This is Amendment B to Agreement GC0010 09 (as amended from time to time the "Agreement between the State of Oregon acting by and through the Water Resources Department, hereinafter called Grantor, and City of Ashland, hereinafter called Grantee. 2. The Agreement is hereby amended as follows: a) Amendment GC0010 09A, if it exists, is hereby deleted in its entirety and replaced with this amendment. b) The Grant Award Amount in Sections 2 and 3 is amended to a maximum of $168,863. c) The amendment increases the total grant award by $57,607. d) The phrase "Water Conservation, Reuse and Storage Investment Fund" is deleted throughout the Grant Agreement and is replaced with "Water Conservation, Reuse and Storage Investment Fund and/or Water Resources Department Water Supply Fund." The phrase is found in Section 1; Section 2.01 (twice), Section 2.04 (twice), Section 2.05, Section 6.02 and Section 6.04. e) The Grant Budget, Section 2.02, of the Agreement is deleted in its entirety and replaced with the following: Budget Category Approved Budget Staff Salary/Benefits $0 Contractual $168,863 Equipment $0 Other $0 Administration $0 Subtotal $168,863 Expenditures from sources other than this grant program $168,863 Grand Total $337,726 f) Exhibit B of the Agreement is deleted in its entirety and replaced with Exhibit B, attached hereto and incorporated by reference herein. Except as expressly amended hereunder, all other terms and conditions of original Agreement are still in full force and effect. Grantee certifies that the representations, warranties and certifications contained in the original Agreement are true and correct as of the effective date of this Amendment and with the same as though made at the time of this Amendment. The original grant study elements were numbers 1 through 10, shown below. Study elements 11, 12, and 13 are new. Use of the grant funds is limited to the following study elements: 1. Develop RFP award Contract (contract oversight/management). 2. Review, analyze, validate and identify gaps in Ashland's existing water master plans and water sources. 3. Validate the City's future water needs to the year 2058. 4. Identify and fully describe all alternative water sources. 5. Identify options that explore the right water for the different water uses; potable, irrigation (sources and uses). 6. Identify benefits and challenges to using irrigation water. 7. Analyze environmental harm or impacts with the long term use of various irrigation water sources for City irrigation use. 8. Evaluate hydrological benefits and challenges and anticipate the effects of climate change with regard to water needs and water use. 9. Identify benefits and challenges to using recycled water. 10. Identify options and cost estimates. 11. Identify potential use of a water exchange to help meet wastewater treatment plant temperature limitations (TMDL). 12. Complete a consolidated engineering and financial feasibility study and cost benefit analysis of the preferred alternatives. Identify the link between conservation and enhanced conservation efforts and the preferred alternative. 13. Identify the specific community and public benefits accruing from the proposed alternative including estimated project costs, financing for the project and projected financial returns from the project. The grant funds cannot be used for the following study elements: Develop justification for the preferred alternative. Develop final report and present to the City Council. Throughout the process, utilize the support and community input form an Ad Hoc Water Reuse and Conservation Task Force that has been convened by the Mayor and Council Report to the Ashland City Council every 6 months with interim ideas and gain support or re- direction. Deliverables for the study shall include a report and addenda. The addenda shall include a table of contents or index that lists where the results of study elements 2 through 13 can be found. The amendment increases the total grant award by $57,607. Since lottery bonds have been issued sooner than anticipated, this money is available immediately.
