal Ashland Ordinance No. 1706, entitled "An ordinance -relating to detention and threshold inquiry by police officers; making unlawful to resist such detention; repealing Section 26 of Ordinance No. 1600 which related to loitering and prowling; and declaring an emergency". The Ordinance sought to be repealed is commonly known as the so called "Stop and Frisk" law. The adoption of the ordinance proposed by this initiative will have the effect of repealing and rendering no longer valid Ashland Ordinance No. 1706. NO I-I I vote to reject the measure -and retain Ord. 1706 SECTION 3. The City Recorder is directed to provide such ballots, ballot boxes, poll boxes, poll books, tally sheets, and such other supplies for each polling place as are necessary for the conduct of said election. You will see that there are a number of offices that must be filled for each of the wards. We must have persons who are able to serve in these capacities so that the Council may adopt this Resolution at its next meeting on February 1, 1972. I have also arbitrarily selected Briscoe School and Ashland Junior High School as the polling places. It would seem appropriate for you to check with the schools to make sure that this would not create any problems. I do not anticipate any since they are commonly used as polling places. ~ext, the Resolution calls for you to prepare ballots, the ballot title you will find in the Resolution. Also, the Resolution calls for you to give notices by publication in the Ashland Daily Tidings. I have taken the liberty of preparing a notice. When the Resolution is adopted, I suggest that you sign and keep on file the original of the notice and sign and forward to the Tidings a copy of the notice requesting that it be published on Febr~ary 16, 1972. WHEREAS, the Common Council finds that Section 26 as enacted by Ordinance No. 1600 has been held to be unconstitutional by the Ashland I t ~ !, Municipal Court; NOW, THEREFORE, THE PEOPLE OF THE CITY_OF ASHLAND DO ORDAIN .AS FOLLOWS: SECTION 1. That Section 26, entitled "Loitering or Prowling" of Ordinance No. 1600 be, and the same hereby is, repealed and there is hereby enacted in lieu thereof and as an amendment to Ordinance No. 1558 a new Section 26 to read as follows: "Section 26. Threshold Inquiry. a. Temporary Detention. The police officers of the City of Ashland may stop any person in a public place if an - officer has reasonable grounds to suspect that the person is committing, has committed, or is about to commit, a crime or breach of ordinance, and may inquire of such person his name, address, business, and where he is going. If the person thus being questioned, fails to give his lawful name and a reasonable explanation of his actions, this shall not constitute a punishable violation of ordinance, but such person may be detained by the officer for a period not exceeding two (2) hours and further questioned or investigated. Successive detentions of a person cannot be used as a colorable basis for detaining the person more than two hours hereunder. No such detention shall be deemed or recorded as an arrest, and at the end of the time thus authorized, the person so detained shall be either promptly released or arrested, and charged with a crime or a breach of ordinance. If a person refuses to submit to lawful detention hereunder, the officer may use such means as may be reasonably necessary to effect the ~en<tTon. -I'f-t-h-ed-e"ten.tion is lawful hereunder, and if the officer employs no greater force, or other means, than reasonably necessary, resistance or flight by the person whom he seeks to detain shall be a violation hereunder. b.
