Study Session Relating to the Distribution of Transient Occupancy Tax Revenue

Question:
How does Council wish to distribute Transient Occupancy Tax (TOT) revenue generated by the
existing 7% tax and the additional 2% tax, for FY 2009-2010 and after?
Staff Recommendation:
Staff recommends council use the revised draft resolution and supporting documents to establish the
allocation of tourism and non-tourism portions of the TOT revenue for ensuing years.
At the June 17 and 30. 2008. meetings Council did not conclude deliberations and adoption of this
resolution. The tables in the resolution have been revised to better represent Council's direction from
the April 15th meeting and the corrections and wording changes discussed on June 30. 2008.
Background:
After meetings and public input at the April 15 meeting, Council chose to hold a public hearing about
raising the TOT tax and identified by motion the following allocation of tourism dollars if
implemented: VCB grant $225,000, OSF grant $120,000, Small tourism grants $109,000, City
projects including Public Art at $15,000 and Other of $53,000.
Council voted to raise the tax from 7% to 9% on June 3. The increase became effective October 1,
2008. Changing the implementation date significantly reduced the amount to be received in FY 2009
which impacted the amounts available for allocation in the first year. During the June 17 meeting
Council approved the FY 2008-2009 distribution by dollar amount. See Attachment #2 TOT
Comparison Table.
Staff proposed that Council adopt a resolution for future allocations that addresses how growth or
drops in the amount of revenue the City receives affects granted amounts. The current resolution had
unintended impacts with a drop in projected revenue in FY 2009, because it diminished the amount
available for small grant applicants.
Staffprepared a draft resolution for allocations in FY 2009-2010. The resolution included a table of
percentages for grant allocations based upon updated projections for tax revenue changes and a table
with minimum amounts and priorities for non-tourism activities to protect General Fund services.
Staff rounded the percentages, and so the percentages in the resolution did not match the percentages
in the April 15, 2008 City Council motion.
At the June 30 meeting Council corrected the percentage distributions in the resolution to more
accurately reflect their April 15 decision. Council did not finish deliberations on the resolution to
allocate monies for FY 2009-2010 and beyond.

During the June 17 discussion, some Council members wanted to address the granting methodology
(disparity) between Large recipients (Chamber and OSF) and Small grantees (all those who must apply
annually). One suggestion was to create a Middle group that would include identified small applicants
that have grown sufficiently to be capable of using tourism restricted dollars from the higher tax in a
manner consistent with State requirements and could also sufficiently document those uses.
Staff has corrected the resolution per the June 30 Council discussion.
Staff requests that Council decide how to best address the allocation in percentages in the coming years
but still protect the funding level for programs in the General Fund, which include core government
servIces.

The table compares the April 15 dollars and percentages to those amounts allocated for FY 2008-2009
and the amounts submitted by staff and corrected by Council for subsequent years. A blank column is
provided for Council ease of use.
A draft resolution is attached. Several Council members indicated that some wording improvements
still need to be discussed. Additionally, Council Member ~hapman's simplified table (see Attachment

The two tables mentioned above have been revised and provided in the draft resolution displaying:

