Prior to that date, anyone who was mailed this Notice Of Final Decision may request a reconsideration of the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance (ALUO) 18.1 08.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in the ALUO 18.108.070(B)(2)(c). An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford the decision maker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that issue. COMPREHENSIVE PLAN DESIGNATION: Single Family Residential; ZONING: R-I-5; ASSESSOR'S MAP #: 39 IE 04 BC; TAX LOTS #: 200, 600, 700 and 800 APPLICANT: Ashland School District SUBMITTAL DATE: DEEMED COMPLETE DATE: STAFF APPROVAL DATE: FINAL DECISION DATE: APPROVAL EXPIRATION DATE: March 13, 2009 March 25, 2009 May 1, 2009 May 14, 2009 May 14, 2010 DECISION The subject property, the Helman School site, consists of four tax lots located between Laurel and Helman Streets, immediately to the south of the Randy Street right-of-way and the Benner Subdivision, and north of the Laurel Street P.U.D. and the undeveloped Re)1101ds property. In total, the Helman campus consists of roughly ten acres with street frontages along Helman, Randy and Laurel Streets. Campus buildings and parking lots are clustered on northern portion of the site, athletic facilities including basketball and tennis courts are located on the central portion of the site, and the southern portion contains athletic fields. Site Review approval to construct an approximately 6,400 square foot gymnasium addition and a 5,010 square foot library addition on the northwest portion of the Helman School campus, near Randy Street, was granted by the Planning Commission in December of 2007. Because the subject property is located in a residential zoning district and identified some conceptual signage in initial submittals, the Site Review approval included a condition that required: #2) That Conditional Use Permit approval shall be obtained prior to the installation of any new signage. including but not limited to the proposed dragon mascot mural/wall graphic on the new gymnasium building, or modification of any existing signage. This condition was reiterated on the building permit issued, however with construction of the new gymnasium a dragon mascot wall graphic was installed without prior Conditional Use Permit approval. Upon being made aware of the sign installation by a concerned neighbor, Planning Staff contacted the School District project team and made them aware of the need to obtain Conditional Use Pennit approval or relocate the sign so that it would not be visible from adjacent public right-of-way before final occupancy permits could be issued for the new buildings. The current application requests Conditional Use Permit approval for sign installation at Helman School, including the dragon mascot wall graphic on the new gymnasium and two other existing student-designed and -installed tile murals located on the northeast and southeast comers of the existing multi-purpose building facing Helman Street (see applicant's Site Plan P A #2009-00322 705 Helman Streetldds Page 1 submittal C 1.2). According to the applicants, the tile murals have been in place since 1992. (Staff would note here that there are a number of other existing murals in place around the Helman School campus, as well as a tile mosaic bench installation currently being plannedfor the outdoor storytelling area located at the southwest corner of the new library, however as these items are not visible from adjacent rights-of-way, they are not subject to sign regulations. The current application is limited to formalizing the approval of three signs which are in place and visible from the adjacent rights-aI-way.) The "Sir Henry" dragon mascot wall graphic is located on the eastern wall of the new gymnasium and has a primary orientation toward the interior of the Helman School campus. The sign itself consists of six ~~inch thick aluminum panels cut and finished in three colors (green and red with a bronze outline). The total size is I O~feet 2-inches wide by] 5-feet tall and the placement has a small portion of the dragon's tail extending above the roofline by less than one-foot. This sign had initially been shown in conceptual drawings for placement on the north wall of the gym oriented toward Randy Street, however after hearing concerns from planning staff and neighbors the applicants chose to install the sign in a location that better addressed the interior of the campus while limiting visibility from adjacent rights-of-way. The application notes that the placement gives the appearance that Sir Henry is walking on the roof of the new library, and places him high enough to be visible from within the campus while remaining out of reach of students who might be tempted to climb onto a lower installation. As installed, this sign is visible from a narrow section of Helman Street right-of-way approximately 400-feet away. The "Dragon Tile" and "Personal Student Tile" murals on the Helman Street side of the existing administration building consist of wall-mounted colored tiles. The "Dragon Tile" mural is 5 Y2 -feet tall and I 9-feet wide. The "Personal Student Tile" mural is 4-feet 8-inches tall and 2 I-feet wide. The application notes that these murals have been in place in their present locations since 1992, and a site plan identifying their locations along with color photos of each have been provided with the application submittal. During the comment period on the application, written comments on the proposed signs were received from neighbors John Engelhardt of656 Helman Street, Sharon Bryson of 138 Cypress Circle, and Susan Vaughn of 536 Parkside Drive. Both Engelhardt and Vaughn expressed support for the signs as proposed, however Bryson's letter raised objections to the dragon wall graphic based on its scale, design and placement. She notes that the dragon's placement and design have an adverse impact on the livability and value of