Last year the Parks Commission lent its support to this land exchange component and we have reviewed the Verde Village plan a number of times to evaluate the benefits to the existing Dog Park, the Bear Creek Greenway connectivity and the public value of a parkway along the ____ - __n__ upper bank of Ashland Creek. I would ask you to please move forward with an approval of the components of this planning action. Your approval will benefit the current and future Parks facilities in this neighborhood. PA# Datdl Sta~ Nov.6thl\ 2007 Dear City of Ashland Council Members, With great interest and enthusiasm I am writing this letter in support of this unique Verde Village project for our area While the long list of benefits to the people that will eventually live in this carefully planned environment is important I have seen and learned of the benefits to communities these types of projects bring. I have seen the Dolf Creek Development in Portland, Northwest Project in Bend, and Iron Horse Resort in Prineville and learned about Pringle Creek in Salem. Locally, Shady Cove has a development starting that will use Energy Star and Earth Advantage standards for more green and sustainable building practices in homes. Our technology today affords tremendous possibilities for efficient, healthier, and sustainable building practices. The communities that endorse these types of building developments are providing valuable and sustainable futures for themselves. A project that uses sustainable building science techniques and captures the awareness of media and other Cities is appropriate and expected for the City of Ashland. With the Cities attention to preserving the surrounding environment, taking pressure off the grid with its use of solar power the Verde Village project will blend well. Continued learning and growing in knowledge is part of my job being a Realtor. In my study for certification as an EcoBroker@ and Earth Advantage@ Agent I have learned a variety of things about the type of development Gary and Valri Williams are proposing. Our family looked deeply into the Verde Village Application, even retaining land use counsel and a traffIC engineer to assist us, and we found so many deficiencies that it was trulYdillheartening. Traffic impacts on Helman St., the school and even the HWY. 99 intersection were issues that really were not adequately or objectively addressed. Why was there no TPR Analysis required/completed for the project? Density also is a legitimate issue, albeit one that has been carefUlly deflected by cloaking the project in a "green" faoade. The Verde Village project as proposed was far from green. We witnessed the developer making promises from the podium at the Planning Commission. . . promises about things that had been completely ignored or glossed over In the Application. The Development Agreement was originally very poorly drafted (by counsel for the Applicant?) and offered the City and community precious few protections. In Its earlier form (i.e. the form first presented to the Planning Commission) it certainly was not requiring a "green" project at all. That site Is a whole lot greener than the 68 houses the developer proposes to pack onto It. The annexation, the land swap, zone change, relaxation of street standards _ so many things to accommodate a development that is too dense, Are there not more appropriate sites for this sort of development within the UGB? We believe that to be a good question. Finally, when we first called the City to find out about the so-called 'Verde Village' project, the person in Community Development said 'oh, you mean the Adroit Construction project?' This notion of the developers being 'simple 3rd generation farmers is a .blt nauseating, but sadly! typical of the way the whole project has been promoted to the city. Verde Village is a visionary project consisting of 3 PUDs which are contemplated to be "Net Zero Energy-Ready". This means that the residences would be capable of generating as much energy as they consume. 2. Verde Village is a visionary project, which could serve as a prototype for "active green" development throughout the Northwest. It would be the first project of its type in Oregon. The Verde Village residential community will be a "cutting edge" green subdivision which not only the Williams, but also the community of Ashland, will be proud 3. Greg and Valri Williams are not developers. They are "petunia farmers". They own Ashland Flower Shop and Greenhouses. The Verde Village property has been in the Williams family for over 100 years. Ashland Greenhouses has now relocated to a new site. Rather than just take the easier path - building a couple of "McMansion ranchettes" under the existing RR-5 County zoning - the Williams desire to leave a legacy by creating a sustainable residential development. The more progressive path the Williams chose in pursuing this application presents some unique challenges and financial risks. Nevertheless, they feel this is the right thing to do under the circumstances. Greg and Valri have been interested in sustainable development for a long time. They feel their family's long history as professional greenhouse farmers is consistent with their aspiration to design and build a "green" residential development on the property . 