KNOW ALL MEN BY THESE PRESENTS, that Paul N, Stranberg and J. Brooke Stranberg,
husband and wife, Grantors in consideration of twenty-five and no/lOO ($25,00)
Dollars to them paid by the CITY OF ASHLAND, a municipal corporation of the State
of Oregon, Grantee, do hereby grant, bargain, sell and convey unto the said Grantee,
its successors and assigns, the water rights on 0.161 of an acre in the NW ~ of
the SW ~ of Section 4, Township 39S RlE WM all within and part of that certain
water right situated in the County of Jackson and State of Oregon, described as
follows, to-wit:
G,W, HAKE, Ashland, Ore" (Proof 167, Vol. 4); Priority 1858; 0,05
second foot; for Irrigation of 2 acres; Helman ditch; Description
of place of use: 2 acres in NW~SW~; Sec. 4, and N~S~; See, 6;
'Tp, 39 S. R. 1 E,W.M., beginning on E, line of 0, & C. R.R, right
of way, whence NW corner of D. L. C, no, 40, Tp. 39 S. R, 1 E,W,M.
bears N, 34 deg. 6 min, W, 818.65 ft; thence S, 89 deg. 57 min. E,
489.50 ft; S. 13 deg, 15 min. W. 279.5 ft; N, 63 deg. 45 min. W,
205,65 ft,; S, 60 deg. 57 min. W. 92.2 ft, to said right of way;
N, 34 deg, 45 min. W. 177.5 ft,; N. 36 deg. 19 min. W, 100 ft. to
beg., containing 1.95 acres; Jackson County, Oregon.
To have and to hold the above described water right unto the said Grantee, its
successors and assigns forever.
And the Grantors covenant that they are lawfully seized in fee simple of
the above granted water right free from all encumbrances, and that they will,
and their heirs, executors and administrators shall, warrant and forever defend
the above granted water right against the lawful claims and demands of all
persons whomsoever.
