Applicant: Lithia Homes, Inc.
The Appeal of the above matter was heard by the Ashland City
Council at a Public Hearinq held April 7, 1981, and based upon the data
and testimoriy presented and the records in this Matter, the Council
finds that the action of the Planning Commission was based on erroneous'
data and for that reason t:ie permission granted is denied without preju=
dice to the Applicant to file a new application and further, the Appli-
cant is given credit for fees already paid.

The above referenced matter concerns the first hearinq
before the Council relative to Lithia Homes. After discussing
this matter with John Fregonese, we concluded that it was appro-
priate for the Council to conclude the first hearing by the
adoption of Findings. Thus enclosed are such Findings which I
suggest be presented to the Council. For John's information,
a copy of the Findings are being sent to him.