Staff is looking for direction in the following two areas:
1. How to revise the tourism allocation to ensure compliance with State spending
requirements. This is where Council could identify an intermediate or Middle group of
grantees and the percentage or dollar amount to go there.. Council could also consider
"banking" the monies if concern remained about grantees' abilities to employ the funds.
2. What targets or minimums (if any) are to be included in the resolution for core
government services that are not tourism related. These include ongoing General Fund
services, specific programs relating to economic development, strategic planning or
other priority projects identified by Council.
If no amounts are identified in #2 the allocation would default to the General Fund, governmental
services or as decided upon annually by Councilor in the annual budget process.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ASHLAND REITERATING ITS POLICY RELATING TO THE
EXPENDITURE OF MONIES FOR ECONOMIC AND CULTURAL
DEVELOPMENT TO THE HOTEL/MOTEL (Transient
Occupancy) TAX AND REPEALING RESOLUTION 2007-08.
THE CITY OF ASHLAND RESOLVES AS FOllOWS:
SECTION 1. That the City Council recognizes that the source of monies for the
Economic and Cultural Development Grant program is the Hotel/Motel Tax.
SECTION 2.
The following are the goals which the Budget Committee is attempting to meet by
granting money to applicants for:
a) Tourism Promotion:
1. Attract someone who travels to Ashland from more than 50 miles away to attend
an event.
2. Attract someone who stays the night in Ashland to attend an event.
b) Economic Development:
1. Promote increased number, variety and size of employers.
.2. Encourage wages at or above median wage.
3. Promote businesses that employ 5 to 100 people or is locally owned.
4. Encourage use of local resources.
5. Work with Southern Oregon University, especially for international commerce.
6. Encourage businesses that efficiently use water and minimize their impact on the
environment such as water and air pollution or creation of toxic waste.
c) Cultural Development:
1. Increase the number, variety and size of cultural opportunities in Ashland
2. Support diversification of the local economy
3. Showcases local talent
4. Work with Southern Oregon University on cultural programs
SECTION 3.
The City of Ashland has determined that as of July 1,2003, $186,657 or 14.230/0 of
total Hotel/Motel tax revenues were expended on tourism promotion, as defined in
Chapter 818 of the 2003 Oregon laws, and will continue to be spent on tourism
promotion increased or decreased annually consistent with the estimated TOT,
revenues budgeted. Additionally, Chapter 818 requires 700/0 of any increased TOT
revenue generated by a higher tax rate is committed to tourism promotion.
The minimum amount to be spent on tourism in FY 2008-2009 is estimated at $392,000
($217,000 from the original tax and $175,000 from the increase that is effective on

October 1, 2008). The proposed allocation for FY 2008-2009 when the additional tax is
in effect for only part of the year) is per the attached table. If sufficient TOT proceeds
are generated to meet the top three priorities
Beginning in Fiscal Year 2009-2010, the City Council will appropriate:
1. A minimum of 14.230/0 of the estimated TOT revenue to be generated by the first
70/0 tax rate for tourism promotion per Chapter 818,
2. A minimum of 700/0 of the estimated TOT revenue to be generated by additional
tax rates approved by Council on June 3, 2008 for tourism promotion per
Chapter 818.

Economic Development programs or other projects are City activities unless otherwise
specified by Council prior to the budget process. Council may determine that such
funds are available for Economic granting purposes and they will then be made
available for the coming budget process and allocation.
If insufficient TOT revenues are generated for the above allocations, the highest priority
uses will receive their full allocation before a lower priority allocation.
By January 31 of each year each recipient of a grant greater than $2,500 for non-
tourism programs or any amount specifically intended for tourism per this resolution
shall submit a report to the city council setting forth how the grant funds received were
expended in furtherance of the goals set forth in Section 2. Grant recipients of $2,500
or less for non-tourism programs are required to report its use only when requesting
additional money in a subsequent year.
SECTION 4. The following guidelines and criteria are established for the Economic and

Cultural Development Grants:
a) Grantee shall be a 501 (c) non-profit agency.
b) Grantee shall be a non-governmental agency.
c) Grantee shall promote livability for the citizens of Ashland.
d) The minimum grant proposal will be $2,500.
e) The grant will benefit Ashland in regards to enrichment and activities of an
economic nature.
f) Grantee shall serve the population in Ashland but may encompass other venues in
the Rogue Valley. Monies granted are intended to be used for programs or
services performed or provided within the City of Ashland or immediate areas.
SECTION 5. Resolution 2007-08 is repealed upon passage of this resolution.
SECTION 6. This resolution was duly PASSED and ADOPTED this , day

