Ingle, Wenner. Absent: None. Counoilmen Applewhite, Hansen and Ingle were sworn in by the Recorder. He stated that the contract had been violated in '3everal instances. Thereupon, the Mayor declared City Ordinance Roo 937 adoptedQ The Talent ITrigation District settlement was brought up b~T the City Attorney and ~~ a resolution r~ad proposing that the City turn over to the Talent Irrigation District 31 acre feet of water in exchange for r ' payment of accrued charges against the City. Moved by Wenner that the \ rules be suspendeCi and the resolution be passed to the second reading by\ title only. Seconded by Bltke. Carried. Having been read the second time' by tttle, it was moved by Wenner that the resolution be adopted as read, ! Seconded by Applewhi te. Roll call was ordered on i t~ admption, the vote i; being. Thereupon, the Mayor declared.the resolution adopf ed. , The election returns being ready to canvas, it was moved by Applewh~ ' that the council resolve itself into a canvasing bm~rd to canvas,the election held Jan. 3, 1935. Seconded by Blake. Carried. The council then proceeded to canvas the votes which were ascertained to be as follows: For the purchase of the Pompadour Mineral Springs---476 Against 'T rT!f Tf !f TT ---134 .A letter from G. IvI. Green suggesting that the city petition the Stat Highway to pave a portion of the highway from the Normal School corner to ,'! the Neil Creek road was read. Moved by Wenner that the Mayor be authorize~ to petition the State Highway to include in their first project, the pav-1 ing above refered to. Seconded by Blake. Carried. A resolution authorizing the Wl8.yor and City Recorder to enter into an escrow agreement with the state Bankinz Department under the nerms of which the purchase of the Pompadour Mineral Springs with full water rights would be guaranteed. Moved by Gregg that the rule. be suspended and the resolution be passed to the second reading by title only. Second~d by Wenner. Carried. After reading the second time, it was moved by Wenner that the resolution be adopted as read. Seconded by Gregg. Carried. Roll call was ordered, the vote being Ayes 6, Nays O. Thereupon the Mayor declared the resolution adopted. _...~ Jan. 4, 1935 no.l The budget for the Light Department was read for the year 1935. 1Ioved by Wenner th~t budget be referred to the Light Com~ittee for study. Seconded by Blake. Carried. The budget for the Water Department was read for the year 1935. Moved by Blake that the budget be referred to the Water Committee for investigation. Seconded by Hanseno Carried. Thelnecessity for transfering $250.00 to the Sewer Bond Redemption Fund to ad jus t an overdraft was brought up. Moved by Wenner tha t ~~2 50. be transfered from the Light Fund to the Sewer Bond Redemption Fund as a loan. Seconded by Blake. Carriedo. The City Attorney advised the council that the case of the City.VS Cates had been settled for $300000, which had been paid by the Bonding Company. Selection of a chairman of the council was mentioned. Moved hy Wenner that due to his long service on thecouncil that Dr. W. E. Blake be elected chairman of the Council. Seconded and carried. Applewhite spoke on the purchase of tractor for the Street Depart- ment but no action was taken. On motion, the council adjourned to meet at the call of the ~~yar. Attest: (Signed) J. Q.