the impact area and that the dragon as placed is visible only to neighbors and cannot be seen by children in the schoolyard. She urges that the sign be lowered to ground level or placed inside the gym to decrease the neighborhood impact while allowing children to view the graphic while at school. While there are no sign regulations specific to schools in Ashland's "Sign Regulations" Ordinance (AMC 18.96), the installation of signage in residential areas is generally restricted. However, the ordinance includes provisions which allow governmental agencies such as schools to apply for Condition Use Permits to place signage which does not confonn with the sign regulations when it is detennined that, in addition to the criteria for a Conditional Use Permit, the signage is necessary to further that agency's public purpose. These provisions have been used to allow signage at the Ashland Community Hospital as well as at other Ashland Schools in the past. In this instance, the applicants assert that the signage being considered is integral to the public purpose and mission of the Ashland School District. The findings provided note that emerging research in the fields of environmental and psychological design indicates that learning opportunities can be woven into the structure of a school so that the built environment becomes a teaching tool in and of itself, rather than merely a passive instructional space. The application further notes that to P A #2009..00322 705 Helman Streetldds Page 2 maximize growth in intellectual development, the school should provide a rich, multi-sensory environment with engaging stimuli which reinforce and stimulate the students' interests, and goes on to indicate that the proposed signs are intended to achieve these goals while providing strong focal points, encouraging a sense of identity for students within the campus, and reinforcing the school's role within the community. In staffs view, the existing tile murals that have been in place since 1992 have become an accepted element of the school's public fa~de. In terms of the applicable criteria. the primary applicable elements would have to do with any adverse material effect on the livability of the impact area based on architectural compatibility for the Conditional Use Permit as well as demonstrating that these murals are in keeping with the school's public purpose. It seems that the murals are compatible with the neighborhood to a degree that they have become accepted fixtures at the school, and even Ms. Bryson, who has concerns over the installation of the dragon wall graphic, notes in her letter that these tile murals have no impact on the neighborhood. These murals have been student-designed and -installed, and thus appear to directly serve the school's public purpose not only in providing a direct and creative participatory educational experience but also in fostering a sense of connectedness between the students, the built environment of the school, and their larger community. Staffhad some concern with the initial proposed placement of the dragon mascot wall graphic on the north wall of the gym, when it was proposed for installation with an orientation toward Randy Street. As initially proposed in conceptu'al drawings early in the planning process for the gymnasium and library buildings, staff felt that the dragon mascot wall graphic had significant visual impacts to Randy Street neighbors while having minimal visibility to students on campus. These concerns were raised to the applicants early in the planning process, and were apparently taken to heart in the ultimate placement of the sign. In relocating the dragon mascot to the east wall of the gym, it is no longer visible to neighbors on Randy Street and only minimally visible to neighbors on Helman Street approximately 400 feet to the east. The sign's primary orientation as installed is to the interior of the campus, most notably to the new courtyard created with the placement of the new gym and library buildings. This is best illustrated in the attached "Staff Photo Exhibit E". This placement serves to create a subtle connection between the newest additions to the campus and the older classroom buildings through the newly created courtyard gathering space. The placement so far from Helman Street, and with an orientation to the interior of the campus, effectively minimizes the visual impact of the sign's placement and in staffs view, the applicable criteria for Conditional Use Pennit approval are satisfied. In terms of the requirement that the sign be necessary to further the school's public purpose, it seems to staff that a school's mascot plays a prominent role both in establishing the school's identity and the students' ability to identify therewith, and as noted in the applicants' submittal the built environment of the school can further serve to carry out primary educational functions by providing a rich, multi-sensory learning environment with engaging stimuli to reinforce and stimulate the students' interests. Staffbelieve that the present placement of "Sir Henry" effectively contributes to Helman School's rich, multi-sensory learning environment, thus furthering the school's public purpose while minimizing impacts to the surrounding neighborhood, and as such, staffbelieve that the proposal satisfies the applicable requirements for approval. The criteria for Government Signs are described in AMC Chapter 18.96.150, as foUows: Governmental agencies may apply for a Cond~jonal Use to place a sign that does not conform to this Code when ~ is determined that, in addition to the criteria for a conditional use, the sign is necessary to further that agency's public purpose. (ORD 2951, amended, 07/01/2008) P A #2009-00322 705 Helman Streetldds Page 3 The criteria for a Conditional Use Permit are described in AMC Chapter 18.104.050, as follows: A condijional use permij shall be granted if the approval authority finds that