IRRIGA TION FACILITIES EASEMENT
Snow berry Brook, LLC, Grantor, does hereby grant unto the City of Ashland, Oregon, a municipal corporation, a
perpetual easement over the following described property:
SEE ATTACHED LEGAL DESCRIPTION - EXHIBIT "A" & "B"
For the purpose of constructing and maintaining, therein, irrigation facilities as part of the irrigation system of
said City, including a right to go upon the premises hereinabove described with such personnel and equipment as
may be necessary to accomplish the purposes hereof, reserving to the Grantor herein the right to possess and make
such use of the premises above described as shall not conflict with the said City in the exercise of this easement;
and the City by these presents covenants that it shall promptly fill to grade of adjoining property, and to restore
the surface over, any excavation it may make pursuant hereto.
Grantor reserves the right to use and possess such land within the easement as shall not interfere with
Grantee's use thereof for the purposes above set forth, but Grantor shall not cause any buildings or permanent
structures to be constructed over any part of the easement without Grantee's consent.

EXHIBIT "A"
That portion of the following two (2) srrips of land lying within Parcel 2 per Partition Plat No. P-27-2009,
according to the official plat thereof, now of record, in Volume 20, Page 27 of "Record of Partition Plats" of
Jackson County, Oregon and filed as Survey No. 20468 in the Office of the Jackson County Surveyor, said strips
being 10 feet in width and lying 5 feet on either side of the following described centerlines:
#1: Commencing at the Southwest comer of said Parcel 2; thence along the South line thereof, South 89055'19"
East, 201.91 feet to the true point of bel!inninl!; thence North 00004'41" East, 137.36 feet; thence North
11015'00" West, 21.64 feet; thence North 00004'41" East, 56.89 feet; thence North 30000'00" West, 21.44 feet;
thence WEST, 10.76 feet; thence North 00004'41" East, 112.83 feet; thence along the arc of a 917.38 foot radius
curve to the left having a central angle of 07048'05", a distance of 124.91 feet (the long chord of which bears
North 03049'22" West, 124.81 feet) to the point of terminus.
#2: Beginning at the most Westerly Northwest corner of said Parcel 2; thence along the North line thereof, South
89055'19" East, 171.16 feet to the interior ell corner thereof and the point of terminus.
