PERMANENT UTILITIES AND DRAINAGE WAY EASEMENT FOR CITY OF ASHLAND
1. Grant of easement. The above named Grantors grant to the City of Ashland, Oregon,
"Grantee," a perpetual non-exclusive easement in gross to construct, reconstruct, install, use,
operate, inspect, repair, maintain and remove and replace public utility facilities including but not
limited to, lines for electricity, sewer, water, gas and telecommunications on real property
described below and further referred to in this easement agreement as the "easement area" as
described on attached Exhibits A and C.
Grantors further grant to the City of Ashland, Oregon, a perpetual non-exclusive drainage way
easement in gross to construct, install, use, operate, inspect, repair, maintain, remove and
replace facilities necessary io carry storm and irrigation waters across the real property
described below and further referred to in this easement agreement as the "easement area" as
described on attached Exhibits Band C.
2. Use of surface. Grantors shall have the right to use the easement area for all purposes not
inconsistent with the uses and purposes of the property, provided that Grantors shall not build or
place any structure upon the easement area without the prior written consent of Grantee.
3. Access to Easement Area. Grantee, its agents, independent contractors and invitees shall
have the right of ingress and egress to the easement area for the purposes connected with this
easement.
4. Notice. Grantee, its agents, independent contractors and invitees shall, upon every occasion
that such public utility facilities are constructed, maintained, replaced, reconstructed, or
removed, provide Grantors reasonable notice and restore the premises of the Grantors, and any
buildings or improvements disturbed by Grantee, as near as practicable.
5. Termination. All rights hereunder shall cease if and when the easement area ceases to be
used for public utility purposes.
6. Prior Encumbrances. This easement is granted subject to all prior easements or
encumbrances of record.

Jackson County, Oregon and is on file in the office of the Jackson County Surveyor as No.
18691; thence along the northerly right-of-way line of Holly Street, North 89054' 19" West 15.00
feet; thence leaving said right-of-way line, North 00020' II" West 20.00 feet; thence South

A strip ofland 20.00 feet in width for drainage way easement purposes, lying 10.00 feet on each
side of the following described centerline:
Commencing at a found I Yz" diameter bronze disk situated at the centerline intersection of
Holly Street, westerly, and Idaho Street, northerly, said comer heretofore being reported as the
Southwest Comer of Government Lot four (4), in the Southwest Quarter of Section 9 in
Township 39 South, Range I East of the Willamette Meridian in Jackson County, Oregon, but
said bronze disk being only a title comer; thence South 89054' 19"East, along the northerly right-
of-way line of Holly Street a distance of 398.59 feet to a found 5/8 inch iron rebar located at the
Southwest comer of that tract ofland described in Instrument No. 2007-016131 of the Official
Records of Jackson County, Oregon, thence along the westerly boundary of said tract, North
00020' II" West 200.82 feet to the TRUE POINT OF BEGINNING; thence leaving said westerly
boundary, North 48046'40" East 5.06 feet; thence along the arc of a 24.00 foot radius curve to
the right (the long chord to which bears North 70007' I 0" East 17.47 feet) a distance of 17.88
feet; thence along the arc of a 33.00 foot radius 'curve to the left (the long chord to which bears
North 73037'56" East 20.21 feet) a distance of20.54 feet; thence North 55048'11" East 6.53
feet; thence along the arc of a 36.00 foot radius curve to the right (the long chord to which bears
