The property owner of2251 Chitwood has agreed to the solar shadow proposal. The Staff Advisor's decision becomes final and is etTective on the I3lh day after the Notice of Final Decision is mailed. Prior to that date, anyone who was mailed this Notice Of Final Decision may request a reconsideration of the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance (ALUO) 18.1 08.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in the ALUO 18.l08.070(B)(2)(c). An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford the decision maker an opportunity to respond to the issue, prec ludes your right of appeal to LU BA on that issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval with sufficient specificity to allow this Department to respond to the issue precludes an action for damages in circuit court. The parcel slopes to the north at approximately five percent. The parcel was created as part of the Chitwood Lane subdivision in 2004. The application is a request for a Solar Variance for a new single-family home. As proposed, the shading on the adjacent property would extend eleven feet at the furthest point beyond the shading of a six-foot fence on the northern lot line. The resulting shadow is shown in the submittal materials and is to fall completely within the required driveway area of the parcel to the north. No shadow would be cast onto the structure or into the habitable space. The Variance requested would only shade non-buildable driveway area, as front loading garages are required to be setback twenty feet from the front property line. According to the definition of the northern lot line for the purposes of calculating the solar setback: Any line or lines less than forty-five (45) degrees southeast or southwest of a line drawn east to west and intersecting the northernmost point of the lot... Based on the submitted site plans the northern lot line on the southwest is forty (40) degrees and the line on the southeast is forty-five (45) degrees. The Solar Variance request cites the angle of the street and where the northern lot line as defined in Chapter 18.70.020. D. falls requires the north lot line to be the shared lot line not the street. Additionally, during the design, phase of the subdivision and where the on-street and off-street parking was located with the driveway and garage placements on the south and east sides of the parcels moving the available dwelling area to the north and west sides creating the solar shadow issues. PA #2009-01081 2261 Chitwood Lane/adg Page 1 In reviewing the request, staff believes that the Variance proposal will have minimal impact on the adjacent property. The shadow will fall completely within the driveway apron of the parcel and will not affect any of the habitable space. The criteria for a Solar Access Variance are described in AMC Chapter 18.70.060, as follows: a. The variance does not preclude the reasonable use of solar energy on the site by future buildings; and b. The variance does not diminish any substantial solar access which benefits a habitable structure on an adjacent lot. c. There are unique or unusual circumstances which apply to this site which do not typically apply elsewhere. The application with the attached conditions complies with all applicable City ordinances. Planning Action 2009-0 1081 is approved with the following conditions. Further, if anyone or more of the following conditions are found to be invalid for any reason whatsoever, then Planning Action 2009- 01081 is denied. The following are the conditions and they are attached to the approval: 1) That all proposals of the applicant shall be conditions of approval unless otherwise modified here. 2) That the additional shadowing approved here is limited to that illustrated in the applicants' Solar Access Waiver Exhibits Band C dated September 4,2009. The final submittals for building permit shall be in substantial conformance with the drawings submitted with the Solar Waiver application, and any additional shading proposed beyond that requested here would require modification of this approval and resubmission of a Solar Waiver application. 3) That the plans submitted for the building permit shall be in substantial conformance with those approved as part of this application. Main Street Ashland, OR. 97520 July 22,2009 Re: Solar Variance 2251 Chitwood Lane To Whom It May Concern: This letter is a formal request for a solar variance allowed under section] 8.70.060 of the City of Ashland Municipal Code. The applicant feels that the waiver is warranted due to certain existing conditions on Lot 8 Deerfield Estates, the property directly to the South of the subject site. The configuration of Lot 8 and the location of the drive approach dictate that the garage be located at the Easterly pOltion of the site The remainder of the site left for the dwelling is the Westerly portion of the site. The desire is to construct a two-story dwelling on the parcel. After applying the required setbacks stipulated by the City Code, the only remaining area for a two-story structure is as shown in the accompanying drawings. The building placement has been manipulated to result in the minimum solar impact to the subject site. The attached site drawing shows the placement of the proposed dwellings on both lots 8 and 9. The drive approach for the subject site is located to the South side of the lot, and due to on-street parking restrictions imposed as part of the subdivision approval, cannot be moved. The Site Drawing clearly shows the shadow from the adjacent home will be cast onto the driveway apron only of the affected parcel. The way the two homes have been positioned relative to one another will still provide complete and adequate solar access for the affected parcel. Please find the attached release form to be recorded with the County Clerk for the affected properties deed, with signature(s) of all owner(s) or registered leaseholder(s) who hold an interest in the property in question. The applicant stipulates that the waiver shall apply only to the specific building to which the waiver is granted. The applicant acknowledges by this action that solar access as guaranteed by the Municipal Code of the City of Ashland shall be waived for the particular structure, and the City shall be held harmless for any damages resulting from the waiver. I believe after reviewing all of the pertinent information you will find that granting the requested waiver will allow both properties to be developed as desired and still meet the intentions of the Municipal Code.
