Prior to that date, anyone who was mailed this Notice Of Final Decision may request a reconsideration of
the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance (ALUO)
18.1 08.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in the ALUO
18.1 08.070(B)(2)( c).
An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to
raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford
the decision maker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that
issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of
appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to
proposed conditions of approval with sufficient specificity to allow this Department to respond to the
issue precludes an action for damages in circuit court.
The application, all associated documents and evidence submitted, and the applicable criteria are available
for review at no cost at the Ashland Community Development Department, located at 51 Winburn Way.

DECISION
The subject property is located at the southeast comer of the intersection Walker and Clark Streets,
previously 720 Walker Street and is zoned R-1-7,5, Single-Family Residential. The lot is approximately
14,800 square feet and has two existing structures on site, making the property non-conforming.
Previous approval of the respite home and resource center required curbside sidewalks between the
applicant's driveway and the comer of the intersection along the Clark Street frontage. The applicant has
submitted a modification request to not install sidewalks due to various prohibitive obstacles that makes
sidewalk installation not practical at this time.
The applicants have indicated that the proposed resource center would be a less "intense" use than that
of the previously approved kindergarten. They state that the resource center will provide a small number
of classes per month, perhaps 2 -3 times per month depending on demand, to a very limited number of
students, approximately 4 - 8 people, none of which will create adverse effects.
Secondly, sidewalk installation within the right-of-way would interfere with four existing cedar trees and
utility structures that would have to be removed or relocated. Additionally, a small retaining wall will
likely be required due to the grade change between the property and the street, thus adding to the overall
expense of the project. Ashland Supportive Housing (ASH) is a small non-profit organization that
depends largely on state and federal funding for its programs. Due to the recent budgetary shortcomings,
ASH's finances have been dramatically reduced. As a result, ASH did not allocate the funding needed to
complete a project of this caliber. Therefore, due to the existing physical constraints and projected
intensity of the use, ASH's ability to meet the specific requirements of the street standards chapter will
prove to be difficult and a variance is the minimum process necessary to alleviate the difficulty.
The applicant is also requesting to remove a Fraxinus Ash and a Plum tree in the rear yard of the parcel.
The Ash is located near the west property line (Walker Street side) and interferes with overhead power
lines adjacent to the parcel. The tree is located under the canopy or two larger trees, an Elm and Cedar,
and removal will be beneficial for the life and longevity of the surrounding trees. The Plum is located in

a small grove of trees in the comer of the property and is fungus infected and leaning on an adjacent tree.
Both trees have been reviewed by an arborist and are recommended to be removed. The Tree
Commission has no issue with removal and feels that mitigation is not necessary due to large number of
remaining trees on the property.
Staff did not receive any public comment on this matter.
The criteria for a Tree Removal Permit are described in AMC Chapter 18.61.080, as follows:
An applicant for a Tree Removal Permit shall demonstrate that the following criteria are satisfied The
Staff Advisor may require an arborist's report to substantiate the criteria for a permit.
B. Tree that is Not a Hazard: The City shall issue a tree removal permit for a tree that is not a
hazard if the applicant demonstrates all of the following:
1, The tree is proposed for removal in order to permit the application to be consistent with
othe,r applicable Ashland Land Use Ordinance requirements and standards. (e.g. other
applicable Site Design and Use Standards). The Staff Advisor may require the building
footprint of the development to be staked to allow for accurate verification of the permit
application,' and
2, Removal of the tree will not have a significant negative impact on erosion, soil stability, flow
of surface waters, protection of adjacent trees, or existing windbreaks; and
3. Removal of the tree will not have a significant negative impact on the tree densities, sizes,
canopies, and species diversity within 200 feet of the subject property,
The City shall grant an exception to this criterion when alternatives to the tree removal have
been considered and no reasonable alternative exists to allow the property to be used as
permitted in the zone, Nothing in this section shall require that the residential density be
reduced below the permitted density allowed by the zone. In making this determination, the
City may consider alternative site plans or placement of structures or alternate landscaping
designs that would lessen the impact on trees, so long as the alternatives continue to comply
with other provisions of the Ashland Land Use Ordinance,
4. The City shall require the applicant to mitigate for the removal of each tree granted approval
pursuant to AMC 18,61,084, Such mitigation requirements shall be a condition of approval
of the permit.
The criteria for an Exception to Street Standards are described in AMC Chapter 18.88.050.F, as
follows:
A. There is demonstrable difficulty in meeting the specific requirements of this chapter due to a
unique or unusual aspect of the site or proposed use of the site;
B. The variance will result in equal or superior transportation facilities and connectivity,'
C. The variance is the minimum necessary to alleviate the difficulty,'
D. The variance is consistent with the stated Purpose and Intent of the Performance Standards
Options Chapter

The application with the attached conditions complies with all applicable City ordinances.
Planning Action 2010-00791 is approved with the following conditions. Further, if anyone or more of
the following conditions are found to be invalid for any reason whatsoever, then Planning Action 2010-
00791 is denied. The following are the conditions and they are attached to the approval:

1) That all proposals of the applicant shall be conditions of approval unless otherwise modified
here.
2) Applicant will sign in favor of a Local Improvement District for the street segment of Clark
Street between Walker and Harmony Streets.
3) All previous conditions of approval not related to the modification request shall remain as
conditions of approval for the use.