515 East Main Street. The Williams' interest in solar energy, water efficiency, and utilizing renewable resources to the extent possible - coupled with their property's location in Ashland, a community which values the concept of sustainability - render this challenging project worth overcoming the hurdles presented by pursuing a real property exchange, annexation, Comprehensive Plan Map and Zoning Map amendments, outline plan approval, street exceptions, physical and environmental constraints permit, and a tree removal permit. Further, because the proposed real property exchange with the City requires approvals by City, State, federal, and County government- the project requires the painstaking task of carefully fitting a number of complex pieces together through a variety of processes. While sustainable development is a concept probably favored by almost everyone, the dominant paradigm discourages sustainable development. Pursuing and achieving sustainable development is viewed by most developers as complex and expensive. Many local codes contain criteria which actually serve to discourage sustainable development, because achieving sustainable development often requires flexibility in design and site planning. 5. The project involves 3 planned unit developments (PUDs). The three PUDs are designed to attract diverse demographics to the project. A. The "Town home Area PUD" (zoning: R-1-3.5) will be gifted to RVCDC (a well-respected local affordable housing non-profit entity) with the roads and infrastructure installed by the Williams. Once the Development Agreement is approved, RVCDC will apply for grants to allow them to construct the Townhomes to net zero energy standards. However, the Williams request that the Townhome Area PUD development not be absolutely required to meet these net zero energy- ready standards, because it is possible that RVCDC may not be awarded the grant it hopes to receive. In that event, RVCDC hopes to nevertheless be permitted to build the 15 affordable Townhome units. This concession will still allow RVCDC to put these 15 affordable units on the ground in Ashland. For this reason, the Williams request that the final Development Agreement only require at least 53 of the 68 residences to meet the net zero energy-ready standards. Also, the Development Agreement should specify RVCDC "or its designated successor or and assigns" in the highly unlikely event that RVCDC . 515 East Main Street. B. The "Cottage Area PUD" will consist of 24 cottages, each approximately 800 to 1200 square feet in size (zoning: R-1-5). These will all meet the net zero energy-ready standard. C. The "Single Family Area PUD" will consist of 25 single family homes of varying sizes, but not to exceed approximately 2500 square feet (zoning: R-1.5). Please note that these include 3 the Williams' existing unimproved City lots on Nevada Street; as well as one single family lot on Alameda Street (zoning R-1-7.5). These single family homes will all meet the net zero energy-ready standard. 6. The Application, Narrative Books presented by Applicants, and the terms of the current draft of the Development Agreement in the record before Council are extensive. If you wish, you can easily add It this evening, 204,030 Section 0 (page 5) would then read as follows "Any topic may be added to an agenda by a majority vote of the Councilors present. Generally these items should be limited to items of timeliness or emergencies" 2) At the September 25 meeting you also discussed adding "The Mayor and council members,.." to precede the statement Section 0 2040,080 Conduct With City Employees, It IS unclear from our notes or from the minutes whether you agreed to do this, If you Wish, you can easily add It thiS evening, 2,04,080 Section 0 (page 9) would then read as follows "The Mayor and council members should strive not to criticize any person in a public meeting or In public electronic mail messages, The same expectation applies to City staff in the exercise of other official duties, Nothing should limit the Mayor, a council member or staff person's right to report wrongdoing," 3) Gentle Person AgreemenLyou did not discuss thiS at the last meeting but you could easily adopt this as a resolution. Council should discuss it this evening and direct staff to bring back a resolution for adoption at a future meeting, There is no need to reference the Gentle Person Agreement in the ordinance because you are not giving It the force of law (per Richard), 4) "No member shall speak tWice on a motion on the floor ,"(2,04020 Section K).. thiS is In your current rules AMC 2,04,060 and in Chapter 2 Section 4 of Roberts Rules, Section 2,04,020 Section H Robert's Rules of Order states that Robert's Rules of Order shall be the authority for government of the Council during ItS sessions, when not in conflict with the City Charter and these code rules, Failure to strictly follow Robert's Rules of Order shall not be cause to void or otherwise disturb a decision or action of the Council The counCil will strive to be clear in its proceeding, Leaving 2,04,020 Section K as is means that even if you do not strictly follow Robert's Rules of Order, you will adhere to "no member shall speak twice on a motion on the floor" because you've adopted it as a rule, I hope this helps, I'll bring hard copies of thiS email to the meeting tonight. (See section 5.0.1 in currcnt drali rules.) 2) Land Use Public Ilearing: Be conscious that extensive questionmg of applicants in land use public hearing can delay public input and lead to continuation of hearing to a later date, witlI the result that public input can be I()rgotten and precious timc expensed. Try to keep questions as succinct as possible. 4) Courtesy: All councilors, Commissioners, Stafland members of the public should be courteous with each other, even when they disagree. Everyone should be reminded that it is counterproductive to attack others in public. 5) Public Positions: Wben dealing witb the public or other public agencies, councilors should be clear about when they are speaking I(lr themselves as opposed to representlllg a position taken by the entire council. (,) Councilors attending otber meetings, either as liaisons or individuals should accord the same respect towards the cbair and other members as they do towards one another and the Mayor or presiding ofllcer at council meetings.