the proposed use conforms, or can be made to conform through the imposition of conditions, with the following approval criteria. A. That the use would be in conformance with all standards wijhin the zoning district in which the use is proposed to be located, and in conformance wijh relevant Comprehensive plan policies that are not implemented by any City, State, or Federal law or program, B. That adequate capacity of City facilities for water, sewer, paved access to and through the development, electricity, urban storm drainage, and adequate transportation can and will be provided to and through the subject property. C. That the conditional use will have no greater adverse material effect on the livability of the impact area when compared to the development of the subject lot with the target use of the zone. When evaluating the effect of the proposed use on the impact area, the following factors of livability of the impact area shall be considered in relation to the target use of the zone: 1. Similarity In scale, bulk, and coverage. 2. Generation of traffic and effects on surrounding streets. Increases in pedestrian, bicycle, and mass transij use are considered beneficial regardless of capacity of facilities. 3. Architectural compatibility wijh the impact area. 4, Air quality, including the generation of dust, odors, or other environmental pollutants. 5. Generation of noise, light, and glare, 6, The development of adjacent properties as envisioned In the Comprehensive Plan. 7. Other factors found to be relevant by the Hearing Authority for review of the proposed use. The application with the attached conditions complies with all applicable City ordinances. Planning Action #2009-00322 is approved with the following conditions. Further, if anyone or more of the following conditions are found to be invalid for any reason whatsoever, then Planning Actions #2009-00322 is denied. The following are the conditions and they are attached to the approvals: 1) 2) That all proposals of the applicant shall be conditions of approval unless otherwise modified herein. That a sign permit shall be obtained for the new signage approved herein. The plans submitted for the sign permit application shall be in substantial conformance with those approved as part of this application. If the plans submitted for the sign permit are not in substantial conformance with those approved as part of this application, an application to modify this Conditional Use Permit approval shall be submitted and approved prior to issuance of a sign permit. That the applicants shall obtain a special inspection from the Building Division prior to issuance of the sign permit. Susan Hollandsworth, the principal, just told me they would like to have a student project - installing a mosaic of 4"x4" art tiles on the sides of the new concrete benches on the west (field side) of the new Library exterior storytelling area. It is in excess of 200 feet from the sidewalk (public way), but would still likely be visible in the distance. If it is too late, I was also wondering if the new sign ordinance revisions might offer any consideration to this project, or do I need to tell her a separate CUP is needed? (Or could this possibly not be a "sign"???) The benches are 24" high x 6'0" long - there are three. Two would be "visible" from the sidewalk. Sorry... Thanks for your help! Important: This comment strictly addresses a dragon wall graphic on the new gymnasium. It seems unnecessary to address the two existing student - designed and installed tile murals. Those murals have no effect on livability of impact area. The objections to the graphic: the scale, design and placement ofthe sign. The cunently installed dragon is multitude in scale compared to the original design graphic that was not approved as a part ofthe overall project. The design lacks artful character and color. It adds greater adverse effect on the livability and value of the impact area when included with the existing monstrous development. This sign should be for the children to enjoy. The placement ofthe sign is only for the neighbors. The children can not see the sign when they are in the school yard. The objection to the process: The Ashland School District was directed, like any other citizen or company to first make application for Conditional Use. The School District neglected to fulfill their responsibility. Now, after the graphic is installed the Planning Department asks for comment; this is a poor example of the school district choice of process. It seems very much like the inconsiderate design of the school expansion. No regard to the neighborhood. GOVERNMENTAL SIGNS 18.96.150 Approval Criteria Governmental agencies may apply for a Conditional Use to place a sign that does not conform to this Code when it is determined that in addition to the criteria for a conditional use, the sign is necessary to further that agency's public purpose. This currently installed (without prior approval) dragon wall graphic is not necessary to further the public purpose. It seems unfortunate if the school is allowed to justify such a graphic is necessary to promote education. SUGGESTION Bring the sign installers back to the project, lower the graphic close to the library at ground level. Or it could be placed inside the gym. This will decrease the neighborhood impact and the children can see the graphic when they use the school. After all, tax payer dollars have already been spent for the graphic. Placing him high enough and centered so that the children would not be climbing him and injuring themselves certainly makes sense. I hadn't thought about that risk. I have purposely driven down Helman several times to evaluate "Henry's" impact. The idea of visually perceiving him as "walking on the library roof' is fun, but, again, I had to make an effort to even see "Henry." I don't know why all the fuss. One of my favorite sayings (and insights when I finally really