request for the following:

Prior to that date, anyone who was mailed this Notice Of Final Decision may request a reconsideration of
the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance (ALUO)
18.1 08.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in the ALUO
18.1 08.070(B)(2)( c).
An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to
raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford
the decision maker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that
issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of
appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to
proposed conditions of approval with sufficient specificity to allow this Department to respond to the
issue precludes an action for damages in circuit court.

DECISION
The applicant is requesting a Conditional Use Permit to convert an existing, three-vehicle garage into a
564 square foot Accessory Residential Unit. The lot is 10,581 square feet and is zoned R-I-5. The lot is
approximately 5,500 square feet larger than is required by the zoning. The existing single-family
residence has approximately 1,536 square feet of living area according to the Jackson County Assessor's
data. Accessory residential units are limited in size to a maximum of one-half of the gross habitable
floor area of the primary residence or to 1,000 square feet, whichever is less. The proposed accessory
residential unit meets this size requirement. The proposal requires two off-street parking spaces to serve
the accessory unit. The applicant is proposing to provide four spaces at the back of the property, two
spaces for the new unit and two for the existing single-family home. Three of the spaces are surface
parking and one is in the remaining garage bay.
The existing building meets the setback requirements for the zone.
The project will not have a significant impact on bulk and scale because the building is existing, and no
new square footage is proposed. The applicants are proposing to upgrade the structure, which is
currently just a flush front garage, by adding new windows and exterior light fixtures.
Utilities, including water, sanitary sewer, and storm drainage, are in place to serve the existing home and
the proposed second unit. Clay Street is an avenue (major collector) without sidewalks or bike lanes.
Middle Clay Street is under County jurisdiction, and is not improved to City standards. The applicant
will provide two street trees located just inside of the front property line as part of this approval.
The property currently has a looping driveway across the frontage of the parcel. According to the Street
Standards only one driveway curb-cut is allowed per parcel. Even though Clay Street is not improved at
this point, the City still strives to bring all lots into compliance with the code and the applicant has
proposed to remove the second driveway curb-cut and the loop across the front of the parcel.
The application includes a landscape and irrigation plan. The existing landscaping on the site is mature
and will remain in place. The applicant has proposed to upgrade the front yard landscaping with lawn
area and other plant materials. The applicant has also proposed two new street trees. The proposal does

not include the removal of any trees on the property since the existing footprint of the primary residence
will not be changed and the proposed structure also exists with no exterior changes. It is outside of the
drip-lines of the existing trees. The existing driveway veers away from the existing Oak tree at the end
of the driveway near Clay St., the site plans show the driveway moving closer to the tree. The Tree
Commission in their review recommended no changes to the driveway in the vicinity of the Oak tree and
to remove the mistletoe from the Oak.
The criteria for a Conditional Use Permit are described in AMC Chapter 18.104.050, as follows:
A. That the use would be in conformance with all standards within the zoning district in which the
use is proposed to be located, and in conformance with 'relevant Comprehensive plan policies
that are not implemented by any City, State, or Federal law or program.
B. That adequate capacity of City facilities for water, sewer, paved access to and through the
development, electricity, urban storm drainage, and adequate transportation can and will be
provided to and through the subject property.
e. That the conditional use will have no greater adverse material effect on the livability of the
impact area when compared to the development of the subject lot with the target use of the zone.
When evaluating the effect of the proposed use on the impact area, the following factors of
livability of the impact area shall be considered in relation to the target use of the zone:
1. Similarity in scale, bulk, and coverage.
2. Generation of traffic and effects on surrounding streets. Increases in pedestrian, bicycle, and
mass transit use are considered beneficial regardless of capacity of facilities.
3. Architectural compatibility with the impact area.
4. Air quality, including the generation of dust, odors, or other environmental pollutants.
5. Generation of noise, light, and glare.
6. The development of adjacent properties as envisioned in the Comprehensive Plan.
7. Other factors found to be relevant by the Hearing Authority for review of the proposed use.
The criteria for Site Review Approval are described in AMC Chapter 18.72.070, as follows:
A. All applicable City ordinances have been met or will be met by the proposed development.
B. All requirements of the Site Review Chapter have been met or will be met.
e. The development complies with the Site Design Standards adopted by the City Council for
implementation of this Chapter.
D. That adequate capacity of City facilities for water, sewer, paved access to and through the
development, electricity, urban storm drainage, and adequate transportation can and will be
provided to and through the subject property.
The criteria for an Accessory Residential Unit are described in AMC Chapter 18.20.030.H, as
follows:
H. Accessory residential units, subject to the Type I procedure and criteria, and the following
additional criteria:

