your request for the following:

Prior to that date, anyone who was mailed this Notice Of Final Decision may request a reconsideration of
the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance (ALUO)
18.1 08.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in the ALUO
18.1 08.070(B)(2)( c).
An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to
raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford
the decision maker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that
issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of
appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to
proposed conditions of approval with sufficient specificity to allow this Department to respond to the
issue rrecludes an action for damages in circuit court.

DECISION
The subject parcel is located at the northeast comer of the intersection of Pioneer, Fork, and Hargadine
Streets at 44 South Pioneer Street. The parcel is roughly rectangular in shape, with a width of approximately
151 feet, a depth of66 feet, and an area of approximately 0.21 acres. The property is located within the C-l-
D Commercial Downtown zoning district on the Oregon Shakespeare Festival (OSF) campus, just across the
street to the east of the OSF Bricks courtyard, and is developed with both the historic Carpenter Hall
building and the "New Theatre" which was approved in 2000. The site is generally devoid of significant
natural features, with vegetation limited to established landscaping and the adjacent street trees. The parcel
slopes down to the north with an average slope of approximately 13 percent.
With the application, the Oregon Shakesp~are Festival proposes to have a food vendor's truck and a separate
mobile grill on site in the courtyard adjacent to the New Theatre during a limited number of special events.
The materials provided note that these special events will occur three to four times a year between the
months of February and October, and that the food vendor would operate for a period of one to four days
during each special event. Examples of special events cited in the submittals include a one-day Open House
in May, and CultureFest, a celebration of multi-ethnic cultures, which is to be held from September 30
through October 3 this year. The application notes that other special events would likely occur in
conjunction with specific Green Show performances.
The application explains that the food vendor will be operating from a mobile food vendor "taco truck" that
is 22-feet long, seven-feet wide and eight-feet high. A bento grill (two-feet deep, five-feet wide and three-
feet high) will be operated by the same vendor and will be positioned on the opposite side of the courtyard
facing the taco truck. The application also notes that a professionally lettered menu sign will be used on the
taco truck. A letter from the Jackson County Environmental Health Department has been provided, noting
that the department has licensed mobile catering trucks to this vendor since 1999 and that the vendor has
been prompt in renewing her licenses, informing the department of changes, and complying with Oregon
mobile unit health codes.

The application notes that there will be no disturbing odors from either the vendor truck or the grill, and that
there will be no impact to established trees or adjacent landscaping. The truck and grill are to be located
entirely on tax lot #1000, which is under the ownership of the Oregon Shakespeare Festival (rather than on
adjacent right-of-way or city-owned parcels that are leased to the Festival).
The application explains that one of the core values of the Festival is inclusion, which serves as a means to
leverage diversity. The application notes that the Festival has chosen a taco truck and grill as a means to
welcome the Rogue Valley's Latino community by providing food and vendors that are familiar to this new
audience.
Within the C-I-D zoning district, uses that are temporary, intermittent or seasonal in nature are subject to
Conditional Use Permit review for compliance with the criteria in AMC 18.104. In reviewing the request for
compliance with the standards of the zoning district, staff noted that restaurants in general are an outright
permitted use, and that the subject property is located within the "North Main, Historic District and Oak
Street" Detail Site Review Zone. Because the New Theatre building is in excess of 10,000 square feet, the
site is subject to the Additional Standards for Large Scale Projects relating to "Public Spaces." These
standards require that public plaza space be provided, and that this space incorporate at least four specific
elements from a list of six options, which include providing outdoor seating and areas for outdoor eating and
food vendors. As such, the proposed placement of an intermittent/seasonal food vendor's truck and grill
seems well suited not only to the existing Festival's use of the site, but also to the broader district.
City facilities for water, sewer, paved access to and through the development, electricity, urban storm
drainage, and adequate transportation are in place within the existing rights-of-way adjacent to the property,
and serve the existing buildings and uses. The proposed truck and grill are largely self-contained, by design,
and would be able to obtain any necessary electrical or water connections from outdoor outlets in the
adjacent courtyard.
In terms of the impacts of the proposal, the truck and grill placement will be within the New Theatre
courtyard, well screened on three sides by existing Festival buildings. While the Pioneer Street side is open
directly opposite the'OSF Bricks courtyard, its exposure remains interior to the campus and thus minimizes
any potential visual impacts'beyond the subject property. The truck and grill are to be in place only during a
limited number of special events such as the Open House, CultureFest, and Green Shows, and as such, staff
believe that they will have no greater adverse material effect on the livability of the impact area than would
development of the site according to its target use. Conditions have been included below to insure that the
placement of the truck and grill do not interfere with existing courtyard seating areas or with pedestrian
circulations routes, and that the truck and grill comply with the requirements of both the Fire and Building
Departments.
The criteria for a Conditional Use Permit are described in AMC Chapter 18.104 as follows:
A. That the use would be in conformance with all standards within the zoning district in which the use is
proposed to be located, and in conformance with relevant Comprehensive plan policies that are not
implemented by any City, State, or Federal law or program.
B. That adequate capacity of City facilities for water, sewer, paved access to and through the
development, electricity, urban storm drainage, and adequate transporlation can and will be
provided to and through the subject properly.
C. That the conditional use will have no greater adverse material effect on the livability of the impact

