COMPREHENSIVE PLAN DESIGNATION: Commercial; ZONING: C-l; ASSESSOR'S MAP #: 39 IE 09AC; TAX LOT: 14400, 14500, & 14600 The Staff Advisor's decision becomes final and is effective on the 13th day after the Notice of Final Decision is mailed. Prior to that date, anyone who was mailed this Notice Of Final Decision may request a reconsideration of the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance (ALUO) 18.1 08.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in the ALVO 18.108.070(B)(2)(c). Failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval with sufficient specificity to allow this Department to respond to the issue precludes an action for damages in circuit court. COMPREHENSIVE PLAN DESIGNATION: Downtown Commercial ZONING: C-I-D; ASSESSOR'S MAP #: 39 IE 09AC; TAX LOT: 14400, 14500, and 14600 SUBMITTAL DATE: DEEMED COMPLETE DATE: STAFF APPROVAL DATE: FINAL DECISION DATE: APPROVAL EXPIRATION DATE: October 12,2010 October 23,2010 November 12,2010 November 26,2010 November 26,2011 DECISION The subject property is a large hotel located at the northwest comer of Siskiyou and Sherman Streets. The tree removal request is to remove a dead Pine tree approximately 12 inches Diameter at Breast Height (DBH), located in the parking lot behind the building. Due to the tree is located in Commercial zone, and initially part of a planning action; a Tree Removal Permit is required and a replacement is to be mitigated upon removal approval. Although the tree is dead, the Ashland Municipal Code does not consider ita hazard, and therefore does not quality for a hazard tree permit. The tree is located in a large landscaped area surrounded by parking spaces. The lot is on the north side of the building, and has a mostly sunny exposure, especially in the summer months. The applicant has not proposed a specific replacement tree; however the Tree Commission recommends that an appropriate tree for the size of the landscaped area, and one that will perform well in a parking lot will be chosen by the applicant. According to the municipal code, removal of non-hazardous trees requires mitigation. The removal of this tree will trigger the mitigation requirements addressed in Ashland Municipal Code, Land Use Ordinance 18.61.080. The applicant may mitigate with a tree that will achieve similar size and stature at maturity as the one removed. Prior to the removal of the trees the applicant shall submit their proposed method of 'mitigation' to the Planning Division so as it may be part of the record of decision. The criteria for a Tree Removal Permit are described in AMC Chapter 18.61.080, as follows: An applicant for a Tree Removal Permit shall demonstrate that the following criteria are satisfied. The Staff Advisor may require an arborist's report to substantiate the criteria for a permit. B. Tree that is Not a Hazard: The City shall issue a tree removal permit for a tree that is not a hazard if the applicant demonstrates all of the following: 1. The tree is proposedfor removal in order to permit the application to be consistent with other applicable Ashland Land Use Ordinance requirements and standards. (e.g. other applicable Site Design and Use Standards). The Staff Advisor may require the building PA#201O-01335 555 SiskiyioulMP Page 1 footprint of the development to be staked to allow for accurate verification of the permit application; and 2. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or existing windbreaks; and 3. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. The application with the attached conditions complies with all applicable City ordinances. Planning Action 2010-01335 is approved with the following conditions. Further, if any one or more of the following conditions are found to be invalid for any reason whatsoever, then Planning Action 2010- 01335 is denied. The following are the conditions and they are attached to the approval: 1) That all proposals of the applicant shall be conditions of approval unless otherwise modified here. 2) That the applicant chose an appropriate replacement tree for the size and location that will equal or exceed the removed tree size and stature at maturity, and shall be planted within a minimum of 180 days of this approval. The tree shall be planted and maintained according to the specifications in the City Tree Planting and Maintenance Guidelines. 