request for the following:

The Staff Advisor's decision becomes final and is effective on the 13th day after the Notice of Final
Decision is mailed.
Prior to that date, anyone who was mailed this Notice Of Final Decision may request a reconsideration of
the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance (ALUO)
18.1 08.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in the ALUO
18.108.070(B)(2)(c).
An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to
raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford
the decision maker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that
issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of
appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to
proposed conditions of approval with sufficient specificity to allow this Department to respond to the
issue precludes an action for damages in circuit court.
The application, all associated documents and evidence submitted, and the applicable criteria are available
for review at no cost at the Ashland Community Development Department, located at 51 Winburn Way.

DECISION
The subject property is on the west side of Dead Indian Memorial Road to the south of the runway for
the Ashland Municipal Airport. In October 200S the Oregon Department of Aviation - a division of the
Federal Aviation Administration (FAA) performed an inspection and found trees adjacent to the airport
runway to be out of compliance for the Conical Surface Area required to be clear of obstructions for the
landing and taking off aircraft. Four trees are proposed for removal, as they are larger than IS-inches in
diameter at breast height.
The application request is to deem the trees hazardous as they pose a threat to the aircraft landing at the
airport and to the property surrounding the airport in the event of a crash. Though this does not meet the
definition of a hazard tree under the ordinance - these trees do pose a hazard and classifying them as
such is reasonable. The applicants have requested not to perform on-site mitigation as the FF A
regulations on height restrictions near the airport and runways limits the maximum heights in the airport
approach zone to less than 20-feet. The applicant shall mitigate the four trees removed off-site at another
City of Ashland owned property or public right-of-way; a condition to this effect has been added,
The Tree Commission reviewed the removal request and concurred that the trees should be removed as
they could pose hazardous for aircraft. The Commission did find that the stumps should be retained due
to their proximity to the wetlands and riparian corridor for Neil Creek. The stumps and roots will
provide soil stability. The Commission recommended that the stumps be spot burned or covered with six
or more inches of bark mulch to slow regrowth. Any stump sprouts should be immediately removed.
The criteria for a Tree Removal Permit are described in AMC Chapter 18.61.080, as follows:
An applicant for a Tree Removal Permit shall demonstrate that the following criteria are satisfied. The
Staff Advisor may require an arborist's report to substantiate the criteria for a permit.

A. Hazard Tree: The Staff Advisor shall issue a tree removal permit for a hazard tree if the
applicant demonstrates that a tree is a hazard and warrants removal.
1. A hazard tree is a tree that is physically damaged to the degree that it is clear that it is likely
to fall and injure persons or property. A hazard tree may also include a tree that is 'located
within public rights of way and is causing damage to existing public or private facilities or
services and suchfacilities or services cannot be relocated or the damage alleviated The
applicant must demonstrate that the condition or location of the tree presents a clear public
safety hazard or aforeseeable danger of property damage to an existing structure and such
hazard or danger cannot reasonably be alleviated by treatment or pruning.
2. The City may require the applicant to mitigate for the removal of each hazard tree pursuant
to AMC 18.61.084. Such mitigation requirements shall be a condition of approval of the
permit.
E. Tree that is Not a Hazard: The City shall issue a tree removal permit for a tree that is not a
hazard if the applicant demonstrates all of the follow ing:
1. The tree is proposedfor removal in order to permit the application to be consistent with
other applicable Ashland Land Use Ordinance requirements and standards. (e.g. other
applicable Site Design and Use Standards). The Staff Advisor may require the building
footprint of the development to be staked to allow for accurate verification of the permit
application; and
2. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow
of surface waters, protection of adjacent trees, or existing windbreaks; and
3. Removal of the tree will not have a significant negative impact on the tree densities, sizes,
canopies, and species diversity within 200 feet of the subject property.
The City shall grant an exception to this criterion when alternatives to the tree removal have
been considered and no reasonable alternative exists to allow the property to be used as
permitted in the zone. Nothing in this section shall require that the residential density be
reduced below the permitted density allowed by the zone. In making this determination, the
City may consider alternative site plans or placement of structures or alternate landscaping
designs that would lessen the impact on trees, so long as the alternatives continue to comply
with other provisions of the Ashland Land Use Ordinance.
4. The City shall require the applicant to mitigate for the removal of each tree granted approval
pursuant to AMC 18.61.084. Such mitigation requirements shall be a condition of approval
of the permit.
The application with the attached conditions complies with all applicable City ordinances.
Planning Action 2009-00257 is approved with the following conditions. Further, if anyone or more of
the following conditions are found to be invalid for any reason whatsoever, then Planning Action 2009-
00257 is denied. The following are the conditions and they are attached to the approval:
1) That all proposals of the applicant shall be conditions of approval unless otherwise modified here.

