III. TYPE I PLANNING ACTIONS PLANNING ACTION: 2007-01399 SUBJECT PROPERTY: 799 Jefferson St. OWNER/APPLICANT: Ashland Property Investors, LLC DESCRIPTION: Request for Site Review approval for a new commercial building located at 799 Jefferson St., comprised office, light manufacturing and warehouse uses. The proposed building is approximately 18,544 square feet in size. COMPREHENSIVE PLAN DESIGNATION: Employment , ZONING: E-1; ASSESSOR’S MAP #: 39 1E 14A; TAX LOT: 2401 Staff Approval stands 3-0 PLANNING ACTION: 2007-01393 SUBJECT PROPERTY: 700 Mistletoe Rd OWNER/APPLICANT: Ashland Holdings South LLC DESCRIPTION: Request for a Land Partition to create three parcels for the property located at 700 Mistletoe Road. The application also includes a request for Site Review approval to construct a new two-story 10,100 square foot building comprised of office, restaurant, retail and industrial uses. TYPE II PLANNING ACTIONS PLANNING ACTION: 2007-00986 SUBJECT PROPERTY: 625 Holly St. OWNER/APPLICANT: Souren Minasian & Vadim Agakhanov DESCRIPTION: Request for a minor land partition to create two lots, with one lot being a flag lot and for Site Review approval for three residential units in addition to the existing house for the property located at 625 Holly St. The application also includes a request for an Exception to Street Standards to allow curbside sidewalks without parkrows. COMPREHENSIVE PLAN DESIGNATION: Multi-Family Residential ZONING: R-2; ASSESSOR’S MAP #: 39 1E 09DB; TAX LOT: 9100 Morris read opening rules and procedures statement Barry gave staff report , Stromberg clarifieid that minimum density isn’t really an exception, but more of a criteria in the R-2 so no formal exception process is needed Mindlin confimed that solar was met with both the existing north line and the newly created lot line by the partition Stromberg clarified that staff feels the north arrow question is resolved Giordano – worked with his clients on many previous projects and vouched for their success in restoring and rehabilitating houses. Surrounded on three sides by the R-2 zone. Compatability, while largely SFR around it, feels the project is far less than what could occur within general neighborhood (see example to the NW). Can’t meet minimum without much larger scale development that wouldn’t be compatable. Provided example (exhibit A) that shows approximate development pattern with the proposed footprints drawn in. Looking for cottage feel rather than one large complex of units. Stromberg – why two separate parcels Giordano – financial primary issue Mindlin – concern with how close footprint is to creek Giordano – concrete channel so no real top of bank. Concern with neighbors to NE about potential flooding PW will be diverting storm drain water to another storm drain system. Until that happens, storm water will be pumped up to Holly rather than going into the drainage channel to reduce potential for flooding Morris – will channel remain Gior – yes Mindlin – all channel drainage Stromberg – collect on site and pump Morris – tree commission recommendations? Gior – trees not shown because they aren’t required as they are less than 6 inches. Gior – basement wall is also retaining wall and foundation, which requires a small overcut Morris – concrete vault Applicant – old irrigation system leftover Steve Siriani – (558 Holly St) submitted Mitigate tree damage, developer must list all trees and doesn’t feel that was met Dogwoods are pride of neighborhood, buffer to the street Before lot split, mitigate damage per tree commission Compensation plan needed, minimum 3 years Rely on the City to guard property rights Stromberg – how do substantiate that it was always a lot split? Steve – based on price, feels that only a lot split would be feasible. Also, corner of Holly/Harrison was Vadim’s lot split. Rebuttal Upper Limb It – project arborist – base where soil is 8 inches, branches out shortly after soil. At TC applicant will comply with neighbor request. Property line, 2 foot average, towards street a little more than 2, back of property line little less than 2 feet. Applicant and neighbor talked about developing, but pricing of lot is a factor in why it is partition Applicant more than willing to comply with TC recommendations Stromberg – neighbor says more than one tree impacted Gior – only those limited by code – within 15 feet, in general trees can be pruned at dripline Gior – exhibits match? Mindlin – basically the same Mindlin – confusing, Barry – tree protection plan, including trees within 15 feet. Concern is over the trees. Letter of law vs intent, 6 inches at base even though it is an old tree.
