According to the cOlnplaint those security personnel have not been hired or used at the present and Inay not be in place for sOlne tilne despite incidents resulting in citations for alcohol, drug use and public urination imlnediately outside the events. The subject project is located on a 1.04-acre property, between Oak Street and Pioneer Street adjacent to "A" Street. The zoning is E-l, Employment and the property is located within the Railroad Historic District. Development on the subject property requires Site Review approval and is subject to the Basic Site Review Standards, Detailed Site Review Standards, and the Historic District Design Stf.lndards, however with the current proposal no exterior changes to the exterior of the building or to the site are proposed beyond the installation of signage and as such, the review here is limited to the proposed use and associated impacts, including parking and noise, as they relate to the Site Review and Conditional Use Permit approval criteria. The restaurant use is proposed to utilize 3,674 square feet of the building as a fully organic, alcohol-free vegetarian restaurant to be open day and night with 56 seats. The daytime hours of operation are described in the application as 10:00 a.m. to 6:00 p.m., and nighttime hours of operation are 6:00 p.m. to midnight, Wednesday through Sunday. The application notes that they have been allocated 18 parking spaces by the property owner to accommodate the restaurant use, with 16 spaces to address the restaurant demand and two spaces for the applicants' office use. The off-street parking required for a 56 seat restaurant is 14 spaces. The performing arts center is proposed to feature a wide variety of community-based events including lectures, musical performances, workshops, art shows, and community forums. The performing arts space is to consist of the 3,674 square feet used for the restaurant and 2,171 additional square feet of public space. Events are proposed to be scheduled during night time hours, from 8:00 p.m. to 2:00 a.m. Wednesday through Sunday. The application proposes to accommodate up to 250 attendees, and at a requirement of one parking space per 4 attendees, 63 parking spaces are required to accommodate this use. P A #2010..00025 310 Oak St.ldds Page 1 The application includes an assessment of the available parking and the parking demand associated with the existing and proposed uses prepared by property owner Brent Thompson. Thompson identifies a total of 44 off-street parking spaces available in the existing parking lot, and shows an additional 25 spac~s available along the three street frontages of the subject property which he equates to 19 on-street parking credits, for a total of 63 available parking spaces, which is sufficient to cover the full parking demand for the proposed performing arts space use. The application notes that nearly all of the businesses in the complex are limited to daytime use, with only Chun's restaurant (open until 9:00 p.m.) and the Video Explorer (open until 10:00 p.m.). open into the evening. The application further explains that evening hours are not a period of peak demand for either of these other uses, and that many of the evening events in the performing arts space would begin after 9:00 p.m., after Chun's has closed, to further offset any impact in parking demand. (Thompson notes that he would also request the 50 percent parking variance allowed by ordinance for existing buildings within the Historic District, however no formal application, findings or fees have been provided for such a Variance, and as such a Variance is not being considered as part of the current request.) In staffs view, the materials provided clearly demonstrate that with the combined off-street parking provided, on-street parking credits available, and an off-set of hours of operation and thus ofparking demand with other uses in the building, the parking demand for the proposed use is satisfied. In addition, while the applicants have not provided a formal lease agreement, nearby businesses Umpqua Bank and Crane Property Management have both provided letters of support for the proposal and have indicated that they are open to parking by clientele of the performing arts space using their available parking, a total of 24 additional parking spaces, during the evenings. The application materials provided note that a sound analysis has been conducted by a certified audiologist from Aural Teclmology, with a finding that because the venue is situated well within the main complex it offers excellent sound insulation which contains noise to a substantial degree. The materials provided note that during a four hour monitoring at the entrance to the complex with the main doors open and an interior sound reading of 110 decibels, the exterior reading was only 75 decibels - five decibels below the sound of passing vehicles. The audiologist concludes that the noise generated by passing vehicles would generate more noise than is likely to leak from the performing arts venue during events, however he stipulates that in order to control any. noise emanation, his recommendation would be that the inner doors should remain closed during performances. A condition to this effect has been included below. The application further notes that in addition to providing sufficient parking for the proposed use, and an alcohol- free family-oriented use, they will also be employing professional, bonded security to patrol the front of the building and parking lot to deter loitering outside of the building. The Historic Commission reviewed the proposal at their February 3, 2010 meeting. The Commission commended the applicants for preparing a very thorough application, and indicated that they believed the use was ideal for the location, that there was sufficient parking, and they expressed their