Hi Martha,
I am in receipt of the recommendation of the Arts
Commission regarding the murals. I am also aware the
matter is going to the Council on March 18, 2008.
I am in agreement with most of the conditions(save and
except payment of a planning fee) and do want to
clarify some of the terms of the donation.
This donation is conditioned upon the placement of the
panels under the overpass. If the City or OOOT decides
to remove them from the Viaduct, they must either be
re-hung on other public property visible to the public
in Ashland, or returned to the donor.
Also, I feel charging a planning fee is inappropriate
for a public arts donation such as this. In light of
the cost of the art, lights and erection, the fee
should be waived. I request this be done.
I will deliver petitions requesting the murals be
returned to the bridge. These were signed by the
public.
Thank you for your help and consideration in this and
other matters.

When eight of the nine property owners involved in the Harrison/Morton alley
LID met with you at the Ashland library some weeks ago, we were all
surprised that everyone in the room was able to come to a compromise
concerning the paving of the alley. Although a one-way alley would limit my
driving choice, I went along with that option because I want the alley
paved. I had wanted to keep the February 5th date with the City Council and
let this LID be decided in an open hearing according to the rules. Ken
Baker, one of the three property owners originally opposed to paving, asked
me to forego the February council date, so that our our agreement to make
the alley one-way and paved, could go to Traffic Safety for a ruling, and
then to the City Council where we would be proposing a consensus agreement
for the LID. To that I agreed.
Thursday March 13th, the City received a letter from Diarmuid McGuire, one
of the property owners, who originally objected to the paving, and signed by
Ken Baker and the Ghavams, Hamid and Julie, representing the other two
properties who originally objected to the paving, but had agreed to the
one-way paving option. As far as I know, Diarmuid McGuire did not send
copies of his letter to any of the property owners who had originally
favored the LID, including myself. In his letter, Mr. McGuire begins by
stating: "As you know, four of the nine property owners included in the
Morton/Harrison Alley LID object to paving the alley." It was my
understanding that we all agreed to the one-way option and paving. Also, I
am not aware that four of the nine properties object to the paving. When I
asked the son of Roy Jorgensen, Steve, who is the tenant of his father's
house on the alley, Tax lot 1100 he told me he thought his father was in
favor of paving. Roy Jorgensen and I have not discussed it, but I have no
evidence that he is in opposition.
On Page 2, Mr. McGuire says, "In essence, you are asking nine neighbors to
pave a driveway for two neighbors who must use the alley to reach their
homes". This is not quite fair. The owners of tax lot 1900 do have
on-street parking on Harrison but want the alley paved because of the dust
and because they access their carport off the alley. The owners of tax lot
2200 have their garage and an additonal parking space, both of which can
only be accessed from the alley, and they have no on-street.parking. They
are also advocates of paving because of the dust. The owner of tax lot 2200
has one parking space off Siskiyou but has his garage and parking area off
the alley. He also wants to pave because of the dust. The owner of tax lot
1100 has his house rented to SOU students, who usually have between 5 and 8
cars and large trucks, parked mainly on the alley. This property accounts

for much of the alley traffic. The two landlocked parcels referred to by
Mr. McGuire belong to my wife and I, and the Hildens. We use the alley to
access our homes and to park. Of the three properties opposed to paving the
alley, Ken and Carol Baker, tax lot 1103, have a two car garage that is not
used for cars, but instead park a truck and camp trailer along the alley.
Hamid and Julie Ghavam, tax lot 1000, park off the alley on Morton St. but
have a rental in the alley and whoever lives there uses and parks in the
alley and accesses that rental from the alley. Diarmuid McGuire and Pam
Marsh tax lot 2000, have a rental that is accessed from the alley and the
tenants have always parked in the alley. Other tenants of the McGuire
property use the Morton end of the alley for egress and ingress to the
McGuire/Marsh property.
Item 2 on page two of the McGuire letter concerning additional traffic, will
not be a problem if the alley is one-way, Harrison to Morton.
As to problems with runoff, storm drains, and maintenance, the engineering
department has informed us that there willi not be a problem with runoff if
the alley is paved, that the storm drain on Morton is 24" and quite
capable of handling the runoff from the alley and that maintenance on a
paved alley is less than if it is not paved.
It is my recollection that each of the 8 properties represented at our
meeting with Jim Olson agreed to the compromise of a one-way alley and
paving. Instead, the McGuire letter suggests that at least three
properties have always objected to the paving. My question to the signers

