Laws, Reid, Williams, Acklin, Winthrop and Arnold were present. APPROVAL OF MINUTES The minutes of the Regular Meeting of August 21, 1990 were accepted as presented. MOMENT OF SILENCE A moment of silence was held in memory of Ramelle Medaris, wife of 55 years of Former Mayor Gordon Medaris. SPECIAL PRESENTATIONS & AWARDS Proclamations: Organically Grown in Oregon Week, September 10-16, 1990; and Clean Air Week, September 9-15, 1990. CONSENT AGENDA Councilor Williams requested that item 5) Confirmation of Mayor's Appointment of Council/Park Commission joint committee to review Open Space funding options be pulled for discussion. Winthrop moved to approve the remainder of the Consent Agenda, those items being: 1) Minutes of Boards, commissions and Committees; 2) Authorization for Parks & Recreation Commission to establish a separate sUb-account for PERS reporting purposes; 3) Confirmation of Mayor's appointment of Dennis Black as Pro-tem Judge; 4) Set date for public hearing on bikeway study for Thursday, October 11, 1990 at 7:30 P.M.; and 6) Request for Attorney Generalis opinion regarding legality of legislation pre-empting the adoption of Real Property Transfer taxes. Williams seconded the motion which carried on voice vote. Williams will not be able to actively serve on the Open Space funding committee until after Christmas. After a short discussion, Winthrop agreed to serve. Laws moved to approve this item, williams seconded, all AYES on voice vote. PUBLIC HEARINGS Appeal of P.A. No. 90-057, SUbdivision on Granite at pioneer _ Planning Dir. John Fregonese gave the staff report and said the proposed project is on a long, narrow strip of approximately 20 acres, the Planning Commission approved the five units and the project meets all City requirements. Arnold questioned the first three items in the Regular Meeting - Ashland City Council - September 4, 1990 - P. 1 Appeal of P.A. 90-057 (Continued) letter of appeal and Fregonese responded by saying the cul-de-sac is less than 500' in length; the street grades do not exceed 18%; and the building envelopes do not have slopes greater than 40%. On a question from Reid, Public Works Dir. Hall said the Granite street water line is more than adequate for the area and proposed subdivision. Fregonese read conditions for appealing to LUBA and the ordinance criteria. Reid, Williams, and Winthrop made site visits and Reid spoke with neighbors. The public hearing was opened. Carl Oates, 351 Granite, appellant, asked that all issue papers read on behalf of the appellants be made a part of the record and copies were received and placed on file. Issue Paper #1 stated that the cul-de-sac is 560' long and requires a variance. Issue Paper #IV discusses neighborhood compatibility including the Lithia Park viewshed and animal life. Oates, also submitted a petition with 79 signatures concerning the impact of the development on Lithia Park. Dennis Friend,' 355 Granite, read Issue Paper #II concerning the street grade. Brad Lavine, 381 Granite, read issue paper #V which suggested an alternative including three lots with one house per lot and one private drive which would not be maintained by the City. John Sully, 365 Granite, read issue paper #III dealing with slope percentages in the building envelopes, and then read the summation of the appeal. Diane Seitz, Alaska, is the property owner and said her family would like to make their home here, they have agreed to reduce the number of lots from six or seven to five, agreed to a larger setback for lot #5, a 10 ft. easement for irrigation ditch maintenance, and 13.3 acres for open space. She also said none of the building envelopes lie within 100' of Lithia Park. She asked that the project stand as approved by the Planning Commission. Dale Hofer, 735 Glenwood, engineer for the project said the road is 494.92 ft. long, the road grade is 18% for 200 ft., and the building envelope slopes are less than 40%. Acklin moved to extend the public hearing to allow for an intermission to celebrate City Administrator Almquist's' twenty-year tenure with the City of Ashland. Winthrop seconded and the motion carried on voice vote. The public hearing resumed and Virginia cotton, 780 S. Mountain, feels a City street is not necessary. Cynthia Lord, 710 N. Mountairi, expressed concern that the land-use ordinance does not provide sufficient protection from erosion. Diane seitz said the Lithia Park issue was decided when the property was re-zoned in 1984. There being no further comment from the audience, the public hearing was clqsed. Winthrop said the appellants' arguments were appropriately rebutted, the applicants were generous in their concessions, and moved to deny the appeal and adopt the Planning commission's Findings. Williams seconded the motion. Arnold said the project is not compatible with the neighborhood. On a question from Acklin, Public