The Staff Advisor's decision becomes final and is effective on the 13th day after the Notice of Final
Decision is mailed.
Prior to that date, anyone who was mailed this Notice Of Final Decision may request a reconsideration of
the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance (ALUO)
18.1 08.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in the ALUO
18.1 08.070(B)(2)( c).
An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to
raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford
the decision maker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that
issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of
appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to
proposed conditions of approval with sufficient specificity to allow this Department to respond to the
issue precludes an action for damages in circuit court.
The application, all associated documents and evidence submitted, and the applicable criteria are available
for review at no cost at the Ashland Community Development Department, located at 51 Winburn Way.

DECISION
The application is a request for modification of a previously approved Site Review (P A #81-64) to allow the
construction of a new 305 square foot enclosed seasonal dining area, a 107 square foot covered trash and
recycling area, and a 126 square foot utility/storage area at Cucina Biazzi, located at 568 East Main Street.
These improvements have already been completed, and the applicant is now seeking the necessary approvals
to bring them into compliance with land use and building code requirements.
The subject property is located on the south side of East Main Street, between Fourth and Fifth Streets, just
east of Fire Station # 1. The parcel is rectangular, with approximately 65 feet of frontage along East Main
Street and an area of approximately 6,266 square feet. The property contains one existing building, located
near the center of the parcel. Parking is shared with the adjacent property to the south, and accessed via a
driveway from East Main along the property's western boundary, a driveway from Siskiyou Boulevard over
the property to the south, or via an alley from Sherman Street to the east. Natural features of the site are
limited to the landscaping associated with the restaurant, which is generally well-maintained.
The existing building is a single-story wood-frame cottage, designated as the Charles and Laura Rose House
and attributed to prominent local architect Frank C. Clark. The Ashland Railroad Addition Historic District
inventory document indicates that the craftsman bungalow was built around 1907 and is a "Historic
Contributing" resource within the district, noting the following: "The building was converted to restaurant
use under the name Clark Cottage in 1981 and is today operated as "Cucina Biazzi" following substantial
renovation. Although somewhat compromised by the last renovation efforts, the Rose House retains
sufficient integrity to relate its historic period of development."
Site Review approval was granted in 1981 as Planning Action #81-64 to allow the conversion of the then-
residence into a restaurant. That approval was based on shared use of the parking area between the proposed

restaurant and the adjacent property to the south at 505 Siskiyou Boulevard, the E.V. Carter House (which
now houses Earth Friendly Kids, a retail use). The approval allowed a 15 percent joint use parking credit,
and limited the restaurant seating to 40 patrons based on the 15 available parking spaces shared by the two
uses.
The current application notes that an outdoor patio was installed on the east side of the building several years
ago, and that the application now requests approval for the enclosure of the 305 square foot area to provide
"three-season" seating. In addition, the application includes requests to approve an enclosure of a 126-
square foot utility/storage area at the southwest comer of the building, the addition of a 107 -square foot
trash/and recycling enclosure, and the addition of new bicycle parking on the covered front porch of the
building.
The work proposed was completed without necessary pennits, and concerns were expressed by the Building
and Electric Departments during a compliance action. Specifically, the Building Department identified
issues relating to accessibility requirements for the landing, deck or other means of egress exit discharge at
north elevation of the addition, and both Departments noted that work done in the immediate area of the
primary electric service panel was a concern as it restricted required access.
Given that the existing restaurant use is commercially zoned and previously received Site Review approval,
the primary issues of concern in considering the proposed additions are that concerns of the Building and
Electric Department are adequately addressed, that the proposed additions to the contributing historic district
resource the Charles and Laura Rose House are acceptable to the Historic Commission, and that the parking
provided is adequate to serve the demand created by the additional seating proposed.
With regard to the Building and Electric Departments' concerns, electrical pennits have now been obtained,
and both the Electric and Building Departments have indicated that their issues relative to the primary
electric service panel have been satisfactorily resolved. The applicants continue to work with the Building
Department's Plans Examiner to resolve the accessibility issues, and a condition of approval has been added
below to require that necessary fees be paid, that building pennits and inspections be obtained and that
Building Department requirements be satisfactorily addressed prior to occupancy of the addition.
The Historic Commission reviewed the proposal at its meeting of July 8th, and was generally supportive of
the proposal with some modifications to a new gate on the west wall and inset detail for the east wall which
were presented at the meeting, and removal of a mural of a door and trees that was painted on the west side
of the building. These recommendations have been incorporated into the conditions of approval detailed
below.
The original Site Review approval granted in 1981 allowed 40 seats; this was based on the shared use of
available parking with the property to the south at 505 Siskiyou Boulevard and included a 15 percent
reduction in the required parking as a joint-use credit. With the proposed addition, the current application
notes that seating would be limited to 42-44 seats, with 26 indoor seats available year-round and an
additional 16-18 "three-season" seats available on the proposed enclosed patio. The application materials
provided indicate that the shared parking arrangement remains in effect, and include a site plan showing 13
shared parking spaces and a copy of a 1983 "Special Warranty Deed" for the purchase of the property which
recognizes an easement for joint use of parking. The applicants have also noted that the uses sharing the
parking are completely offset, in that the Earth Friendly Kids retail use at 505 Siskiyou Boulevard closes

