Dear Derek,
Yes, it would be suffiecient fopr the applicant to place a letter in the
file that they agree to always have both recycling ( the cart and the bin)
and trash receptaces by the front door and be responsible for the disposal
of same. It took far too loong for recycling containers to be available on
sidewalks in the downtown, We can't have businesses that deal in fast food
or instantly throwaway merchandise to not do their share in disposing of
trash and in keeping the sidewalks and streets clean.
If the letter gets into the city by the 8th I will not cause there to be a
public hearing.

be contacting you to see if a mutually agreeable arrangement can be reached.
If you opt to appeal the application, we would need a formal appeal request
to be completed and submitted on the required appeal form by the end of our
business day (4:30 p.m.) on November 8th. I'm attaching the required appeal
form; there is no fee to appeal a Type I application.
I did want to be sure you were aware that the only thing being considered
with the application is the replacement of the historic doors on Lithia Way
to address accessibility requirements; a land use action is required only
because it involves a building permit for exterior modifications to a
historic resource, The use itself is outright permitted, and has already
commenced pending completion of a barrier removal plan to provide
accessibility improvements subsequent to land use approval for the door
replacement.
Given that there are already trash receptacles mid-block on both Lithia and
Pioneer, it seemed to me that a recycling receptacle nearer the building
exit might be the most appropriate way to deal with your concerns if the
applicant were willing to provide it. This would require that they agree to
pay for an encroachment permit through Public Works and select and pay for
an acceptable recycling receptacle. Because the application has already
been approved, we could not add a condition the approval to this effect, but
the applicant could certainly provide a letter for the file agreeing to
install an approved receptacle if that were sufficient for you.

Thank you for updating us on this Issue.
I talked to MR.Burke Thompson this morning and the conversation went well As i told him that i will provide a
adequate size Trash container Plus the Recyling Bin and it will be in place by Thursday. And he was pretty
satisfied with it . So i have a 34 Gallon Container for trash and i have picked up a recycling container from
Ashland Recycling and they will be in place by Thursday morning. So i hope this will resolve this issue.

On October 26, 2010, the Staff Advisor for the Ashland Planning Division administratively approved your
request for the following:

DESCRIPTION: A request for Site Review approval to make an exterior change to a primary
contributing property within the Ashland Downtown Historic District. The exterior changes proposed
involve the replacement of the doors on the Lithia Way entrance to the J.P. Dodge & Sons Funeral Home
building to meet 2010 Oregon Structural Specialty Code (OSSe) and Americans with Disabilities Act
(ADA) standards. The project also includes the replacement of a section of private sidewalk and the
addition of stairs and handrails for ADA compliance. COMPREHENSIVE PLAN DESIGNATION:

The Staff Advisor's decision becomes final and is effective on the 13th day after the Notice of Final
Decision is mailed.
Prior to that date, anyone who was mailed this Notice Of Final Decision may request a reconsideration of
the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance (ALUO)
18.1 08.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in the ALUO
18.108.070(B)(2)(c).
An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to
raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford
the decision maker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that
issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of
appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to
proposed conditions of approval with sufficient specificity to allow this Department to respond to the
issue precludes an action for damages in circuit court.
The application, all associated documents and evidence submitted, and the applicable criteria are available

DECISION
The subject parcel is located at the southeast comer of the intersection of Pioneer Street and Lithia Way,
with entrances from both the Pioneer and Lithia frontages addressed as 90 North Pioneer Street and 110
Lithia Way. The parcel is roughly rectangular in shape, with a width of approximately 62 feet along Pioneer
Street and a depth of approximately 86 feet along the Lithia Way street frontage and 74 feet along the Will
Dodge Way alley frontage. The subject property has an area of approximately 0.11 acres.
The property is located within the C-I-D Commercial Downtown zoning district and the Ashland Downtown
Historic District. The existing building, designated the "J.P. Dodge and Sons Funeral Home" is a primary
contributing resource within the district and was designed in the California Mission-style by noted local
architect Frank Clark and constructed in 1923-24. The historic district survey document notes that the
building is an example of the Spanish Colonial style that became popular during that period, and indicates
that it retains high integrity in its stucco exterior, tiled mansard roof, and window detail and trim, and
remains an important architectural feature in the downtown which effectively and accurately conveys the
associations for which it is significant.
Fully developed as a commercial property, the site is generally devoid of significant natural features, with
vegetation limited to minimal established landscaping and street trees adjacent to Lithia Way. The parcel is
generally flat.
With the application, the applicant is requesting Site Review approval to allow the replacement of the
existing double doors with integral leaded glass windows on the Lithia Way entrance to the J.P. Dodge &
Sons Funeral Home Building in order to meet 2010 Oregon Structural Specialty Code (OSSC) and