Works Dir. Hall said the Engineering staff does not usually check grades on streets, but Council can so request. Acklin asked that'the grades be checked by the City Engineering Staff and the cost passed on to the developer. Williams agreed with the grade check when grades are close to the 18%, and does not think the project will be detrimental to Lithia Park. Laws feels the decision is close and will uphold the Planning commission decision. The motion passed on roll call vote as follows: Laws, Williams, Acklin and Winthrop, YES; Reid and Arnold, NO. Paradise Lane/Peachey Rd. Proposed Sanitary Sewer L.I.D. - City Admin. Almquist reported that the cost per lot would be $1860, not $2455.20 as originally computed. Public Works Dir. Hall said approval by petition is over 90% and the only lot not signed in favor of the improvements is owned by the Archdiocese of Seattle. On a question from Reid concerning tax lot 800, Hall said owners Wayne & Judy Paulsen, 1590 Peachey, are hooking up to the Walker Avenue sewer. Don Rist, 310 Bridge, spoke for property owner David Barrett who is in favor of the L.I.D. and expressed appreciation to city staff for their efforts. There being no further comment from the audience, the public hearing was closed. The ordinance establishing 'the local improvement district was read and Acklin moved to second reading. Arnold seconded and the motion passed unanimously on roll call vote. UNFINISHED BUSINESS Secure Storaqe Annexation - Approval of Findinqs - After a brief discussion, Laws moved to take the item off the table and continue to the next meeting, and Williams seconded. Bob Sullivan, 525 Sheridan st., said the rules were followed throughout the process and asked for reconsideration of the annexation. The motion passed on voice vote with Arnold dissenting. Historic Siqn Inventory Review - Councilor Reid said Mary & Jim Ragland agree with the inventory. Susan Reynolds, Ashland Historic Commission, said exemptions should be allowed for architectural and historical significance, owners should bear the burden of proof, and item B(3) concerning association with an important event, person, etc. should be included. George Kramer, 386 N. Laurel, agreed with Reynolds and said the inventory was intended as a guideline. Georgia Carter is in the sign business and agrees with Kramer. Terry Skibby, 611 Beach, also said the burden of proof should be on the applicant, item B(3) should be included, and the 40-years of age condition should be flexible. Richard Ernst, 975 Walker, is against neon signs. Michael Yondorf, 275 Grandview Dr., co-owner of Omar's Restaurant, said Omar's is the oldest eating establishment .in Ashland and he would like to keep the signs, even though the restaurant is being remodeled. John Schweiger, owner of Varsity Theater, said he wants to restore the building to its 1937 appearance, item B(3) should remain, and sign restoration is very costly. Reid moved to adopt the Historic Sign Ordinance, including item B(3), adding a condition that the owner;bear the burden of proof, and the 40 years used as a guideline. Williams seconded. Winthrop recommended adding a new item C(5) to place the burden of proof on the owner. Laws wants 40 years to remain firm, and agrees with Arnold on item B(3). Williams feels the 40 years should be used as"a guideline. The amendments to section 18.96.160 were read and the motion passed as follows on roll call vote: Laws, Acklin and Arnold, NO; Reid, Williams, and Winthrop, YES. Mayor Golden broke the tie with a YES vote. NEW & MISCELLANEOUS BUSINESS Council Liaison Assiqnments - Williams reviewed his memo requesting rotation of Council liaison assignments every two years to offer new perspectives to both the committees and the Councilors. Acklin said rotating the Hospital Board assignment may be a disservice to ~hem because of the time necessary to learn their operations. Reid feels Williams suggestion is good, as does Winthrop. No further action taken. Arnold moved to extend the meeting, Winthrop seconded, all AYES on voice vote. Endorse Application - Reqiorial strateqies Funds - Carole Wheeldon, Chair of the ad hoc Transportation Committee, asked that Council endorse the application for funds for a shuttle bus between Ashland and Jacksonville, and Ashland and Emigrant Lake. Winthrop said the double-decker bus is not the right approach, and efforts should be centered on facilitating transportation in Ashland. Carl Oates, 351 Granite, said the proposal is to buy 4 double-decker buses at $22,000/per bus, and the application is for $210,000 to serve two summers only. Reid said there are ways to encourage people to ride regular R.V.T.D. buses and she cannot support the double-decker. Ed Chapman, R.V.T.D. Board Member, asked for Council support of the request. Acklin said a letter could be written concerning the need for transportation facilitation, but