support for the application. In Staff s opinion, the approval criteria for Site Review and Conditional Use Permit approval are met by the proposal. There are no exterior changes proposed to the existing building or site and public facilities are already in place serving the building. The application has demonstrated that the parking demand is met for the daytime restaurant use, and that the parking demand for the more intense night time use is accommodated through the available off-street parking, on-street credits, and an off-set in parking demand, PA #2010-00025 310 Oak St.ldds Page 2 as required for a mixed use parking credit, because other uses within the building are closed during the proposed hours of operation of the performing arts venue. In addition, the applicants have provided an analysis demonstrating that noise should not impact surrounding uses if the doors to the venue are closed during performances, and have indicated that the venue will be alcohol free and that security patrols are to be provided during events. The criteria for Site Review approval are described in AMC Chapter 18.72.070 as follows: A. All applicable City ordinances have been met or will be met by the proposed development. B. All requirements of the Site Review Chapter have been met or will be met. c. The development complies with the Site Design Standards adopted by the City Council for implementation of this Chapter. D. That adequate capacity of City facilities for water, sewer, paved access to and through the development, electricity, urban storm drainage, and adequate transportation can and will be provided to and through the subject property. The criteria for Conditional Use Permit approval are described in AMC Chapter 18.104.050 as follows: A. That the use would be in conformance with all standards within the zoning district in which the use is proposed to be located, and in conformance with. relevant Comprehensive plan policies that are not implemented by any City, State, or Federal law or program. B. ,That adequate capacity of City facilities for water, sewer, paved access to and through the development, electricity, urban storm drainage, and adequate transporlation can and will be provided to and through the subject properly. C. That the conditional use will have no greater adverse material effect on the livability of the impact area when compared to the development of the subject lot with the target use of the zone. When evaluating the effect of the proposed use on the impact area, the following factors of livability of the impact area shall be considered in relation to the target use of the zone: 1. Similarity in scale, bulk, and coverage. 2. Generation of traffic and effects on surrounding streets. Increases in pedestrian, bicycle, and mass transit use are considered beneficial regardless of capacity of facilities. 3. Architectural compatibility with the impact area. 4. Air quality, including the generation of dust, odors, or other environmental pollutants. 5. Generation of noise, light, and glare. 6. The development of adjacent properties as envisioned in the Comprehensive Plan. 7. Other factors found to be relevant by the Hearing Authority for review of the proposed use. Planning Action P A #2010-00025 is approved with the following conditions. Further, if anyone or more of the following conditions are found to be invalid for any reason whatsoever, then Planning Action P A #2010- 00025 is denied. The following are the conditions and they are attached to the approval: 1) That all proposals of the applicant, including but not limited to the hours of operation, occupant load, alcohol-free operation, hiring of licensedlbonded security for performances, and closure of doors during performances shall be conditions of approval unless otherwise specifically modified herein. That plans submitted for building permit shall be in substantial conformance with those approved as part of this application. If the plans submitted for the building permit are not in substantial conformance with those approved as part of this application, an application to modify the Conditional Use Permit approval shall be submitted and approved prior to issuance of a building permit. That all requirements of the Building Department shall be satisfactorily addressed prior to occupancy or commencement of the use, including but not limited to that any building permit plans must be drawn by an Oregon-licensed design professional, must include a means of egress and egress lighting, that stage curtains meet requirements for smoke density and flame spread, and that access to bathrooms shall remain available during business hours. That all requirements of the Fire Department shall be satisfactorily addressed prior to occupancy or commencement of the use, including approved addressing and occupant load. Zone Designation - E 1 Applicant: Christopher Iverson and Samantha Sperry Ph: 541 482 0132 PROJECT DESCRIPTION: The AsWand Cultural Center will be an organic vegetarian restaurant and family oriented~ alcohol free community arts venue that will promote lifestyles of optimum health and sustainability. The project is located at 310 Oak St #4 in Ashland and will occupy 3674 sq.ft of space. To fully realize the vision of creating a multi faceted community art space~ the applicant wishes to apply for a conditional use permit with unrestricted hours. To clearly describe the main components of the project this application will be separated into two main sections. Each section will individually address all the application criteria and any concerns that may arise from our proposed uses~ Sectio~ one: Restaurant: The planned restaurant will be the only fully organic vegetarian restaurant in Ashland and will feature a menu that is created by locally sourced produce. The restaurant will open day and night and will be alcohol free. Section