2) That the off~site Iocation(s) for the mitigation trees of the four trees removed shall be provided to the
City of Ashland for review and approval within ISO-days of approval.

The Ashland Planning Division Staff has received a complete application for the property noted above.
Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winburn Way,
Ashland, Oregon 97520 prior to 4:30 p.m. on the deadline date shown above.
Ashland Planning Division Staff determine if a Land Use application is complete within 30 days of submittal. Upon determination of
completeness, a notice is sent to surrounding properties within 200 feet of the property submitting application which allows for a 14 day
comment period. After the comment periOd and not more than 45 days from the application being deemed complete, the Planning Division
Staff shall make a final decision on the application. A notice of decision is mailed to the same properties within 5 days of decision. An
appeal to the Planning Commission ofthe Planning Division Staffs decision must be made in writing to the Ashland Planning Division within
12 days from the date of the mailing of final decision. (AMe 18.108.040)
The ordinance criteria applicable to this application are attached to this notice. Oregon law states that failure to raise an Objection

18.61.080 Criteria for Issuance of Tree Removal, 'f Permit
An applicant for a Tree Removal Permit shall demonstrate that the following criteria are satisfied. The Staff Advisor may require an arborist's report to

Introduction:
The City of Ashland owns and operates the Municipal Airport located within the City
Limits. On a yearly basis the FAA and the Oregon Department of Aviation inspect the
Airport in an effort to make sure it follows all Federal and State Regulations. When there
are discrepancies between existing situations at the Airport and these regulations the City
of Ashland has to remedy the situation. During last years inspections it was noted that
there are trees on Tax Lot 2001 that are encroaching into the 20:1 approach slope zone as
defined by the FAA for Ashland Airport. This approach zone is critical for planes landing
on runway 30 at the Airport. The City of Ashland is applying to remove a bank of Willow
trees and Cotton woods on T.L. 2001 at the far south end as shown on the attached plan
sheet. Removal of the trees will create a safer environment for air travel at the Ashland
Airport and safer for the surrounding tax lots.
Project Description:
This is an application for a Tree Removal Permit under the Tree Preservation and
Protection Ordinance Chapter 18.61.
This application will demonstrate the following criteria for approval per 18.61.050 and
18.61.080.

1. The anticipated date of removal: The City of Ashland would like to remov2ti{~tr~M',',k;;:n0:1t
between April and August 2009. The exact date to be determined once Public Works can
schedule the Street and Electric Departments for the work and determine a method of pay
for the work.
2. Statement of reason for removal or topping: In order to meet FAA and ODA
requirements within the approach slope zone at the Ashland Municipal Airport the City
needs to remove a bank of Willow and Cotton Wood trees that are 380 feet away from
the bank of Neil Creek on Tax Lot 2001. These trees extend into the approach slope of
20: 1 as defined in FAR 77. The trees present a safety hazard for all planes entering into
the approach slope at Ashland Municipal Airport. By removing the Tree's the City as
owner of the Airport will be in compliance will Federal Regulations and create a safer
environment for both air traffic and the surrounding area. In order to remove the trees the
City will also need to do some brush clearing of blackberries in order to get the necessary
equipment on site for removal. As mentioned in the ODA Inspection summary exhibit C,
the obstruction data for runway 30 is 35' trees at 410' and 65' left of centerline. At 410
feet the maximum height allowable is 410' /20'=20' vertical with existing trees over 35'
right now. As stated in Ashland Municipal code 18.60.030; The City may top any tree
which is in excess of those maximum heights listed in section 18.60.020. The maximum
height stated in 18.60.020 is 20'. These trees exceed the 20' requirement. The City needs
to remove these trees not top them because they will continually present the same
problem of encroaching into the approach slope zone height restricted limit.
3. Number of trees and Identification: Access to the site right now is completely limited do
to an overgrowth of blackberries. Attached to this permit are pictures that distinguish the
location and approximate number of trees for removal. All trees at this location will need
to be removed in order to be in compliance with FAA regulations.
Section 18.61.080.
1. Hazard Trees: The City of Ashland would like to quantify all the trees for removal in this
location as hazard trees. These trees present a real hazard to aircraft landing on mnway
30 at the Ashland Municipal Airport. If a plane were to strike one of these trees upon
trying to land it is very real possibility that it could result is serious personal injury to the
pilot along with damage to the Airport and surrounding tax-lots. In addition the potential
for a fire to start on site due to a crash would be high. The Airport to the west is
sunounded by business's and homes that could possible be threatened by a crash and
possibly resulting fire. As stated in the ODA inspection summary (attached exhibit C) the
trees provide only a 6: 1 slope when a 20: 1 is required.
Section 18.61.084 Mitigation Required
1. Replanting on Site: At this time the City of Ashland is offering no mitigation for
replanting on site. This would be counterproductive to the City and the function of
the Airport. The City of Ashland in good conscience can not plant new trees on
site at the Ashland AirpOlt due to the specific height requirements for airplane
traffic that are landing, taking off and taxing around the grounds at the Airpolt.

