On May 12, 2011, the Staff Advisor for the Ashland Planning Division administratively approved your
request for the following:
PLANNING ACTION: 2011-00448
SUBJECT PROPERTY: 165 Fork Street
OWNERJAPPLICANT: Suncrest Homes for Mark Ottis
DESCRIPTION: A request for Physical and Environmental Constraints permit approval for Hillside
Development including Severe Constraints to construct a new single-family residence on a vacant parcel
located at 165 W Fork Street. The proposal modifies the house plans of an existing approval by reducing
the size of the site disturbance from 4,252 to 2,621 square feet. The previously approved decision
including tree removal to remove six trees and the Exception to Street Standards to place a driveway less
than 24-feet from the adjacent driveway remains effective. COMPREHENSNE PLAN DESIGNATION:

The Staff Advisor's decision becomes final and is effective on the 13th day after the Notice of Final

Prior to that date, anyone who was mailed this Notice Of Final Decision may request a reconsideration of
the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance (ALUO)
18.1 08,070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in the ALUO
18.1 08.070(B)(2)( c),
An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to
raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford
the decision maker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that
issue. Failure to speCifY which ordinance criterion the objection is based on also precludes your right of
appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to
proposed conditions of approval with sufficient specificity to allow this Department to respond to the
issue precludes an action for damages in circuit court.
The application, all associated documents and evidence submitted, and the applicable criteria are available
for review at no cost at the Ashland Community Development Department, located at 51 Winburn Way.

MPFA. The applicant is also utilizing a code provision, (18.68.110.C.) which permits the front yard
setback to be reduced to 10-feet when the slope is equal to a one foot fall for each four feet of distance
across the front of the parcel so as to reduce the amount of overall disturbance,
With the previous approval, a Geologic Investigation Report was submitted. The applicant has re-hired
Amrhein Associates, Inc" Environmental & Geotechnical Engineering to review the modified house,
driveway and retaining wall designs, The previous report identified the constraint issues listed in the
Hillside Ordinance (seismic factors, erosion control, slope stability, storm water etc,) and specifically
lists the appropriate mitigation requirements. The report found that site is steep and the soils are prone
to erosion, and it made recommendations for cut and fill of slopes, foundation design, retaining wall
specifications, drainage, and erosion control measures, The report also discusses the need for periodic
inspections in order to assure compliance with the Geotechnical Expert's findings and
recommendations, The findings and recommendations of the Geologic Investigation dated December 6,
2007 and reviewed on April 7,2011 by Amrhein Associates, Inc. are conditions of the Physical and
Environmental Constraints Permit approval, and thus, must be instituted with the development of the lot.
Consistent with the previous approval, the exception to street standards to allow the driveway to be
placed closer than 24 feet to the adjacent driveway on the neighboring property is still necessary, The
frontage of the lot is 49,14 feet, and the neighboring driveway is approximately eight feet from the
property line, In order to meet the driveway spacing standards the drive would have to be moved to the
far south side of the property, where slopes are considerably steeper and is the location of the re-Iocated
public trailhead, Due to the steep slopes from Fork Street, across the un-improved Right-of-Way
(ROW) to the property line and the amount of disturbance, staff believes that the Exception is still
justified, The resulting driveway separation is 16 feet. Encroachment permits from the Public Works
and Engineering Departments will be necessary for the retaining walls to create the driveway across the
public right of way of Fork Street.
The utilities existing within the Fork and Pioneer Streets rights of way to serve the proposed residence,
The water service is from Fork Street, Sanitary and Storm sewer will be connected to the facilities
within Pioneer Street, The electric will be served from Pioneer Street as well. Both the Building
Division and the Electric Department stated that a remote meter and main breaker will be required at the
junction of the private service with the public utility, During the previous approval there was concern
expressed by the Tree Commission as to the impacts on the utility installations and the trees downhill
from the residence, The previous project arborist stated that the utilities would be hand-trenched or
directionally bored through the critical root zones of the trees impacted by utility installation,
There are a number of trees on the parcel and on adjacent properties that are proposed for protection
from the construction. There are six trees, one pine and five oaks, proposed for removal due to their
proximity to the proposed construction of the driveway and residence, The applicant has provided a
revised Landscape Plan to address the areas of disturbance, A revised corresponding Irrigation Plan will
be required to be reviewed and approved prior to the issuance of a building permit; a condition to this
effect has been added.
Currently there is a very steep, narrow pathway from Fork Street to Lithia Park, which traverses the
public right of way along the frontage of the subject property, The applicant has met with the Parks and
Recreation Department and determined the best relocation route for that trail and the location of the new
trailhead, The new trailhead is currently under construction and the amount of disturbance is less than
the thresholds for requiring a separate Physical and Environmental Constraint Review permit.