Americans with Disabilities Act (ADA) standards. The proposed replacement door consists of a 3'0"
accessible wood door with new side lights and true divided lights, painted to match the existing door being
replaced. The proj ect also includes the replacement of a section of private sidewalk and the addition of stairs
and handrails for ADA compliance. The applicants initially considered replacing these doors to provide an
accessible entrance to their planned Stop 'N Shop convenience store before the Historic Commission at the
pre-application level. The Historic Commission noted that the existing doors with their intact leaded glass
window above were "historically perfect", and it was suggested that the applicants retain these doors and
refurbish them in place if at all possible, with the added suggestion that the applicants explore whether
modifications to the vestibule of the building's Pioneer Street entrance might allow the applicants to provide
an accessible entry to the building's tenant spaces. The applicant ultimately went down this path, obtaining a
tenant improvement building permit and enlisting the services of a local door and window restoration expert
to restore the doors to a more functional state. However, a commercial tenant who had leased the remaining
space in the building prior to the issuance of the tenant improvement permit proved unwilling to allow the
modifications to the vestibule entry, forcing the applicants to return to the previous plan for creating an
accessible entry by replacing the doors on Lithia Way. The Historic Commission reviewed the request, and
recommended approval noting that the new wooden door should use true divided lights, should be painted to
match the existing doors to be replaced, and that there should be no changes on the Pioneer Street fayade.
The Commission commended the applicants on the lengths they had gone to in trying to preserve the historic
doors, and strongly suggested that they be stored for replacement on the building at a later date if at all
possible.
The criteria for a Site Review approval are described in AMC Chapter 18.72 as follows:
A. All applicable City ordinances have been met or will be met by the proposed
development.
B. All requirements of the Site Review Chapter have been met or will be met.
e. The development complies with the Site Design Standards adopted by the City
Council for implementation of this Chapter.
D. That adequate capacity of City facilities for water, sewer, paved access to and
through the development, electricity, urban storm drainage, and adequate
transportation can and will be provided to and through the subject property. All
improvements in the street right-of-way shall comply with the Street Standards in
Chapter 18.88, Performance Standards Options.
The application with the attached conditions complies with all applicable City ordinances.
Planning Action 2010-01191 is approved with the following conditions. Further, if any one or more ofthe
following conditions are found to be invalid for any reason whatsoever, then Planning Action 2010-01191 is
denied. The following are the conditions and they are attached to the approval:
1) That all proposals of the applicant shall be conditions of approval unless otherwise modified herein,
including that the proposed new wooden door shall include true divided lights and shall be painted to
match the existing door's color, and that there shall be no changes to the Pioneer Street fayade.
2) That the replacement doors shall be installed to swing inward so as to avoid swinging into the path of
pedestrians using the private sidewalk along the building's frontage.

3) That the applicants shall obtain a building permit prior to making the proposed modifications to the
door.
4) That any handrails shall be installed so as not to project into the public pedestrian corridor or street
right-of-way.
5) That signage shall be limited to that allowed under the Sign Ordinance (AMC 18.96) and the
applicants shall obtain a sign permit through the Planning Division prior to the placement of any
signage.
6) That the recommendations of the Tree Commission's October ih, 2010 meeting shall be conditions
of approval, where consistent with applicable standards and with final approval by the Staff Advisor,
including: a) That the applicants staple wire mesh to wooden 2 x 4's and wrap the adjacent Street
Trees' trunks during construction work; and b) That the applicants and their contractors be mindful
of these tree's root zones when staking forms for the sidewalk installation. The applicants shall
obtain a Tree Verification Permit to verify the installation of tree protection fencing prior to
commencement of the door replacement work.

Dear Derek,
The majority of the work to be performed on the Historic J.P. Dodge
and Sons Funeral Home at 90Pioneer/11 0 Lithia Way is an interior
tenant improvement. Additional work to the exterior and site includes
the replacement of the entrance door and private sidewalk to meet
the 2010 OSSC and ADA accessible standards. The project also
includes the addition of stairs to the Lithia Way public sidewalk with
ADA handrails. The new work will not change the character, size,
massing, and materials of the existing building. See Attachment "An
for changes to 110 Lithia Way Entrance Door.
The work to be performed will meet the following City of Ashland
Standards:
1. The tenant improvement project will meet all applicable City
ordinances.
2. The tenant improvement project will meet all the requirements
of the Basic Site Review Standards.
3. The tenant improvement will meet all of the requirements of the
Detailed Site Review Standards.
4. The tenant improvement will meet all requirements of the
Historic District Development Standards.
5. The tenant improvement will meet all requirements of the
Downtown Design Standards.
In addition the City of Ashland has adequate capacity for water,
sewer, electricity and urban storm drainage. Existing paved access
and transportation will adequately service the project.

Tree Protection and Landscape Plan shall be consistent with City of
Ashland requirements. The only additional work in the landscape
area will be the replacement of the existing private sidewalk with a
new sidewalk at the same width. The existing, non-compliant ramp
to Lithia Way pUblic sidewalk will be replaced with a stair. For
Landscaping Design see Attachment liB".
The color of the new door will match the blue color of the existing
wood door and windows. For Door Details see Attachment IIC".