3) The applicant shall submit to the City of Ashland Planning Division, in writing, their chosen ption for itigation prior to the tree removal. ii, /1-, 2o;Q Date PA#2010-01335 555 Siskiyiou/MP Page 2 PA-2010-01335 391E09AC 90003 343 E 5TH STREET ASSOCIATES 1725 S RAINBOW STE 1-191 LAS VEGAS, NV 89146 PA-2010-01335 391E09AC 90008 BAKER DOROTHY E 636 MAIN ST ASHLAND, OR 97520 PA-2010-01335 391E09AC 14701 BRISCOE JAMES CHRISTOPHER TRUSTEE ET AL 287 FOURTH ST ASHLAND, OR 97520 PA-201O-01335 391 E09AC 14801 DHZ LLC ET AL 8919 24TH ST LOS ANGELES, CA 90034 PA-2010-01335 39lE09AC 15800 HARDWICK CLAUDIA ET AL 2674 RIVERWALK LP EUGENE, OR 97401 PA-2010-01335 391E09DB 4300 HILLIGOSS L OIL KUZMIC 869 HARMONY LANE ASHLAND, OR 97520 PA-201O-01335 391E09AC 90005 LEVISON ROBERT L/DIANE L 1268 DRAKE CIR SAN LUIS OBISPO, CA 93405 PA-201O-01335 39 I E09AC 14803 MC MILLAN GLENN JRlCAROLE 416 LIBERTY ST ASHLAND, OR 97520 PA-2010-01335 391E09AC 14600 STRATFORD L L C 555 SISKIYOU BLVD ASHLAND, OR 97520 PA-201O-01335 39 1 E09AC 90009 ADAMS LOIS R 638 E MAIN ST ASHLAND, OR 97520 PA-2010-01335 391 E09AC 90006 BECKER JOANN ELAINE ET AL 2354 ARGUELLO PL SANTA CLARA, CA 95050 PA-201O-01335 39 1 E09AC 15000 CITY OF ASHLAND 20 E MAIN ST ASHLAND, OR 97520 PA-2010-0I335 391E09BD 7600 ERB LLOYD H ET AL PO BOX 1013 ASHLAND, OR 97520 PA-2010-01335 391E09AC 14700 HENRY TRUSTEE STEPHEN CONWAY 355 GRANITE ST ASHLAND, OR 97520 PA-2010-01335 391E09AC 90002 HOLLAND WILLIAM R TRUSTEE 624 E MAIN ST ASHLAND, OR 97520 PA-2010-01335 391 E09AC 90004 LOFTUS MITZI A TRUSTEE ET AL 628 MAIN ST ASHLAND, OR 97520 PA-2010-01335 39 1 E09AC 14802 RUNKEL DAVID RlDONNAN B 586 E MAIN ST ASHLAND, OR 97520 PA-201O-01335 391E09AC 14900 THIRD STREET PROPERTIES LLC 64 THIRD ST ASHLAND, OR 97520 PA-2010-01335 391E09AC 15700 AUBLE CARMON M TRUSTEE 542 SISKIYOU BLVD ASHLAND, OR 97520 PA-2010-01335 39 I E09AC 90007 BISHOP KIMBERLY A/JOHNSON DAVID A L 2400 AURORA AVE 208 SEATTLE, W A 98109 PA-201O-01335 391E09AC 15500 COOLEY EVA R TRUSTEE FBO POBOX 53 ASHLAND, OR 97520 PA-201O-01335 391E09AC 14300 GHA V AM HAMID/JULIE ANN 195 MORTON ST ASHLAND, OR 97520 PA-2010-01335 39 1 E09AC 15400 HILEMAN CORREN C TRUSTEE ET AL 570 SISKIYOU BLVD ASHLAND, OR 97520 PA-2010-01335 391 E09AC 90001 HONEYWELL SCOTT 622 MAIN ST ASHLAND, OR 97520 PA-2010-01335 391 E09AC 14200 LOUIE SUSAN G FAMILY TRUST 1393 RELIEZ VALLEY RD LAFAYETTE, CA 94549 PA-2010-01335 391 E09AC 14000 SAFEW A Y STORES #292 INC 1371 OAKLAND BLVD 200 WALNUT CREEK, CA 94596 PA-2010-01335 391 E09AC 15600 VOGEL PEGGY/MARK E 8308 DESSERT COVE SCOTTSDALE, AZ 85260 c 5. c:: c; S' U l U o-lA-> _/ :::J c_,_ I 1"'- J J/.-/ 10- ) 0 t00b Planning Department, 51 Wir,~..m Way, Ashland, Oregon 97520 541-488-5305 Fax: 541-552-2050 www.ashland.or.us TTY: 1-800-735-2900 CITY Of ASH LAN NOTICE OF APPLICATION PLANNING ACTION: 2010-01335 SUBJECT PROPERTY: 555 Siskiyou Blvd OWNER/APPLICANT: Josh Hamik/Stratford Inn DESCRIPTION: A request for a Tree Removal permit to remove a dead Pine tree located in the parking lot behind the Stratford Inn Hotel. G:\comm-dev\planninglNotices Maiied\20 1 0\20 1 0-0 133 5.doc TREE REMOVAL 18.61.080 Criteria for Issuance of Tree h\>I noval - Staff Permit An applicant for a Tree Removal Permit shall demonstrate that the following criteria are satisfied. The Staff Advisor may require an arborist's report to substantiate the criteria for a permit. A. Hazard Tree: The Staff Advisor shall issue a tree removal permit for a hazard tree if the applicant demonstrates that a tree is a hazard and warrants removal. 1. A hazard tree is a tree that is physically damaged to the degree that it is clear that it is likely to fall and injure persons or property. A hazard tree may also include a tree that is located within public rights of way and is causing damage to existing public or private facilities or services and such facilities or services cannot be relocated or the damage alleviated. The applicant must demonstrate that the condition or location of the tree presents a clear public safety hazard or a foreseeable danger of property damage to an existing structure and such hazard or danger cannot reasonably be alleviated by treatment or pruning. 2. