On December 10, 2009, the Staff Advisor for the Ashland Planning Division administratively approved
your request for the following:

The Staff Advisor's decision becomes final and is effective on the 13th day after the Notice of Final
Decision is mailed.
Prior to that date, anyone who was mailed this Notice Of Final Decision may request a reconsideration of
the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance (ALUO)
18.1 08.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in the ALUO
18.I08.070(B)(2)(c).
An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to
raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford
the decision maker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that
issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of
appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to
proposed conditions of approval with sufficient specificity to allow this Department to respond to the
issue precludes an action for damages in circuit court.
The application, all associated documents and evidence submitted, and the applicable criteria are available
for review at no cost at the Ashland Community Development Department, located at 51 Winburn Way.
Copies of file documents can be requested and are charged based on the City of Ashland copy fee
schedule.

DECISION
The parcel is approximately 20,000 square feet in size and is located on the north side of Applegate
Way. The site slopes gradually downhill from southwest to northeast, towards Neil Creek. According
to the Local Wetland Inventory, there are wetlands located on the adjacent tax lot to the northeast of the
site. The subject site was developed with a warehouse / manufacturing facility, parking lot and
landscaping in 1997 an addition to the structure was approved in 2002. The proposal is to convert a
portion of the existing building to a retail business space; the remaining portion will be used as
warehouse for the business.
The proposed conversion of the structure from warehouse/manufacturing requires a Site Review
approval in accordance with 18.72.030. Any change in use from a less intensive (warehouse) to more
intensive occupancy (retail), as defined in the City building code, or any change in use which requires a
greater number of parking spaces requires a Site Review approval. The proposal is to convert 3,072
square feet to retail and the remaining 3,072 square feet of associated warehouse space and 327 square
feet for display and office.
The conversion of 3,072 square feet of warehouse space to retail requires 8.79 parking spaces, the
remaining 3,072 requires 3.07 parking spaces for a total of 11.82 parking spaces. The existing parking
lot has twelve parking spaces and there are two on-street parking credits available. The parking lot
striping is faded and shall be restriped to delineate the 12 parking spaces including the delineation of the
disabled parking space off-loading zone.
The applicant has proposed to add a covered bicycle parking structure for four bicycles adjacent to the
building on the existing pavement. The required bicycle u-racks in accordance with 18.92.040 and the
covered structure shall be installed on site in accordance with the approved plan. The structure will

require a structural building permit and that permit shall be applied for and issued prior to the issuance
of the Certificate of Occupancy for the retail side of the structure.
The City's Comprehensive and Zoning Maps indicates that the property is zoned Employment, E-I. The
surrounding properties are also zoned E-I. The site is adjacent to the City of Ashland airport. As a
result, the property is in the Airport Overlay Zone, which limits the height of buildings. When the
building was constructed it complied with all E-I and Airport Overlay Zoning requirements.
Access to the site is provided by way of Applegate Way. Applegate Way is an improved Neighborhood
Street with continuous sidewalks. Electric, water and sanitary sewer facilities are located in the
Applegate Way right-of-way and are available to serve the proposed building.
Landscaping is already provided and surrounds the front and sides of the parcel. Most of the lot is
covered with impervious surface (82.2%). However, the proposal does exceed the minimum landscape
requirement of 15% for the E-I zone. There is a gravel area to the north of the proposed recycle / trash
enclosure which is proposed to remain as is. Any future changes to this area will require Planning
Department staff review and approval.
The criteria for Site Review Approval are described in AMC Chapter 18.72.070, as follows:
A. All applicable City ordinances have been met or will be met by the proposed development.
B. All requirements of the Site Review Chapter have been met or will be met.
e. The development complies with the Site Design Standards adopted by the City Council.fbr
implementation of this Chapter.
D. That adequate capacity of Cityfac ilities for water, sewer, paved access to and through the
development, electricity, urban storm drainage, and adequate transportation can and will be
provided to and through the subject property.
The application with the attached conditions complies with all applicable City ordinances.
Planning Action 2009-01443 is approved with the following conditions. Further, if anyone or more of
the following conditions are found to be invalid for any reason whatsoever, then Planning Action 2009-
01443 is denied. The following are the conditions and they are attached to the approval:
I) That all proposals of the applicant shall be conditions of approval unless otherwise modified here.
2) That building permit submittals shall include:
a) That at the time of building plan submittal, material, design and screening information on the
trash and recycling facility shall be submitted to the staff advisor for review and approval. All
facilities shall comply with the standards adopted under AMC 9.22.030.
b) The inverted u-racks shall be used for the bicycle parking. All bicycle parking shall be installed
in accordance with design and rack standards in 18.92.040.1 and J prior to the issuance of the
certificate of occupancy. The building permit submittals shall verify that the bicycle parking
spacing and coverage requirements are met in accordance with 18.92.040.1.

