Commercial Activities in Parks
The attached information is the cumulative result of a staff brainstorming session. We attempted
to list all the kinds of activities which have been permitted in parks which may involve
commercial activities. Over the years, these are the guidelines' which have been followed in
administering "policy" related to commercial activities in parks. Some of the practices have been
in effect prior to any existing staff working for the Department.
Staff Opinion. We believe that continuing the practices which have been followed in recent
years which pertain to the ordinances discussed would be in the best interest of the parks. We do
not believe that prior practices have detracted from the general public's use and enjoyment of our
parks.
Specifically pertaining to commercial photography and filming, we do not believe that the small
photo shoots or filming sessions which have been allowed to take place in Lithia Park until
recently have greatly impacted on the public's enjoyment of the park. We cannot recall any
instance in which the Department received a complaint or call about this kind of activity
interfering with a park visitor's enjoyment of Lithia Park.
If larger-scale commercial filming were permitted in parks, particularly Lithia Park, staff does
believe that this would intrude upon the public's overall ability to enjoy our park system. If
Commissioners are interested in considering permitting larger-scale filming activities, staff
would recommend that a committee be formed to work with the filming industry to set up
guidelines, rules and regulations, fee structures, and other kinds of things which would be
required to set and administer a clear and comprehensive policy.
Action Required: If the Commission is prepared to move forward with a decision, a motion
would be in order.
Suggested Motion: Related to commercial activities in. parks, I make a motion to adopt the
exceptions noted to specific City ordinances included in the information accompanying this
memorandum as written (or as amended in discussion) as policy, and, to have staff draft a
Resolution which can be approved by the Commission at the next Regular Meeting.

Ordinances and policies
The following is a list of city ordinances which have affect on conducting commercial activities
in parks. Parts of these ordinances also address activities which may not strictly be considered
Mcommercial" activities but include monies exchanging hands in one form or another.
There are no easily accessible written policies pertaining to the topics addressed by these
ordinances. Over the years, as Individual requests were made to Commissions for waivers or
exemptions from the stated ordinance, Commissions have either denied the request or
approved exceptions. 5taff has then incorporated these decisions into operational procedures
and implemented Mpolicy.M The City Attorney indicates that because there is no easily accessible
record of adopted policy, at this time essentially Munwritten policy has been established by
common practice."
In order to assist the Commission in discussion, listed beneath each ordinance is information
which staff has put together as a means of outlining general types or specific kinds of activities
which have been approved over the years as exceptions and that staff has been using as
guidelines to administer Mpolicy".

granted by the Park Commission. No one shall hawk or peddle popcorn, ice cream, candy,
soda water, peanuts, or similar wares within or on any of the park grounds of the city
without first securing a permit to do so from the park Commission. (Ord. 625 56,1916)

Note: When renovation of Llthia Park was taking place in the early 1980's the front
portion of the park was fenced off and activities which had normally been occurring in
that area were unable to occur. Once the lower park was opened to the public again,
the two exceptions noted above were grand-fathered by the Commission.
Outlying parks - Generally speaking, selling has been granted in those parks which have
concession facilities as follows:
At Hunter Park:
. Little League has been permitted to operate a concession each league season
and to conduct fund raising activities.
. Individuals or groups who rent the ballflelds to put on tournaments may use
the concession area by coordinating with Department staff and Little League.
. Activities or events which have Department sponsorship may sell at events.

At the YMCA City Park:
t The YMCA and the Ashland Youth soccer Club have been permitted to run
concessions and to conduct fund raising activities.
At Park Facilities, I.e. the Meyer Pool and the Hunter Park Building:
t Groups or Individuals who rent the facllltles may sell or conduct fund raising
activities within the facility.
<Note: At Its February 1999 meeting the Commission elected not to place vending
machines at the Skate park.>

Solicitors, commercial photographers without permission from the Park Commission,
agents, fakirs, peddlers, mendicants, strolling musicians, organ grinders, exhorters, and
showpersons shall not ply their several vocations within the park limits. (Ord. 626 S7, 1916)
(Note: Of the vocations listed above, the only vocation which the Commission has permitted
to utilize the parks has been "commercial photographers." Showpersons rent the Bandshell
. on occasion to give performances but, In accordance with ordinance 10.68.050 noted above,
no permission has been granted to sell or solicit monies at the Bandshell.>

use of an area, blocking access to paths or trails, supplemental lighting, restricting
sound or other Items which would detract from the general use of the park.