not necessary in support of the double-decker bus, and Laws said the application has to be specific. Arnold moved to continue the meeting, Acklin seconded, all AYES on voice vote. Jim sims, 269 B Street, spoke in favor and suggested a pilot project for a couple of summers. Bill White, a member of the Committee, spoke in support. Councilor Laws, staff liaison to the Committee, said the buses would attract riders including younger people, move large numbers of people while helping with the traffic and air pollution concerns. Williams moved to endorse the recommendation and Laws seconded. Arnold said aesthetics are important in Ashland, and expressed appreciation for the Committee's efforts, as did Winthrop and Acklin earlier in the discussion. The motion failed as follows on roll call vote: Laws and Williams, YES; Reid, ACklin, Winthrop, and Arnold, NO. Regular Meeting - Ashland City Council - September 4, 1990 - P. 4 T.S.C. Recommendations Re: Downtown parkina District - This item was postponed until October 2, 1990. Williams requested that Councilors receive a map of the District. ORDINANCES, RESOLUTIONS & CONTRACTS Air Qualitv Opacity standards - A Resolution was read calling a special election for November 6, 1990 concerning an ordinance establishing opacity standards for woodstoves and residential fuel burning devices. Reid moved to adopt same, Williams seconded and the motion passed unanimously on roll call vote. (Reso.90-44) L.I.D. Nos. 62 & 63 - A Resolution was read directing that notices of proposed assessments be sent to the owners of property in said districts and setting a public hearing to consider objections for September 11 at 7:30 P.M. in the Hunter Park Building. Arnold moved to adopt same, Reid seconded, all YES on roll call vote. (Reso. 90- 45) Historic sian Ordinance Amendments - An Ordinance was read amending the Historic Sign Ordinance. Reid moved to second reading and Williams seconded. It was after 12:00 Midnight and Laws, Acklin, Winthrop, and Arnold refused to vote. OTHER BUSINESS FROM COUNCIL MEMBERS - None. ADJOURNMENT The meeting adjourned 12:04 P.M. and the Council heard from Butch Foster who asked that the streets be closed for Halloween this year. Laws, Reid, Williams, and Acklin were present. Winthrop and Arnold were absent. Historic Sign Ordinance: Section 18.96.60(B) of the Sign Ordinance was read as amended; as was section F and the remainder of the Ordinance. Williams moved to second reading qnd Reid seconded the motion which passed unanimously on roll call vote. Fire Break Easement: City Administrator Almquist asked that this item be put on the agenda and Reid so moved. Williams seconded and the motion carried on voice vote. Almquist explained that the County is requiring the property owner to obtain the easement prior to adding on to his home near the Allen Alsing Reservoir. Reid moved to grant the easement, Acklin seconded and the motion carried on voice vote. Letter to U.S. Bureau of the Census: Planning Director Fregonese expla~ned that a letter was sent to the Bureau regarding the discrepancies in the results from the census and what City records show the population should be. L.I.D.'s 62 & 63: Almquist explained that the improvements in L.I.D. No. 62 have been completed and are being assessed to the benefitted property owners. Those in L,.I.D. No. 63 are still under construction and being pre-assessed, and it is hoped that a bond sale can be completed prior to the November ballot in light' of the provisions of Measure 5 which would disallow bancrofting. He said notices were mailed to property owners and the deadline for letters of protest was September 10th at 12:00 noon. L.I.D. No. 62 Mistletoe Road - No protest received. Alley - Lincoln to Garfield - Dr. James Roth, owner of property at 190 Lincoln, protested that A.J. Bills should pay the whole alley assessment and the other property owners should pay nothing. Bernie Zieminski, 615 Taylor, also feels he should not be assessed and Bills should have paved the alley before his apartment units were occupied. Acklin said the assessments are equitable and moved to go forward with the assessments for the alley. Reid seconded the motion, which passed unanimously on roll call vote. sunnyview Drive - Protest letter received from Jad DIAllura, 391 Grandview. This assessment was reduced to 50% on Sunnyview, ashe has already paid 100% for the assessment on Grandview Drive. He feels that he should not be assessed for more than the half-street (191 wide) rather than 181. On a question from Williams, Almquist sa,id, should an adjustment be necessary the City would absorb it. Orchard street - A protest letter was received from Morris & Patricia Jones, 318 Wrights Creek Drive. Mr. Jones was present and Director of Finance Jill Turner explained that his assessment was reduced by 50% for Orchard street, due to his 