daily at 5:00 p.m. while the restaurant on the subject property does not open until 5:30 p.m. Given that the
proposed two-seat increase in seating at this well-established restaurant is minimal, that the available parking
is adequate to meet the required II space demand, and that the peak parking demand generated by the uses
sharing the parking are to be completely offset, the automobile parking requirements are satisfactorily
addressed by the proposal. Conditions of approval have been included below to require that hours of
operation, indoor seating and three-season patio seating be limited to that described. The applicants have
proposed to provide required bicycle parking on the covered front porch of the building, and a condition has
been included to require that the number, type and placement of required bicycle parking be consistent with
ordinance requirements.
The criteria for Site Review Approval are described in AMC Chapter 18.72.070, as follows:
A. All applicable City ordinances have been met or will be met by the proposed
development.
B. All requirements of the Site Review Chapter have been met or will be met.
e. The development complies with the Site Design Standards adopted by the City Council
for implementation of this Chapter.
D. That adequate capacity of City facilities for water, sewer, paved access to and through
the development, electricity, urban storm drainage, and adequate transportation can and
will be provided to and through the subject property.
The application with the attached conditions complies with all applicable City ordinances. Planning
Action 2009-00710 is approved with the following conditions. Further, if anyone or more of the
following conditions are found to be invalid for any reason whatsoever, then Planning Action 2009-
00710 is denied. The following are the conditions and they are attached to the approval:
I) That all proposals of the applicant including the hours of operation, number of indoor and three-
season patio seats described, and the new gate detail and wall infill proposals presented at the
July 8th meeting of the Historic Commission shall be conditions of approval unless otherwise
modified herein.
2) That the plans submitted for the building permit shall be in substantial confonnance with those
approved as part of this application. If the plans submitted for the building permit are not in
substantial confonnance with those approved as part of this application, an application to modifY this
Site Review approval shall be submitted and approved prior to issuance of a building permit.
3) That the requirements of the Building Department, including but not limited to necessary
accessibility modifications, shall be conditions of approval, and shall be satisfactorily addressed,
inspected and approved prior to the issuance of a certificate of occupancy for the proposed
addition.
4) That the recommendations from the July 8,2009 meeting of the Historic Commission that the
mural of the door and trees on the west side of the building be removed shall be conditions of

approval, and the mural removal shall be complete prior to the issuance of a certificate of
occupancy for the proposed addition.
5) That required inspections by the Jackson County Health Department shall be conducted as
required by the laws of Jackson County or the State of Oregon.
6) The inverted u-racks shall be used for the bicycle parking. All bicycle parking shall be installed in
accordance with design and rack standards in 18.92.040.1 and J prior to the issuance of the certificate
of occupancy. The building permit submittals shall verify that the bicycle parking spacing and
coverage requirements are met in accordance with 18.92.040.1.