It is Staff's opinion that the proposal meets the requirements of the Physical and Environmental
Constraints chapter for Hillside Development and that with some of the conditions of the previous
approval this project can be found to comply with the requirements,
The criteria for a Physical Constraints Review Permit are described in AMC Chapter 18.62.040.1, as follows:
1. That the development will not cause damage or hazard to persons or property upon or adjacent to the area
of development.
2. That the applicant has considered the potential hazards that the development may create and implemented
reasonable measures to mitigate the potential hazards caused by the development,
3, That the applicant has taken all reasonable ~teps to reduce the adverse impact on the environment.
Irreversible actions shall be considered more seriously than reversible actions. The Staff Advisor or
Planning Commission shall consider the existing development of the surrounding are, and the maximum
permitted development permitted by the Land Use Ordinance.
4, That the development is in compliance with the requirements of the chapter and all other applicable City
Ordinances and Codes,
The criteria for an Exception to Street Standards are described in the Performance Standards Options
Chapter 18.88.050.F, as follows:
A) There is demonstrable difficulty in meeting the specific requirements of this chapter due to a unique or
unusual aspect of the site or proposed use of the site;
B) The variance will result in equal or superior transportation facilities and connectivity;
C) The variance is the minimum necessary to alleviate the difficulty;
0) The variance is consistent with the stated Purpose and Intent of the Performance Standards Options
Chapter
The application with the attached conditions complies with all applicable City ordinances.
Planning Action 2011-00448 is approved with the following conditions, Further, if anyone or more of
the following conditions are found to be invalid for any reason whatsoever, then Planning Action 2011-
00448 is denied. The following are the conditions and they are attached to the approval:
1) That all proposals of the applicant shall be conditions of approval unless otherwise modified
here.
2) That the foundation shall be designed by an engineer or architect with demonstrable geotechnical
design experience in accordance with 18.62.080,F.
3) That the engineered plans for the proposed work within the Fork Street Right-of-Way (ROW)
and the driveway construction shall be submitted for review and approval to the Public Works
and Engineering Department and Building Division prior to the commencement of any
construction,
4) That the recommendations of the previous project arborist shall be implemented on site during
the excavation adjacent to the trees #1 and #2 on the plans, specifically, directional boring or
hand-trenching when within the critical rootzones of trees #1 & #2. .
5) A construction staging / storage plan for the proj ect shall be submitted for review and approval to
delineate where materials will be stored and contractors will park,