Dear Diarmuid and Pam, Hamid and Julie and Ken and Carol,
A you are aware, the traffic Safety Commission approved your request for creation of a
one-way traffic pattern on your alley. The one-way system to become effective upon the
improvement of the alley. I was therefore, very surprised to receive your letter of March
12, 2008 in which you listed several points in opposition to the proposed improvement
project. It was my understanding, from our January 17th meeting, that if the alley were
to be designated as one-way, thereby reducing the number of vehicles using it, that you
would not oppose the improvement. If I recall correctly, that was a compromise that was
reached to promote neighborhood unity and goodwill.
Following is a response to each of your concerns expressed in your March 12, 2008
letter. The responses are in the same order as your letter and are referenced by the
same numbering system.
RESPONSE TO STATED FACTS
1. The planning action that permitted the creation of the two lots with sole access
from the alley did in fact require the developer to support a future LID to improve
the alley.
2. The fact that traffic on the alley has increased due to traffic delays on Morton
Street was acknowledged at the Traffic Safety Commission meeting. It was
primarily for this reason that the commission supported the approval of a one-
way designation for the alley. The one-way system will prevent queing traffic on
Morton Street to detour down the alley to Sherman Street.
Even though the traffic on Morton Street has increased significantly since 2004,
the intersection of Morton Street and Siskiyou Blvd. does not meet warrants for a
signal. The signal at Sherman Street was added to help add traffic gaps to aid in
entering the traffic stream at Morton Street.

RESPONSE TO OBJECTIONS
1. Benefit for a paving project must be considered and applied as a whole rather
than on an individual lot basis. It could argued that the north side neighbors
receive more benefit because they are lower that the alley and could receive
storm runoff from the alley. Or it could be argued that the south side residents
receive more benefit because prevailing winds generally blow air borne
particulates in their direction. Or that one lot has more access points on the alley
or has more vehicles or even a larger family and thus uses the alley more
frequently. The city has recognized the difficulty or impossibility of attempting to
assign benefit on an individual lot basis and has created ordinances that consider
each lot or assessment to be equal in voting rights and in assessment
allocations.
2. Once the alley is fully improved it will be immediately designated with a one-way
traffic pattern running from west to east, or from Harrison to Morton Street. This
will entirely eliminate the potential for increased west bound traffic resulting from
a Morton Street overflow.
3. As with any City right of way, the Harrison-Morton Alley is a public right of way
and is open to all to travel. There are no restrictions on who can use the alley
and it is understood that a percentage of the traffic may be from those who do
not live on the street or alley. The amount of traffic and the percentage of non-
local traffic is a function of the street classification and its location within the citys
transportation system. Major arterials such as Siskiyou Blvd. carry as much as 98
percent of non-resident traffic while low volume resident streets might carry only
20-30 percent non-resident traffic. Alleys, because of their function and design
carry the lowest percentage of non-resident traffic.
The City has recognized this condition and has compensated for it in the creation
of Resolution 99-09 where the City has elected to participate in the cost of LIDs
to compensate for general non-resident use of the street or alley.
The City has agreed to pay the following percentages of LID costs:
a. 60% of sidewalk costs
b. 75% of storm drain costs
c. 20% of street surface costs
d. 50%of engineering costs
The City cannot vary from these percentages.

4. The most effective method by which runoff can be controlled on an alley is by
paving the alley with an inverted crown section. This means that the center of the
alley is lower than either outside edge and the storm flow is channeled along the
center of the alley. This type of section cannot be maintained on an un-surfaced
alley where water is free to run across the alley onto private property rather than
along the alley.
Much of the flow from the alley will be directed into the Morton Street storm drain
which has just been upsized and reconstructed to handle increased future flows.
RESPONSE REGARDING OTHER ISSUES
1. In an effort to try to find a more durable solution to the dust and potholes
common on the alley the city has provided a surface of crushed asphalt. While
this is somewhat effective for a short time it is only temporary and presents
additional maintenance problems. The material lacks the needed binders found
in new asphalt and breaks down quickly resulting in potholes. It is difficult to re-
grade the crushed asphalt once it is in place and requires that additional material
be brought in from time to time. If material is placed on top of the surface already
in place it raises the alley surface making even more damage problems for the
south side residents. While silt transference is reduced, the amount of
hydrocarbons transmitted into the storm drain system is greatly increased with
the use of crushed asphalt.
2. The assumption that an asphalt surface is more costly to maintain is an
unsubstantiated generalization. All pavements are designed with a minimum life
expectancy of 20-25 years and most, when truck traffic is, low will last for
50years or more before major repairs are needed. It is estimated that
maintenance cost for the first 10 to 15 years following paving will be zero. This
can be contrasted to the time and effort already expended on the alley in,
grading, placing and compacting a crushed asphalt surface. That surface is
already badly deteriorated and is in need of additional maintenance. The cost of
placing the original crushed asphalt was approximately $3,200 and the
anticipated repair would likely cost $2,500.

