On February 9, 2011, the Staff Advisor for the Ashland Planning Division administratively approved your
request for the following:
PLANNING ACTION: 2011-00025
SUBJECT PROPERTY: 316 Helman St.
APPLICANT: Dondi Visser
DESCRIPTION: A request for a Solar Variance to shade an additional 12 feet onto the neighboring property to
the north with a new addition to the existing house. The neighboring property owner at 332 Helman Street has
agreed to the proposed shading beyond that allowed outright under Ashland's Solar Access ordinance.
The Staff Advisor's decision becomes final and is effective on the 13th day after the Notice of Final
Decision is mailed.
Prior to that date, anyone who was mailed this Notice Of Final Decision may request a reconsideration of
the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance (ALUO)
18.1 08.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in the ALUO
18.108.070(B)(2)(c).
An appeal maynot be made directly to the Land Use Board of Appeals. Oregon law states that failure to
raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford
the decision maker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that
issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of
appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to
proposed conditions of approval with sufficient specificity to allow this Department to respond to the
issue precludes an action for damages in circuit court.
The application, all associated documents and evidence submitted, and the applicable criteria are available
for review at no cost at the Ashland Community Development Department, located at 51 Winburn Way.
Copies of file documents can be requested and are charged based on the City of Ashland copy fee
schedule.

DECISION
The subject property is located at the northeast comer of Hersey and Helman Streets, and is zoned R-I-5,\
Single-Family Residential. The lot is approximately 7,713 square feet in area, rectangular in shape, and'
has a slight downward slope of approximately two percent to the north.
An existing 1320 square foot two-story home was built in 1948 and is placed roughly in the middle of
the lot, while a 600 square foot carport is located approximately 25 feet from the home, in the rear yard.
A gravel drive to access the rear of the lot is placed on the left (north) side of the property. The existing
house has a two-story section on the right (south) portion of the home, while a small one-story addition
is placed on the left (north) side ofthe home. Due to the fact that the home's floor plan and placement of
structures is configured in such a way that does not allow for an addition to be placed elsewhere on the
lot, a solar access variance is required for the second story addition.
The applicant proposes to construct a 240 square foot addition on the north side of the home, which will
cast a shadow 12 feet greater than permitted under Solar Setback Standard A. The subject parcel's
north/south liner is few feet shy of meeting Solar Setback Standard B, which states that a shade
producing point cannot cast a shadow more than a 16-foot high fence. Additionally, the lot is orientated
that the north/south lot lines are nearly 45 degrees of an angle to north, which produces a shadow that
will cross the front comer of the adjacent lot at noon. The applicant has stated in their submitted findings
that the "worst case shading" will likely occur around 4 pm, just before the sun hides behind the
mountains to the west, in which the shadow will be over a non-habitable garage on their property.
Therefore the neighboring property owners have no problem agreeing to the additional shading as
proposed, and considers the shading negligible and inconsequential to future development of the site,
and does not preclude the reasonable use of solar energy on the site by future buildings.
In reviewing the request, staff believes the placement of the addition is dictated by the placement of the

existing home, and that the proposal's impacts to the solar access of the property to the north have been
minimized to the degree possible while addressing these issues.
The criteria for a Solar Access Variance are described in AMC Chapter 18.70.060, as follows:
a. The variance does not preclude the reasonable use of solar energy on the site by future
buildings; and
b. The variance does not diminish any substantial solar access which benefits a habitable structure
on an adjacent lot.
c. There are unique or unusual circumstances which apply to this site which do not typically apply
elsewhere. .1
The application with the attached conditions complies with all applicable City ordinances.
Planning Action 2011-00025 is approved with the following conditions. Further, if anyone or more of
the following conditions are found to be invalid for any reason, then Planning Action 2011-00025 will
become void. The following conditions of approval are as follows:
1) That all proposals of the applicant shall be conditions of approval unless otherwise modified here.
2) That the additional shadowing approved here is limited to that illustrated in the applicants' Solar
Access Waiver site plan dated January 14th, 2011. The final submittals for building permit shall be
in substantial conformance with the drawings submitted with the Solar Waiver application, and any
additional shading proposed beyond that requested here would require modification of this approval
and resubmission of a Solar Waiver application

The Ashland Planning Division Staff has received a complete application for the property noted above.
Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winburn Way, Ashland,
Oregon 97520 prior to 4:30 p.m. on the deadline date shown above.
Ashland Planning Division Staff determine if a Land Use application is complete within 30 days of submittal. Upon determination of completeness, a
notice is sent to surrounding properties within 200 feet of the property submitting application which allows for a 14 day comment period. After the
comment period and not more than 45 days from the application being deemed complete, the Planning Division Staff shall make a final decision on the
application. A notice of decision is mailed to the same properties within 5 days of decision. An appeal to the Planning Commission of the Planning
Division Staff's decision must be made in writing to the Ashland Planning Division within 12 days from the date of the mailing of final decision. (AMC
18.108.040)
The ordinance criteria applicable to this application are attached to this notice. Oregon law states that failure to raise an objection concerning this

Finding of Fact
a) "The variance does not preclude the reasonable use of solar energy on the site by
future buildings."
. The applicant finds that the majority ofthe neighbor's one story roof will never be
shadowed by the proposed addition and allows ample space for installing a solar,. .
domestic water heater or photo voltaic collectors. The neighbor's lot has an enormous
future building envelope that will be unaffected by the shadow that is proposed.
b) "The variance does not diminish any substantial solar access which benefits a
habitable structure on an adjacent lot."
,The affected neighbor has a garage adjacent to the solar exposure side of their property, .
this is not a habitable structure. The worst case scenario of the shadow proposed, on the
shortest day of the year, projects 16' onto the building envelope. Because ofthe street
orientation, almost 45 degrees to the north/south axis, the solar shadow on December 21
at noon, does not fall within the 6' set back. As the day progresses there is shadow 'that
affects the building but it does not achieve the maximum shading before the sun .
disappears behind the molintains to the west. The applicant fwds that approximately 2 to
J hours of a minimal amount of solar exposure, the worst case scenario (December 21 5t)
is minimal, considering the lost solar gain from D~cember inclement weather, fog .and ..
overcast.
c) "There are unique and unusual circumstances which apply to this site which do not
typically apply elsewhere."
The street orientation (north/south) and the proportions of the lot force the calculation of.
. the lot as a type A solar fence (6'). The lot is just a few degrees off from not throwing a
shadow on the affected property at all. If the lot was a few feet narrower it would have
been classified as a type B solar fence height (16') and would make a solar variance
unnecessary and would conform to the requirements of the ordinance. The owner of the,
affected property has a non-habitable (garage) within the solar shadow, and they have:
plante~ a row of evergreen trees along the property line that prevents solar orientation
gain through-out the year. They have stated that they prefer shade over the solar gain on
, their house and are willing to support a second story addition on their neighbors house
because they feel it will enhance the livability of their property.