100% assessment for paving Wrights Creek Drive. Ken Newfield, 460 Orchard st., filed a letter of protest because he was assessed 104.35 ft. for a flag lot with a width of 20 ft. Acklin said she believes the benefit to him is beyond the 20 ft. and many flag lots are developed with abutting property owners subsidizing paving. Golden left at 8:25 P.M. Williams and Laws agreed this is the best solution and is fair to all owners in the L.I.D. Waqidi Falicoff, 585 Orchard st., filed a letter of protest after the deadline. He protested assessments made around the curve on on a corner lot and was told if an adjustment was necessary, it would be made. Williams moved to approve the assessments and ask Staff to look into the corner lot curve issue. Laws seconded, all YES on roll call vote. L.I.D. No. 63 Ashland Mine Road - Letter received from Leanne & Douglas Heydon, 1230 Ashland Mine Rd., regarding prior 100% assessment on Cedar Way. Staff recommends reducing present assessment by 50%. This action was also taken for tax lot 5BA 1301, owned by James Goulston. Bill Teston, 279 W. Hersey st., wrote a letter of protest. City Admin. Almquist will respond and answer questions posed. Ethel Helms, 125 Hersey st., wrote concerning the condition of her driveway, which will be repaired. Captain Barnard is now heading up the Investigative Division. Officer investigated a charge of non-delivery of merchandise of paid goods. A local business filed bankruptcy and customers are out over $50,000. The District Attorney's Office has determined that the losses are a Civil Matter. Detectives were reassigned a case from patrol where $200-300 was taken from a woman's purse visiting a nursing home. The case is currently under investigation. ~A~ROL On August 5th the Revenge of the Siskiyou's bicycle race was held with approximately 400 participants. The park was full with spectators and participants, but no problems were encountered. . On August 16, Republican Candidate for State Representativ~, Jerry Barnes participated in the Ride-Along program by riding with a patrol officer. A large number of forgery cases were cleared w~th the arrest of a male subject who confessed to stealing the checks. A stolen car case was cleared and 6 warrants served on one individual. A patrolman suffered minor abrasions in the arrest of an intoxicated 20 year old male. The suspect was charged with Theft II, harassment, and resisting arrest. CRIME PREVENTION Crime Prevention Officer Bianca reports the end of a quiet summer season. He feels there are less drifters or homeless persons than last year in the City. POLICE RESERVE The Reserve program put in 275 hours for the month of August; 220 hours patrol, 6.5 hours in meetings, 5.5 hours in special assignment, and 43 hours in training. They held their monthly meeting on August 18th. EXPLORERS COMMUNITY SERVICE VOLUNTEERS Hours contributed during August totaled 1217 with 54+ active volunteers. MUNICIPAL COURT There were 1013 citations filed in the Municipal Court, which includes 333 traffic violations, 24 formal complaints, and 956 parking citations. Cases closed totaled 958 which includes 82 traffic violations, 30 formal complaints, 27 fines suspended, 126 citations dismissed (including 2 completed diversions). There were 686 parking citations closed, 522 of these were issued in the Downtown Parking District. No parking citations were dismissed. There were 269 appearances, 118 before the Violations Bureau and 94 before the Court. There were 13 trials held, and 0 no show; 100 persons were placed on diversion and 26 placed on probation. COMMUNICATIONS/RECORDS Communjcations/Records personnel handled 681 Police cases and dispatched 101 fire/medical runs. Two dispatcher completed their probationary periods. The dispatcher center was painted, a new map was installed for r~ferencing as well as a new bookcase. Proposed Vacation of an <<nopened Section of Hillview Drive oO"U Jee!; A petition has recently been presented by Mr. Jimmie Hald, 1800 Crestview Drive for the vacation of an unopened section of Hillview Drive lying south of crestview Drive. The street was dedicated as a half width street 'on the plat of the Norwood Subdivision in 1961. Kensington Subdivision, dedicated in 1965 and located adjacent and westerly of the Norwood Subdivision did not provide any additional right of way for that section of Hillview Drive and, in fact, set that area apart as a private drive which was later acquired by Leslie and Peggy George. The street right of way is extremely steep (25%~) and would require a very deep cut at Crestview Drive for use as a street. The right of way is less than 200 feet long and terminates at the T.I.D. irrigation canal. Can you' foresee any reason why the City might oppose this proposed vacation? Will it be necessary to retain any easements for 'utilities,' etc., if the right of way were to be