3. We have found, through years of observation that people do not choose to travel
a street or alley simply because it is paved. Drivers tend to choose the shortest,
most convenient and most direct route to their designation regardless of the
surface type. The traffic patterns of individuals tend to form by continued use and
driving experience and generally vary on slightly. This problem is further
mitigated with the establishment of the one-way traffic pattern.
Hopefully I have addressed the concerns as expressed in your letter of March 12,2008.
One of the duties of my job is to safeguard the values and safety of the community as a
whole. This often requires that one look at potential projects from the viewpoint of how
the City as a whole will be benefited. From that viewpoint I can see no advantage to not
paving this alley.

Dear Mr. Olson,
As you know, four of the nine property owners included in the Morton/Harrison
Alley LID object to paving the alley. I am writing to explain our objections in
more detail.
First, please understand that we do not oppose the concept of a Local
Improvement District We believe in sharing the cost of facilities and
improvements that benefit us equally as a community. We feel, however, that
paving the Morton/Harrison alley involves unique circumstances and issues that
must be considered carefully by staff and our elected leaders.
Secondly, we agree that making the alley one-way in a west-to-east direction will
mitigate some but not all of our concerns. If the Oty decides to go ahead with
paving, we feel that a one-way designation is of utmost importance to address
both safety and quality of life issues.
As you consider the matter of paving the alley, we urge you to put your decision
in an historical context. Specifically, keep in mind two facts:
1.
Some years ago, the Oty permitted construction of two residences that
are accessible only via the alley. At the time that permits were issued
for these residences, the Oty required neither the developers nor the
future owners to mitigate the additional traffic that these residences
would create on this alley.
When the Oty redesigned Siskiyou Boulevard and reduced access
from certain residential streets to the thoroughfare, one of the results
was a significant increase of traffic on Morton Street. The new design
provided for no traffic light or other control mechanism at the
Morton/Siskiyou intersection. One of the no doubt unintended
consequences of the new design is a pattern of frequent backups on
Morton as impatient drivers attempt to cross the Boulevard and
continue on Morton or make a left hand turn toward downtown.

In light of these two factors, we ask you to consider the following objections to
paving the alley:
1. The benefits of this project are not equally shared. In essence, you are
asking nine neighbors to pave a driveway for two neighbors who must
use the alley to reach their homes. Several others have garages on the
alley, but some of us do not need to use the alley to gain access to our
properties.
2. A paved allE:)' will provide a convenient bypass for traffic backed up at
the Morton/Siskiyou intersection. Currently the alley does not appear
inviting to drivers who wish to turn left on Siskiyou. It is narrow and
has deep potholes. We believe that pavement and other planned
improvements will make the alley into a viable alternative for
westbound traffic. The potential for increased. traffic creates a serious
safety issue on this very narrow byway, which is heavily used by
pedestrians and bicyclists. (One way traffic in the opposite direction
will help mitigate this concern.)
3. Much of the current traffic on the alley is not local and should not be a
nei&hborhood ~bility. We have no way of quantifying traffic
on the Morton/Harrison alley, but please note that this alley connects
with other alleys to create a continuous route from Gresham to Morton
Streets. lhis is one of the reasons why it is popular with pedesbians
and bicyclists. Motorists also find it useful for avoiding the difficult
Morton/Siskiyou intersection in favor of the traffic light at Sherman
and Siskiyou. Some may go all the way to the library. In any event,
the Gty, not the proposed LID, should be responsible for the portion
of alley traffic that is not related to alley residences.
4. A paved alley will create increased runoff. Unlike many Ashland
alleys, the Morton/Harrison alley is not topped with decomposed
granite, which can create an impervious surface. The existing surface
of crushed, recycled material appears to absorb water. The alley is not
currently graded in a manner that would collect water and channel it
toward the adjoining streets. We believe that increased runoff from a
paved alley will place an additional burden on the Morton Street storm
sewer system, which is already inadequate during periods of heavy
rainfall.