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to AMC 18.61.084. Such mitigation requirements shall be a condition of approval of the permit. S, Tree that is Not a Hazard: The City shall issue a tree removal permit for a tree that is not a hazard if the applicant demonstrates all of the following: 1. The tree is proposed for removal in order to permit the application to be consistent with other applicable Ashland Land Use Ordinance requirements and standards, including but not limited to applicable Site Design and Use Standards and Physical and Environmental Constraints. The Staff Advisor may require the building footprint of the development to be staked to allow for accurate verification of the permit application; and 2. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or existing windbreaks; and 3. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property, The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in the zone. Nothing in this section shall require that the residential density be reduced below the permitted density allowed by the zone. In making this determination, the City may consider alternative site plans or placement of structures or alternate landscaping designs that would lessen the impact on trees, so long as the alternatives continue to comply with other provisions of the Ashland Land Use Ordinance. 4, The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to AMC 18.61,084. Such mitigation requirements shall be a condition of approval of the permit. It is in our parking lot and will not cause any erosion, windbreak, design or other such code issues. We will plant another appropriate tree to replace it as we re-plant the open area left behind. I do believe whatever disease or infestation that has taken this pine, may jump to other trees (another small tree next to pine is dying). Hope to get your consent to remove it safely. Do I need a lawyer to take out a dead tree? I provided a paragraph about what is going on and a footprint of the area where the tree is located. If someone comes and looks at it they will see there is nothing we can do but remove it. As I read the language below, I'm not sure what to say, but there will be no impact on soil, canopies, windbreaks, species...there is no alternative course of action and there will be no negative impact to neighbors etc etc...1 just don't want a big wind to come up and have a possible tree blow over on a car or a house. It does not look very nice either, it is a medium sized, very dead tree. Please help me jump through all the hoops, to get to the place, where a dead tree can be cut down safely. Thank you for your help. Josh, In reviewing your submitted permit, I'm going to need a little more information from you that speaks directly to the criteria for removal. I have attached the language below. if you could please send this language so that we can start this process as soon as possible for you. Thanks. B. Tree that is Not a Hazard: The City shall issue a tree removal permit for a tree that is not a hazard if the applicant demonstrates all of the following: 1. The tree is proposed for removal in order to permit the application to be consistent with other applicable Ashland Land Use Ordinance requirements and standards, including but not limited to applicable Site Design and Use Standards and Physical and Environmental Constraints. The Staff Advisor may require the building footprint of the development to be staked to allow for accurate verification of the permit application; and I provided a site-map and footprint with the application. There is a dead tree in our landscape area, within our parking lot. 2. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or existing windbreaks; and There will be no negative impact on anything. 3. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. There will be no negative impact on anything. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in the zone. Nothing in this section shall require that the residential density be reduced below the permitted density allowed by the zone. In making this determination, the City may consider alternative site plans or placement ra or nn of structures or alternate landscaping designs that would lessen the impact on trees, so long as the alternatives continue to comply with other provisions of the Ashland Land Use Ordinance. 4. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to AMC 18.61.084. Such mitigation requirements shall be.a condition of approval of the permit. We are looking to take out a dead tree in our parking lot.