3) That prior to the issuance of a building permit:
a) That the property owner shall sign an airport operations / avigation easement agreement with the
City of Ashland Public Works Department prior to issuance of the building permit.
4) That prior to the issuance of a certificate of occupancy:
a) That the screening for the trash and recycling enclosure shall be installed in accordance with the
Site Design and Use Standards Il-D-6 prior to the issuance of a Certificate of Occupancy. An
opportunity to recycle site of equal or greater size than the solid waste receptacle shall be
included in the trash enclosure in accordance with 18.72.115.B.
b) That all required parking areas shall be re-striped prior to the issuance of a certificate of
occupancy.
c) That a sign permit application shall be filed and approved prior to installation of new signage.

The Ashland Planning Division Staff has received a complete application for the property noted above.
Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winburn Way, Ashland,
Oregon 97520 prior to 4:30 p.m. on the deadline date shown above.
Ashland Planning Division Staff determine if a Land Use application is complete within 30 days of submittal. Upon determination of completeness, a
notice is sent to surrounding properties within 200 feet of the property submitting application which allows for a 14 day comment period. After the
comment period and not more than 45 days from the application being deemed complete, the Planning Division Staff shall make a final decision on the
application. A notice of decision is mailed to the same properties within 5 days of decision. An appeal to the Planning Commission of the Planning
Division Staffs deciSion must be made In writing to the Ashland PlannIng Division within 12 Clays from the date of the mailing of final decision. (AMC

The following criteria shall be used to approve or deny an application:
A. All applicable City ordinances have been met or will be met by the proposed development.
B. All requirements of the Site Review Chapter have been met or will be met.
C. The development complies with the Site Design Standards adopted by the City Council for implementation of this Chapter.
D. That adequate capacity of City facilities for water, sewer, paved access to and through the development, electricity, urban storm
drainage, and adequate transportation can and will be provided to and through the subject property. All improvements in the
street right-of-way shall comply with the Street Standards in Chapter 18.88, Performance Standards Options.

Summary for Commercial Development
Aqua Serene, Inc., does not propose to increase the square footage area of
buildings or impermeable surfaces on the site. There is no outdoor storage or
outdoor merchandising proposed for the site. Exterior elevations of all
buildings will remain the same as part of this change of use. The proposed
change of use and hours of operation for the site will not have a greater
adverse material effect on the liveability of the surrounding area than the
minimal impact 'target use' of the parcel, which is 'general office use',
See site plan map, Annexure 6, for exterior modifications proposed to
southeast side of proposed retail sales building, to include replacement of a
'garage door' with a window, and a proposed replacement of a solid exterior
'man' door with an exterior glass 'man' door, and a covered bike rack.
Parking Spaces:
The total number of parking spaces will be increased on the existing paved
parking area to 13. (More than required by AMC 18.92 Retail parking: nine
spaces, General office: one space, Warehouse: three spaces). One Disabled
Person Parking space is included as per AMC 18.92.030. Another two
contiguous, on-street parking spaces are included to provide a total of 15
automobile parking spaces, A covered bike parking shelter is to be located
near the retail entrance, on the existing paved parking lot area, A minimum
of four covered bike parking spaces will be provided as per AMC 18.92.0400.
Lighting will ensure that bike racks are illuminated during all hours of use.
Landscaping:
The square footage of landscaped areas will remain the same.
Energy Use:
The method and type of energy to be used for heating, cooling, and lighting
of the buildings shall remain primarily electric and gas. The current office
space has an electric heat pump and the west half of the warehouse
(proposed to be changed to retail sales) has a natural gas and electric fan
forced space heater. The east half of the warehouse is non-heated space.
Opportunity- To-Recycle Site:
Both the opportunity-to-recycle site and the common solid waste receptacle
shall be screened by 6' high cedar fencing in order to limit the view from
adjacent properties and public rights-of-way,

Energy Use (continued):
No changes to the existing heating, cooling, or lighting or electrical systems
are proposed. City-supplied utilities are of adequate capacity to support this
project. Additional lighting will be plugged into the existing electrical boxes.
The utility bills for the most recent occupants of the site for the calendar year
of 2008 are as follows: The annual amount paid to for the electric, water and
sewer bill was $1,629.41; the average monthly 2008 bill was $135.78. The
high was $151 and the low was $107. The annual amount paid to for natural
gas was $1,260.00; the average monthly 2008 bill was $105. The high was
$382 and the low was $7.
The approximate annual amount of electrical energy to be used for heating,
cooling, and lighting is estimated to be $10,035.00. The approximate annual
amount of gas energy to be used for heating is estimated to be $3,000.
The methods used to make this approximation were based on a doubling of
the energy use for the existing Aqua Serene garden store in Ashland, OR
which is half the size of the proposed Aqua Serene Retail Garden Center for
465 Applegate Way.
Signage:
The applicant, Aqua Serene, is seeking a Sign Permit Application in
accordance with AMC 18.92 prior to the installation of any signs on the site.
Two signs are proposed for installation, within pedestrian walking view, one
on the ground in front of the westernmost side of the building facing
Applegate Way, to be used for office/display space, and one on the exterior
of the building to be used for retail space, facing towards the southeast.
The width of the west side of the retail building facing Applegate Way is 48',
The size of the sign proposed for this side of the building is 3'h x 12'1 x12ffw,
to be placed two feet off the ground, near the west entrance to the building.
The material composition of this sign is proposed to be fiberglass or rigid
poly-plastic, with an aluminum or steel frame and pedestal anchored into the
ground, and with the option of having lights inside it to illuminate the sign at
night. The height above ground of this 'ground sign' will not exceed 5 ft.
The width of the southeast side of the display/retail/warehouse building is
144', and the size of the proposed wall sign for the face of this side of the
building is 3.5'h x 17'1 x 12"w, to be hung on the exterior wall of the
proposed warehouse building to the left or west or the existing doors. The
material composition of this sign is proposed to be fiberglass or rigid poly-
plastic, with an aluminum frame mounting onto the exterior wall, and with
the possibility of having lights inside it to illuminate the sign at night. The
height above ground level of this wall sign is proposed to be a min. of 8 ft.
Both proposed signs will be of the designs as per Annexure B, attached.