Regarding other issues raised in your letter of November 20, please consider the
following:
1. The Morton/Harrison alley does not contribute granite silt to the
storm water system. Our alley is topped primarily with crushed,
recycled material from other street improvements. It is relatively level.
There is virtually no granite silt in the paved streets at either end.
2. Pavin& the Morton/Harrison alley will place an increased maintenance
obli&ation on the City. Currently, the City provides minimal
maintenance services to this alley. Asphalt surfaces deteriorate over
time and are costly to repair. It is difficult to imagine that maintaining
a paved alley will cost less than maintaining the existing alley, which
costs almost nothing.
3. Pavin& the alley would create a si&J.1ificant risk of increased traffic.
Your letter of November 20,2008, states that based on your
experience, "there is no correlation between the amount of traffic and
the surface type." But you have failed to address the specific
circumstances of the Morton/Harrison alley. Our neighborhood has
already experienced serious negative impacts resulting from the
Siskiyou Boulevard redesign. We are reluctant to rely on
unsubstantiated generalizations in this case.
The remaining issue is air quality. At least one of our neighbors objects to dust
raised by traffic on a portion of the alley in dry weather. H the City takes
responsibility for this problem, we urge you to seek a mitigation strategy other
than paving to address this concern.

I am writing this letter on behalf of my partner Katherine Gosnell and myself to support the
paving project on the alley between Harrison and Morton Streets. We live at 176 Harrison Street,
immediately adjacent to the alley, and we have a two car carport on the alley.
Since we moved into our home in 1996 the alley has continued to be a source of frustration for us.
It has continued to be riddled with potholes, has been muddy and slippery to foot traffic during
rain and has been an ongoing source of dust that settles on our garden our cars and in our lungs.
The city has re-graveled the drive a few times since we have lived here but after each time it
quickly falls into disrepair.
We have as a neighborhood applied a wax product to the alley in an effort to reduce dust which
worked for a period of time, however without consistent application it again quickly returned to
the muddy/dusty surface it is today.
My partner and I have come to the conclusion that paving the alley is the best solution for this
long term maintenance problem.
Now, some would argue that paving the alley would encourage speeding. My observations have
shown me that those that are inclined to speed do so regardless of gravel or potholes. In fact,
some users of the alley have found the gravel more desirable as they can spin their wheels as they
accelerate. This of course only leads to the quick deterioration of the gravel surface.
Some would argue that there will be drainage issues after the alley is paved. Quite frankly, I find
drainage to be an issue right now as the alley is slick and the potholes are full of water which
slops on our fence and creates a muddy treacherous walkway whenever it rains. I for one have
complete confidence that the city engineers will plan for a system that will effectively deal with
runoff and create a road bed that is far superior to the muddy surface we are using now.
I believe that all of our neighbors that live off the alley will benefit from this improvement. Not
only will wear and tear on our vehicles be reduced, we will be less likely to slip and fall and will
without a doubt be able to breath easier. Please support this project.

Due to my inability to attend this council session, I am writing a letter outlining my support of paving the alley
between Harrison & Morton streets.
I have lived at 164 Harrison Street for 8 1/2 years. Following are the reasons why I support the improvements
to the unpaved alley:
1. All neighbors agree that the traffic on the alley has increased significantly since the redesign of
Siskiyou Blvd. Due to this change, dust kicked up from traffic has increased. This, I believe, has caused irrita-
tion and increased allergy symptoms in both my son and myself and would decrease if the alley is paved.
2. The traffic changes have increased the presence of pot holes along the alley. These are only getting bigger
over time and no amount of rocks, leaves or filling seem to curb their development.
3. Over 13 vehicles belong to residents or renters of the alley and drive the alley on a daily basis.
These vehicles and others travelling the alley during the rainy months cause it to be muddy and messy. We have
brought in yards of rocks to cover our driveway area but the mud invariably creeps back over, making it more
difficult to maintain my property.
I am willing to support the one-way solution in order to accomodate the neighbors who have been opposed to
paving the alley. It is not my first choice, but I believe in the value of compromise.
Please consider this improvement project as long overdue and as an improvement to a great neighborhood.