vacated? PETITION SUMMARY A petition was received on August 28, 1990, containing 21 signatures and representing 14 lots, requesting vacation of a portion of Hillview Drive. As required by ORS Section 271.080, 100% of those abutting the right of way to vacate have signed the petition. The "affected area", defined as that area being 200 feet from each side line and 400 feet beyond each end of the proposed vacation, contains 7.813 acres. Salter, City Attorney SUBJECT: Noise Regulation Ordinance Ladies and Gentlemen: The Ashland Municipal Judge on August 15, 1990, found the unnecessary noise ordinance to be unconstitutionally vague. The Judge did concede that it has been in effect since 1968 and that he has enforced it numerous times. However, based upon the argument of defense counsel he did as I indicated, hold it to be unconstitutionally vague. The problem was that the ordinance prohibited loud, disturbing and unnecessary noises but it did not set a standard by which to measure such noises. Accordingly, delivered herewith is an amendment to the Code which makes the . standard the average reasonable person of ordinary sensibility. BACKGROUND The Traffic Safety Commission (TSC) has received numerous requests for special parking zones over the last several years, particularly in the Downtown Parking District. After a review of many requests, the TSC felt it..would be wise to review the entire Downtown Parking District as it exists and then. review that in a public forum. The Engineering Division prepared an "as built" drawing of existing parking in the Downtown Parking Zone. TSC meetings were publicized in the local papers and participation was not on the "packed house" side, but spirited debate evolved during the discussion of options. After the discussions, the TSC came to the following conclusions: + The existing 2 hour parking (8:30am to 5:30pm except Sundays and holidays) works the best for the needs of downtown Ashland. + Loading zones were generally located for specific businesses and not necessarily ease of use by trucks and delivery vans. + There was need for 15 minute zones, generally one per block to assist the "drop in" customers. - - . !~JJ:'~i_:~~ ' '. ~' . :i " .~., ..... i :.: .. Downtown Parking Recommendations - TSC August 30, 1990 Page Two + The commercial bus parking for Shakespeare buses on Pioneer was causing a hazard with the vehicle parking, street width and sight distances at the corner of East Main Street and pioneer adjacent to the Black Swan Theater. + There was a need for additional handicap parking in the downtown area. + There are some specialty parking zones which are not used because of a change of business. + There are some parking zones which do not match city ordinances. + There are some parking zones for which I can find no record of how they were established. After a thorough review, the TSC wishes to make the following recommendations. The overall changes to the Downtown Parking District are minimal in the proposal. The specific changes include: + add eleven and delete one 15 minute zone + add four handicap zones + change all four-hour zones to two-hour zones + remove two commercial bus zones on Pioneer between East Main and Hargadine + transfer four parking stalls on pioneer south of East Main from west side to east side +. add one commercial bus zone on Lithia Way adjacent to the new pioneer Parking Lot (Hours n06n to midnight 2/28 to 11/1) + add one commercial bus zone adjacent to 149 and 151 Pioneer Street (Hours 5:30pm to midnight 2/28 to 11/1) + move several existing loading zones so that at least one end abuts an open or non-parking area for easier access + add one loading zone on northeast corner of First and Hargadine + remove two loading zones, northeast corner Pioneer and Hargadine, southwest corner East Main and First next to Mark Antony Hotel Downtown Parking Recommendations - TSC August 30, 1990 Page Three On May 24, 1990 the TSC held a special meeting which was publicized in the local newspapers to finalize the recommendations. A copy of the minutes of that meeting are attached for your reference. A staff recommendation is to change the limits to a "Traffic Regulation" as attached to this memo. Chapter 11.12.020 of the Municipal Code allows the City Administrator to approve parking and traffic control. After discussing the issue with Brian Almquist, and with his approval, I am recommending that the City Council approve the Ordinance. The City Administrator can th~n sign the attached "Traffic Regulation". This will allow administrative traffic and parking control decisions to made with the recommendation of the Traffic Safety Commission when . required. The location and time of operation of traffic con- trol signals: 3. Bus stops, bus stands, taxicab stands, any other passenger common carrier vehicle stands; 4. The location of passenger loading zones for use in