HEARINGS BOARD
MINUTES
DECEMBER 8, 1992
CALL TO ORDER
The meeting was called to order by Brent Thompson at 1:35 p.m. Cloer was also
present. Staff present were McLaughlin, Molnar and Yates.
APPROVAL OF MINUTES
The Minutes of the November 10, 1992 Hearings Board were approved.
TYPE II PUBLIC HEARINGS
PLANNING ACTION 92-130
REQUEST FOR A MINOR LAND PARTITION TO DIVIDE A PARCEL INTO THREE
LOTS LOCATED AT 1000 WALKER AVENUE. PARCEL 3 TO ACCESS BY A FLAG
DRIVE FROM PEACHEY ROAD.
APPLICANT: TOM COX

Thompson was interested in seeing in whether a pedestrian walkway could extend
?
from Peachey to Ross Lane. He noticed the grade was steep off Peachey and there
were berry bushes through that area and it did not seem that a trail or path was feasible
through Lot 700 but would be better along the boundary between Lots 500 and 600.
Cloer agreed.

No one came forth to speak.
COMMISSIONERS DISCUSSION AND MOTION
Cloer asked whether development standards had been written for conservation
easements. McLaughlin explained that there was a designation for a riparian area that
prohibits permanent structures from being located there and prevents culverting and
filling. Roca Canyon was mentioned as an example of a conservation easement.
Cloer moved to approve PA 92-130 and Thompson seconded the motion.
PLANNING ACTION 92-131
REQUEST FOR A MINOR LAND PARTITION TO DIVIDE A PARCEL INTO THREE
LOTS LOCATED AT 1050 PARADISE LANE.

Thompson drove by it and noticed it was gently sloping.

STAFF REPORT
This area is part of the Peachey/Paradise annexation that was completed in 1990. This
was part of a larger partition in August of 1990. The application follows what was
proposed as a master plan earlier. It has been designed to use only one flag drive with
all lots at least one-half acre in size or larger. The application was approved by Staff
as a Type I and it was called up for a public hearing by Larry Katz. There was a
concern that a county resident was requesting a hearing on a City land use matter and
since the City Attorney did not have an opportunity to review this thoroughly, the safest
way was to hold the public hearing. Katz is requesting the paving of Paradise Lane.
The criteria for approval does not require paving as part of the approval, however, the
Commission could require it but would generally not require paving until the street
reaches a certain level of development. There are enough signatures now to require
paving.
PUBLIC HEARING
DON RIST, speaking for Barrett, said one condition of annexation was that the owner
sign in favor of future improvements which Barrett has done. Rist has talked with the
City Engineer and he did not feel the City was in a position to pave Peachey or
Paradise at this time. They intend to do it in the future, but not at this time. Rist
thought Paradise and Peachey should be improved simultaneously.
BARRETT thought that Paradise could be widened a little more with a little more
granite on the lower end of it.
RIST reminded the Board that at the time the annexation occurred, a petition was
signed by the neighbors from the Garden Way and Harmony Lane area, requesting the
City not pave Ross Lane, Peachey or Paradise at that time.

LANE CASEBEER, 1654 Peachey Road, stated that he is happy with the oil and gravel
road and does not wish to see the road paved at this time. He agrees with Barrett and
would need to see more development there first with the expense of paving spread out
between more land owners.
BOB MCGUIRE, representing Mr. and Mrs. Catsontonis (reservation holders on lots in
that area) would prefer to see the area developed and then paved at a later date.
TOM COX, owner of parcel 700, does not favor paving. Cox said there is whole line of
Oak trees on Peachey that would probably be in the right-of-way and he hoped that
would be taken into consideration.
OARUS MCGEE, 393 Courtney Street, owns property on Peachey and is not in favor of
paving Peachey. He felt it was a poor idea to keep burdening property owners.
LARRY KATZ, 1106 Paradise Lane, favors the partition, however, he believes there are
things that are not being addressed. He said it was correct that in the beginning the
neighbors did not want paving, but because the whole area is now becoming
developed, it is not safe for him to drive up Paradise Lane because of the muddy road.
He believes now is the time to pave and just wanted to bring this to the attention of the
City. He indicated that the County owns the road, but the City makes the decision on
what to do, but that the County would put up half the money for paving.
Thompson thinks it would be a good time for a neighborhood meeting to discuss what
to do at this time instead of paving. He said they could form a local improvement
district based upon the previously collected signatures.
TONY SMITH, 1725 Bristol, felt it was best to get the lots developed prior to bringing in
streets.
NICK VIONI, 1010 Paradise Lane, is building now. He believes some consideration
should be given to maintaining the road. He favors the partition, but not paving just yet.
RIST mentioned that Vioni's is the only building that has gone on in the last two years.
COMMISSIONERS DISCUSSION AND MOTION
Thompson again suggested that neighbors get together and talk about neighborhood
concerns.
Cloer moved to approve PA 92-131 with the attached 12 conditions. Thompson

TYPE I PLANNING ACTIONS
PLANNING ACTION 92-138
REQUEST FOR A CONDITIONAL USE PERMIT FOR A FIVE-UNIT (INCLUDING
OWNER'S UNIT) TRAVELER'S ACCOMMODATION LOCATED AT 111 THIRD
STREET (EXISTING PROFESSIONAL OFFICES). NO EXTERIOR CHANGES ARE
PROPOSED AS PART OF THIS APPLICATION.

PLANNING ACTION 92-140
REQUEST FOR A CONDITIONAL USE PERMIT TO MODIFY AN EXISTING NON-
CONFORMING STRUCTURE AT 662 B STREET. MODIFICATION INVOLVES
MOVING THE DWELLING UNIT LOCATED IN THE STRUCTURE ALONG THE
ALLEY INTO THE MAIN STRUCTURE, AND PROVIDING ADDITIONAL PARKING
OFF THE ALLEY. NO INCREASE IN THE NUMBER OF UNITS IS PROPOSED.
ADDITIONAL PARKING IS PROPOSED.

PLANNING ACTION 92-141
REQUEST FOR A REVIEW OF A CONDITIONAL USE PERMIT FOR A TEMPORARY
USE TO ALLOW FOR THE OPERATION OF A GROWER'S MARKET FROM APRIL
THROUGH NOVEMBER. USE TO INCLUDE THE AREA UNDER THE VIADUCT ON
WATER STREET AND THE PARKING SPACES IN THE ADJACENT LOT
APPROVED FOR USE BY THE CITY COUNCIL, AND THE PARKING SPACES ON
THE WEST SIDE OF WATER STREET BETWEEN NORTH MAIN STREET AND THE
ENTRANCE TO BLUEBIRD PARK.