6) Any road closures necessary for construction shall obtain and road closures permit through the
City of Ashland Public Works Department.
7) That prior to the submittal of a building permit:
a) That the applicant submit an electric design and distribution plan including load
calculations and locations of all primary and secondary services including transformers, cabinets
and all other necessary equipment. This plan must be reviewed and approved by the Electric
Department prior to the building permit submittal. Transformers and cabinets shall be located in
areas least visible from streets, while considering the access needs of the Electric Department.
b) That the storm drainage plan shall be designed, constructed and maintained in a manner
that will avoid erosion on-site and to adjacent and downstream properties in accordance with
IS.62,OSO.C,I. If an alternate storm water system such as a dry well system, detention pond and
leach filed is used, the alternate system shall be designed by a registered engineer or geotechnical
expert. The storm drainage plan shall be submitted for review and approval to the Ashland
Engineering and Building Divisions prior to application for a building permit.
c) That written verification from the project geotechnical experts addressing the consistency
of the building permit submittals with the geotechnical report recommendations (e.g. grading
plan, storm drainage plan, foundation plan, etc.) shall be submitted with the building permit
submittals.
d) That the recommendations of the Historic Commission be incorporated into the final
design and approved by the Staff Advisor. Building sections identifying the height, width, depth,
material and texture of all exterior architectural features shall be provided with the building
permit to verify consistency with the approved building elevations,
e) That exterior building materials and paint colors shall be compatible with the surrounding
landscape to minimize contrast between the structure and the natural environment. Sample
exterior building colors shall be provided with the building permit submittals for review and
approval of the Historic Commission,
f) That a revised Irrigation Plan addressing the modified Landscaping Plan shall be
submitted with the building permit submittals for review and approval ,prior to the issuance of a
building permit. '
g) That Architectural Encroachments of up to IS-inches into the setbacks are permitted; the
eave on the N. side of the structure will need to be reduced to meet that requirement.
S) That prior to the issuance of a building permit:
a) That a fire prevention and control plan for wildfire lands in accordance with I8,62,090,A
shall be submitted for review and approval of the Ashland Fire Department, and implemented
prior to the issuance of a building permit.
b) That the temporary erosion control measures (i,e, silt fence and bale barriers) shall be
installed according to the approved plan prior to any site work, storage of materials, issuance of
an excavation permit and issuance of a building permit. The existing temporary erosion control
measures shall be replaced and repaired as identified in the Amrhein Associates, Inc. report dated
December 6, 2007. The tree protection and temporary erosion control measures shall be
inspected and approved by the Ashland Planning Department prior to site work, storage of

materials, the issuance of an excavation permit, and/or the issuance of a building permit.
c) That the recommendations of the Ashland Tree Commission with final approval of the
Staff Advisor shall be addressed in the landscape and tree removal and protection plan prior to
the issuance of an excavation permit and prior to issuance of a building permit.
d) That the tree protection fencing shall be installed according to the approved plan prior to
any site work, storage of materials or issuance of the building permit. The tree protection shall
be inspected and approved by the Ashland Planning Department prior to site work, storage of
materials and/or the issuance of a building permit.
e) That a Verification Permit shall be applied for and approved by the Ashland Planning
Division prior to site work, excavation, and/or storage of materials, The Verification Permit is to
inspect the identification of the tree to be removed and the installation of tree protection fencing
for the trees on and adjacent to the site. The tree protection shall be chain link fencing six feet
tall and installed in accordance with 18,61.200,B,
f) That a preconstruction conference to review the requirements of the Hillside
Development Permit shall be held prior to site work, the issuance of an excavation permit or the
issuance of a building permit, whichever action occurs first. The conference shall include the
Ashland Planning Department, Ashland Building Department, the project engineer, project
geotechnical experts (i.e, Amrhein), landscape professional, arborist (i.e, Kerry KenCaim) and
the general contractor. The applicant or applicants' representative shall contact the Ashland
Planning Department to schedule the preconstruction conference,
9) That prior to the issuance of a certificate of occupancy:
a) All service and equipment installation shall be installed according to Ashland Electric
Department specifications prior to certificate of occupancy.
b) That the public pathway connection to the Lithia Park trail shall be installed in
coordination with the Parks and Recreation Department prior to the issuance of a certificate of
occupancy,
c) The landscaping and irrigation for re-vegetation of cut/fill slopes and erosion control
shall be installed in accordance with the approved plan prior to issuance of the certificate of
occupancy. Vegetation shall be installed in such a manner as to be substantially established
within one year of installation,
d) That a representative of Amrhein Associates, Inc. shall inspect the site according to the
inspection schedule of the engineering geology report by Mark Amrhein included in the
application and date stamped December 6, 2007, Prior to the issuance of the certificate of
occupancy, Amrhein Associates, Inc. shall provide a [mal report indicating that the approved
grading, drainage and erosion control measures were installed as per the approved plans, and that
all scheduled inspections were conducted by the project geotechnical expert periodically
throughout the proj ect.
10) That all measures installed for the purposes of long-term erosion control, including but not
limited to vegetative cover, rock walls, retaining walls and landscaping shall be maintained in
perpetuity on all areas in accordance with 18.62.089,B.7,