Staff Recommendation:
Staff recommends that Council review the draft Transportation System Plan and provide feedback and
details of suggested changes to the plan.
Background:
In October 2007 the City contracted with HDR Engineering, Inc. to provide an update to the City's
existing Transportation System Plan, to update short and long range transportation improvement plans
and to make recommendations to update the City's Transportation System Development Charges
(SDC).
Previous Related Council Actions:
December 1, 1998
Council approved Ordinance No. 2835 adopting portions of the Transportation System Plan as
prepared by W & H Pacific, Inc. The plan was adopted with the exception of chapters 10, 11
and 12 which related to the financing plan.
June 27,2007
Council adopted the 2007/2008 budget including the capital improvement plan. One element
of the CIP was an update of the City's Transportation System Plan.
October 2,2007
Council approved a contract with HDR Engineering, Inc. for $116,460.00 to update the City's
Transportation System Plan and transportation portion of the Capital Improvements Project list,
including a review of Transportation System Development Charges.
November 5, 2007
Council received a review ofHDR's progress on the TSP update process.
March 8, 2008
Council approved Amendment No. 1 to the HDR contract which added a second phase to the
project to include a review of transit issues. The contract amount was increased by $41,260 to
$158,260.00.

Proi ect Concept
The concept was to review, analyze, and complete an update of several sections of the City's 1998
Transportation System Plan (W &H Pacific, May 1998) and the Transportations Systems Development
Charges (SDC). Ashland's current (1998) Transportation System Plan (TSP) has been the basis for
transportation projects and capital infrastructure improvements for the past nine years, and although
the planning is sound, many of the projects have been completed or due to the City's infill
development, may require further evaluation for continued progress. Updates to the City's
Transportation System Plan include a review of the Existing Conditions and Constraints of the current
Transportation System, development of recommendations and basis for Needed Transportation System
improvements and development of a prioritized 20-year Capital Improvements Project list. With the
updated information, the consultant has provided rationale and revised methodology for updating the
City's Transportation SDC which was completed by staff in July 1999.
This analysis was not intended to be a complete update to the TSP, but focused mainly on updating
projects for street improvements, bicycle routes, pedestrian access, and access to transit with adequate
sidewalks or other pedestrian paths, disabled access points and furnishings such as bus shelters. A
complete TSP update will be scheduled to meet the requirements of the Transportation Planning Rule
and coincide with changes to the Ashland Comprehensive Plan sometime in the near future. The
current Transportation Element (December 17, 1996), Chapter X of the City's Comprehensive Plan,
remains in effect and has not been updated.
Transit Review
In March of this year, HDR's contract was amended to include a transit element to the TSP Update.
Under the approved scope of services agreement, HDR conducted a comprehensive review of the
current public transportation services, operations, ridership, funding sources, and other transit services.
HDR conducted numerous stakeholder interviews and held public open houses to gauge public need
and opinions regarding transit issues.
Presentation
Mr. Evan Dust, Senior Transportation Planner with HDR and Mr. Scott Chapman, Senior Associate
with Nelson/Nygaard will present the results of their research in two separate phases.

Mr. Dust will present the TSP Update as the first phase of the review. He will provide an overview of
the approach used by HDR and its sub-consultants and will review the results in the form ofproject
lists, costs and proposed SDC revisions.
As the second phase of the presentation, Mr. Chapman will address the following topics:
1. Transit goals
2. Alternate service scenarios
3. Funding options
4. Opportunities
5. Long and short term actions
Both Mr. Dust and Mr. Chapman will use a PowerPoint presentation as part of their address. A copy
of the presentation for phase I and phase II is attached.

Related City Policies:
The City's Transportation System Plan (TSP) was completed in 1998. This 20 year plan focused on
deficiencies in the existing transportation system and recommended future capacity improvements
including construction of bike lanes and paths, sidewalks to schools and employment centers and
transit needs. City staff uses the TSP to prioritize and provide general time lines for capacity
improvements to the City's Transportation System.
