The applicant proposes to construct a detached garage to be located to the east of the existing residence. The subject property is located on the southeast corner of Seventh and C Streets, approximately 150 feet north of East Main Street within the Railroad Historic District. The parcel is 5,016 square feet in size and the existing home is 1,758 square feet according to the Jackson County Tax Assessor's information. Both C and Seventh Streets are improved right-of-ways with curbs, gutters, sidewalks, and a landscape strip. The parcel has a north-south orientation with a slight angle to the northeast and gentle slope of approximately 2 percent to the north. Two large Redwood trees are on site and substantial landscaping is in place. The residence originally fronted onto Seventh Street prior to partitioning ofthe parent parcel in 2004. The structure was then re-positioned to face C Street to accommodate two houses on the newly created lots. According to city documents, the residence is known as the Even Evenson House, a historic contributing structure that is known for its "comparatively rare clipped or jerkinhead style head gables. The proposed garage is 10 by 20 feet (120 square feet), the size of a modern day parking space and the smallest size that can fit a vehicle. Due to the house placement, the applicants are requesting a variance to the reduced setbacks allowed for accessory structures. Ashland Municipal Code (AMC) Section 18.68.140.D states that regardless of the side and rear yard setback requirements of the district, accessory structures are permitted to have a reduced setback of three feet as long as the structure is located 50 feet from the street, 10 feet from another structure, and less than 15 feet in height. Additionally, according to R-2 zoning regulations, (AMC 18.24.040.E) accessory structures are to be 10 feet from other structures on the lot. At time of placement, the large redwood trees prevented the house from being located closer to Seventh Street. If the home had been placed at the minimum side yard setback for a corner lot, the garage would PA #2010-00486 1610 ClarkJMP Page 1 have adequate room to meet the setback requirements. Additionally, C Street is classified as a neighborhood street by city standards and has right-of-way is 70 feet, much larger than similar streets within the City. C Street is improved to a width of 33 feet, which leaves approximately 18.5 feet behind curb to the property line. An established pine tree in the rear of the yard prohibits the proposed accessory structure to be placed further back onto the lot. In historic neighborhoods, it is not ~ncommon to see detached garages in close proximity to property lines andlor houses. The proposed garage would be compatible with the existing historic development pattern of the neighborhood, and contains materials, roof pitch, and other design features that will complement the existing contributing structure. The Historic Commission commends the applicants who have positively attributed to the rehabilitation and retention of the historic character of the neighborhood and recommends approval of the application. In reviewing the request, staff believes that the Variance proposed is the least possible option to meet historic character of the existing context of the neighborhood while meeting the needs of modern day use. The criteria for a Variance are described in AMC Chapter 18.100.020, as follows: A. That there are unique or unusual circumstances which apply to this site which do not typically apply elsewhere. B. That the proposal's benefits will be greater than any negative impacts on the development of the adjacent uses,' and will further the purpose and intent of this ordinance and the Comprehensive Plan of the City. (Ord.2425 S1, 1987). C. That the circumstances or conditions have not been willfully or purposely self-imposed. (Ord. 2775,1996) The application with the attached conditions complies with all applicable City ordinances. Planning Action PA-2010-00486 is herby approved with the following conditions: 1) That all proposals of the applicant shall be conditions of approval unless otherwise modified here. 2) That a Tree Protection Plan for the tree in the rear be submitted in accordance with AMC Chapter 18.61.200 shall be submitted for the review and approval of the Staff Advisor prior to the issuance of a building permit. The Tree Protection Plan must include all required items listed in section 18.61.200.2. Other: Vernacular Historic Contributing This fine one and one-half storY vernacular house is notable for its comparatively rare "clipped" or jerkinhead head gables withm the Railroad District. Probably built m 1907, shortly after the comer lot was purchased by local contractor John Hakanson, the house was sold to Even Christian Evenson in 1909. Evenson, a saw filer, retained ownership until 1920 when the house was purchased by Almira Henry. Andrew DeLisle, a lineman for the Pacific Telephone and. Telegraph Company, lived here in 1948 and the current owners Clyde A. Hutson, and his wife Mary owned and occupied the house by 1964. Howlett lived here for five years and then sold to Fenton M. Bagley in May 1906. Bagley, a fruitgrower; lived here until 1910. Later owner included George Dunn, a member of the state legislature, who kept this house as rental until 1923. Two tenants are listed in the 1948 city directory. The measurement from the property side of the liright of way" is 30'. I also request a setback from the house of 6' instead of the required 10'. Variance Criteria: A. That there are unique or unusual circumstances which apply to this site which do not typically apply elsewhere. 1. This house was moved to its location by a previous owner to make room for an infill house to be built. The side yard is the only possible location for an accessory building and is a total of 19' from property line to house. Ifthe house had been placed with a minimum side yard on the Seventh Street side there would have been enough room to accommodate the building setback, but that was the front of the house at that time. 2. The street which was platted to 100 year old standards is 70' wide. It is strictly a local access residential street. Today's standards are much less. 3. The depth of the property at 82' is less than most lots in the area because prior to the property split, to accommodate a new house, that was the width. After the land partition by a prior owner the planning department liturnedli the property so that side to side became front to back. In other words the property used to front on Seventh Street and now it fronts on C Street. 4. It is common in this historic district for garages} outbuildings and even houses in some cases to be in violation of current setback ordinances. A survey of historic properties a block in any direction will show many such violations. B. That the proposal's benefits will be greater than any negative impact on the development of the adjacent uses; and will further the purpose and intent of this ordinance and the Comprehensive Plan of the City. 1. The original garage on the property was torn down when the previous owner moved the house and built an infill house. The property currently has no accessory building of any kind. There is no outside storage for yard and garden equipment} bikes} etc. An outbuilding would have an extremely positive effect as it would provide storage of normal household equipment and tools. It would in fact complement the existing development by completing it as homes are normally developed} with some type of accessory or storage building. 2. The proposed building would be set back more than 10' from the front of the house sufficiently as to not liimposeJJ itself on the existing house. 3. The structure would be built using the same materials and matching colors to the existing house. The gable lisunburst"} would be duplicated on the front ofthe structure. The applicant was not involved in the moving or placement of this house on the lot which created setback issues. He also had no involvement in the platting of the 70' street. 2. The shape of the lot, which is not conducive to meeting proper setbacks, is no one's fault, but a consequence of moving houses and creating opportunities for infill for maximum density and to avoid sprawl. Tree Protection There is a Blue Spruce tree that the applicant brought in and planted in anticipation of building an accessory structure. It was planted in the spring of 2009. It is approximately 10' behind the proposed building.