area when compared to the development of the subject lot with the target use of the zone. When
evaluating the effect of the proposed use on the impact area, the following factors of livability of the
impact area shall be considered in relation to the target use of the zone:
1. Similarity in scale, bulk, and coverage.
2. Generation of traffic and effects on surrounding streets. Increases in pedestrian, bicycle, and
mass transit use are considered beneficial regardless of capacity of facilities.
3. Architectural compatibility with the impact area.
4. Air quality, including the generation of dust, odors, or other environmental pollutants.
5. Generation of noise, light, and glare.
6. The development of adjacent properlies as envisioned in the Comprehensive Plan.
7. Other factors found to be relevant by the Hearing Authority for review of the proposed use.
The application with the attached conditions complies with all applicable City ordinances.
Planning Action 2010-00976 is approved with the following conditions. Further, if any one or more of the
following conditions are found to be invalid for any reason whatsoever, then Planning Action 201 0-00976 is
denied. The following are the conditions and they are attached to the approval:
1) That all proposals of the applicant shall be conditions of approval unless otherwise modified herein.
2) That number and duration of special events each year shall be generally limited to those described in
the application, and that the applicants shall provide the city's Planning Department with a list ofthe
anticipated annual special event dates prior to the first event of each season.
3) That all requirements of the Building Division shall be satisfied prior to operation of the vendor
truck or grill
4) That the requirements of the Fire Department shall be satisfied prior to operation of the vendor truck
or grill.
5) . That the placement of the truck and grill shall not obstruct approved courtyard seating areas or
pedestrian circulation through the courtyard.
6) That signage shall be limited to the menu board attached to the truck noted in the application

The Ashland Planning Division Staff has received a complete application for the property noted above.
Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winburn Way, Ashland,
Oregon 97520 prior to 4:30 p,m. on the deadline date shown above.
Ashland Planning Division Staff determine if a Land Use application is complete within 30 days of submittal. Upon determination of completeness, a
notice Is sent to surrounding properties within 200 feet of the property submitting application which allows for a 14 day comment period. After the
comment period and not more than 45 days from the application being deemed complete, the Planning Division Staff shall make a final decision on the
application. A notice of decision is mailed to the same properties within 5 days of decision. An appeal to the Planning Commission of the Planning
Division Staff's decision must be made in writing to the Ashland Planning Division within 12 days from the date of the mailing of final decision. (AMC

Narrative for Conditional Use Permit
The Oregon Shakespeare Festival (OSF) requests proper authorization to have a
mobile food vendor and a mobile grill on site immediately next to the New
Theatre during Special Events.
Special Events will occur annually three to four times from the month of February
through the month of October. Food vendor would be operating for a period of
one to four days during each Special Event. Examples of Special Events are;
Open House, a one day event held in May, CultureFest, which is a celebration of
multi-ethnic cultures; in 2010 this event will be held September 30 through
October 3. Other Special Events will most likely occur in conjunction with specific
Green Show performances.
Food vendors will of course possess all appropriate Ashland City business
licenses. The mobile food vendor taco truck is 22 feet long and seven feet wide
and eight feet high. The bento grill will be operated by the same food vendor and
will be positioned on the opposite side of the courtyard facing the taco truck. The
bento grill is two feet deep and five feet wide and three feet high.
The taco truck will be acquiring professionally lettered menu signage. There are
no disturbing odors that result from either taco truck or bento grill. No contact or
obstruction of trees is involved with placement of taco truck or bento grill.
The taco truck and bento grill will be located on Lot #1000 which is the property
of the Oregon Shakespeare Festival.
Oregon Shakespeare Festival contacted both Starbucks and Enchanted Florist to
inform them of the taco truck food vendor and neither expressed any concerns.
The Oregon Shakespeare Festival and taco truck owner, Margarita Castillo, met
with Margueritte Hickman, Division Chief, Ashland fire department, for an
inspection of the taco truck on the exact location on OSF property where food
vendor will be stationed.
The Oregon Shakespeare Festival has chosen a taco truck and bento grill
specifically as a means to welcome the Rogue Valley Latino community. One of
OSF's core values is inclusion. Inclusion is a strategy to leverage diversity.
Diversity always exists in social systems but inclusion on the other hand, must be
created. OSF has found that one of the most successful methods of welcoming
new audiences is through providing food from vendors that are familiar to that
new audience. The taco truck and bento grill are favorites of Rogue Valley
Latinos.

This letter is to infonn interested parties of the history that the Jackson County Health Department has
with Tacos EI Gallo mobile units. The Jackson County Health Department has Licensed Tacos El Gallo
as a mobile catering operation since 1999. Since this date Margarita Castillo has added two more
catering trucks to her fleet. Ms. Castillo has always been very prompt in renewing her mobile unit
licenses every yeart as well as informing us of any changes to her operation. She has always been very
cooperative to staying in compliance with Oregon mobile unit health codes. A file of her mobile unit
inspections can be viewed at the Jackson County Health Department For more information you can