No One Deserves to Live on a Chain

What would you do if you
saw someone tied to a tree by a
six-foot chain? What if you discov-
ered that he's been chained 24
hours a day, year after year? If you
called the authorities, they'd rush
over to free the victim and pros-
ecute his abusers, right?
Not if that someone is a
dog or other animal. Ashland,
along with most cities, allows
animal family members to live
permanently on chains. This type
of animal abuse is more common
than many people think. For ex-
ample, in the 14 years I've lived in
Ashland, I've seen neighbor after
neighbor tie their dog in the yard
for much, and in certain cases, for
all of the animal's life.
Tie up an animal unattend-
ed for long periods, and he can
wind up in deep trouble. Often ani-
mals get uncomfortably wrapped
up in their chains. Some break off
limbs, or even strangle to death.
People have told us of chained
animals who jumped a fence or
walked off a porch and hanged
themselves to death.
Some animals run around
the tree or post they're tied to, un-
til they can no longer reach shade
or water. Many get dehydrated or
even die of heatstroke. This is es-
pecially true if, like many chained
life on a chain cont'd
away from home, such as at a
store or a friend's house.)

someone is tying a child all day,
you can report that anonymously.

tor of the National Animal Control

When animals are tied constantly
in the same spot, they wear away
the grass. "You get.a downpour
of rain, and that dirt turns into
mud real quick," Mays said. Many
animals can get parasites or skin
infections from standing in mud for
long periods.
When animals get tied
up young, sometimes their flesh
cycled materials, they can be built
for the cost of a package of nails.

build fences.

They're also
more likely to be attacked by other
animals. Elderly, sick and weak
animals have an especially tough
time.
But if you've ever com-
plained to Jackson County Animal
Control that an animal is chained
up for much of the time, you know
how hopeless the situation is. Ash-
land resident Diane Meyer found
this out when she called
about a permanently chained dog
on East Main. "The shelter said
they couldn't do a thing about it,"
she says. She wrote to the animals'
caretakers, to no avail.
About 1 00 US communities
limit the tethering of dogs or other
animals at their homes. It's time
that Ashland, one of America's
most progressive cities, joins this
nationwide trend. Already over six
thousand people have signed a
petition asking Ashland to heavily
restrict the tethering of animals
at their homes. (The ordinance
wouldn't affect tying animals
example, we need people to gather
petition signatures, make phone
calls, and distribute fliers.

I recently completed a breakthrough ~tudy on tethering limit~. My
research is so significant that Animal People [hold it up], a national
ne~paper, is doing a story on it. Dogs Deserve Better, the national
organization helping chained dogs, is posting my study on its website.
Several months ago, Mayor John Morrison told me one reason he couldn't
vote for a tethering limit is that he wa~ concerned more dog~ would run
loose. So I called communities around the country and asked: Did they
have more report~ of d09~ running loo~e after their tethering limits
passed? I also asked them other things, including whether they had more
reported dog bites.
I was determined to report the results honestly and scientifically. If
every community had told me that after its law passed, it got more
report~ of dogs running loo~e or biting people, I would have told the
mayor that.
To my relief, the results were favorable to having an ordinance in
ADhland. Only one of ten communiti.~--Big Spring, Texas--had more loose
dogs and dog bites after its ordinance passed. Three communities--Dodge
City, Kansas, Laurinburg, Borth Carolina, and Scotland County, Borth
Carolina--actually saw their reports of loose dogs go down. And five
communitie~--half the sample--saw their dog-bite reports drop.
Why would fewer dog~ run loose once you make it illegal to tie them for
long periods? Maybe it's because, as Laurinburg Animal Control said,
dog~ can't get out of their pen~ and fences as easily as they can break
loose from a chain.
Balf the communities saw dog bites go down. Laurinburg's bites
plummeted an e~timated 7S percent in the fir~t year1 Carthage'~ bite~
plumetted an estimated 25 percent. Animal control officers told me
bite~ went down becau~e dogs were biting more when they'd been tied up a
lotI one officer said bites went down also because children were no
longer walking by chained dog~ and getting bitten.
This is only a small sample--ten communities. But if we can use it as a
guide, then Ashland only has a ten percent chance of having more loose

running loose. And five times as likely to have fewer dog bites.
This study suggests that Ashland's tethering limit would be highly
unlikely to cau~e more dogs to run loose or bite people. It's may be
the opposite: that a tethering limit is more likely to reduce the
number of loose dogs and dog bites.
Why i~ it a good thing to have fewer dogs running loo~e? Dogs cause
drivers and bicyclists to slam on their brakes or swerve and get into
accident~. [~tat~?J Some dog~ make a me~s of people'~ garbage. Some
spread disease. Some attack people's cats and kill wildlife. Some
loo~e dogs poop on neighbors' lawns.
This study suggests Ashland may have a 50 percent chance of reducing dog
bites if it passes a tethering limit. I don't need to tell you why
that'~ de~irable.