Incompleteness Determination
Dear Mr. Seibert,
I have reviewed the September 10,2010 submittals for your application for a Site Review for the change
to the doors on the historic building at 110 Lithia Way/90 North Pioneer Street. After examining the
materials presented, I have determined that the application is incomplete because the information listed
below was not provided. Incomplete applications are subject to delay in accordance with ORS 227.178.
The application cannot be further processed and deemed complete until the missing information is
submitted or the applicant indicates that the missing information will not be provided.
Findings Addressing the Site Review Criteria in AMC 18.72 Written findings responding to the Site
Review criteria in our land use ordinance as well as to the Basic, Detail, Downtown Design Standards, and
Historic District Development Standards in our Site Design and Use Standards handbook are needed.
These can be fairly limited as the scope of the project is limited to the door modifications, but we do need
narrative responses to the criteria and standards as they relate to the proposal.
The applicable approval criteria are:
A. All applicable City ordinances have been met or will be met by the proposed
development.
B. All requirements of the Site Review Chapter have been met or will be met.
C. The development complies with the Site Design Standards adopted by the City Council
for implementation of this Chapter.

of-way shall comply with the Street Standards in Chapter 18.88, Performance Standards
Options.
Tree Protection & Landscaping Plan Tree protection details consistent with the requirements
of our ordinance (see AMC 18.61.200) need to be provided for the two trees near the Lithia Way
door. In addition, size- and species-specific landscape plans are needed for the landscaped
area between the building and the street.
Details For complete review by staff and Historic and/or Planning Commissioners, the plans
need to include specific detail of the colors, materials, trim, etc. to be used.
Building Department/Occupancy While not a completeness issue for the land use application,
I wanted to make you aware that I spoke with our Building Official, Chris Reising, and he
indicated that he could sign a temporary Certificate of Occupancy if we are provided with a
Barrier Removal Improvement Plan as prescribed by ORS 447.241. Chris needs to review and
approve this plan prior to issuance of temporary Certificate of Occupancy. and to date he hasn't
seen it. I've copied the materials you submitted for the land use action and given the copies to
our Building Department to review the proposed modification of the current building permit;
you'll want to verify with Building Plans Examiner Dan McLeary or directly with Chris whether
any additional information is needed for the permit modifications or the barrier removal
improvement plan.
To continue the Planning Department's review of your application, you must select and complete one of
the following three options:
1. Submit all of the missing information;
2. Submit some of the requested information and give the City of Ashland Planning Division
written notice that no other information will be provided; or
3. Submit written notice to the City of Ashland Planning Division indicating that no other
information will be provided.
Please note that failure to complete one of the three options within 180 days of the application submittal
date (September 10, 2010) will result in your application being deemed void. The application will be
deemed void if the additional information is not submitted by March 9, 2011.
I have enclosed a form, entitled the "Applicant's Statement of Completeness". Please review the
enclosed form and return it to me with any additional material you will be submitting. Your application

Ashland Downtown Historic District, Ashland, OR
Constituting only a portion of the original 1889 Opera House volume, the present single-
story building retains some elements of its pre-1912 exterior, notably the large sandstone
engaged columns that flank the primary entry way. However other elements of the
exterior and much of the storefront design, with day-lighted basement windows bear little
connection to the building's original development and obscure its history.

This single-story masonry volume was erected in 1923-24 as the funeral home of J. P.
Dodge and Son's, a longtime furniture dealer in the Ashland, (See Site #14.0) The
building is an example of the Spanish Colonial style that became popular during that
period and its design is attributed to the prolific southern Oregon architect Frank
Chamberlain Clark. Construction began in 1923 and the building was opened in early
January 1924, It..,J, p, Dodge and Sons' new funeral chapel [is] almost finished and will be
open for inspection On Saturday..." (Tidings, 14-January-1924)
John Page Dodge arrived in Ashland in the late 19th century and in partnership with his
SOnS Louis and Will established the successful furniture company, located just around the
corner on East Main Street after 1904. In 1909 Will graduated from the Western College
of Embalming and assumed control of the mortuary portion of the business,14 Likely as a
result of the division of the company into more separate furniture and funerary operations,
the subject building was erected to the rear of the main store. In 1943 Will Dodge sold
the business to the Litwillers although he retained ownership of the building. (Who's Who,
1948:155) After Litwiller's relocated the site was long-associated with the Ashland
Hardware company and today it is a group of small retail uses facing both Pioneer and
Lithia Way,
Retaining high integrity in its stucco exterior, tiled mansard roof, window detail and trim,
the J. P. Dodge and Sons Funeral Home is an important architectural feature in downtown
and effectively and accurately conveys the associations for which it is significant.
14 Historically, furniture dealers and manufactures often saw dual duty as undertakers as the result of their role in
building or selling coffins. Morticians as a specialized business typically evolved from this arrangement. See, for
example, the Weeks Brothers company in Medford, which follows a similar pattern.