The Ashland Planning Division Staff has received a complete application for the property noted above,
Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winburn Way, Ashland,

Ashland Planning Division Staff determine if a Land Use application is complete within 30 days of submittal. Upon determination of completeness, a
notice is sent to surrounding properties within 200 feet of the property submitting application which allows for a 14 day comment period, After the
comment period and not more than 45 days from the application being deemed complete, the Planning Division Staff shall make a final decision on the
application. A notice of decision is mailed to the same properties within 5 days of decision. An appeal to the Planning Commission of the Planning

TREE REMOVAL
18.61.080 Criteria for Issuance of Tree Ret, ,vllal - Staff Permit
An applicant for a Tree Removal Permit shall demonstrate that the following criteria are satisfied. The Staff Advisor may require an
arborist's report to substantiate the criteria for a permit.
A. Hazard Tree: The Staff Advisor shall issue a tree removal permit for a hazard tree if the applicant demonstrates that a tree is a
hazard and warrants removal.
1. A hazard tree is a tree that is physically damaged to the degree that it is clear that it is likely to fall and injure persons or
property. A hazard tree may also include a tree that is located within public rights of way and is causing damage to existing
public or private facilities or services and such facilities or services cannot be relocated or the damage alleviated. The applicant
must demonstrate that the condition or location of the tree presents a clear public safety hazard or a foreseeable danger of
property damage to an existing structure and such hazard or danger cannot reasonably be alleviated by treatment or pruning.
2. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to AMC 18.61.084. Such
mitigation requirements shall be a condition of approval of the permit.

EXCEPTION TO STREET STANDARDS
18.88.050 F - Exception to Street Standards
An exception to the Street Standards is not subject to the Variance requirements of section 18.100 and may be granted with respect
to the
Street Standards in 18.88.050 if all of the following circumstances are found to exist:
A. There is demonstrable difficulty in meeting the specific requirements of this chapter due to a unique or unusual aspect of the site
or proposed use of the site.
B. The variance will result in equal or superior transportation facilities and connectivity;
C. The variance is the minimum necessary to alleviate the difficulty; and
D. The variance is consistent with the stated Purpose and Intent of the Performance Standards Options Chapter,
(ORD 2951, 2008; ORD 2836,1999)

At this time ASH is asking for a modification of the conditional use permit granted on June 8, 2010, The
requested modification is to remove conditions 4 and 5, which mandate the addition of a public
curbside sidewalk along Clark Street and for engineered construction drawings for review and approval.
We are asking for this modification based on the following reasons:
1. ASH is a small non-profit organization who is able to take on this project only because of grant
funding approved by the City. A clear and well researched budget was supplied at the time of
our application for funding in which we asked for only what we needed, We do not have extra
funds to take on additional costs, which would be extensive, for an added major construction
project. This is especially true as ASH will receive a 6% budget cut in funding from the State of
Oregon, which is to take effect October 1, 2010 and remain in effect until at least July 2011. The
project itself is not expected to return a profit until at least 2014. We simply do not have extra
funds for this addition. We have obtained an estimate for sidewalk construction that totals
$25,000, This includes: architectural and engineering fees; heavy equipment to restructure the
hillside; a retaining wall; concrete pouring; and, rebuilding the fence that would have to be
moved to accommodate the sidewalk,
2, The area in which the sidewalk is to be located is a very difficult area to work in due to elevation
and existing structures. In order for a sidewalk to be installed, heavy equipment will need to be
brought in to restructure the hillside to create a retaining wall, Architectural and engineering
services will have to be brought in to create the plans, We will lose a part of our existing - and
necessary- fencing. The sidewalk design will have to take into consideration a telephone pole
with guide wire, survey pin, and cable box located at the corner. None of this is described on
the plans we have already drawn, which means we would have to recreate some of the work we
have already paid for.