11) That the six removed tree shall be mitigated for on-site, off-site in accordance with 18.61.084,B
with a tree that will achieve similar size and stature at maturity as the ones removed or a payment
in lieu of planting as set forth in 18.61.084.C or $400.00 per tree. The determined mitigation for
the tree removal shall be selected prior to the issuance of a certification of occupancy. Evidence
of off-site planting (type, size and location of trees) or payment to the City of Ashland Tree Fund

165 W, Fork Street property - change of trail entrance location and construction of
new stairs and section of new trail.
On Friday, March 25,2011, I (1. McFarland) received a call from Mark Ottis, the new owner of
165 W, Fork Street in Ashland, requesting a meeting to look at relocating the existing trail up the
road from its present location. Mark informed me that he would be building a house beginning in
June, 2011, and the trail crosses his only approved location for a driveway entrance off the road,
I met Mark on Monday, March 28, looked at a possible new trail entrance location, and made a
determination that moving the trail entrance approximately 75 feet up the road would be an
improvement for several reasons:
1. Gets the trail out of Mark's driveway access,
2. New site improves safety for trail users by increasing visible sight paths to and from new
trail entrance location,
3, Moves the trail entrance away from existing fire hydrant.
4. Creates a safer stairway entrance down to the trail for trail users rather than existing steep
sloped trail.
5, Decreases possibility of future trespassing problems by moving the trail usage
approximately 50 feet away from Mark's property line rather than adjacent to it. (Mark
informed me that he likes looking out into the open park land and would prefer not to
have to build a fence,)
6, Calculated total soil disturbance would be minimal-less than 2 cubic yards (approx, 80
feet long x 2 feet wide x 3 inches deep) to build 85 feet of new trail two feet wide and
plant support posts for the new stairs with small landing, f

Home of Famous Lithia Park
That Mark agrees to pay for the costs involved to make the trail change happen, including:
1. Hire and pay contractor to construct the new trail stairway approach in accordance with
APRD guidelines/specs/recommendations.
2. Pay APRD for Jeff McFarland's time/wages associated with this project.
3, Hire and provide laborers to work with Jeff McFarland on a trail work day to make the
trail change and construct approximately 100 feet of new trail switching back down to the
existing trail.
4, Pay for approximately 20 feet ofPT 2x12 for Jeff to construct small landing for bottom
of stairway,
5, Help deconstruct/close the last 50 feet of old trail on the day the trail change occurs
(some time to be scheduled before June) working with Jeff McFarland.
Later on 3-28-11, after the meeting with Mark Ottis, Jeff relayed the information from the
meeting to current Parks Superintendent Steve Gies. Gies gave verbal approval and
acknowledgement to proceed with this agreement.
The next day, on 3-29-11, Jeff visited the site with new interim superintendent, Brenda
Hammers.
Hammers was also fine with proceeding with the proposed agreement but recommended
documenting/writing a memorandum of understanding for all of the parties.
Jeff McFarland met with contractor Evan Roberts (Accent on Redwood) on Wednesday, April
20, and went over construction plans/guidelines for the new stairs to be built at the new trail
entrance located approximately 80 feet south of old existing trail entrance on W, Fork St.
Evan gave a price of $3,500 to do the construction work for the new stairway, He felt confident
that he could perform the work in the given time frame before late May (Mark expects to begin
building his house in June).
Mark talked to Evan over the phone and accepted the price/time frame for the work to be
performed,
On Friday, April 22, 2011, Jeff called Evan and asked for APRD to be provided a copy of his
business insurance. Evan agreed.
The City of Ashland Parks Department will work in conjunction with the homeowner of 165 W.
fork Street, Mark Ottis, and contractor Evan Roberts, to make this project go smoothly through
Lithia Park.