FINDINGS OF FACT SUBMITTAL:
The project is a change of use in an E-1 Zone from Manufacturing/Warehouse
use to a Retail garden center with a warehouse storage facility; on a site
bordering the west side of the Ashland Municipal Airport. All of the adjacent
properties are also in the E-1 Zone. The change of use involves only minor
remodeling of the interior and exterior of the building, as described in this
application, but does not involve any changes to the existing square footage
of buildings or impermeable surfaces on the site. The proposed retail and
warehouse spaces will each be 3,072 sq. ft., to be 'divided' from the existing
6,144 sq. ft. of manufacturing/warehouse space. The existing warehouse
space is currently divided by an interior wall which physically separates the
two halves of the building that are proposed to be used for retail and
warehousing, respectively. There is a 'ramped' service opening approximately
8 ft. wide between these walls that may be used to transport merchandise
from the warehouse to the retail gardening area via forklift. This interior wall
can be upgraded to meet specifications for a one hour fire wall, and the
ramped' service opening could be fitted with a closeable utility door if
required. Most of the additional 327 sq. ft. of existing office space is
proposed to be used as an indoor garden display and demonstration area for
fruits, vegetables, and houseplants. Approximately one third of the existing
office area will be retained for use as office space.
The major criteria to be observed are as follows: The westernmost of the two
bay garage doors, on the proposed retail side of the building, will be replaced
with a prefabricated window that fits into the space (8'h x 10'w). The
westernmost exterior, steel 'man' door on the proposed retail side of the
building will be replaced with a glass door (6'6"h x 3'w). These modifications
are not anticipated to increase adverse glare. The remaining loading garage
door and 'man' door on the proposed retail side will remain unchanged.
Since these doorways will not be in regular use, two parking spaces have
been placed in front of them. As part of the proposed plan, the remaining
operable garage door may be used occasionally for loading of customer
vehicles parked in the adjacent parking spaces. The number of parking
spaces on the existing paved parking lot is proposed to be increased to a
total of 13, with two of four contiguous on-street parking spaces contributing
to the number of required parking spaces. Covered bike parking and four
metal hitching post style bike racks are proposed to be located near the
southeast retail side entrance, on top of an existing paved parking lot area.
The original building project and landscaping were installed by the previous
owners of the 'Moffitt Industrial Building' in 1997. The building was expanded
to nearly twice its original size by the previous owner after a warehouse
expansion proposal was submitted to the City of Ashland in 2002. Since the
current proposed change of use involves only minor renovations and no
change in the building footprint, area of impermeable surfaces, landscaping,
irrigation, exterior lighting, or utility infrastructure, we hope you will approve
this change of use proposal.

18.72.070 Criteria for Approval
A. This development proposal meets or will meet all applicable City
ordinances.
B. This proposal meets or will meet all requirements of the Site Review
Chapter.
C. The development complies with the Site Design Standards adopted by the
City Council for implementation of this Chapter.
D. All City-supplied facilities have been exa mined and found to be of
adequate capacity to support this project. No street right-of-way
changes are required.
18.72.030 Applicability:
Minimal parking space relocation proposed should not affect circulation.
18.72.080 Basic Site Review Standards
18.32.020: The existing building complies with Permitted Uses.
18.40.020: The existing building complies with Permitted Uses.
18.61.200: All street trees are in place and are not being altered, thus
they comply with the requirements of this standard.
18.72.110 Landscaping Standards
Existing landsca pe screening and buffering is in place and conforms to
the respective requirements of these standards. The proposed change
of use does not interfere with the existing landscaping.
18.72.115 Recycling Requirements
Opportunity-to-recycle site and solid waste receptacle, including
proposed screening, is included in the proposed site design.
18.92 Parking Standards
The existing parking is on the south side of the building. New parking
will be provided on the same side of the existing building, with two
additional contiguous street parking spaces on the west boundary
credited towards the tota I number of required parking spaces. The
number of required parking spaces is met by the proposed site design.
The owner is willing to post a satisfactory performance bond to ensure
the installation of said a utomobile and bicycle parking facilities within
a reasonable time frame as may be specified by the City of Ashland.