3. The building that will house the Respite Home faces Walker Ave., but the side of that home that
has the bedrooms faces Clark St. and it is outside these bedroom windows that the proposed
sidewalk would run along. We do not want people to walk in front of these bedroom windows,
The Respite Home is meant to be a place of peace, tranquility, and respite. We are concerned
that bringing the public so near to people who have particular vulnerabilities to public scrutiny
will be a detriment to their time of rest and respite,
4, It has been proposed that we apply for more funding next year to pay for the sidewalk, This
would have a detrimental effect on our project, which needs to be fully completed before we
open for business. Our opening is scheduled for Spring 2011. Should we be required to install a
sidewalk with funds received next year, we would have to close the facility while work is in
progress due to the upsetting nature of having heavy construction occurring while people are
supposed to be at rest and the dangers of having people with disabilities present at a
construction site. The work would have to occur during what we anticipate to be our busy
season. The first year of a new business is the hardest and is when most new businesses fail.
Having to close at that time could be a breaking point and would certainly lose revenue at a time
when that could not be afforded.
Over the years the building facing Clark Street has mostly not had a residential use, It has been a dance
hall, a meeting hall, a day-care, a five bedroom group home, and most recently was converted back to a
classroom set-up for use as a kindergarten, Its proposed use is as a Resource Center, which will provide
a meeting hall for support groups and small classes for persons with disabilities, and which is anticipated
to have a lower impact than in previous conditionally permitted uses, This is in keeping with both the
previous uses and with current activity on Clark Street, which is a C-1 zone on the opposite side of the
street. The Presbyterian Church directly across the street has numerous group meetings on a daily
basis, and on the same side of Clark Street there is a community park and another church, the Seventh
Day Adventists, that runs a weekly food bank, There will be much less traffic generated by the Resource
Center than in these other locations on Clark Street. This will provide a smooth transition from the
heavy commercial type use of Presbyterian Church across the street through the quiet, residential type
use of the Respite Home, to the neighborhood of single family homes on Walker Avenue. The Resource
Center will have small sized classes of 4 to 8 people during mostly weekday, daytime hours. Activities
will be conducted indoors and in the interior ofthe property during daylight hours. There may be 2 to 3
evening meetings per month, none of which will run late or generate excessive noise, light, or glare, The
number of people on site at any given time will be limited to small groups of 4 to 8, with heavy use not
being anticipated due to the specialized nature of the services, The facility will be staffed when in use by
one or two staff members, Classes will be made available to the developmentally disabled population in
Jackson County. Some individual instruction may also be offered, It is anticipated that approximately 4
differing classes will be offered at a time, none running concurrently. Proposed classes may include
money management, art, specialized exercise classes, social support groups, gardening, and other
classes as developed with community input. Class duration is expected to be from 1 to 3 hours per
session. Classes will be scheduled at times when church is not in session.

The sidewalk that is currently in front of the Resource Center is felt to be sufficient for the proposed use,
Clientele are disabled and as a general rule do not drive, This will generate an increased use of public
transportation, Class sizes will be kept small; each will be held 1-3 times per week. We do not expect
heavy traffic at any time for this operation. Some classes may even be administered at the facility, but
located off site, some group transportation may be arranged, and some transportation may be provided
by ASH staff. All this combined will result in traffic patterns having no greater impact than in a single
family residence.

Request for Removal of Two Additional Trees
for Modification of Conditional Use Permit

Ashland Supportive Housing
Ashland Supportive Housing wishes to remove two additional trees from our original request for
tree removals. The two trees we wish to add are #9 Fraxinus Ash and #22 Plum. Both are
recommended to be removed by our Arborist, August Schilling of the Village Arborist.
The Fraxinus Ash is near the property line and interferes with city power lines. It is also under
the canopy of the adjacent #8 Ulmus Elm and against #10 Calocedrus Cedar. Per "Criteria for
Issuance of Tree Removal" 18.61.080, under Criteria B: removal of the tree will not have
significant negative impact on erosion, soil stability, flow of surface waters, or existing
windbreaks. It is in an area of several other trees which will ameliorate these conditions. Safe
removal of this tree will have a positive impact on the two adjacent trees. Removal of the tree
will have no negative impact on the surrounding trees. It will be the opposite as this tree is
fungus infected and pushing against adjacent trees,
The Plum tree is in a small grove of trees at the corner of the property and is also fungus
infected. The structure is weak and it is leaning against the adjacent #21 Apple tree. As above,
removal of the tree will not have a negative impact on erosion, soil stability, flow of surface
waters, nor existing windbreaks. The nearby trees will make up for the loss of this tree to the
soil. Safe removal of the tree will actually benefit the neighboring #21 Apple and #23 Native
Oak as it will no longer be leaning on them and taking their light. There are so many trees on
this property that losing this tree will not have a negative impact on any trees within 200 feet.
We are not planning on replacing #9 Fraxinus Ash with any other tree. The two large, mature
trees near it make this impractical. There is also a walkway which will be repositioned across its
roots, We will add a tree to our group home at 290 W, Nevada to satisfy City requirements of
replacing trees we remove. Weare willing to replace #22 Plum tree with a dwarf ornamental
fruit tree in the same area.
