On April 15,2009, the Staff Advisor for the Ashland Planning Department administratively approved
your request for the following:

18.1 08.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in the ALUO
18.108.070(8)(2)( c).
An appeal may not be rnade directly to the Land Use Board of Appeals. Oregon law states that failure to
raise an objection concerning this application, by letter, or fai lure to provide sufficient specificity to afford
the decision nlaker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that

DECISION
The subject property a nine-unit condominium complex that was constructed in the 1980s. The property
is located on the north side of Siskiyou Boulevard down a flag-driveway behind the current location of
Siskiyou Cyclery~ The application is to remove seven trees from the site~ Six trees from in front of the
units and one tree along the driveway, two of the six trees are actually at the rear of the property between
1739 Siskiyou and the north lot line and one between 1747 Siskiyou and the north lot line. The original
application was for the removal of six trees throughout the site and the removal of one walnut along the
driveway. The applicant did not provide adequate findings for the walnut removal therefore its removal
is denied.
The four maple trees in front of the units have significantly outgrown the space designated for planting.
They are maple trees, which have become too large for the space. The root systems of the trees have now
begun to lift the asphalt driveways and damaging the foundations of the units they are adjacent too. The
applicant stated that at this point they no longer request approval to remove the two trees, liquidambar
trees, which are along the rear of the property line. A condition reflecting this statement has been added.
At the April 9, 2009 meeting of the Tree Commission the applicant stated that if they were going to be
required to mitigate the removal of the walnut they would likely not remove it. The Tree Commission
added a condition regarding the mitigation and irrigation if the walnut tree is removed. As stated above,
due to the lack of adequate findings justifying the removal of the walnut tree, its removal has been
denied.
The criteria for a Tree Removal Permit are described in AMC Chapter 18.61.080, as follows:
A. Hazard Tree: The Staff Advisor shall issue a tree removal permi(for a hazard free if the
applicant demonstrates that a tree is a hazard and ttJarrants removal.
1. A hazard tree is a tree that is physically damaged to the degree that it is clear thaI it is
likely 10 fall and i!1J~ure persons or property. A hazard tree may also include a free thaI is

located within public rights of way and is causing damage 10 existing public or private
facilities or services and suchfacUities or services cannot be relocated or the damage
alleviated~ The applicant must demonstrate that the condition or location of the tree
presents a clear public sq(ety hazard or aforeseeable danger ofproperty damage to an
existing structure and such hazard or danger cannot reasonably be alleviated by treatment or
pruning.
2. The City may require the applicant to mitigate for the removal of each hazard tree pursuant
to AMC 18.61.084. Such mitigation requirements shall be a condition of approval of the
pennit.
B. Tree that is Not a Hazard: The City shall issue a tree removal permit for a tree that is not a
hazard if the applicant demonstrales all of the following:
1. The tree is proposedfor removal in order to permit the application 10 be consistent with
other applicable Ashland Land Use Ordinance requirements and standards~ (e.g. other
applicable Site Design and U"ie Standard"i). The Staff Advisor may require the building
footprint of the development to be staked to allow for accurate verification of the permit
applicationt' and
2. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow
o.fsurface waters, protection l?f adjacent trees, or existing windbreaks; and
3. Removal oj.the tree will not have a significant negative impact on the tree densities; sizes,
can()pies, and .\pecies diversity within 200 feet oj'the subject property.
The ('ity shall grant an exception to this criterion when alternatives to the tree removal have
been considered and no reasonable alternative exists to allow the property to be used as
permitted in the zone. Nothing in this section shall require that the residential density be
reduced below the permitted density allowed by the zone. In m{lking this determination. the
City may consider alternative site plans or placement of structures or alternate land'icaping
designs that would lessen the impact on trees, so long as the alternatives continue to comply
with other provisions C?fthe Ashland Land Use Ordinance.
4. The City shall require the applicant to mitigate for the removal of each tree granted approval
pursuant fa AMC /8.61.084. ...f)uch mitigation requirements shall be a condition 0.( approval
of the permit.
The application with the attached conditions complies with all applicable City ordinances.
Planning Action 2009-00266 is approved with the following conditions. Further, if anyone or more of
the following conditions are found to be invalid for any reason whatsoever, then Planning Action 2009-
00266 is denied. The following are the conditions and they are attached to the approval:
1) That all proposals of the applicant shall be conditions of approval unless otherwise modified here.
2) That the two liquidambar trees along the rear property line shall not be removed as per the applicant's
statement that they no longer want to remove them.
3) That a Tree Removal Verification Permit shall be obtained in accordance with Ashland Municipal Code
18.61 prior to the removal of any of the trees on site~

4) The Tree Commission recommends that the walnut tree not be removed, if upon the removal of the
walnut tree, it shall be mitigated for on-site in accordance with Ashland Municipal Code 18 t61. A

TREE REMOVAL
18.61.080 Criteria for Issuance of Tree Reml. Staff Permit
An applicant for a Tree Removal Permit shall demonstrate that the following criteria are satisfied. The Staff Advisor may require an arborisfs
re port to substantiate the crite ri a fo r a perm it.
A. Hazard Tree: The Staff Advtsor shall issue a tree removal permit for a hazard tree if the appHcant demonstrates that a tree is a hazard and
warra nts re moval.
1. A hazard tree is a tree that is physicaUy damaged to the degree that it is clear that it is IikeJy to fall and injure persons or property. A

Land Use Ordinance will be held before the Tree Commission on April 9. 2009 at 6:00 p.ma at the office

A Boundary Line Adjustment a request for a Physical and Environmental Constraints Permit to allow
construction within the Ashland Flood Plain corridor, and a request for a Variance to Section 18.62.070 of
the Ashland Municipal Code to modify the lot line on a lot that does not have adequate buildable area
outside the floodplain corridor for the property located at 440 Helman Street
A request for a Tree Removal Permit to remove seven trees, six maple trees in front of the units and one

A request for Final Plan approval for a six-lot five-unit Performance Standards Subdivision for the

Please accept our request to have 6 maple trees and 1 walnut
tree relTIoved from our property at Rose Court Condos as the
trees are getting too large for the space they are planted.
The maple tree roots are causing cracks in our driveway and
cracks in our foundation. They are beautiful maple trees,
planted 19 years ago in the wrong place as they are too close
to our buildings. The entire Homeowners Association is in
agreement to have them removed as soon as we get permission
froll1 the city.
A walnut tree at the entrance to our property is leaning,
causing cracks in the driveway, and a liability as it may fall
onto our neighbor's property. It also drops walnuts onto our
driveway that make a huge mess at the entrance of our
property and running over them with our cars may cause
dalTIage to the tires.
We would like a recommendation on what type of trees or
bushes to replace the trees after they are removed. There is
very little dirt and what dirt is there is filled with tree roots.