18.62.040,1 Criteria for Approval
A Physical Constraints Review Permit shall be issued by the Staff Advisor when the Applicant demonstrates the following:
1, Through the application of the development standards of this chapter, the potential impacts to the property and nearby areas have been considered, and
adverse impacts have been minimized.
2, That the applicant has considered the potential hazards that the development may create and implemented measures to mitigate the potential hazards
caused by the development.
3. That the applicant has taken all reasonable steps to reduce the adverse impact on the environment. Irreversible actions shall be considered more
seriously than reversible actions, The Staff Advisor or Planning Commission shall consider the existing development of the surrounding area, and the
maximum permitted development permitted by the Land Use Ordinance,
(ORD 2808,1997; ORD 2834,1998; ORD 2951,2008)
TREE REMOVAL
18.61,080 Criteria for Issuance of Tree Removal - Staff Permit
An applicant for a Tree Removal Permit shall demonstrate that the following criteria are satisfied, The Staff Advisor may require an arborist's report to
substantiate the criteria for a permit.
A. Hazard Tree: The Staff Advisor shall issue a tree removal permit for a hazard tree if the applicant demonstrates that a tree is a hazard and warrants
removal.
1. A hazard tree is a tree that is physically damaged to the degree that it is clear that it is likely to fall and injure persons or property, A hazard tree may
also include a tree that is located within public rights of way and is causing damage to existing public or private facilities or services and such facilities or
services cannot be relocated or the damage alleviated, The applicant must demonstrate that the condition or location of the tree presents a clear public
safety hazard or a foreseeable danger of property damage to an existing structure and such hazard or danger cannot reasonably be alleviated by
treatment or pruning.
2, The City may require the applicant to mitigate for the removal of each hazard tree pursuant to AMC 18.61,084, Such mitigation requirements shall be
a condition of approval of the permit.
B. Tree that is Not a Hazard: The City shall issue a tree removal permit for a tree that is not a hazard if the applicant demonstrates all of the following:
1, The tree is proposed for removal in order to permit the application to be consistent with other applicable Ashland Land Use Ordinance requirements
and standards, including but not limited to applicable Site Design and Use Standards and Physical and Environmental Constraints, The Staff Advisor may
require the building footprint of the development to be staked to allow for accurate verification of the permit application; and
2. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or
existing windbreaks; and
3, Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the
subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable
alternative exists to allow the property to be used as permitted in the zone, Nothing in this section shall require that the residential density be reduced
below the permitted density allowed by the zone, In making this determination, the City may consider alternative site plans or placement of structures or
alternate landscaping designs that would lessen the impact on trees, so long as the alternatives continue to comply with other provisions of the Ashland
Land Use Ordinance.
4. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to AMC 18,61,084. Such mitigation
requirements shall be a condition of approval of the permit.

EXCEPTION TO STREET STANDARDS
18,88.050 F - Exception to Street Standards
An exception to the Street Standards is not subject to the Variance requirements of section 18.100 and may be granted with respect to the
Street Standards in 18.88,050 if all of the following circumstances are found to exist:
A. There is demonstrable difficulty in meeting the specific requirements of this chapter due to a unique or unusual aspect of the site or proposed use of the
site,
8, The variance will result in equal or superior transportation facilities and connectivity;
C, The variance is the minimum necessary to alleviate the difficulty; and
D. The variance is consistent with the stated Purpose and Intent of the Performance Standards Options Chapter.
