A. Szate of Oregon, Department of Human Resources, State Community Services Program,
hereinafter called SCSP, and;
B. Cit of Ashland hereinafter called the Home Enerqy
Supp ier, a so HES.
PURPOSE OF AGREEMENT
The purpose of this aqreement is to provide a mechanism by which SCSP can carry out the
provisions of the low-Income Home Energy Assistance Act of 1981 and specifically that
the funds available under this Act be used in accordance with the reauirements of Title
XXVI of the Omnibus Budget Reconciliation Act of 1981. Therefore, to carry out the con-
ditions of the Act, the parties agree to the following terms and conditions set forth
helow. The Low-Income Home Energy Assistance Proqram shall be referred to in this agree-
ment as LIEAP.
SCSP CONDITIONS
SCSP shall pay all valid Energy Assistance Authorizations promptly and no later than
45 days after eligibilit.y is established by SCSP or its agents for a household. An
eligible household is one that has applied for energy ass,istance and the HES has been
notified that the household is qualified for assistance.
2. SCSP or its agents sha,yT keep the HES informed in a timely manner of any oertinent
chanqes in program operation caused by Federal modification of the regulations.
3. SCSP or its agents will notify the HES of payments made on behalf of their customers.
4. SCSP will notify all eliqible households of the amount of payments made on their be-
half to a HES.
HOME ENERGY SUPPLIER CONDITIONS
l. The HES agrees to charge the household in its normal billing process and no more than
the difference between the actual cost of the home energy and the amount of the pay-
ment made by SCSP under this agreement.
2. The HES agrees that no household receiving assistance under LIEAP will be treated any
differently because of such assistance under applicable provisions of State law or
public regulatory requirements.
3. The HES agrees not to discriminate, either in the cost of the goods supplied or the
services provided, against the eligible household on whose behalf payments are made.
5. The HES ma,y refer its customers to SCSP or its agents for assistance.

6. A credit memo will be promptly applied to the eligible household's account as soon as
notification is received of authorization for an account payment by SCSP or its agent.
SCSP will provide copies of bills, if available, with the authorizations that are
mailed to the HES.
7. Account Payments are payments which SCSP pays to the HES and includes both orepayment
for fuel prior to its delivery as well as payment for bills incurred prior to the
date of the application for LIEAP.
8. A reconnection charge or security deposit will not be charged to any eligible house-
hold except where such charges were company policy prior to October 1, 1981. LIEAP
payments can be applied to those charges.
9. If interruption in service to the eligible household has occurred, reconnection of
service will be made promptly upon notification of authorization for payment by SCSP
or its agent. If a balance is still owed, payment arrangements should be arranged
betv�een the HES and the eligible household.
10. In the event that services cannot be delivered b,y the HES because of a discontinuation
of service, the full amount of the unused line of credit can be returned to the cus-
tomer or forwarded to the new HES.
11. In the event that service cannot be delivered by the HES because of death or the cus-
tomer cannot be located after service is discontinued, the full amount of the unused
line of credit will be returned to SCSP as soon as possible and not later than 45 days
after the service has been terminated. All payments returned to SCSP shall be accom-
panied by a notification showing the HES name, the household's name, the Energy Assis-
tance Authorization number, the amount returned on behalf of the eligible household
and the date and reason for return.
12. The HES will maintain an adequate accounting system to allow SCSP to verify the amount
of home energy delivered to eligible households for which payment was made by SCSP, if
necessary.
Acknowledgement of this agreement shall be fonvarded to all HES branch offices. This
agreement will not be effective until aoproved by both parties and shall terminate upon
notification by SCSP or upon 30 days taritten notice by either party. Termination by
either party shall not discharge any obligation owed by either party to the other or to an
eligible household if such obligation was incurred during the effective period of this
agreement.