The City would just create new problems for itself by planting any new trees on
site. The only other options would be mitigation offsite or monetary payment as
established by the Planning Department upon approval of this permit.

On October 16, 2008, I conducted an Airport Safety Data Inspection of Ashland Municipal Airport-
Sumner Parker Field. This letter documents the results of my inspection.
Tbe Obstruction Data for Runway 12 is 45 foot trees at 250 feet from the threshold and 90 feet right of
centerJ ine, providing an approach slope of 1; 1. The Obstruction Data for Runway 30 is 35 foot trees at
410 feet from the threshold and 65 feet left of centerline} providing a Clearance Slope of 6:1. Both
runway ends approach slopes fall \\tell below the 20: 1 standard. In additio~ there .are many trees on the
west of the runway that appear to penetrate the 7:1 Transitional Surface.
The Runway surface remains in good condition, in spite of a few new areas of narrow cracking
occurring. Vegetation growing in these cracks, and should be eliminated before it gets well-rooted. I
also noted a minor amount of gravel on the nmway and taxiways that should be removed. Two signs
(runway information and noise abatement) arc cWTently located at the entrdnce to Runway 12, which J'd
recommend relocating 10 outside the Object Free Area (OFA) and mounted 1rangibly. The OPA
bo~ndary is at tl:1e runWay'ho141in.e~.(2 solid, 2 dashed cr.ossing the CO.nncctof taxiway). .. ._.'.' ..._
All of the runway edge lighting was operating correctly. However, the Runway 33 V ASJ and RElL are
partially obscured by grass and blackberry briars. All vegetation should be cleared from around these
lights, especially in &ont of them, as It increases their visibility. It also makes for safer maintenance, by
keeping mowing equipment away from them. Additionally, the ground around the V ASI supports is
badly eroded and should be backfilled with gravel and compacted to stop the erosion.
The.taxiways surfaces are generally in good condition. however. there are a few things that need your
attention. On the north end, a sink hole has developed, which I have marked with orange paint. This
should be repaired as Soon as possible. It may well have been caused by a Ground Squirrel burrow
underneath the taxiway. If left unresolved, it could lead to substantial repair costs. I have addressed the
Ground Squirrel problem in a subsequent paragraph. Along the taxiway edges, many of the retro-
reflectors have vegetation growing around them, which need') to be removed to adequately delineate the
edge~. Some of these reflectors are askew and need to be realigned, while others arc damaged and need

to be completely replaced. The curbing flanking the run-up area at the north end of the taxiway,
including the orange/yellow retro-reflectors needs to be removed. The reflectors are non~s{andard in
color and the curb poses a very real prop strike hazard.
On the center portion of the main aircraft parking ramp near the fueling facility, the T's are starting to
fade from yellow and should be repainted. The white Parking T's on far north ramp are the wrong color
and should be repainted yellow. \Vhite markings are reserved for runways. Also, the tree at the
northwest comer of this ramp should be removed, as it is a deiinite hazard to aircraft. maneuvering to
park. A few edge reflectors are also missing and should be replaced.
There appears 10 be a very ~erious Ground Squirrel and Mole problem on the airport. During the.
inspection, I sighted seven Grourid. Squirrels in holes .adjacent to the runway and taxiway. Numerous
other Ground Squirrel holes surrounding the runway, taxiway, V AS! and other lighting fixtures were
also visible. These animals burrow under the nmway and taxiway edges, lighting fixtures and electrical
vaults. The burrows compromise pavement strength and create safety hazards, as their holes axe big
enough to fit an airplane wheel into. 1 also witnessed a Deer feeding next to the lUnway and then
crossing it to escape On the west side. At your own cost, I'd recommend contacting Kevin Christensen
..{:: (503~326M2346) at the USDA Wildlife Services for advice on addressing both of these problems. He is
an expert on Airport wildlife haza~s.
The north-end 'Nind sock badly fadcdM needs replaced. The mid-field wind sock is only slightly faded
and will probably need to be replaced within a few months or just turned inside out for a fresher look.
Finally, I have added bottled oxygen to the airport records and changed the total based"aircraft count
from 62 to 86.

page), Approval is required from the Airport Commission before any new construction can occur.
A request must be submitted to the City Engineer's office indicating the elevation of the top of the
proposed construction. Please include a detailed site plan that contai.llS enough information to
verify the exact location of the construction on the City's topographic maps. The Airport