The Ashland Planning Division Staff has received a complete application for the property noted above.
Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winburn Way,
Ashland, Oregon 97520 prior to 4:30 p.m. on the deadline date shown above.
Ashland Planning Division Staff determine if a Land Use application is complete within 30 days of submittal. Upon determination of
completeness, a notice is sent to surrounding properties within 200 feet of the property submitting application whic lows for 14 day
comment period. After the comment period and not more than 45 days from the application being deemed complete, lann ivision

The main portion of this two-story vernacular wood frame dwelling was built some prior to
October 1890. In July 1902 the Ashland Tidings reported that Jesse McCall [is building] an
attractive 'dwelling on East Main Street at a cost of about $1500." This apparently refers to
additional remodeling or a major addition to the earlier structure. Subsequent additions to the
rear, based upon available Sanborn Fire Insurance Maps, all date prior to 1911. McCall, son of
Martin L. McCall the original developer of this part of Ashland, lived in this house for a number
of years. Following McCall's divorce, the house was sold to Charles Rose, who maintained it as
a rental until 1923. Later owners included George L. and Sarah Carey who apparently oferated
the building a multiple family rental. Since the 1970s the McCall has been in commercia use as
a hair saloon. While somewhat modified with asbestos shingle siding and other changes, the
McCall House retains sufficient integrity to relate its historic period of development.

This single-story wood-frame cottage was built prior to June 1907 possibly for Jesse McCall but
has long been known as the home of Charles and Laura Rose. Rose, who with his brother
operated the Rose Brothers Confectionery for over 20 years. The building is attributed to
locally prominent architect Frank Chamberlain Clark but than has not been conclusively
documented. The Roses remained the owners of the property until 1923 although by 1920 they
were apparently renting to Osmer W. Long, an SP Railroad conductor, and his wife Eliza.
Followmg Eliza's deatli, Long married a neighbor, Minda DeWitt and the couple lived in this
home. Minda Long retained ownership and resided here until her own death in the 1960s. The
building was converted to restaurant use under the name Clark Cottage in 1981 and is today
operateo as "Cucina Biazzi" following substantial renovation. Although somewhat
compromised by the last renovation efforts, the Rose House retains sufficient integrity to relate
its historic period of development.

This parcel remained vacant throughout the primary period of significance and it was only-
following a rather complex transfer of property that it came into die possession of Osmer ana
Minda Long, who lived immediately to the west. The Longs may. have had this structure built
for rental pUl:poses sometime prior to 1948, when it appears on Sanborn Fire Insurance Maps,
but it is consioered likely that the dwelling was moved onto this site sometime after WWII and
may have been one of the many structures from Camp White that were relocated throughout the
Rogue Valley during that period. The Long Rental was renovated in 1992 in connection with
the construction of the separate structure to the rear and while modified, continues to reflect its
historic period of development.
Built by Ashland contractor R B. Meiser in 1992, the separate two-story tri-plex at the rear of
the parcel is identified as ID# 369.100 and considered to be a Non-Historic, Non-Contributing
feature.

Re: Design Narrative for New Enclosed Patio for Cucina Biazzi, 568 East Main Street
Derek;
Several years ago the building and business owner of the restaurant listed above had installed an
outdoor patio to allow dining patrons additional eating options. He now wishes to enclose part of that
patio to allow for three season dining.
In order to do that, several modifications under the review of the Building Department are required to
the existing building, including relocating the main electrical meter to a location on the building outside
the patio enclosure. That has already been accomplished.
The building and site are located in the C-1 Zone within the Ashland Historic District and the Detailed
Site review area. As such, the proposed change is to be reviewed under the Detailed Site Review
Standards, Code Section II-C. Following is my analysis of how this proposed change complies with those
standards:
II-C-2a Orientation and Scale
The existing business is housed in a former residence. Great care has been taken to maintain the
exterior of the building and its street scale and presence. Several years ago a patio space was added to
the rear and side. This proposal seeks to cover a portion of that patio along the side of the original
structure with a cover and walls. The covered portion is set back from the street and the scale is in
keeping with the scale of the original structure. It slopes low to the side, so it has a minimal impact on
the neighbors. IN fact, things will probably be quieter with the cover.

