Notice of Final Decision
On October 7,2009, the Staff Advisor for the Ashland Planning Division administratively approved your
request for the following:
A Site Review approval to operate a bookstore in the existing building located at 264 Fourth Street, which
previously contained an auto repair shop. No additional square footage is being proposed as part of this
application.
The Staff Advisor's decision becomes final and is effective on the 131h day after the Notice of Final
Decision is mailed.
Prior to that date, anyone who was mailed this Notice Of Final Decision may request a reconsideration of
the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance (ALUO)
18.1 08.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in the ALUO
18.108,070(B)(2)(c),
An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to
raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford
the decision maker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that
issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of
appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to
proposed conditions of approval with sufficient specificity to allow this Department to respond to the
issue precludes an action for damages in circuit court.
The application, all associated documents and evidence submitted, and the applicable criteria are available
for review at no cost at the Ashland Community Development Department, located at 51 Winburn Way.
Copies of file documents can be requested and are charged based on the City of Ashland copy fee
schedule.

DECISION
The proposal is a request for a Site Review approval to operate a bookstore in the existing building located
at 264 Fourth Street, which previously contained an auto repair shop. No additional square footage is being
proposed as part of this application.
The subject property is located on the east side of Fourth Street between A and B Streets. The parcel is
rectangular with a 25-foot wide frontage along Fourth Street, and 142 feet of frontage along an alley that
runs along the north side of the property, connecting Fourth and Fifth Streets. The subject property is zoned
Employment (E-l) and is located within the Ashland Railroad Addition Historic District. The existing
building is identified as the "Ashland Hose Company No.2 Building" in the survey of resources within the
district, and is described as:
A single-story bearing masonry building constructed of cast concrete block, this structure was built in 1908 as
Ash/and's second fire station, to serve the thriving Railroad District. Motivation for the structure likely
stemmedfrom a devastatingfire in May 1903 that destroyed much of the Fourth Street commercial corridor....
The building also served as an auxiliary police station, complete with drunk tank, probably a l1ecessity given
the many bars and taverns located here during the railroad's heyday.... The Ashland Hose Company No.2
Building retains exceptionally high integrity and effectively relates its original period of significance.
The building was recently renovated by the applicants, and their efforts earned an award from the Historic
Commission during the 2008 National Historic Preservation Week activities for "Historically Compatible
Commercial Renovation," In making this award, the Commission noted:
After consulting with preservation specialist, George Kramer, the first order of business was to restore the
"Miracle Block" masonry exterior. Ashland Plaster Company painstakingly reproduced the molded texture
on the extensively broken and crumblingfafade. Jay Treiger, historic window specialist, restored the large
original wood window sashes and again making them operational. On the interior, the aluminum corrugated

ceiling was blackfrom decades of coal burning in a pot belly stove and automotive grease. The shine is back,
adorned with new lighting and an exposed duct heat system. The 1920 gas pump restoration, just completed
after 14 months of work, sits proudly on the sidewalk and anew periodfire bell is again on top of the building
that now houses many of the historical items from the firehouse, railroad and garage.... {The applicants 1
dedicated efforts to both the building restoration and the ongoing historical display are a wonderful and
inspiring example of preservation and why "places like this matter".
Fourth Street is designated as a neighborhood street, and is paved in this vicinity with curbs, gutters and
curbside sidewalks in place along the subject property's frontage.
Site Review
As noted above, the building is pre-existing with an established orientation to the Fourth Street pedestrian
streetscape, and an award-winning renovation was recently completed. No additional modifications beyond
the intensification of use described have been proposed. The proposal to change the use from its previous
split use of automobile repair (a special pennitted use) and auto parts retail (a pennitted use) while operating
as Haskin's Garage to Rogue Books, a used bookstore entirely dedicated to retail involves a more intensive
occupancy and increased parking demand, thereby requiring Site Review approval per AMC
18.72.030.A.1.e.
Since the building is existing, with an established orientation to the streets cape, and there are no additional
modifications are proposed, the primary focus of Site Review approval is ensuring that adequate parking is
to be provided and is to be installed according to City standards, and to verify that the signage complies with
the City's Sign Ordinance.
In tenns of required parking, the previous split of 625 square feet ofthe 1,250 square foot building operating
as retail and the remaining 625 square feet operating as an automobile repair shop required three parking
spaces ({625/350} + {625/700} = 2.69). With the intensification to full retail use of all 1,250 square feet of
the building, four parking spaces are required (1,250/350 = 3.57). While no off-street parking had
previously been provided, the applicants have proposed to provide two off-street parking spaces at the rear of
the parcel to address the increased parking demand associated with the proposed intensification of use. The
applicants have proposed to surface these parking spaces in gravel to remain in keeping with the historic
character of the neighborhood. Section 18.92.070.E.1 of Ashland's Municipal Code includes standards that
required parking be ''paved with concrete, asphaltic or comparable surfacing..." In discussions between
City staff, the Historic Commission and the applicants, it appears that "Hollywood strips" or a similar paver
treatment would satisfy the paving requirements of the ordinance while addressing concerns for historic
compatibility as well. A condition has been added to require that the two parking spaces be installed in
"Hollywood strips" or other similar historically compatible surface treatment which complies with the
paving requirements of the ordinance prior to occupancy.
In tenns of signage, the application materials suggest that the existing Haskin's Garage signage on the
building fa~ade is exempt from regulation as an original historic sign, and that the remaining awning sign,
window sign, and small sandwich-board "open" sign which have been placed are all exempt from regulation.
While recently recognized by the Historic Commission both in giving the applicants an award for
"Historically Compatible Commercial Renovation" and in the Commission's review of the current
application, the Haskin's Garage sign has not been fonnally placed on the Historic Sign Inventory and thus
cannot be considered exempt. Placement on the inventory requires that the applicants fonnally request this