1. The proposal must conform with the overall maximum lot coverage and setback requirements
of the underlying zone.
2. The maximum number of dwelling units shall not exceed 2 per lot.
3. The maximum gross habitable floor area (GHF A) of the accessory residential structure shall
not exceed 50% of the GHFA (~fthe primary residence on the lot, and shall not exceed 1000
sq. ft. GHF A.
4. Additional parking shall be in conformance with the off-street Parking provisions for single-
family dwellings of this Title.
The application with the attached conditions complies with all applicable City ordinances.
Planning Action 2010-00141 is approved with the following conditions. Further, if anyone or more of
the following conditions are found to be invalid for any reason whatsoever, then Planning Action 2010-
00141 is denied. The following are the conditions and they are attached to the approval:
1) That all proposals of the applicant shall be conditions of approval unless otherwise modified here.
2) That the plans submitted for the building permit shall be in substantial conformance with those
approved as part of this application. If the plans submitted for the building permit are not in
substantial conformance with those approved as part of this application, an application to modify this
Conditional Use Permit approval shall be submitted and approved prior to issuance of a building
permit.
3) That prior to the issuance of a building permit:
a) A storm water drainage plan for review and approval by the Ashland Building Division.
b) The applicants shall sign in favor of a Local Improvement District (LID) for the future
improvement of Clay Street, including but not limited to curb, gutter, storm drain facilities and
sidewalks.
c) That a landscaping and irrigation to include irrigation details satisfying the requirements of the
Site Design and Use Standards Water Conserving Landscaping Guidelines and Policies shall be
provided with the building permit submittals.
d) Exterior lighting details demonstrating that the lights are appropriately shrouded, so there is no
direct illumination of surrounding properties.
e) Building materials and the exterior colors shall be identified for the review and approval of the
Staff Advisor to demonstrate compliance with Site Design and Use Standards requirements that
the materials and colors be compatible with the surrounding area.
f) That Systems Development Charges (SDCs) shall be paid for the conversion of the garage space
to habitatable living space.
4) That prior to the issuance of a certificate of occupancy:
a) That a separate electric meter for the accessory residential unit shall be installed in accordance
with Ashland Electric Department requirements
b) That a separate address for the accessory residential units shall be applied for approved by the
City of Ashland Engineering Division. Addressing shall be visible from Public Street

c) Requirements of the Ashland Fire Department shall be met, including the installation of
approved addressing.
d) Parking will be delineated with wheel-stops or pavement markings shall be provided to delineate
individual spaces.
e) That the driveway loop be removed and replanted in accordance with the approved landscaping
plan prior to issuance of a certificate of occupancy.
f) That all landscaping and irrigation in the new landscaped areas shall be installed according to the
approved plan prior to the issuance of a certificate of occupancy.
g) That street trees, 1 per 30 feet of street frontage, be installed All street trees shall be chosen from
the adopted Street Tree List and shall be installed in accordance with the specifications noted in
Section E of the Site Design and Use Standards. The street trees shall be irrigated, and shall be
selected and placed to comply with the vision clearance standards of the City of Ashland.

CUP PROPOSAL: 857 CLAY ST. PROJECT DESCRIPTION
We propose to create a one bedroom rental unit within the footprint of an existing 3 car
garage. One parking space would remain within the garage. A reduction of paved
surfaces is contemplated.. No change to the existing residence is contemplated.
The conditioned space on the lot would increase. Proposed total would be 2099.5 sq. ft.
conditioned, which consists of existing residence 1536, and proposed rental unit 5635.
The total building footprints would not change: 1536 and 886 = 2422 sq. ft.
There would be offstreet parking for 3 vehicles exterior, and one inside the garage, for a
total of 4spaces.
If approved, this CUP would provide Ashland with another reasonably affordable rental
unit, and a modest income for the homeowner who lives in the existing residence.