two: Performing Arts Venne: The performing arts venue will feature a wide variety of community based events including lectures, music performances, workshops, art shows, community forwns ~d so on. Night time - 6pm to Midnight Wednesday to Sunday Food Concept: Fully Organic vegetarian restaurant featuring dishes that are created by locally sourced produce. The restaurant will promote a lifestyle of health and sustainability and will work closely with local farms. It will also offer a wide selection of juices and shakes and items for special diets, such as raw, vegan) wheat and gluten free, etc. Number of Seats: 56 seats. (11 x 4 top tables, 4 x 2 top tables, Internet zone - 4 seats) Square foot: 3674 sq.ft - Includes public seating areas and kitchen. PARKING: Daytime Usage: Given the already existing parking allotments assigned to the building, it is evident that there is adequate parking available to accommodate our parking needs for the daytime restaurant hours. The table below provides a detailed outline of parking allotments for the entire property. The owner of the property has verified this to be correct. Given that the AsWand Cultural Center has been allocated 18 car parking spaces (16 for cafe plus 2 for offices), this equals an occupancy load of 72 persons. (4 people x 18). SIGNAGE The applicant has verified with the owner the amount of signage allowed for the building. The applicant proposes to install a professionally made sign of 8 sqft to be located with the other business signs on the front of the building above the main sliding doors. 8 3 SECTION TWO: PERFORMING ARTS VENUE Hours of Operation: Night time - 8pm to 2am - Wednesday to Sunday. Conf;cpt: The Performing Arts venue component of the Ashland Cultural Center will offer a 4iverse selection of inspiring community events~ focusing on events that promote a lifestyle of health and sustainability_ To ensure that the space will meet the diverse needs of the Ashland community our programming will cater to both young and old, especially young families.. Events will include public speaking forums, mu~ic and theater, conscious dance, workshops featuring internationally renowned teachers, film nights and so on. The venue will be alcohol free and open to all ages. The large square footage of the . main space will also provide the much needed "meeting room" area that many local non- profits and community groups need in our town. We have had discussions with many community groups in Ashland and they are keen to utilize the space. Organizations include, In My Village/Heart Circles, Web Spirit Community, The WeIlness Guide, The Beloved Community, The Grandmothers conference, Peace Village, Earthdance and. others. Capacity: 250 Square foot: 3674 sq.ft total- Includes public seating area and kitchen. 2171 sq.ft - Public area only. N PARKING Night time usage: Given that the current operating hours for nearly all the businesses in the complex are daytime only, the applicant would like to request an offset parking allocation to achieve an occupancy rating of250 persons for night time use. The only businesses that operate later than 8pm are Chun's Palace, which closes at 9pm and Video Explorer which closes at 10pm. After many weeks of observation, it is evident that both these businesses are never busy and have a quick turn around of clientele. Furthermore, the 50 person banquet room of Chun's is now being used for storage space which reduces their need for parking spots. Thus, the night time parking demand for these businesses is very light. It is also important to note that many events at the AsWand Cultural Center will begin at 9pm (post dinner session), which will be when Chun'g is closing. Given that the facility has 63 parking credits available (see table #1), it is evident that we _ can fulfill our need for a 250 person night time occupancy rating. (63 x 4 ::::; 252 persons). Adding to this, it is also worthy to note that there is plenty of night time parking available in the general area not bordered by residential homes. A perfect example is along A Street alongside the A Street Marketplace which is closed at night. Also, the applicant has 4 been granted permission to use both the Umpqua Bank (12 spaces) and Crane Parking spaces (12 spaces) - (Please see Appendix H - Letters of Support). Furthermore, all the businesses on the opposite side of the immediate parking lot are closed at night leaving even more space available. Also, the owner of the facility has requested for the 50% parking variance for commercial buildings in the Historic zone, which increases the overall parking available for the building to 94 spaces in total. Overall; it is evident that parking will not be an issue for our night time operating hours. GENERATION OF NOISE, LIGHT AND QLARE Given that the venue is located inside the main building complex it will not be generating any light or glare onto the outside area. After conducting an extensive night time sound analysis by a recognized authority, it is evident that the venue will not generate any sound problems for the surrounding area. This is due to the fact that the venue is perfectly situated deep within the main complex, which offers excellent sound insulation and containment. It is important to :note that the only residences near the facility are located on Oal{ St, which is one of the busiest residential pass through streets in Ashland. Observations show that during a four hour window of time, from 8pm to ~2am on a weekday night, cars are traveling along Oak St more than 60% of the time. The average sound decibel reading when a car is driving along Oak St is around 80 DB. The sound test reveals that even at the entrance to the complex when the main doors are open (and the inside reading is 110DB), it only shows a reading of75DB, which is 5DB lower than cars driving along the road. It was even noted that a Hybrid car, which is considered one of the quietest types of automobiles; was even louder than any of the noise readings from the venue. We would like to point out ~at our intention with the sound test was to- push the sound level inside the venue beyond our comfort zone to clearly point out that noise is not an issue for the surrounding area.