Prior to that date, anyone who was mailed this Notice Of Final Decision may request a reconsideration of
the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance (ALUO)
18.108.070(B)(2)(b) and /or file an appeal to the Ashland Planning Commission as provided in the ALUO
18,108.070(B)(2)(c).
An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to
raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford
the decision maker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that
issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of
appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to
proposed conditions of approval with sufficient specificity to allow this Department to respond to the
issue precludes an action for damages in circuit court.
The application, all associated documents and evidence submitted, and the applicable criteria are available
for review at no cost at the Ashland Community Development Department, located at 51 Winburn Way.

The subject property is located at the northeast corner of Morton and Forest Streets, and is zoned R -1-
7,5, Single- Family Residential. The lot is approximately 9,900 square feet in area and rectangular in
shape. The parcel has an average downward slope of approximately 10 percent to the north.
An existing 900 square foot single -story home is placed roughly in the middle of the lot, while a 216
square foot shed is located 10 feet from the eastern property line. Due to the fact that the home's floor
plan and placement is configured in such a way that does not allow for an addition to be placed
elsewhere other than on the northern side, a solar access variance is required.
The applicant proposes to construct a 320 square foot addition on the north side of the home, which will
cast a shadow 28 inches greater than permitted under Solar Setback Standard A. As previously stated,
the placement of the house in the center of the lot greatly inhibits an addition to be placed elsewhere on
the property. A large vegetable garden is located in the front yard, and an existing tool shed and mature
tree sits directly east of the house, and the floor plan and side yard setbacks for corner lots do not make it
possible to add on to the house in either of those directions.
The application materials provided state that the addition will not produce any additional shadow than
already produced by a line of hedges that have been placed on the property line between the two properties

for more than 20 years. In addition, that the property owner to the north considers the proposed shading to be
negligible to the current condition and inconsequential to future development of the site. Therefore does not
preclude the reasonable use of solar energy on the site by future buildings.
In reviewing the request, staff believes the placement of the addition is dictated by the constraints of the
property and the placement of the existing home, and that the proposal's impacts to the solar access of the
property to the north have been minimized to the degree possible while addressing these issues.

The criteria for a Solar Access Variance are described in AMC Chapter 18.70.060, as follows:
a. The variance does not preclude the reasonable use of solar energy on the site by future
buildings; and
b. The variance does not diminish any substantial solar access which benefits a habitable structure
on an adjacent lot.
c. There are unique or unusual circumstances which apply to this site which do not typicall apply

The application with the attached conditions complies with all applicable City ordinances.

Oregon 97520 prior to 4:30 p.m. on the deadline date shown above.
Ashland Planning Division Staff determine if a Land Use application is complete within 30 days of submittal. Upon determination of completeness, a
notice is sent to surrounding properties within 200 feet of the property submitting application which allows for a 14 day comment period. After the
comment period and not more than 45 days from the application being deemed complete, the Planning Division Staff shall make a final decision on the
application. A notice of decision is mailed to the same properties within 5 days of decision. An appeal to the Planning Commission of the Planning
Division Staff's decision must be made in writing to the Ashland Planning Division within 12 days from the date of the mailing of final decision. (AMC

To the Ashland Planning Department,
Thank you Carolyn Michael for your assistance with our paperwork!
I am submitting a revised request for a solar variance for my home at 580 Morton Street. I hope to add a
room onto our house, with attic space for storage. Although the height for this addition would be lower
than a standard two -story structure, it still casts a shadow on my neighbor's property that exceeds the
solar regulations. I respectfully offer the following points for your consideration in this matter:
Please find enclosed Solar Waiver form signed by the affected neighbor (and notarized by your staff).
The solar access for the house to the north would have zero to minimal impact from this variance. The
affected house itself is three full stories high, and the proposed addition would still be substantially
lower. If the impacted house wished to add solar panels on the roof, there would be no obstruction from
the proposed addition.
Other solar access for the house to the north is currently affected by a tall hedge on the property line,
which was planted before this applicant purchased the house 20 years ago. This hedge has not been a
problem for the neighbors, who have lived there longer than the applicant. The roof shadow from the
revised proposal would actually fall lower than the current hedge, so there would be no change in solar
access compared to the existing situation.
Neighbor downhill to the north most directly affected has been consulted at length, and was happy to
sign the waiver paperwork. Other neighbors have also given advance approval and are supportive of the
project.
After consulting with Michael Pina, we have redesigned the proposal, re- orienting the roofline to cast
less shadow. Although this gives us less usable space, it does reduce the number of inches of solar
variance requested.
I have owned and lived in this house for 20 years, and most of my neighbors have been here for a
similar length of time.

My home is quite small, a single story of less than 900 square feet, and was built in 1951. It is one of
the smallest houses in the neighborhood. Even with the proposed addition, it would remain one of the
smallest houses in the neighborhood.

The addition itself is small in terms of square footage.
The orientation of the house on the lot does not leave any other options for the direction of the
additional room. The south side of the house (facing Forest Street) has been in use for many years as a
vegetable garden. The west side of the house (facing Morton Street) has the property's largest tree (a
maple). The east side of the house has a smaller tree and an addition in that direction would fall too
close to the property line. The north side is the only reasonable direction in this situation.
Since the storage space is needed for musical instruments (my husband is a lathier) and other climate
sensitive storage, a separate outbuilding is not feasible.
Although the proposed addition would be built partially into the ground, creating an entire
underground storage room up to code and weatherproofed against temperature and moisture is cost
prohibitive.
The character of the neighborhood would not be impacted by this proposal. Most houses nearby have
multiple stories of living space. The house to the south is 3 stories tall. The house to the north (most
directly impacted by our structure) is also 3 stories tall, with an additional basement. The houses to the
east and west are both 2 stories tall, with additional basements. Our proposal of a one story room with
attic space would be quite small in relation to the rest of the neighborhood, and we would remain one of
the only single -story structures in the area, and also one of the smallest in terms of overall footprint.
The neighborhood is on a steep hillside, and many of the older homes as well as the newly built larger
homes have been granted solar variances (or have been grandfathered in). Granting a variance for this
proposal would not set a negative precedent, since it would still be one of the most modest homes in the
neighborhood in terms of size and solar impact.