connection with a hotel, auditorium, theater, church, school, or public building; 5. Loading zones for commercial purposes; 6. Intersections or areas where drivers of vehicles shall not make right, left, or u-turns, and the time when the prohibition applies: 7. Crosswalks, safety zones, parking spaces, traffic lanes, and other symbols: 8. Traffic control signs: and 9. All other signs, signals, markings, and devices re- quired to implement traffic and parking controls enacted by the Councilor required by State law or regulation. C. Pursuant to subsection A of this Section, the City Administrator may provide for temporary, experimental, or emer- gency traffic regulation that shall not remain in effect for more than thirty (30) days. No temporary, experimental or emer- gency regulation is effective until adequate traffic signs, sig- nals, markings, or other devices are erected, clearly indicating the regulation. ACTION REQUESTED Review staff proposal and direct staff to draft an ordinance to amend Chapter 11.28 of the Ashland Municipal Code relating to the Downtown. Parking District (Chapter 11.30). Note: Ordinance will be returned to the Traffic Safety Commission for final approval and recommendation to the City Council at a June meeting (1 'hope!l??). BACKGROUND The Traffic Safety Commission has received several requests for "special" parking zones in the downtown area. . Direction was given to staff to inventory the downtown parking and return to the TSC for discussion of potential alternatives. The study area is limited to the "Downtown Parking District" as specified in Chapter 11.30 of the Ashland Municipal Code. At the March 1990 TSC staff presented a map of existing parking in the downtown area and.requests from the Handicap Access Subcommittee. The meeting was publicized by the Ashland Daily Tidings in the community calendar. Minutes of that meeting are attached. A brief summary of the directions of TSC from that meeting include the following: .~- . + Handicap Access Subcommittee requested handicap parking at: * Both sides of SW crosswalk on Plaza (1 exists) * NE corner of Oak and E. All existing loading zones should be located adjacent to a no parking area or intersection to provide easier access for delivery vans. I have attempted to "scatter" 15 minute zones at one per block on E. Main and on Oak. I also investigated the potential need for 15-minute parking zones on Pioneer, First, Second and Third between E. Main and Lithia Way. Particular attention was given to Benjamin Franklin Savings and Loan which has no off-street parking and has requested 15-minute parking . zones. They are the only bank in the downtown area without off-street parking. I have no reco~mendations for the Plaza area other than the additional handicap zone at the southerly crosswalk and a request from the city J~nitor. with proposed revisions to the Plaza in the Downtown Plan, that issue should be reviewed when final plans are available. At the Barrier Awareness Day, .1 spoke with Larry Hyland and he noted that the proposed handicap stall adjacent to the alley behind City Hall was not practical. That is not proposed as a handicap zone by staff. I also question the useability of two handicap stalls on First above' E. Main. One exists and I assume it is difficult to use because of /the steep grade of First. To provide two stalls as requested, one regular stall would hav~ to be eliminated and a ra~p cut into the curb to allow wheelchair access to the sidewalk. with the grade of First, this seems rather unworkable although Larry Highland might have some comments. Main, I do not recommend a handicap stall. There is also a handicap ramp at the west side of the Water street parking ~~t with a ramp across th~ curb to the riewly paved area under the Water street bridge. The bus parking on N. pioneer for OSF poses several problems with no ~asy solutions. N. pioneer is 32 feet wide, curb to curb. with parking on both. sides near E. Main, there is only 16 to 17 feet available for 2' lanes of 'traffic. A traffic lane in this situation should be at least 10 to 11 feet wide. There are three options. Eliminate the 4 parking spaces on the west side, remove the bus parking across the street from the west side parking or eliminate all bus parking. The Commission is considering removing all bus parking during daylight performances and representatives of the OSF will ,be presen~ to give their point of view. PARKING STUDY Phil referenced Hall's memo reviewing the entire staff recommendation and asked the Commissioners and the audience) to only bring up the items that they had concerns with. They were: 1. Shakespeare buses on pioneer (Paul Nicholson). 2. Substandard parking in front.of Mark Antony (Sims). 3. Possible added parking space across from Greyhound bus terminal (Sims) . 4. Add another loading space in front of Varsity Theatre (John Schweiger) . 