- We will never be producing events that generate that level of noi~e. Please see Appendix F (Sound Test by Certified Audiologist) for full test results. IMPACT ON SURROUNDING RESIDENTIAL AREA Given that the facility- offers' adequate parking for our night time needs~ we feel that their will be very minimal impact to neighboring residential zones. The most important point we would also like to stress is that no alcohol will be s.erved inside the venue. This should remove any local concerns about drunk and boisterous patrons spilling onto the streets late at night. Given that our mission is to provide' an alternative performing arts space for the Ashland Community that promotes a healthy lifestyle, we will no doubt be attracting a more conscious clientele that is very different to the average late night bar and club scene. To deter loitering around the outside of the venue we will also be hiring professional bonded security to patrol the front of the building and parking 19t. N -s Given that Oak 8t is a busy residential road with constant traffic f1ow~ the impact of cars leaving late at night from the Oak St facility parking lot should not create any problems for the surrounding area. Currently we have approximately 18,682 sq. ft of leasable space. Using the guideline of one parking space for each 350 square feet of leasable space in the building, the parking requirement would be 53..377 spaces or 54 spaces. There are other ways of calculating estimated need according to different uses, but the following cafculation would be a valid beginning point and an approach which would hopefully help staff and the Commission make a determination. One approach also is to demonstrate the amount of square footage effectively in use at different times of the day. This is an approach helpful in assessing parking requirements for mixed use buildings in Ashland and elsewhere. The building at 310 Oak is a mixed use building in that although it does not yet have a residential component, its commercial uses include retail, restaurant, office, personal service, and entertainment. Thus, the term "mixed use" is valid. In the main parking lot there are 44 spaces with two being handicapped spaces. To maximize on-street parking in commercial areas, the Public Works Department stripes 2- 20' spaces with a six foot maneuvering space between them to save 1 foot per space. Therefore,it is viable to use 23 feet in calculating available on street parking in commercial zones. The credit for on-street parking spaces can be calculated as follows after factoring in a 1 0' reduction at each corner or driveway.: Oak S1. 243 linear feet; 243 /23 yields 10.4 spaces; 4 non credit spaces & 6 credit spaces Pioneer S1. 164 linear feet; 164 / 23 yields 7 credit spaces A street 142 linear feet; 142 /23 yields 6 credit spaces Total on-street parking credit spaces 19 Onsite parking spaces 4 4 Total onsite and credit for on street parking spaces 63 Or using combined or total curb length to calculate parallel parking, there are 407 linear feet on Oak and Pioneer Streets yielding 17+ spaces reduced by 4 = 13 + 6 on "A" St.= 19 spaces. We have 94 To summarize, the scheduling for this mixed use building shows that although the building is open from 6 AM to 10 PM except Sundays, only between the hours of 12 PM and 5 PM Tues.- Fri is there potential for a parking demand that would approach the parking capacity available on site or on the street. However, any potential problem is mitigated by the fact that 58% of the business for Baxter Fitness occurs before 11 :30 AM, and 80% of the business of the Video Explorer occurs after 4 PM. The use of the dance space is light use in the mornin.9s and after- noons. Any lunch business peak for the restaurant would begin at 12 PM and cease by 1 :30 PM. Any parking problem is also mitigated by statistics for Chinese restaurants showing that a large percentage of food orders are consumed off site. Parking requirements for such orders are 10 minutes or less, and often a delivery service picks up the food.. The level of activity at the building for the restaurant would usually increase at 5:30 PM after Pet Pause closes and when Baxter Fitness is almost closed. These closures result in parking for 3500+ sq. ft. not being needed Thus, with 18,957 sq. ft. of leasable space it is shown by posted hours for the businesses that some space is unused every day at the mid day peak period from 11 :45 AM-1 :30 PM, and much is unused after 5:30 PM during the evening peak period. Thus, at present there is no onsite parking problem, nor do the activities in the buHding cause a neighborhood parking problem. And it is not foreseen that additional uses would cause a parking problem. Therefore, this mixed use building which has a restaurant, offices, retail, and personal services is an efficient use of land.. Several different activities are coexisting without parking conflicts, and the existing quantity of on-site and on-street parking will meet future needs" Additional second floor development anticipated in 2011 will be for residences which will require a planning action including a recalculation of parking. But the residential component should not have any official impact according to Ashland Planning Code as applied to mixed use when it involves residences. On Monday, Jan 4, 2010, I performed noise level measurements at various locations, indicated on the accompanying chart, on the property described above. Those measurements are provided on attached work