FINDINGS: RESPONSE TO STAFF COMMENTS
PARKING: 4 spaces of 100x 18' are provided. 3 exterior and 1 garage space. There is a
minimum of25' of backup space for each vehicle, and all vehicles can access each space
without the necessity of moving other vehicles.' ,
LOT COVERAGE: After the removal of an existing 2nd curb cut and roundabout, the lot
coverage percentages are as follows:

Thus this proposal complies
DRIVEWAY CURB CUTS: The number of curb cuts has been reduced fron the existing
2, to one to achieve compliance with street standards ordinance. The northmost curb cut
will be removed, and the roundabout roadway will be landscaped. Less than 25% of the
front yard will be impermiable.
SIDEWALK LID: The property owner DOUG FERGUS, will sign in favor of the
CLAY ST. LID.
STREET TREES: Two new street trees from the approved list will be planted per
location requirements set out in Staff Comments. Please see Landscape and Irrigation
plan for location.
CONDITIONAL USE PERMIT CRITERIA: See attached sheet
SEP~TE ELECTRICAL SERVICES: 2 meters planned, see bldg. Plan
EXTERIOR LIGHTING: Note e1evations- All proposed exterior lighting to be hooded
downlights.
CONDITIONAL USE PERMIT CRITERIA:
The location of this proposed one bedroom rental unit at 857 Clay St would afford the
tenant access to public transportation on Siskiyou Blvd., and is also within walking
distance of shopping, recreation, classes at SOU, and many city job locations. It would be
possible to live in this location without an auto, and would certainly be feasible to reduce
daily vehicle trips to a minimum.
The above is important as it mitigates excess traffic on Clay St., thus reducing impact to
neighboring property owners. Further it should be noted that the new street trees should,
over time, calm traffic flow, and the upgraded front yard landscaping an irrigation will
beautify the streetscape. Parking will be moved to the rear of the property with the
removal of the roundabout. The main residence entry will be more clearly defined, which
would enhance the residential character of Clay S1..
It is hoped, that in combination, the above listed factors would add to the residential built
environment and outweigh the issues of increased density and vehicle miles within the
city. The modest nature of this proposed project, and the human scale of the proposed
changes, seems in keeping with this residential neighborhood, and another affordable
living space within Ashland is much needed.
We respectfully submit that this project would meet criteria outlined by the City of
Ashland for the conditional use of this property for both residential use and rental use.

Irrigation Plans
Minimum Standards
The following infonnation is the minimum
requiremcnts for submitting an irrigation plan in
conjunction with a landscape plan to the City of
Ashland Planning Department for review and
approval in all Planning applications.
The intent of the irrigation design is to provide the
proposed plant material with levels of irrigation
where they are able to mature and prosper while
also making the most eftlcient use of the water
being used.
General Irrigation Plan Requirements
Two copies of the irrigation plan should be
submitted for review at the time of formal planning
action application and the plan should contain the
following information.
Legible plan drawn to scale with a north
arrow and date.
Project name, address, nearest cross
street(s) and irrigation contact person,
including address and phone number.
The water source, point of cOlU1ection,
static and operating pressure must all be
labeled.
IfTID is used, list the size and type of
filtration method.
List the size, type, brand and location of
the backflow device, as well as the make,
model, precipitation rate and location of
sprinkler heads.
Layout of drip systcm showing the type of
emitter and its outputs, as well as the type
of filtration used.
Description of piping including: pipe size,
schedule or class, type of mounting used
between piping and sprinkler head, depth
of proposed trenching, and provisions for
winterization.
The type, brand, size and location of control valves
and timc clocks.
Type and size of low voltage wire
Size, type, depth and location of materials
for underpaving sleeves.
Typc and location of rain sensor and
pressure regulator
General Irrigation Design Standards
Sprinkler heads should be a variety of a
pop-up head whenever possible and must
be a pop-up when located near walkways,
driveways, in lawns or near childern's play
areas.
Drip system piping should be installed
underground or under mulch covering,
except at plant location, where it should be
slightly above grade.
Precipitation rates are to be matched for all
irrigation heads on each circuit.
Valves and circuits should be separated
based on water use.
Shrubs and lawn areas should not be placed
on the same irrigation zone.
All irrigation systems should be equipped
with a controller capable of multiple
programs including multiple cycle stm1
capacity and a flexible calendar program.
On benns greater than one loot in height,
drip irrigation is required.
A watering schedule for each circuit
based on the installation must be
posted inside the controller.
Planning Commission may require a monthly
irrigation schedule for the first two years of
existence as well as a one year maintenance
schedule and agreement.