II-C-2c Parking and On-Site Circulation
All parking is in the rear, as required by code. Parking is within a shared lot with a retail business
fronting on Siskiyou Blvd (see attached deed). No change is contemplated in the parking. There are
enough parking spaces within the lot to meet seating requirements in the restaurant (see the plan)
II-C-2d Buffering and Screening
Buffering has already been accomplished with the construction of the 6-foot high decorative masonry
wall that already exists. The patio structure will rise approximately 1- 1/2 above the wall and will extend

in a single slope from the existing building eave line. On other parts of the common property line
buffering and screening are accomplished with mature shrubs.
II -C-2e Lighting
Not applicable - patio lighting already exists and meets this criterion No other exterior lighting is
proposed for this addition.
II-C-2f Building Materials
Building materials will be compatible with the existing construction and reflect the scale of what would
be expected in an addition to such a structure (such as an enclosed porch or sun room) at the time in
history when the original structure was built.
We further believe the proposed addition to the building would be classified as a renovation or a minor
addition, which is probably best reviewed under the Design Standards for new development. Following
is my analysis of how this proposed change complies with those standards:
IV-C-1 Height
The height of the proposed addition is in keeping with buildings constructed within the historic era of the
original structure.
IV-C-2 Scale
The scale of the proposed addition relates to the scale of the existing building. It will be single story
with a shed roof.
IV-C-3 Massing
The proposed addition will blend into the massing of the original structure and will look like it has always
been a part of it.
IV-C-4 Setback
There is no side yard setback requirement in the C-1 zone. The properties located adjacent to this
structure are also zoned C-1, so there is no zoning setback requirement from adjacent structures.
IV-C-5 Roof Shapes
The form of the roof will be compatible with roof shapes found on other buildings in the area of a similar
vintage to the original structure. The form also mimics the simple roof splanes found on the original
structure.
IV-C-6 Rhythms of Openings
The openings from the proposed addition onto the balance of the patio will be reminiscent of a three-
season porch or sun room that would typically have been constructed on residences of this era.

This proposed addition will reflect the height, scale and detailing of the original structure.
I believe the above comments address all the applicable Standards for the proposed change to the 568
East Main Street. I am available to answer any questions you might have.

I would like to add a covered patio addition to the southeast side of my restaurant Cucina
Biazzi. This solid tongue and groove wood shingled roof would replace myoId existing open air
arbor in the back comer of my patio. The 5/12 roof is ahnost hidden from the front view of the
restaurant on east main by the 8' concrete block back corner wal] built in 1991. It will be
supported by an existing concrete and steel rebar filled concrete block wall built on a 2' concrete
pier. The roof will also be supported by a 4 x 12 beam across the 20' length of the patio cover.
The covered space is 20 x 16. 320 square feel. Under the covered area there will be seating for
16 to 18 (down from the old open air arbor seating 01'24), with a wait station and a "ventless"
fireplace with natmal gas logs. It will also have exterior electrical plugs and a ceiling fan and
light. I would like to put 48" ascetic only French doors for appearance and ventilation only, but
if this confuses the exit plan we can replace with a window.
At the same time, I would like to enclose my element exposed ice machine, freezer and
walk-in by enclosing a southwest walkway under the existing shed roof. Over my 17 years tllis
fenced in, half covered area has been a constant problem area of vandalism and theft. I also want
to continue the shed roofto cover and make more attractive my garbage area. This northwest
shed roof will be supported by two 6x6 posts anchored 2 feet into the ground by concrete. A
washable slab under the shed roof will be added for sanitary washable reasons.
I will also be replacing myoId eyesore outdoor ice/water station with a more attractive
smaller marble enclosed mini station.
T have already submitted photographs and a site plan survey to Adam Hanks. These
additions will bring a much needed uplift to the appearance of my west side
maintenance/garbage area and an additional area protected from summer rainstorms for my
patrons in the precious outdoor days of May through October. Being such a small indoor
restaurant (26 seats), my survival depends heavily on the precious late spring and summer
tourist season. The enclosed walk-en and ice machine will be more energy efficient and add
security as well. I have never received any Historic District tax notices and since the city
approved a variance for a zero lot line apartment building immediately adjacent my proposed
addition, I assumc I am not breaking any historical guidelines. But I don't know that for sure.
r have 26 indoor seats and eleven parking places. The parking spaces are deeded,
recorded and filed. The new Fire Station construction did add an additional two spaces a few
years ago that 1 share with the Victorian house behind me.