sheets. The initial phase of the survey, which was performed roughly between the hours of 8:30 pm and 9:30 pm, was to establish a minimum environmental noise base line as well as record the level of non continuous noises that occur on a regular basis (repetitive noise). During the course of the hour, it was determined that when there were no observable discrete noise events from local structures, no pedestrian noise and no noise from traffic within an approximate radius of three blocl{s (including part of Lithia Way), the ambient noise level readings for Oak Street averaged 46dB, A weighted, and 57 dB, C weighted. Pioneer street averaged ambient noise was a bit higher, due to emanations from commercial buildings on the east side of the street, at 48dB A weighted and 61dB C weighted. For clarification: "C" weighted sound measurements cover a relatively broad spectrum that includes the normal range of human hearing. "A" weighted sound measurements have a significant portion of the low frequency, and some high frequency, information removed. "A" weighting was developed to help quantify noise levels that would be hazardous to hearing, and that would interfere with warning signals, in the work place. "A" weighting is very commonly (mis)used to quantify environmental noise levels, which is why it is included here. It is my recommendation that primary attention be given to "C" weighted measurements when considered the information contained in this noise study. A chart is attached that shows where the various measurements were taken on the property, providing an index to the placement of the meter for a particular measurement. Approximate start and end times of the period during which each ambient noise measurement was taken are provided. On average, each entry in the chart corresponds to a measurement taken over a period of about two minutes. That was generally sufficient time to acquire the noise levels associated with typical neighborhood activity, including automobile traffic and pedestrian noise. No railroad noise occurred during this test, but from experience, I would estimate that railroad noise (engines, car trucks, horn, etc.) would result in readings of at least 6 to as much as 20 dB greater than the loudest measurements taken in any phase of this test. After the ambient noise levels were recorded, the sound system inside of the Ashland Cultural Center was excited with computer generated "pink" noise, which is random, but steady, noise that has gradually increasing energy as frequency decreases. The sound pressure level of this noise was fixed at 110dB, C weighted, measured in the center of the room. 110dB-C is quite loud and corresponds well with the highest average levels likely to be generated inside of the Ashland Cultural Center during any anticipated event. The results are documented in another attached chart. It is interesting to note that no one showed the slightest interest in, or curiosity about, a person wandering around the area waving a meter around. During this test, which began at approximately 10:00 pm and lasted for about 30 minutes, I encountered no one who even seemed aware of the noise. Oak Street, between A and Main Streets, is historically, and continues to be, a busy thoroughfare. The frequent passage of automobiles at all times of day and night and pedestrians throughout the day and into the night time are preexisting conditions that will not decline in the foreseeable future. The noise generated by any motor vehicle, even relatively quiet hybrid cars, or typical conversation of only two people, generates more sound than was measured leaking from the Ashland Cultural Center during our tests. The only stipulation that I would suggest in the way of controlling noise emanation is that the inner door to the room occupied by the Ashland Cultural Center should remain closed when music is being played or performed, other than when someone is going through it. / homas Garson "./ Aural Technology, Ashland, Or. As business owners, involved community members, and parents, we urge you to consider the positive impact this proposal will have on the Ashland community. We hope you will approve and issue whatever permits are necessary to make this vision a reality . We have had the privilege of reviewing the plans and site of the proposed Cultural Center, as well as discussing the project with Chris Iverson and Samantha Sperry. That review has left us hopeful and excited about how the Cultural Center would enhance our community . First, there is a desperate need for high quality, non-Shakespeare, affordable entertainment for families and young(ish) adults in our community - a place for families and adults to gather for music, conscious theater, and entertainment, with a responsible and respectful clientele. We see this daily, dealing with Ashland's new citizens who have just moved to the area. Unfortunately, we have few options other than the theater and the park to offer. We believe the Cultural Center will provide a fresh and exciting venue for working p~ople and families to gather, and will attract more families and young adults' to our City. Second, the, restaurant promises to provide families with a place to get wholesome (yet tasty!) food grov.vn in a sustainable manner. As you know, most of the restaurants in Ashland are quite pricey and do not provide sustainable options. There are only a couple that are truly family friendly, in budget and ahnosphere. The Cultural Center would add to our small list, and enhanc€7the dining options for the local community. Third, we believe the ~ommunity workshops and forums will serve the intelligent and unique Ashland citizenry by bringing in world class speakers and artists. Again, a big segment of Ashland's population has a desperate thirst for this type of enrichment, and finds it far too scarce among current venues.