In addition the Commission also stated that they would not support uniform requests or official salaries.
None of the applicants are asking for this kind of support. The Commission also stated that they would not
support continuing groups, organizations or programs that have their own non-profit organization. The
YMCA, Community Works, Charter School, Wilderness Program and Crew Inc. are non-profit types of
organizations to the best of our knowledge. (At the meeting the Commission may want to determine the
non-profit status of each organization).
All of the applicants have been informed of the regular Park Commissions March meeting and have been
invited to attend to answer any specific questions the Commission may have.
Anticipated dollars available in the 1999-2000 Budget for allocation of recreational programs is $16,000.
The money for programs would not be available until July 1st, 1999.

Proposed 1999-2000 Department Budgets
The attached budgets contain all the items which the Commission indicated during Budget Study
Sessions that it would like to have included in the 1999-2000 fiscal year budgets. These specific
dollar amounts may change due to the fact that I am still working with City staff on several items
which could have some affect on the overall budget.
Once all the details have been worked out, I plan to ask that the Commission meet so that I can
provide you with any additional information that comes from the work which is ongoing with
City staff regarding the Department's budgets. I would anticipate that a meeting will need to be
held some time early in April.
Required Action:
A motion is required to adopt the proposed budgets. Because the budgets may still be subject to
significant change, I recommend that the Commission pass a motion which indicates a
"contingency. "
Suggested Motion:
I move to have the Commission approve the Ashland Parks and Recreation Department budgets
for Fiscal Year 1999-2000 as presented contingent upon the budgets being brought back to the
Commission for review if significant changes are made and prior to having the budgets presented
to the City Budget Committee.

Oak Knoll Driving Range and Oak Knoll Clubhouse
Driving Range - Some additional information for consideration.
If the Commission chooses to move forward with completing construction of the driving range,
neighbors have indicated that they may proceed with an appeal to LUBA. The appeal to LUBA
will not actually be based on the Commission's decision but on the City of Ashland Planning
Department's opinion that the construction of a driving range at Oak Knoll is not a land use issue
and therefore does not require a land use hearing.
If LUBA determines that the Planning Department was incorrect in its.opinion, it would not
mean that the driving range would need to.be torn down but that the Conunission would need to
go through the process of applying fora Conditional Use Permit. An application would be
submitted to and reviewed by .the Ashland Planning Commission to determine whether or not the
driving range meets the criteria for granting a ConditiOl1alUse Permit.. Depending on the
Planning Commission' sdecision, either the neighbors or the Conunissioncouldfile an appeal
with the City Council for review. The Council Can overturn a Planning Commission decision.
If Commissioners would like to move forward with completing the driving range, they may want
to take into consideration that the Commission may need to participate in a land use action at
some future date. The following would be the worst case scenario: LUBA indicates that the
driving range should have gone through the land use process, the Commission undertakes
acquiring a Conditional Use Permit with all the steps and turns which are sometimes required,
and, ultimately a ruling comes down against the Commission. At that time, the driving range
would need to be taken down and an additional cost would be incurred in order to remove it.
These comments are not made to influence the Commission's decision one way or another. But,
if the Commission chooses to move forward with the driving range, it may also want to take into
consideration the fact that it may be committing itself to a land use process at some future date.

Clubhouse facUity -
The Commission approved the construction of a new clubhouse facility which includes removal
of the existing clubhouse structure. The goal was to have a new clubhouse facility ready by late
spring this year for this year's prime golfing season. However, due to delays associated with
decisions related to the driving range which could affect the overall design of the clubhouse, we
will not be able to meet the spring completion date for the clubhouse.
Staff Opinion:
After discussions with Bob Haney, staff recommends that we delay construction of the new
clubhouse until next fall. We strongly believe that it would not be in the best interest of the
course to have a construction project happening during prime golfing season.
Mr. Haney has indicated that he would be interested in opening the present facility for food and
beverage service this year if he can obtain the appropriate licenses from the health department. It
would be limited to a lunch menu. He would also apply for a beer and wine permit.
If Bob can obtain the necessary permits to reopen the kitchen, we could move forward under the
same agreement as last year. Bob would be responsible for all costs related to the food and
beverage service including payroll and utilities. As in our previous agreement, there would be no
rent charged for use of the facility. Staff believes that it is critical to be able to offer some kind
of food and beverage service during prime golfing season. As we did last fall, we believe
entering into an agreement with Mr. Haney would be an excellent stop-gap measure to carry us
through this year.
