Does the Council wish to approve a Liquor License Application from Suk Cha Molder dba Lee's Cuisine at 2345 Ashland Street? Staff Recommendation: .Endorse the application with the following: The city has determined that the location of this business complies with the city's land use requirements and that the applicant has a business license and has registered as a restaurant, if applicable. The city council recommends that the GLCC proceed with the processing of this application. Background: Application is for a new liquor license. The City has determined that the license application review by the city is set forth in AMC Chapter 6.32 which requires that a determination be made to determine if the applicant complies with the city's land use, business license and restaurant registration requirements (AMC Chapter 6.32). Related City Policies: In May 1999, the c,?uncil decided it would make the above recommendations on all liquor license applications. Council Options: Approve or disapprove Liquor License application. Mayor Stromberg, Councilors and City Staff, My name is Kim Clark and I am the General Manager of Mt. Ashland Association. I come before you tonight to request that the City of Ashland please consider asking the USFS to transfer the Mt. Ashland Ski Area Special Use Permit from the City of Ashland to Mt. Ashland Association and dissolve the operating lease between the City and the Association. Over the past 18 years Mt. Ashland Association a local non-profit organization, has operated the Ski Area under lease from the City and has proved to be a capable and willing partner in supporting the City and the USFS in all aspects of the operations. As Mt. Ashland moves forward into the future we will need the support of our Donors and the communities of Southern Oregon and Northern California in order to fulfill our mission "to provide and promote a quality experience in an alpine environment". The singular management and permit holder basis of Mt. Ashland Association will help instill confidence needed when going forward with all aspects of the operation. Equally important is by transferring the Special Use Permit from the City to the Association this will relieve the City of Ashland, and ultimately the citizens of Ashland, from any and all liability that could be associated with the Ski Area in the future. Mt. Ashland Association wishes to continue working closely with the City and your great staff for the common good of our area and natural resources of the region. We urge you to consider our request and direct staff to work with the Mt. Ashland Association to come up with a mutually agreed upon and timely request to the USFS for the transfer of the Special Use Permit to Mt. Ashland Association. Thank you. I ask the Council to add to the December agenda a proposal to transfer the Permit for Mount Ashland from the city to the Mount Ashland Association. I would like the sitting Council to act upon this and not delay the discussion to the new Council. It was not that long ago that Southern Oregon was faced with losing the Ski Area. Thanks to many individuals, rotary clubs, businesses, and the State of Oregon Lottery, the money was raised to form the current not for profit organization. The necessity of a valid organization to accept the donations was gratefully and enthusiastically adopted by the City of Ashland (I might point out that no money was given by the City). The step that never occurred was the transfer of the Permit by the US Forest Service to the new Organization. I would now like to ask for the Council, on Behalf of the City, complete what should have happened long ago. This has become a political issue and should be addressed by the current Council and you have two meetings to accomplish this. The Permit has nothing to do with the Expansion but everything to do with the liability of our residents: If for some reason (no snow) the 'Ski area fails then the City would be responsible to restoring the area as the permit holder. It is a burden our taxpayers should not have; Ashland would be in a better position to work under our agreement with the Forest Service to protect our watershed than as the Permit holder. Please do not hold this as a bargaining chip as others are doing (Sierra Club), instead hold the Forest Service responsible for the water shed. I ask you to add this to the next agenda, discuss in Public and put to a vote the transfer and relieve our City residents from this liability before seating the new Council members.