got it) is that "No two eyes see the world in the same way." I guess that holds true for "Henry." I encourage the keeping of whimsical "Henry" right where he is and getting on with the business of supporting our students, teachers administration and school board in providing excellent educational opportunities in the present economic challenges. I find the artwork very appropriate for an elementary school, and it helps enliven the view of the buildings. The dragon has been Helman School's mascot for as long as I can remember, and it's fitting to have some visual display of it. Far from finding it unsightly, I find it cute. There are only a handful of houses on Helman Street that have a decent view of it from their residence. From conversations with three of my neighbors directly south of me, I found that Steve Haskell @ 622 Helman is fine with it, as are Glenn and Barb Street @ 642 Helman. In fact, Glenn said that it looked like the dragon was walking on top of the library, which was pretty cool. Sue, who lives next to Glenn, is neutral on it, but her kids love it. I hope that the dragon can remain. For goodness sake, it's an elementary school fixture! It complements the previous artwork on the other school buildings-both the student-created tiles and the murals that adorn the courtyard. I 50) Narrative With the construction of the new Helman Elementary School Gymnasium and Library, great strides have been taken toward providing a stimulating, quality learning environment for the children of Ashland. Already, there is great community pride and student excitement regarding the new facilities and the district hopes to enhance this feeling of community with the installation of the much loved Helman School mascot, "Henry the Dragon", in the form of a two dimensional color graphic on the South wall of the new gymnasium building. Each offset panel section is shape-cut from 5'x5' aluminum panels that produce a graphic measuring 10'-2" wide by 15'-0" tall including all trim and mounting hardware. It is the districts belief that the streetscape will be minimally effected by the choice of this location as the graphic will be blocked from public view with the exception of a small portion of Helman street. We feel the benefits to the spirit and pride of the school will actually improve the livability of the area. 2) Generation of traffic and effects on surrounding streets. The colors used for "Henry" are traditional colors used in the depiction of the Helman mascot and will serve to liven and enhance the campus environment. The district believes that the (3) "signage" items referred to in this application are integral to the public purpose and mission of the School District. Research findings in the emerging environmental psychological/design and behavior discipline during the past 25 years indicate that the inherent potential of school environments are essential learning tools for students, not simply books and instructors. Learning opportunities can be woven into the structure of a school so that the built environment becomes an active, well-ordered work of art and a three dimensional teaching tool rather than a passive space for instruction. To maximize growth in intellectual development, the school should be a rich, multi-sensory environment with engaging stimuli, the design of which reinforces and stimulates the individual interests of the child. The richer the environment, the greater the learning. All sensory modes need to be considered when creating a learning environment that reinforces a sense of place. The Helman "tile dragon", "Personal student tile" mural and the new "Henry" graphic are intended to achieve these goals. The location of the Dragon was purposely selected so as to minimize the perceived impacts to the neighbors while providing a strong focal point and sense of identity for the students within the campus. We also request that a small portion (the tip of "Henry's" tail) be permitted to project less than one foot above the roofline ofthe gymnasium to achieve a perceivable interaction with the structures from within the campus. This would allow the dragon to be more dynamic and whimsical by appearing to be walking on top of the library. This projection would not be visible from the other side of the gym or by the neighbors on Randy street. The very few neighbors that would have a possible view of the dragon from Helman street have offered their support for its installation. The selected location is in the perceived center of the campus between the new gymnasium and library buildings, maximizing the ability to achieve its purpose while minimizing the visual impact to neighbors. The mounting height ofthe dragon also ensures that it is safely out of reach of children who may be tempted to climb "Henry". The proposed (3) "signs" intent is to foster a sense of unity and identity among the student body and staff while at the same time reinforcing the school's function as a focal point within the community. I find the artwork very appropriate for an elementary school, and it helps enliven the view of the buildings. The dragon has been Helman School's mascot for as long as I can remember, and it's fitting to have some visual display of it. Far from finding it unsightly, I find it cute. There are only a handful of houses on Helman Street that have a decent view of it from their residence. From conversations with three of my neighbors directly south of me, I found that Steve Haskell @ 622 Helman is fine with it, as are Glenn and Barb Street @ 642 Helman. In fact, Glenn said that it looked like the dragon was walking on top of the library, which was pretty cool. Sue, who lives next to Glenn, is neutral on it, but her kids love it. I hope that the dragon can remain. For goodness sake, it's an elementary school fixture! It complements the previous artwork on the other school buildings-both the student-created tiles and the murals that adorn the courtyard.