recognition from the City Council, pay a "Type r' application fee, and provide findings in support of the
request. In addition, the three signs which are specific to the "Rogue Books" used bookstore use exceed the
number and area of small incidental exempt signs allowed. Outside of the Downtown Design Standards
Zone, only two such signs are allowed and they may not exceed two square feet per sign. A condition has
been added to require that the applicants' signage be brought into compliance with the Sign Ordinance
standards and necessary sign pennits obtained within ninety days of this approval. (Should the applicants
choose to pursue placement of the Haskin's Garage signage on the Historic Sign Inventory through
application to Council, additional time would be allowed for the completion of the application process.)
The Historic Commission considered the request at their meeting of September 2nd, 2009. Commission
discussion suggested that they felt that a bookstore was a good use of the building and they recommended
approval of the application. Commissioners also indicated that they hoped that the old signs would remain
in place, and that the parking be surfaced in a manner compatible with the historic building and its
surroundings, such as using "Hollywood strips."
The criteria for Site Review Approval are described in AMC Chapter 18.72.070, as follows:
A. All applicable City ordinances have been met or will be met by the proposed development.
B. All requirements of the Site Review Chapter have been met or will be met.
e. The development complies with the Site Design Standards adopted by the City Council for
implementation of this Chapter.
D. That adequate capacity of City facilities for water. sewer, paved access to and through the
development, electricity, urban storm drainage, and adequate transportation can and will be
provided to and through the subject property.
As noted above, the existing building is a strongly established element within the Ashland Railroad Addition
Historic District and on the Fourth Street streetscape, and was recently the subject of an award-winning
renovation by the applicants, With the addition of the two parking spaces to address the intensification of
use proposed, and the conditions listed below, the application merits approval.
The application with the attached conditions complies with all applicable City ordinances. Planning Action
2009-01106 is approved with the following conditions. Further, if anyone or more of the following
conditions are found to be invalid for any reason whatsoever, then Planning Action 2009-01106 is denied.
The following are the conditions and they are attached to the approval:
I) That all proposals of the applicant shall be conditions of approval unless otherwise modified herein.
2) That two parking spaces shall be installed according to the approved plan, inspected, and approved
by the Staff Advisor prior to the issuance of an occupancy permit. Parking spaces shall be surfaced
in "Hollywood strips" or a similar historically compatible material which will satisfy the standards of
AMC 18.92.070.E.I.
3) That a single inverted U-rack for bicycle parking shall be installed according to the approved plan,
inspected and approved by the Staff Advisor prior to the issuance of an occupancy permit. The
applicants shall obtain the necessary Encroachment Permit from the Public Works/Engineering
Department for the placement of this rack within the public right-of-way.

4) All signage shall meet the requirements of Chapter 18.96. Sign permits shall be obtained within 90
days for any signage not exempt under the allowance for two small incidental signs not to exceed
two square feet per sign. Should the applicants pursue listing of the Haskin's Garage signage on the
Historic Sign Inventory, additional time would be allowed for the completion of this application
process.
5) That the applicants shall obtain a City of Ashland business license prior to operation of the
bookstore.
6) That the requirements of the Building Division that the entry hardware and threshold be improved
for accessibility compliance shall be satisfactorily addressed prior to the issuance of an occupancy
permit.
7) That the requirements of the Fire Department including obtaining mercantile occupancy
classification and the installation of approved addressing shall be satisfactorily addressed prior to
occupancy.

Parking Compliance for 264 4th Street
After meeting with Angela Barry on Wednesday, July 12,2009 at the site,
264 4th Street we submit this letter and zoning permit application for
parking compliance of retail space at this location.
The Pre-Application Conference Comment Sheet of March 18,2009
amended by follow up letter from Planning Staff of July 19,2009 points
up a requirement of two vehicle parking spaces at this site. We intend to
bring this site into compliance by dedicating two parking spaces (see
attached site plan of August 17, 2009). We plan to move a gated fence
and extend the existing gravel surface by 6 feet. The existing parking
area has historically been dirt and gravel (see photo); a tradition we
would like to maintain. We have restored this building with its historic
ambience and appearance and would like the parking to follow suit.
Over the past 27 years we have observed the steady growth of the 4th
Street block between A & B Street. Most people walk and bicycle in the
neighborhood visiting galleries, etc. in support of this we would like to
offer a bike rack next to the gas pump (also per site plan).
The existing building already has all utilities and one additional
improvement is required at this time (per Mike Broomfield's comments in
the Pre-App Sheet) we will improve the entry threshold by feathering the
concrete for the accessibility compliance.
The current retail tenant "Rogue Books" plans to have only three exempt
signs to identify the business (see attached photo with markings of
August 19th). If further signs are planned, "Rogue Books" will file a Sign
Permit at that time.
