True and Actual Consideration:
PERMANENT BICYCLE AND PEDESTRIAN EASEMENT FOR CITY OF ASHLAND
1. Grant of easement. The above named Grantor grants to the City of Ashland, Oregon,
"Grantee," a perpetual non-exclusive easement in gross to construct, reconstruct, install, use,
operate, inspect, repair, maintain and remove and replace a public pedestrian easement and
sidewalk across, along and upon the real property described below and further referred to in this
easement agreement as the "easement area."
A five foot wide strip of land located within Lot 60, Block 3 of the Eureka
Addition to the City of Ashland, Jackson County Oregon being more particularly
described as follows:
Commencing at the Northwest corner of Lot 60, Block 3 of said addition, being
on the Southerly right.of way line of 'B' Street; thence South 00012' 26" West
along the boundary common to Lots 59 and 60 of said addition a distance of 5.00
feet; thence leaving said boundary line, South 890 57' 36" East, 10.00 feet; thence
North 000 12' 26" East, 5.00 feet to the Southerly right of way line of 'B' Street;
thence along said southerly right of way line North 890 57' 36" West, 10.00 feet
to the point of beginning, containing 50,0 square feet.
2. Use of surface. Grantor shall have the right to use the easement area for all purposes not
inconsistent with the uses and purposes of the property, provided that Grantor shall not build or
erect any structure upon the easement area without the prior written consent of Grantee.
3. Prior Encumbrances. This easement is granted subject to all prior easements or encumbrances
ofrecord.