5. Entrance to Shakespeare Parking Lot on Hargadine -- Vision Clearance problem (Nicholson). 6~. Businesses on Oak ,Street between B & C (Letter to Staff). 7. First parking space on pioneer across from bus parking. Varsity Request - Phil psked the Commission if the extra space should be granted in front of the Varsity Theatre and. they unanimously agreed that it should. Shak~speare Buses - Hall noted that the width of Pioneeri~ 32' curb to curb. standard lane width is at least 10' and when buses and cars were parked 9P the street, it left only 8'. Armitage asked Paul how many buses' were we talking about and he responded about five.. ,They talked about the possibility of eliminating the first two bus parking spaces. Paul noted that an attempt was made about 10 years ago to alleviate the bus parking problem with no solution. , He mentioned the danger of the corner of E~ Main and pioneer when turning the corner and thought one of the auto parking spaces at the end could be removed. He apologized for not having any solid recommendations. Phil asked where the buses go when there are more than five and Paul said anywhere they can (usually on E'. Main). Paul said there were as many buses during the day as there were at night. Armitage asked if making Hargadine one way in order to accommodate bus parking was ever discussed. Hall said would be too limiting. Paul noted that originally, Shikespeare wanted to park their buses on Hargadine and were going to make bays at the entrance of the parking lot. Armitage asked which parking served more people... the bus or auto parking on pioneer? Four auto spaces served four people whereas two bus spaces served many more people. Paul felt his patrons used the limited parking spaces to get tickets and information and did not think it a good idea to take those away totally. Schweiger endorsed (from a business owner's standpoint) to alleviate at least the first auto parking space. Armitage felt removing only one space would create a bottleneck problem for~eople turning onto pioneer from E. Main. Sims said he felt strongly about keeping the auto parking on one side of pioneer and could eliminate the bottle neck problem by removing the bus parking on the lower part. Bus parking on the flat of 11argadine seemed a safer solution than on a hill. Paul noted there were 213' available for bus parking on pioneer (5 buses) and 230' available on Hargadine (which could accommodate six buses). Phil noted it would take at least 3 years to construct and felt we needed to make an immediate change while planning ahead. Sims felt Shakespeare needed to come back with firm recommendation. Phil preferred to" pass al plan now even if we need to modify it at the next meeting. Sims recommehded removing the bus parking within 2 years time. Walt thought that was a good idea and Armitage thought it gave leeway to change in a year, if necessary. Paul said he would rather not put parking on Hargadine. Sims recommended to remove the lower two bus parking.spaces and create a two year program to remove all bus parking on Pioneer. Arm'itage asked;if we took two buses out, would we make those spaces auto parking? all noted that would only allow 20' for travel lanes (about 16') so probably not. After much deliberation, Phil asked for a motion. Armitage moved to remove the first two bus parking spaces, eliminate all auto parking on west side and move it to east (bus parking) side. Walt seconded and the motion carried with Ken and Sims opposing. Walt suggested that the Commission instruct staff to work with the festival to find alternative parking for the buses, possibly on Hargadine, and all agreed. Parkinq Space on Oak -.Sims moved that staff look at parking spaces on Oak acro$s from Greyhound Bus Terminal and see if one can be added making all standard two hour spaces, and Walt seconded. The motion carried unanimously on voice vote. Request from Businesses on Oak Street between B & C Streets - Ken moved to deny the request and leave as is and Sims seconded. The motion carried unanimously on voice vote. Overall Parking Plan - Sims moved to approve the overall downtown parking plan as amended and Walt seconded. BACKGROUND At the review of the appeal of the Seitz proposed subdivision on Granite Street (PA 90-057), staff was directed to. field verify the final "as staked" grades in the 18% section of the proposed street prior to final grading/paving and charge city costs to the applicant. City Council noted that it may wish to establish a policy for street grade verification where they approach maximum allowable limits. Ron Salter will have to respond as to the legality of charging the owner for city cost in verifying the street grades. In some instances, grade verification may involve three survey lines, each curb line and centerline if the street is on a curve or has a non-symmetrical cross section.
